Succession Certificate Name Mismatch in Uttarakhand
For families collecting a late relative's bank balances, deposits and shares through a court's certificate, where the names on the death certificate, the accounts and the heirs' own papers do not agree: which names the court and the bank read, how to settle them before filing, and what can be done after the certificate is granted.
A succession certificate name mismatch is best settled before the petition is filed. List every form of the dead person's name and of each heir's name, correct the death certificate if it is the odd one, and have the petition state that the forms are one person. After the grant, a slip is corrected by the same court.

A succession certificate is a court's order, and a bank reads it the way it reads any order: word by word. A succession certificate name mismatch can send a family back to court for one letter. This page explains succession certificate name mismatch for families in Uttarakhand, so that the names are settled before the case begins.
A petition for this certificate is a lawyer's work, and we do not file cases. We prepare a Gazette notification, in the rare case where a living heir's own change of name needs one. The provisions cited are from the published text of the Indian Succession Act, 1925. For the certificate the revenue office gives, read name correction in a death certificate and legal heir certificate.
What Is the Certificate, and What Is It For?
- What it is. A certificate granted by a civil court under Part X of the Indian Succession Act, 1925.
- What it does. It authorises the holder to collect the debts and securities of a person who has died: money in banks, deposits, shares, bonds and the like.
- What it does not cover. Land and houses. Those pass by mutation, a will or a decree.
- Why institutions ask for it. A bank that pays the holder of a certificate is protected, even if someone else later turns out to be the true heir.
- When it is asked for. Mostly where there is no nominee and no will, and the sum is too large for the institution's own simpler procedure.
It is a summary proceeding. The court does not finally decide who owns what. It decides who may collect, and names that person on a paper every institution will honour.
What Does the Act Say?
From the published text of the Indian Succession Act, 1925, and a Law Commission summary of its scheme. Your lawyer will apply it to your facts.
| Section | What it provides |
|---|---|
| 370 | No certificate for a debt or security where the right has to be established by probate or letters of administration |
| 371 | The District Judge of the place where the dead person ordinarily lived, or where the property is, may grant it |
| 372 | The application sets out the time of death, the ordinary residence, the family or other near relatives, the right in which the applicant claims, and the debts and securities |
| 373 and 374 | The court gives notice, hears the matter in a summary way, and grants a certificate that specifies the debts and securities |
| 375 | The court may require security from the person to whom it grants the certificate |
| 376 | The District Judge may extend a certificate to a debt or security not originally specified |
| 380 and 381 | A certificate has effect throughout India, and gives full indemnity to those who pay its holder in good faith |
| 383 and 387 | A certificate can be revoked on stated grounds, and its grant does not bar a later suit on who is truly entitled |
Section 372 is why names matter. The petition has to identify one dead person, a list of relatives and a list of assets. Each is identified by a name, and each name will be compared with a paper.
How Does It Differ From Other Papers?
| Paper | Who gives it | What it does |
|---|---|---|
| Succession certificate | A civil court | Authorises collecting debts and securities, where there is no will to be proved |
| Legal heir certificate | The revenue office | States who the heirs are. Used for pensions, service dues and smaller claims |
| Probate or letters of administration | A civil court | Proves a will, or appoints someone to administer the whole estate |
| Nomination | The account holder, in life | Tells the institution whom to pay. The nominee receives for the heirs |
| Family register extract | The panchayat | Shows the family. Supports the others, and replaces none |
Families often arrive at court because a bank refused a legal heir certificate for a large sum. Read will and probate name mismatch and nominee name mismatch in a bank claim.
Which Four Sets of Names Does a Petition Carry?
The person who has died
- As on the death certificate
- And as on each account, deposit and holding
- These are often two or three different forms
The petitioner
- As on the petitioner's own identity papers
- The certificate will be granted in this name
- The bank will pay into an account in this name
The near relatives
- Every one of them, as the Act asks
- In the names they now carry
- With their consent where they give it
The debts and securities
- Each identified by its number and the institution
- And by the holder's name on it
- The certificate lists them one by one
A man who opened a savings account in 1985 as "R. S. Negi", bought shares in 1994 as "Ranjeet Singh" and died in 2024 as "Ranjit Singh Negi" on his death certificate is one person and three names. The petition has to say so, once, clearly.
In Which Three Places Can a Name Differ?
The dead person, across papers
- The death certificate against the accounts and holdings
- The commonest kind
- Cured by correcting the death certificate where it is wrong, and by stating every form in the petition
The heir, across the heir's own papers
- A married daughter, a son with a short form, a widow known by a home name
- The certificate and the heir's bank account then disagree
- Cured by bringing the heir's papers to one name before filing
The certificate itself
- The petition was right, and the certificate was typed wrongly
- Or the petition carried the slip, and the certificate copied it
- Cured by an application to the same court
The first two are in the family's hands, before any court is involved. That is where the effort belongs. Read short name and full name difference.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The death certificate misspells the dead person | A correction by the Registrar, before filing | No |
| The accounts carry initials or an older form of the name | The petition states every form as one person, with proof | No |
| A married daughter's papers carry two surnames | Her present name in the petition, with her marriage certificate | No |
| The certificate was granted with a typing slip | An application to the same court to correct it | No |
| An account was left out of the certificate | An application to extend the certificate | No |
| The bank will not act on the certificate because a name differs | Ask what it needs in writing. Then the court, through your lawyer | No |
| A living heir has changed a name by choice | Gazette, then the heir's papers. Ask your lawyer first | Yes |
A dead person's name is never changed by a Gazette. Only the papers that wrote it wrongly are corrected, or the court is told that the forms are one.
How Do You Settle the Names Before Filing?
This is the family's homework. The petition itself is your lawyer's.
Step 1: List every asset the certificate is to cover
Each account, deposit, share holding and policy, with its number.
Step 2: Copy the dead person's name from each one
Exactly as that bank or company holds it.
Step 3: Put the death certificate beside the list
Mark every asset whose name differs from it.
Step 4: Correct the death certificate if it is the odd one
At the Registrar, on the dead person's identity papers.
Step 5: List every near relative, with their names as on Aadhaar
Including married daughters, in their present names.
Step 6: Check your own papers
Your Aadhaar, PAN and bank account should carry one name.
Step 7: Give your lawyer every form of every name
So the petition can set them out and say they are one person.
Step 8: Read the draft petition, and later the certificate, name by name
A slip caught in the draft costs nothing. One caught at the bank costs a second application.
What Can Be Done After the Certificate Is Granted?
- A typing slip in the certificate. Your lawyer applies to the court that granted it. Courts can correct clerical and accidental slips in their own orders.
- A slip that came from the petition. The same court is asked to amend, with the paper that shows the right name. Expect to explain how the mistake arose.
- An asset left out. The Act lets the District Judge extend the certificate to a debt or security not originally specified. A further fee follows the added value.
- A relative left out. This is graver. The Act lists grounds on which a certificate can be revoked, and a relative who was not told may rely on them.
- An institution that still refuses. Ask for its reason in writing. The court's order is then sought on that reason.
Do not alter a certificate, add a line to it or attach a private affidavit in its place. A bank will read only what the court wrote.
How Do Banks and Companies Read It?
- Under the Act, an institution that pays the holder of a certificate in good faith is fully protected. That protection is why it reads the certificate strictly.
- It checks that its own customer is the dead person named, that the account or holding is one of those listed, and that the person at the counter is the holder named.
- A share registrar is stricter than a bank. A folio in an old form of the name, not listed in that form, may be sent back.
- Each institution asks for its own claim form, the holder's identity papers and bank details, and a certified copy of the certificate.
- The holder's bank account has to be in the name the certificate gives the holder.
- A certificate has effect throughout the country, so one certificate serves accounts and holdings in any state.
Read name change in bank records, name change in demat and mutual fund accounts and share certificate name change and correction.
Why Must Every Relative Be Named?
- The Act asks the petition to state the family or other near relatives of the person who has died, and where they live.
- The court gives notice so that anyone with a claim can speak. A relative who is not named is not told.
- Married daughters are heirs. They are named in their present names, with the earlier name mentioned.
- A relative who agrees usually files a consent. The name on the consent, and on the identity paper filed with it, has to match the name in the petition.
- A relative who lives abroad or far away gives consent on a paper executed there. Its name too has to match.
- A family register extract helps the court see the whole family at once. Where it spells a member wrongly, correct it or explain it.
Read name correction in the family register and name correction in marriage registration certificate.
When May a Certificate Not Be Needed?
- A nominee is registered. The institution pays the nominee. Check the nomination on every account before assuming there is none.
- A joint account with a survivor. The balance usually goes to the survivor under the account's terms.
- A smaller sum. Banks have their own simpler procedure for claims up to a limit, on an indemnity and the heirs' papers. The limit is each bank's to state.
- Pension and service dues. These follow service rules and the nominations made under them.
- A will that has to be proved. The route is then probate or letters of administration, and the Act bars a certificate for such debts.
- Land and houses. Never by this certificate.
Ask each institution what it needs before going to court. Many families obtain a certificate for an account the bank would have settled on simpler papers. Read name change in post office savings and name change in EPFO and UAN records.
How Does the Central Gazette Route Work?
Use this only where a living heir has changed a name by choice, so that the family's papers carry the heir's old name and the heir's identity papers the new one. It has no part in the name of the person who has died.
Step 1: Confirm with your lawyer that a Gazette is what the court or the institution needs
For a spelling or a married surname it seldom is.
Step 2: Fix the exact new name, and the old name as the family's papers carry it
Letter by letter.
Step 3: Make the affidavit
State the old name, the new name, your father's or husband's name and your address. Sign before a notary.
Step 4: Publish the newspaper notice
In a daily local leading newspaper. Keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then give your lawyer the Gazette
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Update Aadhaar, PAN and your bank account as well.
Would the Uttarakhand Gazette Do?
For the court, possibly. The banks and companies that will act on the certificate are the reason to prefer the Gazette of India.
Step 1: Ask your lawyer what the court will accept
A court reads evidence, and either Gazette is evidence.
Step 2: Think about the banks, companies, Aadhaar and PAN
They are spread across the country. The Gazette of India serves them all.
Step 3: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 4: Ask for the papers, the format and the fee, and submit
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
To weigh the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do Families Make?
| Mistake | What to do |
|---|---|
| Filing on the death certificate's name alone | Give your lawyer the name on every account |
| Listing assets from memory | List each with its number and the holder's name on it |
| Leaving out a married sister | Name every near relative |
| Going to court without asking the bank what it needs | Ask each institution first |
| Not reading the certificate when it is issued | Read it name by name that day |
| Writing a correction on the certificate | Never. Apply to the court |
| Filing a new case for a forgotten account | Ask for the certificate to be extended |
| Expecting the certificate to transfer the house | It covers debts and securities only |
| Asking for a Gazette in a dead person's name | There is no such notice |
A typical case we handle: two brothers in Dehradun obtained a certificate for their late father's deposits. A share registrar then refused it, since the folio was in the name "R. S. Negi" and the certificate named "Ranjit Singh Negi". One brother rang us for a Gazette to "change" the father's name. There is no such thing for a man who has died. Their lawyer applied to the same court, with old share papers and the father's PAN, and the certificate was amended to carry both forms. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
The petition, the hearing, an amendment or extension of the certificate, a dispute among heirs, and any advice on which route the estate needs.
When you do not need us
Nearly always, on this subject. The Registrar corrects a death certificate, and the court does the rest through your lawyer. We are useful only where a living heir has changed a name by choice and a Gazette notification is needed to link the heir's old and present names.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. The certificate is granted by the court of your district. The Gazette file, where one is needed, is prepared on WhatsApp.

Who grants a succession certificate in Uttarakhand?
The District Judge's court of the district, or a court empowered for it.
Up to what amount can a bank settle a claim without a succession certificate?
Under the RBI's 2025 directions on deceased customers' claims, where there is no nominee or survivor, banks use a simplified procedure below a threshold: Rs 15 lakh for most banks and Rs 5 lakh for co-operative banks, or a higher limit the bank fixes.
What can a bank ask for above that limit?
For larger sums the bank may ask for additional documents such as a succession certificate or a legal heir certificate. Read the bank's own claim policy before going to court.
Does a nominee need a succession certificate?
No. Guides to the RBI's 2025 directions say that where there is a nomination or a survivorship clause, banks pay the nominee or survivor without asking for a succession certificate or probate.
How long can a bank take to settle a deceased depositor's claim?
Not more than 15 calendar days from receiving all the required documents, under the RBI's 2025 directions. A name the bank cannot match can hold the clock, so settle it first.
What if the bank delays a deceased depositor's claim?
Guides to the directions say that where the delay is the bank's, it pays interest on the amount due, at the Bank Rate plus 4% a year, for deposit accounts.
When do the RBI's deceased claim rules apply from?
The RBI said banks must put the 2025 directions in place as soon as possible, and not later than 31 March 2026. Ask your bank which procedure it now follows.

Names in a Succession Certificate: The Short Version
A succession certificate is a court's authority to collect a dead person's bank balances, deposits and shares. Institutions read it word by word. Before filing, list every asset with the name on it, compare each with the death certificate, correct the death certificate if it is the odd one, and name every near relative in their present names. Read the certificate the day it is issued. A slip or a forgotten account goes back to the same court.
None of that needs a Gazette. To find out if your case does, message us on WhatsApp 9540005064, and we will reply in working hours.
