MACT Compensation Name Mismatch in Uttarakhand
When a motor accident claim is slowed because the victim's or a claimant's name differs between the police papers, the hospital papers, the death certificate and Aadhaar: where names are compared, and what closes each gap.
A MACT compensation name mismatch is settled by the claims tribunal on evidence. The victim's name across the police, hospital and death papers is proved by documents and witnesses, and a wrong certificate is corrected at its own office. A living claimant's changed name is linked by a marriage certificate or a Gazette notification. This is a lawyer's case.

After a road accident, a family goes to the Motor Accidents Claims Tribunal with papers written in a hurry by a constable, a hospital clerk and a village informant. A MACT compensation name mismatch is what happens when those papers do not agree. This page explains MACT compensation name mismatch for families in Uttarakhand, and what can be put right before it costs time.
We do not file claims or appear before tribunals. A motor accident claim is a court case and needs an advocate from the first day. We prepare the Gazette notification, which helps only with a living claimant's own name. For the first police paper, read FIR name wrong correction in Uttarakhand.
What Are the Tribunal and the Claim?
- The tribunal. A Motor Accidents Claims Tribunal is a court set up under the Motor Vehicles Act to decide compensation for death, injury or damage from a motor accident. It sits at the district courts.
- Who claims. An injured person, or the legal representatives of a person who has died: usually the spouse, children and parents.
- Against whom. The driver and the owner of the vehicle at fault, and its insurer.
- What is decided. That the accident happened, who was at fault, who the victim was, who the claimants are, and how much is payable.
- How it ends. In an award naming each claimant and each one's share, which the insurer pays, generally by deposit and transfer to the claimants' bank accounts.
Two of those five questions are about identity: who the victim was, and who the claimants are. A name mismatch goes to one of them. The insurer's advocate is entitled to test both, and does.
Which Papers Does a Claim Rest On?
| Paper | Written by | Name it carries |
|---|---|---|
| First information report | The police, from the informant's account | The victim, the informant, the driver if known |
| Accident and inquest reports | The investigating officer | The victim |
| Medico-legal and hospital papers | The hospital, at admission | The victim, as given by whoever brought him |
| Post-mortem report | The doctor, from the police request | The victim |
| Death certificate | The Registrar, from the hospital or the informant | The victim, and the parents or spouse |
| Proof of age and income | School, employer, tax records | The victim |
| Proof of relationship | Family register, ration card, marriage and birth certificates | The victim and each claimant |
| Claimants' identity and bank papers | Aadhaar, PAN, bank | Each claimant |
The first five are written within hours or days of an accident, by people who never met the victim, from what a shaken relative or a bystander said. They are where a home name, a missing surname or a wrong father's name gets in.
Where Is a Name Compared?
- When the petition is drafted. Your advocate sets the victim's and claimants' names down. Tell him of every other form each name takes.
- When the insurer files its reply. A difference between the police papers and the claim is often pleaded as a doubt about identity.
- In evidence. A claimant is examined and cross-examined on who the victim was and how the claimant is related.
- When the award is written. Names go into the award as they appear in the petition.
- When the money is released. The tribunal and the bank compare each claimant's name in the award with that claimant's identity proof and bank account.
- For a minor's share. The child's name and date of birth are checked against the birth certificate, since the money is usually kept in deposit until majority.
The fifth checkpoint is the one families do not expect. A case can be won and the money still wait, because the award says "Guddi Devi" and the bank account says "Kamla Devi".
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The police papers give the victim a home name or a wrong spelling | Evidence before the tribunal that both are one person. A supplementary police statement where possible | No |
| The death certificate differs from the victim's Aadhaar | Correction by the Registrar of births and deaths | No |
| The hospital papers carry a different name | The hospital's own correction, or its certificate that both are one patient | No |
| The widow's name differs between papers | Her marriage certificate, and a Gazette notification if she uses two forms | Sometimes |
| A claimant has changed a name by choice | The Gazette notification | Yes |
| The award misspells a claimant | An application to the tribunal to correct the slip | No |
| A claimant's bank account differs from the award | Correct the bank's record, or the award, so the two agree | Rarely |
Most rows are about a person who has died. A Gazette cannot be taken out for him. His name is proved, not changed.
How Is the Victim's Name Put Beyond Doubt?
Where the victim has died, nothing about his name can now be changed. The task is to show the tribunal that the man in the police papers, the man in the post-mortem report, the man on the death certificate and the man on the Aadhaar card are one.
Papers that can still be corrected
- The death certificate, by the Registrar, on the victim's Aadhaar or other proof
- The hospital's record, by the hospital, on a written request
- A police record, by a supplementary statement to the investigating officer, at his discretion
Evidence that ties the names together
- The victim's own Aadhaar, voter card, licence and bank passbook
- Older papers carrying the other form: a school certificate, a ration card, a service record
- The photograph on the papers and on the post-mortem identification
- The sworn evidence of the family and of a witness who knew him by both names
- The village head's or the ward member's certificate
The father's name, the age and the address on each paper matter as much as the name. Where those agree, a difference in spelling is easily explained. Where they also differ, more is needed.
Where the victim is alive and injured, he can correct his own papers and, if he uses two names, take out a Gazette notice stating both. See hospital discharge summary name correction and name correction in a death certificate.
What About the Claimants' Names?
- Each claimant goes into the petition in the name on that claimant's Aadhaar and bank account. That is the name the award will carry and the bank will pay.
- A widow is often known by one name in the village and another on her papers. Her marriage certificate, the family register and the children's birth certificates naming her tie her to the victim.
- A married daughter claims in her present name. Her marriage certificate links her to her father.
- Parents have the oldest papers. Check their Aadhaar against the victim's school and birth records, which name them.
- Children are named as on their birth certificates, with the date of birth. A child without a birth certificate should get one registered now.
- A claimant who uses two forms of a name, or has changed one, can take out a Gazette notification. That is the one place in this subject where a Gazette does its ordinary work.
Open or check a bank account for each adult claimant, in that claimant's own Aadhaar name, before the case reaches judgment. See name change in bank records in Uttarakhand.
What Can a Family Do?
Step 1: Engage an advocate at once
There are time limits, and the first papers are being written now.
Step 2: Collect every paper, and copy the names out
The victim's name, father's name, age and address from each. Do the same for each claimant.
Step 3: Tell the advocate of every difference
Before the petition is drafted. A difference disclosed and explained is far weaker in the insurer's hands than one discovered in cross-examination.
Step 4: Correct the papers that can be corrected
The death certificate at the Registrar, the hospital record at the hospital.
Step 5: Gather the evidence that ties the names together
The victim's identity papers, older papers in the other form, and witnesses.
Step 6: Put each claimant's own papers in order
Aadhaar, PAN and a bank account in one name, with the marriage certificate or a Gazette notification where the name has changed.
Step 7: Read the petition before it is filed
Check every name, age and relationship. Ask for other forms of a name to be stated with "alias" where your advocate advises.
Step 8: Read the award the day it is given
If a name is misspelt, ask your advocate to apply for correction at once, before the money is deposited.
What About the Award, and the Bank Account?
- The award names each claimant and the amount for each. Courts have directed that compensation be paid into the claimants' bank accounts, with part kept in deposit, and not handed over in cash.
- The claimant's name in the award, on the identity proof and on the bank account therefore have to be the same.
- A clerical or typing slip in the award can be corrected by the tribunal on application. That is your advocate's work.
- A difference that is not a slip, because the claimant in fact uses two names, is met by the linking paper: a marriage certificate or a Gazette notification.
- A minor's share is kept in deposit in the child's name. The guardian's name on the deposit should match the guardian's Aadhaar.
- Where a claimant dies during the case, that claimant's heirs are brought on record. That is a further step in court.
Ask your advocate, well before judgment, what the tribunal and the bank will want at the release stage, and have it ready.
What About Hit and Run Cases?
Where the vehicle is never identified, there is nobody to claim against before the tribunal. The Government runs a compensation scheme for such cases. These points are from the transport ministry's reply in Parliament.
| Point | Position |
|---|---|
| Amount | A fixed sum of Rs 2 lakh for death, and Rs 50,000 for grievous hurt |
| Where to apply | To the Claims Enquiry Officer of the sub-division or taluka where the accident took place, with the prescribed documents |
| Enquiry | The officer conveys a decision within one month of receiving the claim |
| Sanction | The Claims Settlement Officer has fifteen days to sanction |
| Payment | By e-payment to the bank account given |
- The insurers' council's guidance asks for a copy of the bank passbook with the claim.
- The same names are compared: the victim in the police and post-mortem papers, and the claimant against the passbook.
- The claim is made to an officer of the administration, not to a court. Ask the sub-divisional magistrate's office for the form.
What About Time Limits?
- As legal guides report, the Motor Vehicles Act as amended requires a claim petition to be filed within six months of the accident. Courts have been asked to rule on that limit, and the position may change. Ask an advocate at once and do not rely on this page for the period.
- A correction of a death certificate, a hospital record or an Aadhaar card does not stop that clock. File the claim in time, and correct the papers alongside.
- A Gazette commonly takes 3 to 7 weeks. Where a claimant needs one, start it when the case is filed, not when the award is due.
- An application to correct a slip in an award should be made promptly.
How Does the Central Gazette Route Work?
Use this only for a living person: a claimant, or an injured victim, who has changed a name or uses two forms of it. It cannot be done for a person who has died.
Step 1: Ask your advocate if a Gazette would help the case
A marriage certificate may already link the names.
Step 2: Fix the name on Aadhaar and the bank account, and list the other form as in the case papers
Letter by letter.
Step 3: Make the affidavit
State both forms, the father's or husband's name and the address. Sign before a notary.
Step 4: Publish the newspaper notice
In a daily local leading newspaper. Keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult, with Rs 250 more for each alias. It is not refunded.
Step 8: Send the file yourself, then give the Gazette to your advocate
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Your advocate files a copy of the published notification in the case.
Would the Uttarakhand Gazette Do?
A tribunal weighs any Gazette notification as a public document. The bank and an insurer based elsewhere are the reasons to prefer the Gazette of India.
Step 1: Ask your advocate which he would rather file
He knows the tribunal.
Step 2: Think about the bank account the money will go to
The Gazette of India serves the bank, Aadhaar and PAN.
Step 3: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted, and how long it takes.
Step 4: Ask for the papers, the format and the fee, and submit
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
To weigh the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do Families Make?
| Mistake | What to do |
|---|---|
| Hiding a difference in names from the advocate | Tell him everything before the petition is drafted |
| Waiting to correct papers before filing | File in time, and correct alongside |
| Giving the victim's home name to the police and hospital | Give the name on his Aadhaar, and carry it |
| Trying to get a Gazette for the person who died | Not possible. His name is proved by evidence |
| Altering a police or hospital paper | Never. It destroys the claim and is an offence |
| Signing a settlement with an agent at the hospital gate | Deal only through your own advocate |
| Claimants without bank accounts in their own names | Open or correct them early |
| Not reading the award | Check every name the day it is given |
| Leaving a child without a birth certificate | Register the birth now |
A typical case we handle: a young man from Chamoli died in a road accident. The police papers, written from a co-passenger's account, gave his name as "Sonu". His Aadhaar and death certificate said "Surendra Singh Negi". The insurer's reply questioned if the two were one. His family's advocate led the school certificate, a bank passbook and two villagers who knew him by both names. His widow, who appeared as "Pinki" in the petition and "Priyanka Negi" on her Aadhaar, took out a Gazette notice stating both, which we prepared, so that her share could be released to her account. This is an illustrative example of the type of case we handle, not a named client review.
What is an advocate's job, not ours
All of the claim: the petition, the evidence, the argument, the award, its correction and any appeal.
When you do not need us
For the victim's name, always. It is proved in court, and wrong certificates are corrected at the Registrar and the hospital. For a married claimant, the marriage certificate. We are useful only where a living claimant has changed a name, or uses two forms of it, and a Gazette notification is wanted to link them.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. The claim is filed where your advocate advises. The Gazette file for a claimant, where one is needed, is prepared on WhatsApp, so a bereaved family need not travel for it.
People Also Ask About a Name Mismatch in an Accident Claim
Can an accident claim be rejected for a name mismatch?
It can be contested. The tribunal decides on evidence that the names are one person.
The FIR has the wrong name of the deceased. What do we do?
Tell your advocate. It is explained by evidence, and a supplementary police statement where possible.
Can a gazette correct the name of a person who died in an accident?
No. A Gazette is taken out by a living person for his or her own name.
The award has my name spelt wrongly. How is it corrected?
By an application to the tribunal, through your advocate.
Why has the compensation not been released to my account?
Often the name in the award differs from the name on the bank account.
What is the compensation in a hit and run case?
Under the 2022 scheme, Rs 2 lakh for death and Rs 50,000 for grievous hurt.
Is the six-month limit for MACT claims still applied?
On 7 November 2025 the Supreme Court stayed the six-month limit in section 166(3) and directed tribunals and High Courts not to dismiss claim petitions as time-barred while the challenge to it is pending. File promptly anyway, and ask your advocate for the position on the day you file.
When did the six-month limit for accident claims come in?
Section 166(3), added by the Motor Vehicles (Amendment) Act, 2019, took effect on 1 April 2022. Before that, from 1994, there was no time limit for filing a claim.
Can a tribunal condone delay in filing an accident claim?
High Courts have differed: some held that delay cannot be condoned under the amended Act, and others that the Limitation Act still applies. The question is before the Supreme Court.
What is the cashless treatment scheme for road accident victims?
Under the Cashless Treatment of Road Accident Victims Scheme, 2025, in force from 5 May 2025, a victim gets treatment up to Rs 1.5 lakh for up to seven days from the accident at a designated hospital. Give the victim's name as on Aadhaar at admission, since that record later goes into the claim. See hospital record name correction.
Who runs the cashless treatment scheme?
The National Health Authority implements it, and each state's Road Safety Council is the nodal agency. A hospital that is not designated gives treatment only to stabilise the patient.
Does a name mismatch stop cashless treatment?
Treatment is given first. The hospital's record should still carry the victim's correct name, since it is compared later with the death certificate or the claim papers.

The hit and run scheme's amounts, offices and periods are from the transport ministry's reply in Parliament and the insurers' council's guidance. The six-month limit is as legal guides report it. Everything else, including how a tribunal treats a difference in names, how an award is corrected and how compensation is released, is general guidance and not legal advice. A motor accident claim needs an advocate.

MACT Compensation Name Mismatch: The Short Version
A motor accident claim is a court case, and the tribunal decides on evidence who the victim was. A dead victim's name is proved, not changed: correct the death certificate and hospital record where they are wrong, and lead older papers and witnesses for the rest. Each claimant should claim in the name on Aadhaar and the bank account, since the award is paid there.
