Name Change in Property Documents in Uttarakhand
When your name on a deed, a land record or a house tax receipt is not the name you use today: why ownership is not affected, which papers are corrected and which are only linked, and where each is done.
A name change in property documents does not transfer ownership, and a registered deed is not rewritten for it. The deed stays in the name of the day it was signed. A marriage certificate or a Gazette notification links it to your present name, and the land record and local tax record are updated on that paper.

People worry that a name change in property documents means registering the property again, with stamp duty to pay. It does not. This page explains name change in property documents for owners in Uttarakhand: what a change of name does and does not do to a property, and how each record is brought up to date.
We do not draft deeds or appear at the tehsil. We prepare the Gazette notification, which is the public paper that links an old name to a new one. Much of this page is general guidance on property practice, and a lawyer should read your own papers. For loans, read home loan name mismatch in Uttarakhand.
Why Is a Name Change Not a Transfer?
A transfer moves a property from one person to another. A change of name moves nothing. The same person owns the same property, and is now called something else.
- No sale, gift or release takes place, so there is nothing to register and no stamp duty on a transfer to pay.
- The registered deed is a record of what happened on the day it was signed. It was right then, and it stays right.
- What changes is how the owner is described from now on, in the records that are kept current and in the next deed the owner signs.
- The bridge between the old description and the new is a document: a marriage certificate for a married surname, a Gazette notification for any other change.
Anyone who tells an owner to "transfer the property to the new name" by a fresh sale or gift deed is describing something the law does not require. A person cannot sell or gift a property to himself. Take a lawyer's advice before paying for any such thing.
What Are the Layers of a Property's Papers?
| Layer | Kept by | After a change of name |
|---|---|---|
| The registered deed, and the chain of deeds before it | The owner, with a copy at the sub-registrar's office | Stays as it is. Linked by a paper |
| The land revenue record, the khatauni | The tehsil | Updated on application |
| The local body's tax record | The municipal corporation, council or panchayat | Updated on application |
| An allotment or lease from a development authority, housing board or society | That body | Its own procedure, on application |
| Utility connections | The electricity, water and gas suppliers | Updated on application |
| A mortgage or charge | The lender | The lender's record is updated |
Only the first layer proves title. The others are records of who is in possession, who pays, and who is to be billed. A revenue record is not a document of ownership. But banks, buyers and offices read all of them together, and want them to tell one story.
Which of Three Situations Are You In?
| Situation | Example | Answer |
|---|---|---|
| The deed has a slip | The deed was typed "Rajesh Sing". Your papers then and now say "Rajesh Singh" | A rectification deed, registered. A lawyer's work |
| Your name has changed since | You bought as "Sunita Bisht" and are now "Sunita Rawat", or changed your name by Gazette | Nothing in the deed. A linking paper, and the current records updated |
| A current record is wrong | The deed is right, and the khatauni or the tax record misspells you | An application to that office to correct its record, with the deed |
The three are often confused, and the wrong remedy is costly. A rectification deed for a name that was right on the day of the deed is unnecessary. A Gazette for a clerk's slip in a khatauni is unnecessary too. Decide which row you are in before you spend.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| A woman owns in her maiden name and uses a married surname | The marriage certificate links them. Update the land and tax records if you wish | No |
| An owner has changed a name by choice | The Gazette notification links them. Update the records on it | Yes |
| The deed has a home name or a short form the owner still uses alongside the full name | Identity papers showing both, a declaration, or a Gazette notice stating both | Often |
| The deed misspells the owner | A rectification deed with the seller | No |
| The khatauni misspells the owner, and the deed is right | A correction application at the tehsil | No |
| The house tax record is in an earlier owner's name | Mutation at the local body, with the deed | No |
| The recorded owner has died | Mutation in the heirs' names by succession | Only for a living heir's own name |
The third row is the commonest in the hills, where land was recorded generations ago by the name a person was called. It is also the one where a Gazette notice with an alias does the most good.
What Happens to the Registered Deed?
- Where your name has changed, nothing. Keep the deed and the linking paper together, in the same file, for good.
- Where the deed has a slip, a rectification deed is signed by the parties to the original, or their heirs, and registered at the same sub-registrar's office. It corrects a genuine mistake. It cannot change who the buyer was.
- Where the other party cannot be found or will not sign, a court's declaration may be the only route.
- Where the slip is small and the person is plainly the same, many buyers and lenders accept identity papers and a sworn declaration without a rectification deed. That is their choice, not a rule.
- A certified copy of the deed can be had from the sub-registrar's office if the original is lost. It will carry the name as registered.
A Gazette notification does not amend a registered deed. As far as we know, the sub-registrar's office does not note a change of name on an old deed either. The Gazette is read beside the deed. That is all it has to do.
How Is the Land Record at the Tehsil Updated?
The state's land records are kept by the tehsil and can be viewed on its land records portal. Guides describe two kinds of request.
Mutation
- Entering a new holder after a sale, a gift, a partition or a death
- Applied for at the tehsil, with the deed or the proof of succession
- The revenue official verifies, and a notice invites objections for a period
- If none is upheld, the khatauni is updated
- It records a change that has already happened in law. It does not create ownership
Correction
- Putting right a mistake in the record itself, such as a spelling or a father's name
- Applied for at the tehsil or through the revenue official, with documents
- The deed, earlier years' records and identity papers are the usual support
- The tehsildar decides, after a report
A holder whose own name has changed is in neither box exactly. The request is to show the same holder under the present name. Ask the tehsil which form it treats this under, and give it the deed, the old record, your identity papers and the marriage certificate or Gazette notification.
We could not confirm the state's written procedure or fee for this, so take the tehsil's list before you prepare papers. Check the record again on the portal after the order.
How Do You Update the Records After a Change of Name?
Step 1: Get the linking paper
The marriage certificate, or the Gazette notification of the change.
Step 2: Update Aadhaar and PAN
Every property office will ask for identity proof in the present name.
Step 3: Make a file for the property
The deed, the latest khatauni extract, the latest tax receipt, and the utility bills.
Step 4: Apply at the tehsil
Ask for the land record to show your present name, with the deed, the linking paper and identity proof.
Step 5: Apply at the local body
For the house tax or property tax record, on its own form, with the same papers.
Step 6: Apply to any authority, board or society
Where the property is an allotment or on lease, that body's record matters as much as the tehsil's.
Step 7: Tell the lender, if the property is mortgaged
In writing, with the linking paper.
Step 8: Change the utility connections
Last, since they follow the tax record and identity proof.
None of this is compulsory on a deadline. An owner can leave every record in the old name and rely on the linking paper when the need arises. But the need arises at a sale, a loan or a death, when time is short. Doing it in a quiet year is easier.
What About House Tax, Authorities and Societies?
- House tax or property tax. The municipal corporation or council keeps an assessment register by owner. A change is applied for at its office or on its portal, with the deed and identity proof. The tax receipt is then issued in the present name.
- Development authority and housing board allotments. The allotment letter, the lease or the conveyance is the root paper. These bodies have their own rules for recording a change in the allottee's name, and often their own fee and notice.
- Group housing and societies. The society's register of members and the share certificate are updated on application to the managing committee.
- Leasehold plots. The lessor's record has to be updated. A lessor may treat a change of name differently from a transfer, but check its rules so that no transfer charge is raised by mistake.
In each of these, say plainly in the application that the owner is the same person and that no transfer has taken place. Offices handle transfers every day and may reach for the transfer form by habit.
What About Electricity, Water and Gas?
- A connection in an old name keeps working. Nobody disconnects supply over a spelling.
- The bill is, however, widely used as proof of address, and a bill in a different name is refused for that.
- The supplier changes the consumer's name on an application with identity proof, proof of ownership or the tax receipt, and the linking paper.
- Where the connection is still in a dead parent's or an earlier owner's name, that is a transfer of the connection, on the supplier's own form, and not a change of name.
- A cooking gas connection follows the same pattern through the distributor.
Do these after the tax record, since suppliers ask for it.
What About Inherited Property?
Inheritance is where names in land records cause the most trouble, because two sets of names are in play: the dead holder's and the heirs'.
- The dead holder's name in the khatauni has to be matched with the death certificate. A grandfather recorded as "Lachhu" whose death certificate says "Lakshman Singh" has to be shown to be one man.
- That is done by evidence: older records, the family register, the neighbours' and the village head's statements, and the heirs' sworn declarations. A Gazette cannot be taken out for a person who has died.
- Each heir's name is entered as on that heir's identity papers. A married daughter is entered in the name she uses now, with her marriage certificate linking her to her father's family.
- An heir who has changed a name, or is known by two, gives the marriage certificate or a Gazette notification for that heir's own name.
- Mutation by succession is applied for at the tehsil. Where the heirs or the shares are disputed, it becomes a contested matter, and a lawyer's work.
Do not leave land in a dead person's name for a generation. Each death adds heirs, and each heir adds a name to be proved. See name correction in a death certificate and legal heir certificate.
What Happens When You Sell?
- The buyer's lawyer and lender read your deed against your identity papers. Where the names differ, they ask for the link.
- The new sale deed describes the seller so that both names are covered. Deeds commonly use wording such as the present name followed by "formerly known as" or "also known as" the earlier name. The drafting is the lawyer's.
- The linking paper is recited in the deed and a copy is handed over with the title papers, so the buyer can show the link in turn.
- The sub-registrar checks the seller's identity proof at registration. The name in the new deed has to be the one on that proof.
- Where the land record is still in the old name, get it updated before you offer the property. A buyer checks the portal first.
A seller whose two names cannot be linked by any paper will find the sale stalls. This is the point at which most owners come looking for a Gazette. See alias name in a gazette notification.
How Does the Central Gazette Route Work?
Use this where you have changed your name by choice, or where a deed or a land record carries a form of your name that no certificate links to your present one. The notice is made by the living owner whose name it is.
Step 1: Decide which of the three situations you are in
A slip in the deed or in a current record is not a Gazette matter.
Step 2: List every form of your name across your property papers
From each deed, the khatauni and the tax record, letter by letter.
Step 3: Fix the present name, as on Aadhaar and PAN
The other forms are stated as aliases or as the former name.
Step 4: Make the affidavit and publish the newspaper notice
Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult, with Rs 250 more for each alias. It is not refunded.
Step 8: Send the file yourself, then keep the Gazette with the deed
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Print the published notification, file a copy with each property's papers, and use it for the tehsil and the local body.
Would the Uttarakhand Gazette Do for Property?
For the tehsil and a local body in the state, a state notice may well serve. A lender, a buyer from outside the state, PAN and Aadhaar are the reasons to prefer the Gazette of India.
Step 1: Ask the tehsil and the local body which Gazette they accept
If either will do, think about the wider use.
Step 2: Think about a future sale or loan
A lender's legal officer anywhere in the country knows the Gazette of India.
Step 3: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 4: Ask for the papers, the format and the fee, and submit
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do Owners Make?
| Mistake | What to do |
|---|---|
| Registering a fresh deed to "transfer" the property to a new name | Not needed. Ownership has not changed |
| Getting a rectification deed for a name changed after buying | The deed was right. Use a linking paper |
| Expecting a Gazette to amend a registered deed | It is read beside the deed |
| Writing on or altering a deed | Never. An altered deed is a damaged title |
| Treating the khatauni as proof of ownership | The registered deed proves title |
| Using the transfer form at an authority or a society | State that the owner is the same person |
| Leaving land in a dead parent's name | Apply for mutation by succession |
| Trying to get a Gazette for a dead holder | Not possible. Use evidence |
| Finding the mismatch when a buyer is waiting | Check every layer in a quiet year |
A typical case we handle: a farmer near Pithoragarh held land recorded in his own lifetime as "Gopal Datt", while his Aadhaar, bank account and a later sale deed said "Gopal Dutt Pant". A buyer's lender would not accept that the two were one man. A property dealer suggested a gift deed to himself, which made no sense. We prepared a Gazette of India notice stating both forms. He gave it to the tehsil with his deed and identity papers, the record was updated to his present name, and the sale went through. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
Reading title, a rectification deed, a contested mutation, a partition, a will, and any suit or appeal in a revenue court.
When you do not need us
For a married name, the marriage certificate. For a slip in a current record, the office that keeps it. For a slip in a deed, a lawyer and the sub-registrar. We are useful where a living owner has changed a name, or is recorded under two forms of it, and a public paper is needed to link them.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. Each record is updated where the property lies. The Gazette file is prepared on WhatsApp, so an owner living outside the state can have it done without travelling.
People Also Ask About a Name Change in Property Documents
Do I have to re-register my property after changing my name?
No. A change of name is not a transfer of ownership.
How do I change my name in property documents after marriage?
Keep the deed as it is. The marriage certificate links it, and the land and tax records can be updated.
Can a gazette notification correct a sale deed?
No. It links your old and new names. A slip in a deed needs a rectification deed.
How is a name corrected in a khatauni?
By an application at the tehsil, with the deed and supporting papers.
Is the khatauni proof of ownership?
No. It is a revenue record. The registered deed proves title.
Is stamp duty payable on a change of name?
Not for the change itself, since nothing is transferred.
Is the Registration Act of 1908 being replaced?
A draft Registration Bill, 2025, prepared by the Department of Land Resources, proposes to replace it with an online system of registration. It is a draft put out for consultation, not yet the law, so registration still follows the 1908 Act.
Will Aadhaar be compulsory to register a property deed?
Under the draft, Aadhaar-based authentication is allowed with consent but not made compulsory, and nobody is to be refused registration only for not having Aadhaar. The name in the deed should still match the identity proof shown.
Which more documents would have to be registered under the draft Bill?
The draft widens compulsory registration, with agreements to sell among the documents named in commentaries. A buyer's name in such an agreement would then be on a registered record, so it should match the buyer's papers from the start.
Does a land parcel's Bhu-Aadhaar number change with a sale or a name change?
No. The 14-digit ULPIN stays with the plot's boundary even after a transfer or sub-division. It identifies the land, not the owner, so a change of name does not touch it.
Can someone from outside Uttarakhand buy land in the state now?
After the 2025 amendment, outsiders cannot buy agricultural or horticultural land in 11 of the 13 districts, though a non-resident may still buy less than 250 square metres for a home. Haridwar and Udham Singh Nagar are outside the ban.
Does the 2025 land law stop me updating my own name on my land?
On its face, no. The law restricts purchases by non-residents, and a change of name is not a purchase or a transfer. Ask the tehsil if any new form or affidavit is now asked for.
