Motor Insurance Name Mismatch in Uttarakhand: Vehicle Insurance Policy
For vehicle owners in Uttarakhand whose insurance policy names someone, or something, different from the registration certificate: a short name, a former owner after a sale, a maiden name, or an owner who has died. What the law says on transfer, which paper to correct first, and why it matters before a claim.
A motor insurance name mismatch is corrected by the insurer's endorsement on the policy, on the registration certificate and your identity paper. Correct the registration first where it is the odd one. After buying a used vehicle, apply to the insurer within fourteen days of the transfer. No Gazette is needed.

Every vehicle on the road in Uttarakhand carries an insurance policy, renewed each year, often online or through an agent. The policy names the insured, and the insurer reads that name against the registration certificate when a claim comes. A motor insurance name mismatch is a policy that names a different person or form of the name. This page explains motor insurance name mismatch.
We do not sell or correct policies, and this subject needs no Gazette. The rules on compulsory cover and transfer are from sections 146 and 157 of the Motor Vehicles Act, 1988. For the registration itself, read vehicle RC name correction.
What Is the Policy, in Brief?
- Third-party cover. Compulsory for a vehicle in a public place. It pays others for injury, death or damage the vehicle causes.
- Own damage. Optional cover for the vehicle itself.
- The insured. The person named on the policy, usually the registered owner.
- The vehicle. Named by number, engine and chassis.
- An endorsement. A change made to a policy during its term, such as a name correction.
The policy is read with two other papers: the registration certificate, which names the owner, and the driving licence of whoever was driving. Each was made by a different office.
What Does the Law Say?
From the Motor Vehicles Act, 1988, as published. Insurers' practice beyond these is from their published terms and varies.
| Point | What the law says |
|---|---|
| Compulsory cover | Section 146: no vehicle may be used in a public place without a policy covering third-party risks |
| Transfer with the vehicle | Section 157(1): when a vehicle with a certificate of insurance is transferred, the certificate and policy are deemed transferred to the buyer from the date of transfer |
| Fourteen days | Section 157(2): the buyer applies to the insurer within fourteen days of the transfer for the necessary changes |
| The registration | The owner's name comes from the registration, kept by the transport office |
The law protects third parties even when the paperwork lags. The owner's own cover is safer when the policy is changed in time.
Where Is the Owner's Name Written?
| Paper | Kept by | Where it is corrected |
|---|---|---|
| The registration certificate | The transport office | The transport office |
| The insurance policy | The insurer | The insurer, by endorsement |
| The driving licence | The transport office | The transport office |
| Aadhaar | The identity authority | An Aadhaar centre |
| The loan papers, if any | The lender | The lender |
The first two should name the same owner, in the same way. The policy follows the registration, not the other way round.
What Kinds of Mismatch Are There?
A spelling or a short form
- The policy and the registration name one owner differently
- Typed by an agent or a website
- Corrected by endorsement
The wrong owner
- A used vehicle still insured in the seller's name
- Or renewed year after year that way
- Transferred to the buyer
An owner who has died
- The registration and policy in the deceased's name
- The vehicle used by the family
- Registration and policy transferred to the heir
The second is the dangerous one. A family can drive a vehicle for years insured in a seller's name, and learn of it only when a claim is refused.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The policy has a spelling slip | The insurer, by endorsement | No |
| The registration has the slip | The transport office, then the insurer | No |
| A used vehicle insured in the seller's name | Transfer the registration, then the policy within fourteen days | No |
| The seller still gets challans | Transfer the registration | No |
| The loan is closed, the lender still on record | Remove the hypothecation, then the policy | No |
| The owner has died | Transfer to the heir, then the policy | No |
| A claim is made after an accident | The claim, with matching papers | No |
| The owner changed a name by choice | Gazette, then Aadhaar, licence, registration and policy | Yes |
A Gazette appears once in eight rows. The transport office and the insurer settle the rest.
How Do You Put It Right?
This is the general method. Each insurer has its own form or online request.
Step 1: Read the owner's name on the registration certificate
It is the record the insurer follows.
Step 2: Read the insured's name on the policy
And the vehicle number, engine and chassis numbers.
Step 3: Correct the registration first, where it is the odd one
At the transport office, before the insurer.
Step 4: Ask the insurer to endorse the policy to the registration's name
With the registration certificate and your identity paper.
Step 5: After buying a used vehicle, have the registration transferred, then the policy
The law gives the buyer fourteen days to apply to the insurer after transfer.
Step 6: Keep the endorsement with the policy
It is the paper that shows the change.
Step 7: At renewal, read the name again
An old name can return from an old record.
Step 8: Carry the policy, registration and licence in the vehicle
The police and an insurer read them together.
What About After Buying or Selling?
- Used cars, bikes and taxis change hands often in Uttarakhand.
- The law treats the policy as transferred to the buyer from the date of transfer.
- It gives the buyer fourteen days to apply to the insurer for the changes.
- First have the registration transferred at the transport office.
- Then take the new registration to the insurer for the endorsement.
- A seller should see that both are done, so that challans and claims no longer come to him.
Read vehicle RC name correction, traffic e-challan for a sold vehicle and vehicle NOC and re-registration.
What Happens at a Claim?
- At a claim, the insurer reads the policy, the registration and the driver's licence together.
- A small spelling difference plainly about one person is seldom the problem.
- A policy in a former owner's name, or a dead owner's, is a larger one.
- Third parties are protected by law. The owner's own damage cover is where trouble comes.
- Correct the papers before you need to claim, not after an accident.
- A claim by an injured person is made before the claims tribunal, with its own papers.
Read motor accident claim name mismatch and name change in driving licence.
What About a Vehicle on a Loan?
- A vehicle bought on a loan has the lender noted on the registration.
- The policy notes the lender too, and the lender may hold a claim payment.
- When the loan is repaid, the lender's interest is removed from the registration.
- Then ask the insurer to remove it from the policy as well.
- The owner's name on all three should be the same.
- A lender's no-objection letter names the owner as its records do. Read it.
Read vehicle loan hypothecation removal and FASTag KYC name mismatch.
What Happens When the Owner Dies?
- Families often go on using a vehicle registered and insured in a dead father's name.
- The registration can be transferred to the person entitled to the vehicle, on the death certificate and the family's papers.
- Then the policy is transferred to that person.
- Until then, a claim can be complicated.
- The death certificate should name the owner as the registration does.
- Ask the transport office what it needs for a transfer on death.
What About the No-Claim Bonus?
- A no-claim bonus is a discount on renewal for years without a claim.
- It is commonly treated as earned by the insured person, not the vehicle.
- So a seller may keep it for his next vehicle, and a buyer may not inherit it.
- The name on the old policy is how the bonus is traced to you.
- Keep old policies, in your correct name.
- Ask the insurer how to carry it forward. We could not confirm each insurer's rules.
Read name change in an LIC policy, on correcting other policies.
Where Does a Gazette Come In?
Only where the owner has changed a name by choice. A spelling or a transfer is done by endorsement.
Step 1: Confirm that the owner's name has in fact changed
A spelling on a policy is corrected by endorsement.
Step 2: Remember the order
The registration follows identity papers, and the policy follows the registration.
Step 3: Fix the exact new name
The spelling that will go on Aadhaar, the licence, the registration and the policy.
Step 4: Make the affidavit and publish the newspaper notice
Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then update in order
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then Aadhaar, the licence, the registration and the policy.
Which Gazette Should You Use?
The registration is the state's, the insurer is centrally regulated, and both read Aadhaar. The Gazette of India serves all three.
Step 1: Remember who issues the registration
The state's transport office.
Step 2: Remember who regulates insurers
A central regulator.
Step 3: Prefer the Gazette of India
It serves Aadhaar, the transport office and the insurer.
Step 4: Contact the Roorkee press only if a state notice suits you
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 5: Download the notice
Search egazette.gov.in and save the PDF.
For the difference between the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do Owners Make?
| Mistake | What to do |
|---|---|
| Renewing a used vehicle in the seller's name | Transfer it to your name |
| Correcting the policy before the registration | The registration first |
| Missing the fourteen days after a sale | Apply to the insurer at once |
| Leaving a dead owner's name on both papers | Transfer to the heir |
| Forgetting to remove the lender after repaying | Remove it from both |
| Typing a short name on an online renewal | The registration's name |
| Not reading the policy when it comes | Read the name and numbers |
| Throwing away old policies | Keep them for the bonus |
| Asking for a Gazette for a policy | The insurer endorses it |
A typical case we handle: a man in Rudrapur bought a used car in 2023 and renewed its insurance twice online, keeping the details the website filled in. The registration had been transferred to him, but the policy still named the seller. He noticed when the renewal reminder came in another man's name, and asked us whether he needed a Gazette. He did not. He sent the insurer his registration certificate and identity paper, and the policy was endorsed to his name. This is an illustrative example of the type of case we handle, not a named client review.
When you do not need us

Insurers commonly allow it for a vehicle of the same class. One insurer's published terms allow it within three years where the old vehicle is sold. Keep the old policy in your exact name.

That third-party insurance is compulsory is from section 146 of the Motor Vehicles Act, 1988. That a policy is deemed transferred with the vehicle, and that the buyer applies to the insurer within fourteen days, are from section 157. How insurers treat own-damage cover after a late transfer, the no-claim bonus, endorsements and claims are from general practice and their published terms, which vary. We did not read any insurer's policy wording or the regulator's circulars for this page. The insurer and the transport office are the authority.

Motor Insurance and Names: The Short Version
A motor insurance policy should name the owner exactly as the registration certificate does. Correct the registration first where it is wrong, then ask the insurer for an endorsement. After buying a used vehicle, transfer the registration and apply to the insurer within fourteen days. Remove a repaid lender from both. Transfer a dead owner's vehicle to the heir. Do all of it before you need to claim.
No Gazette is needed. To find out which paper differs, send photos on WhatsApp 9540005064, and we will reply in working hours.
