Hypothecation Removal Name Mismatch in Uttarakhand: Vehicle Loans

For vehicle owners who have repaid a loan and find the transport office will not remove the lender's name from the registration certificate, since a name does not match: which two names are read, who corrects each, what to do when the bank has merged, and why this should not be left for years.

Quick answer

A hypothecation removal name mismatch is cured before applying. Ask the lender to issue its no objection letter and the termination form in the owner's name exactly as on the registration certificate. Where the lender's own name has changed, ask it for a letter saying so. A short name needs no Gazette.

A vehicle owner in Uttarakhand comparing the registration certificate with the bank no objection letter and Form 35 to remove a hypothecation entry
A hypothecation entry is removed on Form 35, which carries the owner and lender names, so both are checked against the registration certificate first.

When a vehicle is bought on a loan, the lender's name is written on its registration certificate, and stays there until someone has it taken off. Paying the last instalment does not do it. A hypothecation removal name mismatch is found on the day the owner goes to clear the certificate, often years later, when he wants to sell. This page explains hypothecation removal name mismatch for owners in Uttarakhand.

We do not remove hypothecation, and this subject seldom needs a Gazette. What the termination form is, and who signs it, are from the form itself and from guides. For the owner's name on the certificate, read vehicle RC name correction.

What Is the Loan Entry, in Brief?

  • What it is. A note on the registration certificate that the vehicle is under a loan agreement with a named financier.
  • When it is made. At registration, where the vehicle was bought on finance.
  • What it does. It tells every reader that the lender has a claim on the vehicle.
  • What it stops. A clean sale or transfer, while it stands.
  • How it ends. On the owner's application, with the lender's consent, at the transport office.

Many owners believe the entry falls away when the loan is repaid. It does not. Many certificates still carry the name of a lender who was paid off years ago.

How Is It Removed?

From the termination form itself, as published, and from guides to the procedure. The transport office has the present steps and fee.

What the termination form and guides say about removing a hypothecation entry

What it asksThat the note endorsed in the certificate of registration be cancelled

One form, two signatures, two names. The transport office reads each name against its own record. Either can fail.

Which Two Names, on Which Four Papers?

Papers in a hypothecation removal and the names each carries
PaperThe owner's nameThe lender's name
The registration certificateAs typed at registrationAs the lender was called then
The loan accountAs on the borrower's KYCThe lender's own
The no objection letterCopied from the loan accountAs the lender is called today
The termination formSigned by the ownerSigned and sealed by the lender

The first and third rows are the pair that has to agree. One was written by a dealer's clerk on the day of purchase. The other is printed by a bank's system years later.

What Kinds of Mismatch Are There?

The owner is named in two ways

  • A full name on the certificate, a short one in the loan account
  • Or a surname on one and not the other
  • The lender reissues its papers, or the record is corrected

The lender is named in two ways

  • The bank has merged, or the company has a new name
  • The certificate carries the old one
  • A letter from the lender explains it

The owner is no longer the borrower

  • The vehicle was sold or passed on with the entry still on it
  • Or the borrower has died
  • The old lender's papers, and a transfer, in an order the office sets

The second catches people who did everything right. Their own name is the same everywhere. The bank that lent them the money no longer exists under that name.

A Gazette appears once in eight rows. The lender's branch settles nearly all the rest.

How Do You Put It Right?

This is the general method. Do it in the month the loan closes.

Step 1: Take out the registration certificate and read two names on it

The owner's, and the financier's in the hypothecation entry.

Step 2: Take out the loan papers and read the same two names

The borrower as the lender has him, and the lender's own name today.

Step 3: See where they differ

Your name in two forms, or the lender's name in two forms, or both.

Step 4: Correct your own name first, on whichever record is wrong

The registration record at the transport office, or the loan account at the lender, on your Aadhaar.

Step 5: Ask the lender for its closing papers in the name on the certificate

The no objection letter and the termination form, naming you and the vehicle exactly as the certificate does.

Step 6: Where the lender's name has changed, ask it for a letter saying so

A merger or a new name is the lender's to explain, on its own letterhead.

Step 7: Apply for the termination at the transport office

Through the national vehicle portal or at the counter, with both signatures on the form.

Step 8: Collect the fresh certificate, and tell the insurer

The policy also names the financier. Have that removed too.

What About the Owner's Name?

  • The certificate's name was typed by the dealer, from the papers given at purchase.
  • The loan account's name was typed by the lender, from the papers given for the loan.
  • These were often different papers: a licence for one, a PAN for the other.
  • The lender's closing letter copies the loan account. The transport office reads it against the certificate.
  • The simplest cure is to ask the lender, before it prints anything, to name you exactly as the certificate does.
  • Where the certificate itself is wrong against your Aadhaar, correct that first. A cleared certificate in a wrong name is half a job.

Read vehicle RC name correction and short name and full name difference in documents.

What About the Lender's Name?

  • Banks have merged in recent years, and finance companies have been renamed or taken over.
  • A certificate of some years ago carries the lender's name as it then was.
  • The closing papers come from the lender as it is now, under its present name and seal.
  • The two names are one lender, and only the lender can say so.
  • Ask it for a letter on its letterhead stating that it was formerly known by the name on the certificate, or took over that bank.
  • Where a branch has closed, write to the regional office. The loan record has moved, not vanished.

We could not confirm what the transport offices in the state ask for where a lender's name has changed. Ask at the counter before the lender prints its papers.

What About a Loan Closed Long Ago?

  • A lender's no objection letter is usually good for a limited time from its date.
  • An owner who puts it in a drawer and comes back after years is asked for a fresh one.
  • By then the branch may have moved, the bank merged, and the owner's own papers changed.
  • Each of those is one more name to reconcile.
  • Write to the lender with the loan account number and the vehicle number, and ask for fresh closing papers.
  • The loan number is on old statements and on the first no objection letter. Keep both.

The lesson is the usual one on this site. A paper is cheapest to settle on the day it is made.

What About Selling, Buying and a Death?

  • A vehicle with a live loan entry cannot be cleanly transferred. A buyer's transport office will ask for the lender's consent.
  • So clear the entry before you advertise the vehicle, not after you find a buyer.
  • A buyer who took a vehicle with the entry still on it needs the old lender's papers, made out for the seller's loan.
  • Where the borrower has died, the lender deals with the family on the death certificate and proof of the heirs.
  • The entry is then removed and the vehicle transferred to an heir. Ask the transport office which it takes first.
  • In each of these, three or four names have to line up. Start with the lender.

Read e-challan in the wrong name, on what an untransferred vehicle costs its registered owner, and name correction in a death certificate and legal heir certificate.

What About the Insurer and the Credit Record?

  • The insurance policy on a financed vehicle names the financier, so that a large claim is paid to it.
  • That stays on the policy at each renewal until the owner asks for it to be removed.
  • After the certificate is cleared, send the insurer a copy and ask for an endorsement.
  • The loan should also show as closed on your credit record.
  • Check your credit report a few months after closing. An open loan there counts against a new one.
  • If it still shows, ask the lender in writing to update it.

Read name mismatch in a CIBIL credit report and personal loan and credit card name mismatch.

Where Does a Gazette Come In?

Only where the owner's own name has changed by choice. Even then, the loan and the certificate usually agree with each other in the old name, so remove the entry first and change the name afterwards.

Step 1: Confirm that your own name has in fact changed

A short name in the loan account, or a bank that merged, is not a change of name.

Step 2: See which way the difference runs

If you changed your name after the loan began, the loan and the certificate are both in the old name. They agree with each other.

Step 3: Fix the exact new name

The spelling that will go on Aadhaar, the licence and the registration record.

Step 4: Make the affidavit and publish the newspaper notice

Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.

Step 5: Type the form and sign the undertaking

Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.

Step 6: Prepare the CD, photographs and certificate

The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.

Step 7: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult. It is not refunded.

Step 8: Send the file yourself, then update the lender and the transport office

Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054.

Would the Uttarakhand Gazette Do?

The transport office is the state's, and may accept a state Gazette. The lender is the reason to prefer the Gazette of India.

Step 1: Remember that the transport office is the state's

It may accept a state Gazette for the registration record.

Step 2: Remember that the lender is not

A bank or a finance company follows Aadhaar and PAN.

Step 3: Prefer the Gazette of India

It serves both.

Step 4: Contact the Roorkee press only if a state notice suits you

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.

Step 5: Download the notice

Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do Owners Make?

Common mistakes with names in hypothecation removal
MistakeWhat to do
Thinking the entry ends with the last instalmentApply to have it removed
Putting the lender's letter in a drawerUse it in the same month
Not reading the name on the lender's letterRead it against the certificate at the branch
Changing your name on the certificate firstRemove the entry first
Arguing with the transport office about a merged bankBring the lender's letter
Finding a buyer before clearing the entryClear it, then sell
Buying a vehicle with the entry on itAsk for it to be cleared before you pay
Forgetting the insurance policyAsk for an endorsement
Asking for a Gazette for a short nameThe lender reissues its letter

A typical case we handle: a man in Haldwani wanted to sell a car whose loan he had repaid six years before. The certificate read "Mahesh Chandra Joshi", with a bank that had since merged into another. The old no objection letter read "M C Joshi" and had long lapsed. He asked us if a Gazette would join the two names. It would not, and he had changed no name. The present bank issued fresh papers in his full name, with a letter that it had taken over the earlier bank. The transport office removed the entry on those. This is an illustrative example of the type of case we handle, not a named client review.

When you do not need us

For a short name, a merged bank, lost papers and a late application. The lender and the transport office settle those. We are useful only where an owner's own name has changed by choice and a Gazette notification is asked for.

Which Areas of Uttarakhand Do We Cover?

All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. The entry is removed at the transport office where the vehicle is registered. Send photos of the certificate and the lender's letter on WhatsApp and we will tell you which name to settle.

How soon must a lender release papers after a loan is repaid?

Under the Reserve Bank's direction of 13 September 2023, lenders must release all original movable and immovable property documents, and remove charges registered with any registry, within 30 days of full repayment or settlement of the loan.

What if the lender delays beyond 30 days?

The lender must tell the borrower the reason. Where the delay is the lender's fault, it compensates the borrower at Rs 5,000 for each day of delay.

Does the rule cover vehicle loans?

Yes. Reports of the direction list vehicle loans among the loans covered, along with home loans, education loans and secured personal loans.

From when does the 30-day rule apply?

To all cases where release of the original documents falls due on or after 1 December 2023. A loan closed before that is outside the compensation rule, though the lender must still release its papers.

What if the lender has lost my papers?

It must help you obtain duplicate or certified copies and bear the cost, in addition to the compensation. It gets a further 30 days in that case, so compensation runs after 60 days.

Where do I collect the papers from?

The direction gives the borrower the choice of collecting them from the branch where the loan was serviced or any other office of the lender where the documents are available. Check the name on them before you leave.

It may not. Ask the lender to issue its letter and form in the name on the registration certificate.

Ask the lender for a duplicate. It has the record that the loan is closed.

The registered owner applies. If you are now the owner, you need the old lender's papers, which were issued for the earlier owner's loan. Ask the seller for them.

Only if the certificate was changed and the loan was not, or the reverse. If both are in your maiden name, they agree. Remove the entry first, and change the name afterwards.

Yes. The policy names the financier as well. Ask the insurer to remove it once the certificate is clear.

No. The transport office does, on the lender's papers. We prepare a Gazette where an owner's own change of name needs one.

That the termination form is a notice of termination of an agreement of hire purchase, lease or hypothecation, that it asks for the note in the certificate to be cancelled, that it is made in duplicate or triplicate, and that the financier signs with its seal, are from the form itself as published. That the owner signs too, the papers that go with it, and the application through the national vehicle portal are from guides. We did not read the Act's section or the rules, and could not confirm the present fee, how long a lender's letter is good for, or what the state's transport offices ask where a lender's name has changed. How names come to differ, and the cases of a sale and a death, are general guidance. The transport office and the lender are the authority.
