Will and Probate Name Mismatch in Uttarakhand

When a will names its maker or a beneficiary differently from their other papers: what can be put right while the maker is alive, how identity is shown after a death, and where a Gazette notification does and does not help.

Quick answer

A will and probate name mismatch is cured most easily while the maker is alive, by a fresh will or a codicil that states every name in full. After the maker's death, nothing in the will can be changed. Identity is then shown by documents, and a living beneficiary with two names can link them by a Gazette notification.

While the maker lives, a wrong name in a will is cured by a codicil or a fresh will naming each person as on identity proof, with other names added.

A will is written once, often in a hurry, and read years later by a bank, a tehsil or a court that never met the family. A will and probate name mismatch is what those readers stop at. This page explains will and probate name mismatch for families in Uttarakhand: who can fix what, and when.

We do not draft wills or appear in courts. Both are a lawyer's work, and the law on succession in this state has changed recently. We prepare the Gazette notification, which helps only with a living person's own name. For the property's other papers, read name change in property documents in Uttarakhand.

What Is a Will, and Who Is Named in It?

The people named in a will and why each name matters
PersonWho that isWhy the name matters
The makerThe person whose will it isIt has to be the same person as on the death certificate and the property papers
The beneficiariesThe people who are to receiveEach has to prove being the person named
The executorThe person asked to carry the will outOffices deal with the executor on identity proof
The witnessesThose who saw the maker signOne may have to be found and identified if the will is questioned
  • A will takes effect only on the maker's death. Until then the maker can change or cancel it.
  • A codicil is a short further document that amends a will. It is made with the same formality.
  • Probate is a court's certificate that a will is genuine and that the executor may act on it.
  • A will describes property as well as people. A wrong plot number or account number causes as much trouble as a wrong name.

What Has Changed in the Law?

Two changes bear on wills in this state. Both are as reported. A lawyer will tell you which law governs your own case.

Recent changes in the law on wills that bear on Uttarakhand, as reported
ChangeWhat is reported
The state's civil codeIn force from 27 January 2025. It covers succession and wills. Its online portal lets a will be uploaded for registration, modification, revalidation or revival, with common service centres authorised to help. Scheduled Tribes are outside it
ProbateA central Act that received assent on 20 December 2025 omitted the provision of the succession law that had made probate compulsory before certain rights under a will could be established. Probate can still be sought, and other provisions on it remain
RegistrationLaw firms note that a will does not need to be registered, stamped or notarised to be valid. Registration helps to prove it later

For names, the practical point is this. Fewer wills will now pass before a judge, so banks, tehsils and housing bodies will read them directly. They read the names literally. A will that names people exactly as their identity papers do is worth more than it used to be.

Where Are the Names in a Will Compared?

  1. At the tehsil, when a beneficiary asks for land to be mutated on the strength of the will.
  2. At the local body or the development authority, for a house or a plot.
  3. At a bank, a post office, an insurer or a fund house, where there is no nominee, or the nominee and the will point different ways.
  4. At a housing society or a company, for a flat or shares.
  5. In court, where probate is sought, or where someone disputes the will.
  6. At the sub-registrar, when the beneficiary later sells and a buyer's lawyer reads the chain.

At each, two comparisons are made. Is the maker in the will the same person as on the death certificate and the property record? And is the person at the counter the beneficiary the will names?

The first two rows are the only ones where the will itself can be put right. Everything below them is proof.

What Can Be Done While the Maker Is Alive?

Everything. A living maker can read the will again, see that a name is wrong, and make another. No office has to agree.

  • A fresh will replaces the old one. It should say so, and the old one should be destroyed or marked cancelled.
  • A codicil corrects a name or a detail and leaves the rest standing. It is signed and witnessed like a will.
  • Each person is named as on identity proof, with any other name they are known by added as "also known as".
  • Each is described, by relationship, father's or husband's name, age and address, so that a slip in one detail is covered by the others.
  • A married daughter is named in the name she uses now, with her maiden name noted.
  • The maker's own name is written as on the property papers and as on Aadhaar, and where those differ, both, with a sentence saying they are one person.
  • The will can be registered, at the sub-registrar or on the state's portal, which fixes its date and text.

Where the maker's own papers carry two forms of the name, this is also the time for the maker to cure that at source, by correcting the odd paper or by a Gazette notice. Heirs cannot do it afterwards.

How Do You Make the Names in a Will Safe?

These steps are for a living maker, with a lawyer.

Step 1: Read the existing will aloud, with the family's identity papers on the table

Check every name, relationship and address against them.

Step 2: List every name each person is known by

The maker, each beneficiary and the executor.

Step 3: Put the maker's own papers in order

The property papers, Aadhaar and PAN should agree. Correct the odd one, or take out a Gazette notice for two forms of the name.

Step 4: Check each property's description

Against the deed, the land record and the account statements.

Step 5: Have a lawyer draft a fresh will or a codicil

With each person named as on identity proof, other names added, and a full description.

Step 6: Sign before two witnesses

Who are younger, easy to find, and not beneficiaries.

Step 7: Register it

At the sub-registrar or on the state's portal, as your lawyer advises.

Step 8: Tell the executor where it is kept

And bring the nominations on bank accounts and investments into line with it.

What If the Maker's Name Is the Problem?

After the maker's death, the will is fixed and so is his name. Nobody can now correct either. The question becomes one of proof: was the person who made this will the person who owned this property and whose death is certified?

Papers that can still be corrected

  • The death certificate, by the Registrar, on the dead person's Aadhaar or other proof
  • A slip in a current land or tax record, by that office, on the deed

Evidence that ties the names together

  • The will itself, which gives his father's name, address and family
  • His Aadhaar, PAN, pension order and bank passbook
  • The property deed and older land records
  • The witnesses to the will
  • The family's sworn statements, and a neighbour's or the village head's

A Gazette cannot be taken out for a person who has died. Anyone who offers one for a dead parent's name is offering something the Department of Publication does not do. Read name correction in a death certificate and legal heir certificate.

What If a Beneficiary's Name Is the Problem?

  • A slip in a beneficiary's name does not usually defeat the gift. The law of succession has long said that a mistake in the name or description of a beneficiary does not matter where it is clear from the will who was meant. Your lawyer will confirm how that applies under the law that governs your case.
  • The will's own description helps. "My elder son Guddu" identifies a man whose Aadhaar says something else, if there is one elder son.
  • Documents close the gap: the birth certificate, the family register, school records naming the father, and the marriage certificate for a daughter.
  • A beneficiary who has since changed a name shows the Gazette notification of the change.
  • A beneficiary known all along by two names can take out a Gazette notice stating both. That gives a bank or a tehsil one public paper to rely on, where it would otherwise have to weigh evidence.
  • Where two people could answer to the name, such as two cousins with one pet name, it is a real ambiguity. That goes to a court.

The beneficiary is alive, so the beneficiary's own name is the one thing in this subject that can still be put in order. Read alias name in a gazette notification.

When Does a Court Come In?

Often settled without a court

  • A spelling difference, with clear documents
  • A daughter's maiden and married names
  • A registered will that nobody disputes
  • All the heirs agreeing in writing

Likely to need a court

  • An heir says the will is forged or was forced
  • Two wills are produced
  • The will's description fits more than one person
  • An office refuses to act without a court's order
  • Property in several places, or of large value

Reports of the 2025 change say probate is no longer a precondition, and that it can still be sought. An office may still ask for it, or for a succession certificate, where it is uneasy. Where the names in the will are doubtful, expect it to be uneasy. That is a lawyer's matter from the first day.

For land, the Tahsildar records a beneficiary's name by mutation on the will. Where another heir objects, the mutation becomes a contest. Read name correction in khatauni and land records.

How Does the Central Gazette Route Work?

Use this only for a living person: a maker who wants two forms of his own name tied together before he dies, or a beneficiary who has changed a name or is known by two. It cannot be done for a person who has died.

Step 1: Ask the lawyer handling the will if a Gazette would help

A marriage certificate, or a fresh will, may be the better cure.

Step 2: Copy the name exactly as the will has it, and as identity proof has it

Letter by letter.

Step 3: Make the affidavit

State both forms, the father's or husband's name and the address. Sign before a notary.

Step 4: Publish the newspaper notice

In a daily local leading newspaper. Keep the original newspaper.

Step 5: Type the form and sign the undertaking

Two typed copies of the specimen, signed with two witnesses, and the undertaking.

Step 6: Prepare the CD, photographs and certificate

The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.

Step 7: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult, with Rs 250 more for each alias. It is not refunded.

Step 8: Send the file yourself, then keep the Gazette with the will

Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. File a print of the published notification with the will, and give copies to each office.

Would the Uttarakhand Gazette Do?

A tehsil or a local body in the state may accept it. Banks, fund houses and a court elsewhere are the reasons to prefer the Gazette of India.

Step 1: Ask the lawyer and the offices concerned which Gazette they accept

Before you choose.

Step 2: Think about where the property and the accounts are

Assets outside the state point to the Gazette of India.

Step 3: Contact the Roorkee press

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.

Step 4: Ask for the papers, the format and the fee, and submit

Keep photocopies of everything.

Step 5: Download the notice

Search gazettes.uk.gov.in and save the PDF.

To weigh the two, read Uttarakhand Gazette vs Gazette of India.

Which Mistakes Do Families Make?

Common mistakes with names in a will
MistakeWhat to do
Writing beneficiaries by pet namesName each as on identity proof, with other names added
Naming a married daughter only by her maiden nameUse her present name, and note the earlier one
Never reading the will againRead it every few years, and after any change of name
Correcting a will by writing on itNever. Make a codicil or a fresh will
Leaving the maker's own papers in two namesCure it while the maker lives
Trying to get a Gazette for a dead personNot possible. Use evidence
A beneficiary as a witnessUse independent witnesses
Nominations that contradict the willBring them into line
Treating a disputed will as a paperwork problemSee a lawyer at once

A typical case we handle: a retired teacher in Haldwani had made a will leaving his house to "my daughter Munni". Her Aadhaar, PAN and bank account all said "Meenakshi Joshi". He was alive and well when the family noticed. On their lawyer's advice he made a short codicil naming her in full, with "also known as Munni" and her husband's name, and registered it. No Gazette was needed, and we said so. Had he died first, she would have had to prove the point with documents and witnesses. This is an illustrative example of the type of case we handle, not a named client review.

What is a lawyer's job, not ours

Drafting a will or a codicil, registering it, probate, a succession certificate, a contested mutation, and any dispute among heirs.

When you do not need us

While the maker is alive, a fresh will or a codicil is the cure. For a married daughter, the marriage certificate. For the dead maker's name, evidence. We are useful only where a living person, the maker or a beneficiary, has changed a name or carries two forms of it, and a public paper is wanted to link them.

People Also Ask About a Name Mismatch in a Will

Is a will invalid if a beneficiary's name is misspelt?

Usually not, where it is clear from the will who was meant.

Can a name in a will be corrected after the maker's death?

No. Identity is then shown by evidence.

How is a mistake in a will corrected while the maker is alive?

By a codicil or a fresh will.

Is probate compulsory?

Reports of a 2025 change say it is no longer a precondition. Ask a lawyer.

Can a will be registered online in Uttarakhand?

As reported, the state's civil code portal lets a will be uploaded for registration.

Can a gazette be published for a dead person's name?

No. Only a living person can apply for his or her own name.

Which Act removed compulsory probate?

The Repealing and Amending Act, 2025, which received Presidential assent on 20 December 2025, omitted Section 213 of the Indian Succession Act, 1925.

Has probate been abolished?

No. Probate is no longer a statutory precondition to enforcing rights under a will, but it can still be sought. It stays useful where certainty is needed, such as when names in the will are in doubt.

Can a bank still ask for more papers after the probate change?

Yes. Banks, registrars and other asset-holders may still ask for a death certificate, a succession certificate, affidavits or indemnities, depending on the asset. Names on all of them should agree.

Can a succession certificate now be taken without probate?

Yes, for many estates. Section 370 was amended to remove the reference to Section 213, so bank deposits, shares and other securities can be pursued by succession certificate without first obtaining probate.

What happens to probate cases already pending?

They continue under the old framework. The 2025 Act's savings clause protects pending probate matters.

Does the probate change stop anyone from challenging a will?

No. A will still has to be proved if someone challenges it, and questions of genuineness, coercion, fraud or capacity remain. A doubtful name in the will is often where such a challenge begins.
