Nominee Name Mismatch in a Bank Claim in Uttarakhand
When a family claims a dead relative's bank money and a name does not match: what the Reserve Bank's rules ask of a nominee, which name is the problem, and how each gap is closed.
A nominee name mismatch in a bank claim is closed by a paper that links the two names. Under the Reserve Bank's 2025 directions, a nominee gives the claim form, the death certificate and an officially valid identity document. Where the nominee's name has changed, a marriage certificate or a Gazette notification supports that document.

A nominee name mismatch in a bank claim comes at the hardest time. Someone has died, the family needs the money, and the branch says the name on its record is not the name on the paper in front of it. This page explains nominee name mismatch in a bank claim for families in Uttarakhand, and what closes each kind of gap.
We do not make claims on banks. We prepare the Gazette notification, which is one of the papers that supports an identity document after a change of name. For the death certificate itself, read name correction in a death certificate and legal heir certificate.
What Do the Reserve Bank's Directions Ask of a Nominee?
In 2025 the Reserve Bank of India issued directions to standardise how banks settle the claims of dead customers. These points are from banks' published policies under the directions and from reports of them.
| Point | Position |
|---|---|
| Where there is a nominee or a survivor | Three papers: the claim form, the death certificate of the dead depositor, and an officially valid document of the nominee or survivor to verify identity and address |
| Other legal papers | Reports say a bank is not to ask a nominee for a succession certificate or the like |
| Where there is no nominee, up to a threshold | A simplified procedure. The threshold is Rs 15 lakh, or higher if the bank fixes one, and Rs 5 lakh for co-operative banks |
| Above the threshold with no nominee, or a dispute | A succession certificate, probate or a court's order |
| Time | Settlement within 15 days of receiving complete documents, with compensation for delay |
| Lockers and articles in safe custody | Covered by the same directions |
The directions use the same term the customer identification rules use: officially valid document. That matters for names. The identification rules say such a document stays valid after a change of name, where it is supported by a marriage certificate issued by the State Government or a Gazette notification.
Each bank publishes its own policy and claim forms under the directions. Take the bank's current form from its website or the branch.
Which Two Pairs of Names Have to Match?
A claim rests on two comparisons. A mismatch is in one of them, or both.
| Pair | On the bank's side | On the family's side | What it proves |
|---|---|---|---|
| The dead person | The account holder's name in the bank's record | The name on the death certificate | That the account holder is the person who has died |
| The nominee | The nominee's name in the bank's nomination record | The name on the nominee's identity document | That the claimant is the person who was nominated |
Ask the branch plainly which of the two it is not satisfied with. Families often spend weeks correcting the wrong paper because nobody asked.
Which Case Is Yours?
| The situation | Example | The paper that closes it |
|---|---|---|
| The nominee married after being nominated | Nominated as Sunita Bisht, now Sunita Rawat | The marriage certificate issued by the State Government |
| The nominee changed a name by choice | Nominated as Rakesh Kumar, now Aarav Negi | The Gazette notification |
| The nominee was written by a home name | Nominated as Guddi, Aadhaar says Kamla Devi | Ask the bank. A declaration with proof of relationship, or a public paper linking the names |
| The bank misspelt the nominee's name | Record: Kamla Davi | The nominee's identity document, and the bank's own correction |
| The death certificate differs from the account | Account: Trilok Singh Rawat. Certificate: Trilok Singh | A corrected death certificate, or what the bank accepts in its place |
| The dead person's account itself was in a different name from his other papers | Account opened in a short name | Papers showing both names were his: old identity papers, a pension order, a declaration |
| No nominee was ever registered | An old account | The simplified procedure, or a succession certificate above the threshold |
The first two rows are the cleanest, because the rule names the paper. The rest depend on what the bank is satisfied by.
What If the Nominee's Own Name Has Changed?
This is the commonest case. A father nominates his daughter when she is in college. She marries, takes her husband's surname on Aadhaar, and twenty years later claims under a nomination in her maiden name.
- She gives the claim form, the death certificate and her identity document.
- Her identity document is in her married name, and the nomination is in her maiden name. Her marriage certificate links the two.
- Under the customer identification rules, an identity document is treated as valid after a change of name where it is supported by a marriage certificate issued by the State Government or a Gazette notification.
- So a registered marriage certificate is the paper. No Gazette is needed for a married surname.
- Where she changed her name for any other reason, the Gazette notification is the paper.
An older identity paper still in the maiden name, a school certificate naming her father, or her birth certificate all help, since they show she is the daughter who was nominated. Carry whatever she has.
What If the Dead Person's Name Does Not Match?
Here the gap is between the bank's record of its customer and the death certificate.
- See which is the odd paper. Compare both with his Aadhaar, PAN and pension papers.
- If the death certificate is wrong, ask the Registrar of births and deaths to correct it. It was written from what the informant said, and a slip is common.
- If the bank's record is the odd one, the account cannot now be corrected by its holder. Give the bank his other papers that show the same person used both forms.
- Give the bank's own evidence back to it. The address, date of birth, photograph, PAN and Aadhaar on the account match the dead person's. Point to them.
- Offer a sworn declaration by the nominee that both names are of one and the same person, and ask what else the bank needs.
A Gazette notification cannot be taken out for a person who has died. A change of name notice is made by the living person whose name it is. So this gap is closed by a corrected death certificate or by evidence, not by a Gazette.
See name correction in a death certificate and legal heir certificate.
What If the Bank's Nomination Record Has a Mistake?
- Ask the branch to show the nomination form the account holder signed, or its scanned copy. The name on that form, in his hand, is the real nomination.
- Where the form is right and the bank's computer entry is wrong, the slip is the bank's. It should correct its entry and pay.
- Where the form itself has a home name or a wrong spelling, the bank looks at the other details on it: the relationship, the age or date of birth and the address. If those fit the claimant, most branches are satisfied with a declaration.
- Where two people could fit the name on the form, the bank will be careful, and may ask for more. That is a real doubt, not a formality.
The nomination form gives the nominee's relationship to the holder. A claimant who can prove that relationship, with a birth certificate, a school certificate or a family register extract, is most of the way there.
How Do You Make the Claim?
Step 1: Tell the branch of the death, in writing
With a copy of the death certificate. Ask it to confirm if a nominee is registered, and in what name.
Step 2: Take the bank's claim form
From its website or the branch. Use the form for an account with a nominee, or without, as the case is.
Step 3: Compare the two pairs of names
The account against the death certificate. The nomination against the nominee's identity document.
Step 4: Collect the linking paper for each gap
The marriage certificate or Gazette notification for the nominee. A corrected death certificate or supporting papers for the dead person.
Step 5: Fill the claim form in the name on your identity document
And state the name as in the nomination, where it differs.
Step 6: Submit the form with the three papers and the linking papers
Self-attested copies, with originals shown. List them in a covering letter.
Step 7: Take a dated acknowledgement that the documents are complete
The time for settlement runs from complete documents. If the bank says something is missing, ask it to say what, in writing.
Step 8: Follow up, and escalate if the time passes
The grievance officer first, then the Reserve Bank's ombudsman.
What If There Is No Nominee?
- Up to the threshold, the directions provide a simplified procedure, without a court's order. Reports list the claim form, the death certificate, the claimants' identity documents, an indemnity, a legal heir certificate or a declaration, and a no objection from the other heirs.
- Above the threshold, or where there is a dispute or a will in question, the bank asks for a succession certificate, probate or a court's order.
- Every heir's name is then compared with that heir's identity document, and with the legal heir certificate. One daughter in a married name and one in a maiden name is the usual tangle.
- Each heir closes her own gap with her own marriage certificate or Gazette notification.
A legal heir certificate that lists the heirs in the names on their present identity papers avoids most of this. Ask the tehsil for it in those names. A succession certificate is a court matter, and a lawyer's work.
What Are the Time Limits, and What About Delay?
- The directions, as reported, give a bank 15 days to settle a claim once it has the complete documents.
- They provide for compensation where the bank delays beyond that for reasons of its own.
- The clock does not run while a document is missing. A name mismatch that the bank has raised, and you have not yet answered, stops it.
- So answer a query on a name quickly, and get it recorded that the documents are now complete.
- Banks were given time into 2026 to bring the directions into their systems. Ask your branch for its current policy.
Do not sit on a claim. Deposits left unclaimed for ten years are moved to a fund kept by the Reserve Bank. They can still be claimed, through the bank, but it takes longer.
What Should an Account Holder Do Today?
Everything on this page is easy for the account holder and hard for the family. Ten minutes at the branch now saves them months.
- Ask the bank who your nominee is. On every account, deposit and locker. Many people do not know.
- Register a nominee where there is none. Banks have to offer the facility. Ask the branch how many nominees it can record.
- Check the nominee's name against the nominee's present identity document. If your daughter has married and changed her name, file a fresh nomination in her present name.
- Give the date of birth and relationship on the form, in full. They identify the nominee when a name is in doubt.
- Take the acknowledgement. Banks are to acknowledge a nomination request, as reported, within three working days.
- Make your own name on the account match your Aadhaar and PAN. Then the death certificate, written from Aadhaar, will match as well.
- Tell the nominee. Where the accounts are, and that the nomination exists.
How Does the Central Gazette Route Work?
Use this where the nominee's or an heir's own name has changed for a reason other than marriage, or where a nominee has two forms of a name and the bank wants a public paper linking them. It is for a living claimant's own name only.
Step 1: Ask the bank what it will accept
A marriage certificate, or a declaration with proof of relationship, may be enough.
Step 2: Fix the name on your identity papers, and list the other form as in the nomination
Letter by letter, from the bank's record.
Step 3: Make the affidavit
By the nominee. State both forms, the father's or husband's name and the address. Sign before a notary.
Step 4: Publish the newspaper notice
In a daily local leading newspaper. Keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult, with Rs 250 more for each alias. It is not refunded.
Step 8: Send the file yourself, then give the Gazette to the bank
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Give the published notification to the bank with the claim.
A Gazette commonly takes 3 to 7 weeks. Tell the bank in writing that it is under way, so the claim is not closed meanwhile.
Would a Bank Accept the Uttarakhand Gazette?
The rule says Gazette notification, without naming one. Where the same paper has to serve an insurer, a pension office and other banks, the Gazette of India is the safer choice.
Step 1: Ask the branch if it accepts a state Gazette
Before you choose.
Step 2: Think about every office the family is claiming from
The Gazette of India serves them all.
Step 3: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted, and how long it takes.
Step 4: Ask for the papers, the format and the fee, and submit
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do Families Make?
| Mistake | What to do |
|---|---|
| Not asking which name the bank objects to | Ask plainly: the holder's or the nominee's |
| Getting a Gazette for a married daughter | Her marriage certificate is the paper |
| Trying to get a Gazette for the person who has died | It is not possible. Correct the death certificate or give evidence |
| Giving the informant's guess for the death certificate | Give the Registrar the dead person's Aadhaar |
| Accepting an oral "papers incomplete" | Ask what is missing, in writing |
| Paying an agent near the branch | A nominee needs three papers and a linking paper |
| Going to court where a nominee exists | A nominee's claim does not need a succession certificate |
| Leaving the claim for years | Claim promptly, while papers and people are at hand |
| Never checking one's own nomination | Check it this month, and refresh it |
A typical case we handle: a woman in Haridwar was the nominee on her late father's fixed deposits, in her maiden name. Her Aadhaar had her married name, and the branch told her to bring a succession certificate. She did not need one. She gave the claim form, the death certificate, her Aadhaar and her registered marriage certificate, with her school certificate naming her father, and asked for a written reason if the bank still declined. The deposits were paid. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
A succession certificate, probate, a dispute between heirs, and a claim the bank has refused in writing.
When you do not need us
For a married nominee, the marriage certificate. For a wrong death certificate, the Registrar. For the bank's own slip, the bank. We are useful only where a living nominee or heir has changed a name otherwise than by marriage, or the bank asks for a Gazette notification to link two forms of the claimant's own name.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. The claim is made at the dead person's branch. A nominee who lives elsewhere can send us papers on WhatsApp for the Gazette file, where one is needed.

The claim form, the death certificate and an officially valid identity document.
My name as nominee is my maiden name. Can I still claim?
Yes. Your marriage certificate links it to your present identity document.
Does a nominee need a succession certificate?
Reports of the directions say a bank is not to ask a nominee for one.
The death certificate name differs from the bank account. What do I do?
Have the death certificate corrected, or give the bank papers showing both names were his.
How long does a bank have to settle a death claim?
As reported, 15 days from receiving complete documents.
Can a gazette be made for a person who has died?
No. A change of name notice is made by the living person whose name it is.
How many nominees can I have on a bank account now?
Up to four. Under the Banking Laws (Amendment) Act, 2025, the nomination provisions came into force on 1 November 2025, for deposit accounts, articles in safe custody and lockers. Write each nominee's name as on that person's Aadhaar.
What is the difference between simultaneous and successive nomination?
Simultaneous nominees share the deposit in the percentages you fix, which must add up to 100. Successive nominees take in order, the next one only on the death of the nominee above. A depositor may choose either for deposits.
Can I name several nominees for a locker?
Yes, up to four, but only successively, not simultaneously. The next nominee comes in only on the death of the one above.
What happens if the first nominee has died before the account holder?
Under a successive nomination, the next nominee becomes operative on the death of the nominee placed higher. Each nominee's name is then checked against that person's own identity document.
Which rules set out the new nomination forms?
The Banking Companies (Nomination) Rules, 2025, notified by the Ministry of Finance and effective from 1 November 2025. Ask your branch for the form under these rules when you refresh a nomination.
When was the Banking Laws (Amendment) Act passed?
It was notified on 15 April 2025, with amendments to five laws, including the RBI Act, 1934 and the Banking Regulation Act, 1949. The nomination sections were brought into force from 1 November 2025.

Nominee Name Mismatch in a Bank Claim: The Short Version
A nominee gives the bank three papers: the claim form, the death certificate and an identity document. Two pairs of names have to match: the account with the death certificate, and the nomination with the nominee's identity document. A married nominee closes her gap with her marriage certificate. A wrong death certificate is corrected by the Registrar. A Gazette is for a living claimant's own changed name only.
