Date of Birth Correction in Uttarakhand

A wrong date of birth in one of your papers: which record is the base, which office corrects each paper, the time limits to watch, and what an affidavit or a Gazette cannot do.

Quick answer

A date of birth correction in Uttarakhand is made by the office that holds the wrong record, against your birth certificate or class 10 certificate. A wrong birth certificate is corrected by the Registrar. An affidavit or a Gazette notice does not change a date of birth, and most offices set their own time limits.

A man in Uttarakhand comparing the date of birth on his class 10 certificate, birth certificate and Aadhaar card
A date of birth is corrected by the office that holds the wrong record, against the birth certificate or the class 10 certificate, not by an affidavit or a Gazette.

People come to us asking for a date of birth correction in Uttarakhand through the Gazette, because agents sell it that way. It does not work like a name. A person can choose a name, but nobody chooses a date of birth. This page explains date of birth correction in Uttarakhand honestly: which paper is the base, where each record is corrected, and where the limits are.

We prepare Gazette papers for names. For a date of birth there is usually very little we can do for you, and this page says so. For a name, read name spelling correction in Uttarakhand.

Why Is a Date of Birth Not Like a Name?

A name and a date of birth compared
PointNameDate of birth
Can you choose it?Yes. An adult may take a new nameNo. It is a fact
What can be doneA change, or a correctionOnly a correction of a record that got the fact wrong
Your own declarationCounts. A Gazette notice of a change of name is your declarationCounts for little. Offices want a record made near the time of birth
Why offices are strictIdentityAge decides school entry, jobs, retirement, pension and benefits
Time limitsFewCommon, and often short

So there is no such thing as a "date of birth change". There is only the correction of a paper that recorded the date wrongly, and the office holding that paper decides if it is satisfied.

A date cannot be corrected to suit a purpose. A request made to become eligible for a job, to gain service or to delay retirement is refused, and a false statement about age in an affidavit is an offence.

Which Record Is the Base for Your Date of Birth?

Every correction is made against a paper that offices trust for age. In practice they rank them in this order.

  1. The birth certificate issued by the Registrar of births. It is the record made nearest to the event. For people born after the 2023 amendment to the Registration of Births and Deaths Act came into force, the law makes it the main document for date and place of birth for many purposes.
  2. The class 10 certificate. For most adults it is the paper every office asks for as proof of age.
  3. The passport, where one is held.
  4. Other papers, such as a service record or a pension order, which offices accept where the first three do not exist.

Lay your papers out and write down the date on each. Then answer three questions.

  • Do my birth certificate and my class 10 certificate agree?
  • If they do, which other paper is the odd one out?
  • If they do not, which of the two is wrong, and can I prove it?

The first two questions lead to an easy correction. The third is the hard case, and it is dealt with below.

Which Case Is Yours?

Cases of a wrong date of birth and how hard each is
The situationWhat it isHow hard
Aadhaar, PAN or voter card differs from the birth certificate and class 10 certificateOne odd recordEasy. That office corrects it on proof
A typing slip in a certificate, such as 1996 for 1995A clerical errorManageable, if within the office's time limit
The birth certificate itself has the wrong dateAn error in the birth registerThe Registrar's procedure, on proof
The class 10 certificate differs from the birth certificateTwo base records disagreeHard. The board's rules and time limits apply
The school entered a "school date" at admission and it has been used ever sinceA wrong date in every recordVery hard. Often not possible after many years
No birth certificate was ever madeAn unregistered birthLate registration, with an order of the authority named in the Act
A government employee wants the service record alteredA service matterStrict rules and a short limit from the date of joining

The fifth row is common among people who went to school some decades ago. A date was written down at admission to suit the class, and it became the date on every paper. Be realistic about that case before you spend on it.

Which Office Corrects Which Paper?

This is the usual position. Each office keeps its own list of proofs and its own limits, and can change them.

Which office corrects a date of birth in each record
Paper with the wrong dateWho corrects itMain proofWatch for
Birth certificateThe Registrar who issued itHospital record, and a declaration where askedThe Registrar must be satisfied the entry is erroneous
School registerThe schoolBirth certificateDo it before board registration
Class 10 or 12 certificateThe board, through the schoolThe school's record and the birth certificateThe board's time limit after the result
AadhaarUIDAIA document from its list for date of birthA limit on how many times the date can be updated
PANIncome Tax DepartmentProof of date of birth, as its form listsAadhaar and PAN are matched
PassportPassport SevaBirth certificate, as its rules sayIts own rules on a change in date of birth
Voter IDElection CommissionProof of age with Form 8Little
Driving licenceThe transport officeProof of ageLittle
Service bookThe employerAs the service rules sayA short limit from joining

No row in this table says "Gazette". A date of birth is corrected by the office that holds the record, on documents made near the time of birth.

How Do You Get a Date of Birth Corrected?

Step 1: List the date on every paper

Birth certificate, school certificates, Aadhaar, PAN, passport, voter card, service record.

Step 2: Settle the base record

The birth certificate where there is one, and the class 10 certificate. See if they agree.

Step 3: Correct the base first, if it is the wrong one

A wrong birth certificate at the Registrar. A wrong board certificate through the school.

Step 4: Check each office's own list and time limit

Before you apply, read which proofs it accepts and how long after issue it takes a request.

Step 5: Apply on its form, with proof

Give the date as it stands and as it should read. Attach the base record.

Step 6: Keep the acknowledgement

A slip, a reference number or a dated receiving on your copy.

Step 7: Check the corrected paper and move to the next

Aadhaar, then PAN, then the bank and the rest.

Do not start with Aadhaar if your certificates disagree with each other. You may spend its limited date of birth update on a date you later find you cannot support.

What If the Birth Certificate Is Wrong, or Was Never Made?

The birth certificate has the wrong date

  • The Registrar who holds the record can correct an erroneous entry under Section 15 of the Registration of Births and Deaths Act, 1969
  • The correction is noted in the margin of the register. The original entry is not altered
  • A wrong date is an error in substance. The rules made under the Act provide for a declaration by two credible persons who know the facts
  • Carry the hospital's record of the birth where it exists

No birth was ever registered

  • This is a late registration, not a correction
  • The Act allows registration after one year only on an order of the authority it names, after the date of birth is verified
  • Apply through the Registrar for the place of birth, who will explain the procedure
  • The date registered must be the true one. It will be compared with your school papers

A birth certificate obtained late in life, with a date that differs from your class 10 certificate, does not by itself overturn the class 10 certificate. Offices and courts look at when each paper was made and why. Take a lawyer's advice before you set out to create a conflict between the two.

For a baby's birth record, see name change for a newborn.

How Is a Date of Birth Corrected in School and Board Certificates?

  • While the child is in school. The school corrects its register from the birth certificate, on a parent's written request. Do it before the school registers the child with the board.
  • After the board has registered the candidate. The request goes to the board through the school, on the board's form.
  • After the result. Boards set time limits. The Central Board of Secondary Education's rules have said that a request to correct a date of birth is entertained only within one year of the declaration of the result, forwarded by the head of the school.
  • The Uttarakhand Board. It has its own correction form. We could not confirm its time limit or fee, so ask the school.

The class 10 certificate is the paper that matters most for an adult, and it is the one with the shortest window. A parent who checks the date in class 8 or 9 saves the child a problem that may have no remedy later.

For the state board's correction form, see father's name correction in an Uttarakhand Board marksheet. The route through the school is the same.

How Is It Corrected in Aadhaar, PAN and the Passport?

Aadhaar

  • Updated at an Aadhaar Seva Kendra with a document from UIDAI's list for date of birth
  • UIDAI limits how many times a date of birth can be updated. Treat it as a single chance
  • Settle your base record first

PAN

  • The request for changes or correction in PAN data, with proof of date of birth
  • The PAN number stays the same
  • Aadhaar and PAN are matched, so make them agree

Passport

  • A re-issue with the corrected date
  • Passport Seva has its own rules on a change in date of birth, and looks at the birth certificate
  • Read its current rule before you apply

These three are the easy part where your birth certificate and class 10 certificate agree. Each corrects its own record against them. They are hard only when the two base papers disagree.

What About a Date of Birth in Service Records?

A date of birth in a service book decides the date of retirement, so the rules are the strictest of all.

  • The rules for central Government servants allow a request to alter the date of birth only within five years of entering service, for a genuine mistake, and not to gain an advantage.
  • State employees, teachers and employees of public bodies are governed by their own service rules, which follow a similar idea. Ask your establishment section for the rule that applies to you.
  • Courts have been firm against requests made near retirement.
  • A date declared by the employee and published in a Gazette is not treated as better evidence than a birth certificate and school record. A High Court has said so in a service case.

This is a service matter. If you are an employee and your date of birth is in question, take advice from a lawyer who handles service cases. We cannot help with it.

What Can an Affidavit Do, and Not Do?

It cannot

  • Change or correct a date of birth in any record
  • Stand in for a birth certificate or a class 10 certificate
  • Create proof of age where none exists
  • Bind an office to accept the date you state

It can

  • Support an office's own correction form, where that office asks for it
  • Explain a difference between two papers
  • Record the facts known to parents or elders, where a Registrar asks for a declaration

An affidavit is your own statement. For a date of birth, an office wants a record made by someone else, close to the event. A shop that sells an affidavit as a "date of birth correction" is selling you a statement of what you already say.

What About a Gazette for a Date of Birth?

We are often asked this, so here is the honest position.

  • The Department of Publication's guidelines that we have read deal with a change of name, and with a public notice for matters such as a wrongly written name. We have not found one that provides for a notice correcting a date of birth.
  • At least one published reading of the Department's guidelines says that correction of date of birth is among the matters not published in Part IV of the Gazette of India.
  • Many websites say the opposite and offer a "date of birth Gazette". We could not find the Department's own authority for that.
  • Even if a notice were printed, it would be your own declaration. A High Court has said a date declared by a person and published in a Gazette is not better evidence than a birth certificate and school record.
Do not pay for a "date of birth Gazette" on anyone's word, ours included. Ask the Department of Publication in writing if it publishes such a notice, and ask the office that holds your record in writing if it would act on one. If either answer is no, the money is wasted.

We do not prepare a Gazette file for a date of birth unless the Department has confirmed in writing that it publishes such a notice. Where a name and a date of birth are both wrong in a paper, we can help with the name. See public notice for wrongly written name.

How Do You Check With the Gazette of India?

If an office has told you to bring a Gazette notification for your date of birth, check before you prepare anything.

Step 1: Get the office's demand in writing

Ask it to say exactly what notification it wants and under which rule.

Step 2: Read the Department's current guidelines

On the Department of Publication's website, see what kinds of notice it accepts in Part IV.

Step 3: Ask the Department in writing

Ask if it publishes a notice about a date of birth, and under which guideline. Keep the reply.

Step 4: Take the reply back to the office

If the Department does not publish such a notice, show that to the office and ask what else it will accept.

Step 5: Go back to the documents

The birth certificate, the school record and that office's own correction procedure are what settle a date of birth.

If the Department confirms in writing that it will publish a notice in your case, follow the guideline it names. Do not pay any charge on BharatKosh before that, because the charge is not refunded.

How Do You Check With the Uttarakhand Gazette?

The Government Press at Roorkee sets its own practice for private notices. The same caution applies.

Step 1: Ask the office which Gazette it has in mind

And why it wants one for a date of birth.

Step 2: Contact the Roorkee press

Take the contact from govtpress.uk.gov.in and ask if it accepts any private notice about a date of birth.

Step 3: Ask for the answer in writing

With the format, the papers and the fee, if it says yes.

Step 4: Confirm with the office that it will act on it

Before you pay for anything.

Step 5: Keep to the documents in any case

A notice does not replace the birth certificate or the school record.

Which Mistakes Do People Make?

Common mistakes in a date of birth correction
MistakeWhat to do
Paying for a "date of birth Gazette"Ask the Department and the office in writing first
Treating an affidavit as a correctionIt is only your statement
Updating Aadhaar before the certificates agreeSettle the base record first
Missing the board's time limit after the resultApply through the school at once
Getting a late birth certificate that differs from the class 10 certificateTake advice first. It creates a conflict, not a correction
Asking for a date that suits a job or a pensionOnly the true date can be recorded
Raising a service record correction near retirementThe rules give a short limit from joining
Letting the school enter an estimated date at admissionGive the birth certificate at admission
Correcting one paper and leaving the restList them all and work through them

A typical case we handle: a man from Haldwani had one date on his class 10 certificate and birth certificate, and a different year on his Aadhaar. He had paid for an affidavit and was about to pay for a "date of birth Gazette". We told him neither was needed. He took his class 10 certificate to an Aadhaar Seva Kendra and had the one record corrected. This is an illustrative example of the type of case we handle, not a named client review.

What is a lawyer's job, not ours

A conflict between a birth certificate and a class 10 certificate, a late registration of birth, a refusal by a board or a Registrar, and any service record matter.

When you do not need us

On the Gazette, the page states what we could and could not find, and tells you to ask the Department of Publication in writing. A dispute about age is a matter for a lawyer.
