Name Correction in a Death Certificate and Legal Heir Certificate in Uttarakhand
When a name is wrong on a death certificate or a legal heir certificate, or does not match the bank and property papers: who corrects each, the proof to carry, and what a Gazette cannot do.
A name correction in a death certificate is made by the Registrar who registered the death, on proof of the dead person's correct name. A legal heir certificate is corrected by the tehsil office that issued it. Neither is a Gazette matter, and no Gazette notice can change the name of a person who has died.

A name correction in a death certificate is something a family finds it needs at the worst time, when a bank or an insurer returns the papers because one letter does not match. This page explains name correction in a death certificate and in a legal heir certificate in Uttarakhand: which office corrects each, the proof to carry, and where a lawyer is needed.
We prepare Gazette papers for the names of living people. For these two certificates there is very little we can do for you, and this page says so plainly. For the correction of a birth record, which follows the same law, read mother's name correction in a birth certificate.
Which Papers Does a Family Need After a Death?
Three different papers are spoken of as if they were one. They come from three different offices, and a name is corrected in each by the office that issued it.
| Paper | What it shows | Who issues it | Who corrects a name in it |
|---|---|---|---|
| Death certificate | That a named person died, with the date and place | The Registrar of births and deaths for the place of death | The same Registrar |
| Legal heir certificate | Who the surviving family members are | The revenue department, through the tehsil office | The same tehsil office |
| Succession certificate | Who may collect the debts and securities of the person who died | A civil court | The court |
In Uttarakhand the legal heir certificate is, as guides report, called the surviving member certificate, and is applied for through the state's citizen services portal or at the tehsil. Ask your tehsil office for the name and the form it uses.
The death certificate comes first. The other two are made from it, so a wrong name in the death certificate travels into both.
Where Are Names Compared After a Death?
Every office that holds something in the name of the person who died will compare three things: its own record, the death certificate, and the papers of the person claiming.
| Office | What it compares |
|---|---|
| Bank and post office | The account holder's name with the death certificate, and the nominee's or heir's name with their identity proof |
| Insurance company | The name on the policy with the death certificate, and the nominee with their identity proof |
| Pension and provident fund | The service record with the death certificate, and the family member's name with the record of the family |
| Tehsil, for land records | The name in the land record with the death certificate, and the heirs with the heir certificate |
| Municipal body, for house tax | The owner's name with the death certificate |
| Transport office | The registered owner with the death certificate, for a transfer of the vehicle |
So there are two names to get right: the name of the person who died, and the name of each person who claims. They are corrected in different ways, and the rest of this page takes them in turn.
Which Case Is Yours?
| The situation | Example | Route |
|---|---|---|
| The death certificate misspells the name | Mohan Singh Bist for Bisht | The Registrar, on proof |
| The death certificate has a short form or leaves out a surname | Mohan Singh for Mohan Singh Bisht | The Registrar, on proof of the full name |
| The father's or husband's name on the death certificate is wrong | A letter wrong in the husband's name | The Registrar, on proof |
| The death certificate is right, and the bank account has another form of the name | The person used two forms in life | The bank's own procedure. See the section below |
| An heir's name is misspelt in the heir certificate | Sunita for Suneeta | The tehsil office, on the heir's identity proof |
| A married daughter is shown in her maiden name | Her Aadhaar has her married surname | Her marriage certificate links the names |
| An heir has been left out, or a wrong person put in | A daughter not listed | Not a name correction. An objection at the tehsil, and a lawyer |
None of these rows ends in a Gazette. The first three are for the Registrar, the fifth and sixth for the tehsil, and the fourth for the bank.
How Do You Correct a Name in a Death Certificate?
Step 1: Find the Registrar who registered the death
The certificate names the office. It is the local body for the place where the death occurred, which may be a hospital town and not the home village.
Step 2: Settle the correct name
Take it from the identity papers of the person who died: Aadhaar, PAN, voter card, pension order or passport.
Step 3: Ask the Registrar how it treats your case
A slip in writing or an error of fact, which form to use, and the fee.
Step 4: Apply in writing
A close family member applies. Give the registration number and date, the entry as it stands and as it should read.
Step 5: Attach the proof
The death certificate with the mistake, the identity papers of the person who died, the hospital's record where there is one, and your own identity proof.
Step 6: Give a declaration where it is asked for
For an error of fact, the rules provide for a declaration by two persons who know the facts.
Step 7: Collect the corrected certificate and read it
Check the name, the father's or husband's name, the date and the place, letter by letter. Take several copies.
Step 8: Use it for the heir certificate and the claims
Apply for the heir certificate only after the death certificate is right.
What Can the Registrar Correct?
Deaths are registered under the same law as births, the Registration of Births and Deaths Act, 1969. Section 15 lets the Registrar correct an entry that is erroneous in form or substance, by a note in the margin of the register. The original entry is not altered.
| Point | Clerical or formal error | Error in substance |
|---|---|---|
| What it is | A slip in writing | The entry states a wrong fact |
| Example | Bist for Bisht | A wholly different name, or a wrong date of death |
| What the rules ask for | The Registrar enquires and, if satisfied, corrects it | A declaration setting out the error and the true facts, made by two credible persons who know the facts |
States make their own rules on this pattern. We could not confirm the current text, fee or form of Uttarakhand's rules, so treat the table as the general position and the Registrar as the authority.
A death certificate should carry the name the person held in life, as shown by his or her own papers. If the family gave a home name or a short form when reporting the death, that is the usual cause of the trouble, and it is a correction the Registrar can make on proof.
What If the Person's Own Papers Were in Two Names?
Sometimes nobody made a mistake. The person who died used one form of the name at the bank and another on Aadhaar, and never brought them together. The death certificate can carry only one.
- A change of name notice cannot be published for someone who has died. It is a living person's own declaration, signed by that person. No one else can make it afterwards.
- The death certificate follows the person's main identity papers. Ask the Registrar if it can also record the other form as an alias. Some offices will, on proof that both were in use.
- Each office then settles its own record. A bank has its own procedure for a claim where the names differ, usually resting on a sworn statement by the heirs that both names were the same person, with papers that show it.
- Collect what links the two forms. A paper that carries both, the same photograph, the same father's name, date of birth and address on each.
If you are reading this for a parent who is living and whose papers are in two names, this is the reason to settle it now. A person can sort out his or her own name while able to sign. The family cannot do it afterwards. See alias name in a gazette notification.
How Is a Name Corrected in a Legal Heir Certificate?
A legal heir certificate lists the surviving members of the family by name and relation. It is made at the tehsil, after the local revenue official has checked the family. A name in it can be wrong in two ways.
The name of the person who died is wrong
- It was copied from the death certificate
- Correct the death certificate first, at the Registrar
- Then ask the tehsil office to correct or reissue the heir certificate on the corrected death certificate
An heir's name is wrong
- It was taken from the application, the family register or what the family said
- Apply to the same tehsil office, with that heir's identity proof
- Ask for a corrected certificate, and check every other name on it while you are there
- Find the office and the reference number on the certificate.
- Apply in writing, giving the entry as it stands and as it should read.
- Attach the identity proof of the heir concerned, and the paper that shows the relation.
- Keep a dated receiving, and collect the corrected certificate.
In villages, the family register kept by the panchayat is often the source of these names. If it carries the mistake, ask the panchayat office how its entry is corrected, or the same error will come back the next time a certificate is drawn from it.
What About a Married Daughter's Name?
A daughter is an heir whether or not she is married. Her name is the one that most often does not match, because her father's records know her by her maiden name and her own papers now carry her married surname.
- Both names are hers. Nothing was written wrongly.
- Her marriage certificate is the paper that links them.
- Ask the tehsil office to enter her name as on her present identity proof. Where it will not, ask it to show both, as one name alias the other.
- At the bank, she gives her identity proof with the marriage certificate.
- Where she changed her first name as well, by Gazette, her Gazette notification is the link.
A married daughter does not have to change her name back, and no office can ask her to. See name change after marriage in Uttarakhand.
What Do Banks and Insurers Ask For?
Each bank and insurer has its own claim form and its own list. Ask for it in writing before you collect papers. In general:
- Where a nominee is registered, the claim is usually paid to the nominee on the death certificate and the nominee's identity proof. The names on those two papers must match the bank's record.
- Where there is no nominee, the bank asks for more, such as a legal heir certificate, a sworn statement and an indemnity, and for larger amounts a succession certificate.
- Where a name differs, ask the branch which paper will satisfy it: a corrected death certificate, a sworn statement that both names are one person, or something else.
- If a branch will not say, write to the bank's grievance officer and ask for the requirement in writing.
Do not sign a blank claim form, and do not hand over an original death certificate. Take several certified copies from the Registrar at the start. You will need one for almost every office.
When Is a Court or a Lawyer Needed?
A succession certificate
Asked for by a bank or a company for debts and securities, above the amount it settles on simpler papers. It is granted by a civil court.
A will
Where the person left a will, the heir certificate is not the paper that decides who takes what. Take advice on the will.
A dispute among heirs
An heir left out, a second family, or an objection to the certificate. These are not name corrections.
A refusal by the Registrar or the tehsil office to correct an entry is also a matter for a lawyer, once you have the reason in writing.
Where Does a Gazette Come In, If at All?
For the name of the person who died, nowhere. For the name of a living heir, only in the ordinary way.
- If an heir has changed his or her own name by Gazette, that notification links the heir's old name in the family's records to the name on the heir's identity proof.
- If an heir's own papers are in two forms and an office will not accept the claim, the heir can publish a notice stating both, joined by alias. That is the heir's own notice, about the heir's own name.
- A public notice in the Gazette is for a name wrongly written in the applicant's own records. It is not a way to alter a bank account or a land record that stood in the name of someone who has died.
How Does the Central Gazette Route Work for an Heir's Own Name?
Use this only for a living heir whose own name has to be changed or whose two forms have to be linked. The notice goes in Part IV of the Gazette of India.
Step 1: Ask the office concerned what it will accept
A marriage certificate or a sworn statement may be enough. Get the answer in writing.
Step 2: Fix the heir's name as on the present identity proof
List the other form, as it appears in the family's records, to be joined by alias.
Step 3: Make the affidavit
The heir states the forms in use and the one to be used from now on, and signs before a notary.
Step 4: Publish the newspaper notice
In a daily local leading newspaper, in the same wording. Keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed by the heir with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult, with Rs 250 more for each alias. It is not refunded.
Step 8: Send the file yourself, then give the Gazette to the office
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Download the published Gazette from egazette.gov.in and give a printed copy with the claim.
A Gazette commonly takes 3 to 7 weeks. Tell the bank or the office that it is on its way, so the claim is not closed meanwhile.
Can the Uttarakhand Gazette Be Used?
A tehsil office is a state office, so a state notice may serve there. A bank, an insurer or a pension office may want the Gazette of India.
Step 1: List every office that will see the notification
The tehsil, the bank, the insurer, the pension office.
Step 2: Ask each which Gazette it accepts
If any one wants the Gazette of India, use that for all.
Step 3: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 4: Ask for the papers, the format and the fee, and submit
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do Families Make?
| Mistake | What to do |
|---|---|
| Reporting the death in a home name or a short form | Give the name as on the person's Aadhaar, in full |
| Not reading the death certificate when it is issued | Check every line at the counter |
| Applying for the heir certificate on a wrong death certificate | Correct the death certificate first |
| Paying for a Gazette to change a dead person's name | It cannot be done. Go to the Registrar |
| Asking a married daughter to change her name back | Her marriage certificate links the two names |
| Giving away the original death certificate | Take several certified copies at the start |
| Treating a left-out heir as a spelling matter | That is an objection, and a lawyer's work |
| Collecting papers before asking the bank what it wants | Get its list in writing first |
| Leaving a living parent's papers in two names | Settle it now, while the person can sign |
A typical case we handle: a widow in Pithoragarh came to us because her husband's death certificate said "Mohan Singh" and his bank account stood in the name "Mohan Singh Bisht". She had been told to get a Gazette. We told her one could not be made for him. The Registrar corrected the death certificate on his Aadhaar and pension order, which carried the full name, and the bank then took her claim. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
A succession certificate, a will, a dispute among heirs, an heir left out of the certificate, and a refusal by the Registrar or the tehsil office.
When you do not need us
For these two certificates, almost always. The Registrar corrects the death certificate and the tehsil office corrects the heir certificate, at little or no cost. We will tell you, free, which office to approach. We are useful only where a living heir's own name needs a Gazette.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. The death certificate is always with the Registrar for the place of death, and the heir certificate with the tehsil that issued it.
People Also Ask About Names in a Death Certificate
How can I correct a name in a death certificate?
Apply to the Registrar who registered the death, with proof of the correct name.
Is a gazette required to correct a death certificate?
No. The Registrar corrects an erroneous entry under Section 15 of the Act.
Can a dead person's name be changed through a gazette?
No. A change of name notice is a living person's own declaration.
Who can apply to correct a death certificate?
A close family member, with identity proof and the papers of the person who died.
How is a name corrected in a legal heir certificate?
By the tehsil office that issued it, on the heir's identity proof.
The name on the death certificate and the bank account are different. What do I do?
Correct the death certificate if it is wrong. If not, ask the bank in writing which paper it will accept.
How long can a bank take to settle a deceased person's account?
Under the RBI's Settlement of Claims in respect of Deceased Customers of Banks Directions, 2025, banks are to settle claims within 15 calendar days of receiving all the documents. The death certificate is one of them, so its name should match the account.
What if the bank delays the claim?
The Directions provide compensation for delay: interest at the Bank Rate plus 4% for deposit claims, and Rs 5,000 a day for locker claims.
Is a succession certificate needed if there is a nominee?
No. Where there is a nomination or a survivorship clause, banks can pay the nominee or survivor without a succession certificate or probate, after proper due diligence.
What does a bank need when there is no nominee?
For claims up to a threshold, Rs 5 lakh for co-operative banks and Rs 15 lakh for other banks, a simplified procedure applies: a claim form, the death certificate, proof of identity, and a legal heir certificate or an affidavit.
What is needed above that threshold?
For claims above the threshold, a bank may ask for additional papers such as a succession certificate or probate of the will. Take a lawyer's advice on these.
When were these RBI Directions issued?
They were issued on 26 September 2025, as RBI/2025-26/82. Ask your bank for its current claim form under them.
