Name Wrong in an FIR in Uttarakhand
When a name is misspelt or wrongly given in a First Information Report: why the report itself is not rewritten, how the right name is brought on record, and where a lawyer is needed.
When a name is wrong in an FIR, the report itself is not rewritten. The right name is brought on record through a written application and a further statement to the police, and it is carried into the final report to the court. No affidavit or Gazette corrects an FIR. Where much depends on it, take a lawyer's advice.

A name wrong in an FIR is usually noticed when an insurer, a court or a passport office reads the report and finds it does not match the person. It is a police and court matter from start to finish. This page explains what can be done about a name wrong in an FIR in Uttarakhand, in plain terms, and where the limits are.
This is not our work. We prepare Gazette papers for names, and a Gazette has no power over a police record. We have written this page because people ask, and so that nobody pays for a Gazette or an affidavit in the hope of fixing a report. For a police check on your own name, read name mismatch in police verification.
What Is an FIR?
A First Information Report is the first record the police make when they are told of an offence they can investigate without a court's order. Since July 2024 it is registered under the Bharatiya Nagarik Suraksha Sanhita, 2023, which replaced the earlier Code of Criminal Procedure.
- It is written down from what the informant says, read over, and signed by the informant.
- The informant is entitled to a copy, free.
- A copy goes to the Magistrate.
- It sets the investigation in motion. It is not the end of the matter, and it is not proof of what it says.
Names enter an FIR in a hurry: the informant's, the injured person's, the owner of a vehicle or of stolen property, and the persons accused. Each is written as it was spoken or as the writer heard it. That is where a wrong letter, a home name or a missing surname comes from.
Why Is the Report Itself Not Rewritten?
An FIR is valued because it is the first, untouched account. Once it is registered and a copy has gone to the Magistrate, the police do not go back and alter its text. If they could, nobody could rely on one.
That does not leave a mistake uncorrected. The correct particulars are brought on record in the papers that follow the FIR.
| Paper | What it does |
|---|---|
| A written application to the police | Tells the station and the investigating officer what is wrong and what is right, with proof |
| A further statement | The investigating officer records your statement with the correct particulars |
| The case diary | The officer notes the correction in the record of the investigation |
| The final report to the court | The police report at the end of the investigation gives the names as found to be correct |
| The court's record | Where a case goes to court, the court can be asked to take the correct particulars on record |
So the aim is not a "corrected FIR". It is a set of later papers, from the police and the court, that show the right name and explain the first one.
Whose Name Is Wrong?
| Whose name | Example | Usual route | How serious |
|---|---|---|---|
| The informant's own | Your surname misspelt in your own report | Application and further statement to the police | Usually small |
| The injured person's or the deceased's | A home name written for an accident victim | Application with identity proof, and care that the later papers carry the right name | Matters for a claim |
| The vehicle owner's or the property owner's | The owner's name differs from the registration | Application with the registration or ownership papers | Matters for insurance |
| An accused person's, misspelt | The right person, a wrong spelling | For the police and the court. Take a lawyer's advice | Serious |
| A wrong person named as accused | You are named and had no part | A lawyer, at once | Very serious |
The first three rows are the ones ordinary people can start on themselves. The last two should not be handled without a lawyer.
What Do You Do If You Gave the Report?
This is the general method for an informant, an injured person or an owner whose name was written wrongly. It is not a substitute for a lawyer's advice in a serious case.
Step 1: Get a copy of the FIR and read every name
Yours, the injured person's, the owner's, the fathers' names, the vehicle number and the address.
Step 2: Write down exactly what is wrong
The entry as it stands, and as it should read.
Step 3: Collect proof of the right particulars
Identity papers, and for a vehicle or property, the registration or ownership papers.
Step 4: Give a written application at the police station
Address it to the officer in charge, quoting the FIR number and date. Ask that the correct particulars be taken on record.
Step 5: Take a dated receiving
A stamped copy of your application. Without it, you cannot show that you raised the point.
Step 6: Ask the investigating officer to record your further statement
Give the correct particulars in it, and show the originals.
Step 7: Follow up, and go higher if nothing happens
Write to the senior police officer of the district, with a copy of your application and the receiving.
Step 8: Check the final report
When the investigation ends, see that the police report to the court carries the right name. If it does not, a lawyer can ask the court to take it on record.
Do this early. A correction asked for in the first days reads as a slip being put right. One asked for months later, just before a claim, invites questions.
What If You Are the Injured Person or the Owner, and Someone Else Gave the Report?
After an accident, the report is often given by a bystander, a driver or a relative, who may not know the full name of the person hurt or of the vehicle's owner.
- You, or a close family member, can give the same kind of written application with proof of the correct particulars.
- See that the other papers of the case carry the right name too: the medical report, the post-mortem report where there is one, and the seizure and inspection papers.
- Where the person has died, the name on the death certificate should match the identity papers, and the police papers should match both.
- Keep copies of everything. A claim rests on the whole set, not on the FIR alone.
For a death certificate, see name correction in a death certificate and legal heir certificate.
What If You Are Wrongly Named as an Accused?
This is a different matter from a spelling slip, and it is the one case on this page where time matters most.
- If the report names you by mistake for someone else, a person with the same or a similar name, the police can be shown who you are by your father's name, address, age and where you were.
- If the report names you falsely, that is a question of fact for the investigation and, if need be, the court.
- In either case, see a lawyer before you do anything else. A lawyer will advise on representing to senior police officers, on protection from arrest, and on asking the High Court to quash a report that discloses nothing against you.
- Do not ignore a notice from the police, and do not rely on a friend at the station.
How Does a Wrong Name Affect Insurance and Accident Claims?
Where it is checked
- A motor insurer compares the FIR with the policy, the registration and the driving licence
- A claim for compensation after a road accident rests on the police papers and the medical record
- A theft claim rests on the FIR and the final report
- A life or accident insurer compares the police papers with the policy and the death certificate
What usually satisfies it
- The later police papers that carry the right name
- Identity papers that tie the two forms together
- A letter from the police station confirming the person, where the insurer asks for one
- A sworn statement, where the insurer's own procedure calls for it
Ask the insurer in writing what it needs to treat the two names as one person. In a compensation case before a tribunal, your lawyer will lead evidence on who the person was. A wrong letter in an FIR does not by itself defeat a genuine claim, but it has to be explained.
Where the vehicle's own papers disagree, see vehicle RC name correction in Uttarakhand.
What About a Lost Article Report?
A report of a lost document, a phone or a card, made at a station or online, is usually not an FIR. It is an entry that an item was reported lost, used to apply for a duplicate.
- If your name is wrong in such a report, the simplest course is usually to make a fresh one with the name as on your identity papers.
- Type the name yourself where the form is online, and copy it from your Aadhaar.
- The office issuing the duplicate, such as the passport office, a board or a bank, will compare the report with your identity proof.
Ask the station or the portal if an earlier report can be withdrawn or simply left. Do not hold two reports with different facts.
What If Your Own Name Has Changed Since the Report?
Here the FIR was right when it was written. You have since married, or changed your name by Gazette, and your identity papers no longer match the report.
- Nothing in the FIR needs correcting. It records the name you had then.
- What you need is the paper that links the two names: the marriage certificate or the Gazette notification.
- Tell the investigating officer, or your lawyer if the case is in court, so that the change is noted and notices reach you.
- Give the insurer or the tribunal the linking paper with your identity proof.
This is the one situation on this page where a Gazette has a part, and only if you have in fact changed your name. See gazette name change in Uttarakhand.
What Can an Affidavit or a Gazette Not Do?
They cannot
- Alter the text of an FIR
- Remove a person named as accused
- Replace the further statement and the final report
- Bind the police, a court or an insurer
What they can do, at most
- A sworn statement can support your application, where the police or an insurer asks for one
- A Gazette notification can show that you changed your own name, and link the old name to the new
We say this plainly because people are sold both. A public notice in the Gazette is for a name wrongly written in the applicant's own records such as certificates. A police report is not that kind of record, and we know of no guideline that provides for a notice about one.
How Does the Central Gazette Route Work, Where Your Own Name Has Changed?
This is only for a person whose own name has changed, or is changing, and who needs the public record of it. It does nothing to the FIR.
Step 1: Take advice first if a case is pending
If you are a party or a witness in a pending case, ask your lawyer before changing your name.
Step 2: Fix the exact new name
The spelling you will use on every paper.
Step 3: Make the affidavit
State the old name, the new name, your father's or husband's name and your address. Sign before a notary.
Step 4: Publish the newspaper notice
In a daily local leading newspaper. Keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then tell the police or the court
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Give a copy of the published Gazette to the investigating officer or to your lawyer.
Can the Uttarakhand Gazette Be Used?
The same caution applies. A state notice records a change of your own name. It does not touch a police record.
Step 1: Ask your lawyer, if a case is pending
Before any change of name.
Step 2: Think about who will read the notification
An insurer, a tribunal or a central office may want the Gazette of India.
Step 3: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 4: Ask for the papers, the format and the fee, and submit
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
To weigh the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do People Make?
| Mistake | What to do |
|---|---|
| Signing the FIR without reading the names | Read it, or have it read to you, before you sign |
| Giving a home name or a short form to the police | Give the name as on the identity paper, with the father's name |
| Asking the station to "change the FIR" | Ask for the correct particulars to be taken on record |
| Making an oral request only | Give a written application and keep a receiving |
| Paying for an affidavit or a Gazette to fix the report | Neither corrects an FIR |
| Waiting until the claim is refused | Raise it in the first days |
| Handling a wrongly named accused without a lawyer | See a lawyer at once |
| Filing a second report with different facts | Add to the first by a further statement |
| Paying anyone to "manage" the record | It is an offence, and it harms your case |
A typical case we handle: a man from Rudrapur called us after his scooter was stolen. The FIR had his name as "Raju", the name the neighbour who phoned the police knew him by, and the insurer would not take the claim. He wanted a Gazette to say Raju and Rajendra were one person. We told him a Gazette was not the answer. He gave the station a written application with his registration certificate and Aadhaar, his statement was recorded, and the final report carried his full name. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
Everything on this page that goes beyond a written application to the police: an accused wrongly named, a quashing petition, a claim before a tribunal, and any application to a court.
When you do not need us
For a name wrong in an FIR, always. Go to the police station, and to a lawyer where the matter is serious. We are useful only where your own name has changed and you need the Gazette that shows it.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. An FIR is dealt with at the police station where it was registered, and in the court for that area.

That is where you can see if the right name was used.
Not Sure Where to Take It?
Tell us whose name is wrong and what the report is for. We will tell you, free, if it is a matter for the police station or for a lawyer. We do not charge for that. A Gazette is of no use for an FIR.
