Vehicle NOC Name Mismatch in Uttarakhand: Re-Registration From Another State

For people who have brought a vehicle to Uttarakhand from another state, or bought one registered elsewhere, and find the owner's name does not agree across the papers: what the law asks, which office holds the record, why a name is corrected before the no objection certificate, and what a buyer should check.

Quick answer

A vehicle NOC name mismatch is cured in the state where the vehicle was first registered, before the no objection certificate is issued, since the certificate copies that record. Correct the owner's name there, clear any loan entry, then apply. In Uttarakhand, give proof of address in the same name. A slip needs no Gazette.

A vehicle NOC copies the record of the first state, so the owner name is corrected there before the certificate is issued and the vehicle re-registered in Uttarakhand.

People come to Uttarakhand with their vehicles for work, on retirement, or after buying a used car from Delhi or the plains. A vehicle kept here beyond a year needs a number of this state, and that needs a certificate from the old one. A vehicle NOC name mismatch is found between the two offices. This page explains vehicle NOC name mismatch for owners and buyers in Uttarakhand.

We do not arrange vehicle transfers, and this subject seldom needs a Gazette. The twelve months, the no objection certificate and its thirty days are from sections 47 and 48 of the Motor Vehicles Act, read in a published copy. The state's own procedure and fees we did not read. For the name on a registration certificate, read vehicle RC name correction.

What Is the Move, in Brief?

  • The rule. A vehicle kept in another state for more than twelve months is to be given a registration mark of that state.
  • The first paper. A no objection certificate, from the office that first registered the vehicle.
  • The second. An application here for a new registration mark, with that certificate.
  • If it was bought. A transfer of ownership as well, from the seller to the buyer.
  • What results. A new registration certificate, with an Uttarakhand number.

Two transport offices in two states handle one vehicle. The first knows the owner's history. The second knows only what the first puts on paper.

What Does the Act Say?

From sections 47 and 48 of the Motor Vehicles Act, 1988, read in a published copy, and state transport pages for the form numbers.

What sections 47 and 48 of the Motor Vehicles Act say about moving a vehicle to another state
PointWhat the Act says
Twelve monthsWhere a vehicle registered in one state has been kept in another for more than twelve months, the owner applies to the registering authority there for a new registration mark, and presents the certificate of registration
With itThe no objection certificate obtained under section 48, or the receipt for the application for one
A loanWhere the vehicle is under a hire purchase, lease or hypothecation agreement, a no objection certificate from the financier as well
Who gives the certificateThe registering authority by which the vehicle was registered
RefusalIt shall not refuse unless it records reasons in writing and communicates them. If it does not refuse within thirty days, the certificate is deemed granted
A sale across statesThe same certificate is asked for where a transfer is to be effected in a state other than the state of registration

State transport pages give Form 28 as the application for the certificate and Form 27 as the application for a new mark. They also list insurance, a pollution certificate, proof of residence and tax.

Which Papers Are Read?

Papers of an inter-state re-registration and who corrects each

The registration certificateThe original registering authorityThat authority
The no objection certificateThe same authority, from its recordThat authority, before it is used
The financier's no objectionThe lenderThe lender
Proof of address in UttarakhandA landlord, a utility or another issuerIts issuer
The insurance policyThe insurerThe insurer
The owner's AadhaarThe identity authorityAn Aadhaar centre

The first two carry the name that matters most, and both are in the hands of an office in another state. Once the vehicle and its owner are in Dehradun, a visit to that office is a long trip.

What Kinds of Mismatch Are There?

The old record names the owner loosely

The papers here are in another name

  • A rent agreement in a spouse's name, a bill in a landlord's
  • The vehicle is in the owner's
  • Proof of address the office accepts, in the owner's name

The seller's papers do not agree

  • A bought vehicle, with the seller named three ways across his papers
  • The buyer cannot correct another person's record
  • Settled by the seller, before money changes hands

The third is the buyer's trap. A used car from another state comes with another person's papers, and they are often examined only after the price is paid.

How Do You Do It in Order?

This is the general order. Each transport office has its own counters and fees.

Step 1: Read the owner's name on the registration certificate, letter by letter

Every later paper will be read against it.

Step 2: Put Aadhaar and your proof of address in Uttarakhand beside it

A rent agreement, an electricity bill or another paper the transport office accepts.

Step 3: Correct the name in the original state first, if it is wrong there

The office that registered the vehicle holds the record. A no objection certificate copies it.

Step 4: Clear what stands against the vehicle in that state

A loan entry, unpaid tax and pending challans can each hold up the certificate.

Step 5: Apply to the original registering authority for the no objection certificate

In the prescribed form. Take the receipt. The law gives the office thirty days to refuse in writing.

Step 6: Read the certificate before you leave that state

Owner's name, vehicle number, chassis and engine numbers, and the office it is addressed to.

Step 7: Apply in Uttarakhand for a new registration mark

In the prescribed form, with the certificate, the registration certificate, insurance and proof of address.

Step 8: Read the new registration certificate, then tell the insurer and the toll tag issuer

The vehicle's number has changed. Every record tied to the old one has to follow.

Why Does the First State Come First?

  • The no objection certificate is issued by the registering authority that registered the vehicle.
  • It is written from that authority's own record. Whatever name the record holds, the certificate carries.
  • The Uttarakhand office then builds its record from the certificate.
  • So a slip left in the first state is copied into the second, and now sits in two offices.
  • The Uttarakhand office cannot correct another state's record. It can only question it.
  • Correct the name while you are still dealing with the first office, in the same visit as the certificate if you can.

The Act says the first office may refuse only for reasons recorded in writing, and that silence for thirty days is deemed a grant. Keep the receipt for your application. It is the paper that proves the date.

What If You Bought the Vehicle?

  • A vehicle bought in another state is still in the seller's name, on that state's record.
  • The no objection certificate is issued to the registered owner, who is the seller.
  • The transfer to you is then recorded, on the seller's signed forms and your papers.
  • The seller's name on the registration certificate, on his identity paper and on the transfer forms should be one.
  • You cannot correct his record. Only he can, in his state.
  • So read his papers before you pay. Ask for the certificate to be obtained, in order, as a condition of the sale.

A buyer who takes the car and "sorts the papers later" may be left with a vehicle he cannot register. Read e-challan in the wrong name, on what an untransferred vehicle means for both sides.

What About a Loan on the Vehicle?

  • A vehicle bought on finance carries the lender's name on its registration certificate.
  • The Act asks for the financier's no objection as well, where a vehicle under such an agreement is to be given a new mark.
  • If the loan is repaid, remove the entry in the original state first. That is simpler than carrying it across.
  • If the loan is running, ask the lender for its no objection to the move, in the owner's name as on the certificate.
  • A lender that has merged or been renamed gives a letter saying so.
  • Three names then have to agree: the owner's, the lender's, and each as the certificate has it.

Read hypothecation removal name mismatch.

What About Proof of Address in Uttarakhand?

  • The office here registers a vehicle to a person at an address in its area.
  • It asks for proof of residence, in the owner's name.
  • A newcomer's rent agreement may be in a spouse's or an employer's name.
  • An electricity bill is in the landlord's.
  • Ask the transport office which papers it accepts, and what it takes where the paper is in a family member's name.
  • Updating Aadhaar to the new address, where you mean to stay, gives one paper that serves many offices.

Read rent agreement name mismatch and name change in Aadhaar card.

What Follows the New Number?

  • The vehicle now has a new registration number. Records tied to the old one do not change by themselves.
  • The insurance policy is endorsed with the new number, by the insurer.
  • The toll tag is tied to the vehicle's number, and is updated or replaced.
  • A permit or fitness record for a commercial vehicle is dealt with at the transport office.
  • Tax paid in the first state for years not used may be refundable there. Ask when you take the certificate.
  • Read the new registration certificate the day it comes: name, father's name, address, and the chassis and engine numbers.

Read FASTag KYC name mismatch, name change in driving licence and taxi permit name mismatch.

Where Does a Gazette Come In?

Only where the owner's own name has changed. Do it before the move or after it. A change of name made while the file is between two states gives both offices something to question.

Step 1: Confirm that your own name has in fact changed

A slip on a registration certificate is corrected by the office that issued it.

Step 2: Choose the order

Change the name before moving the vehicle, or after. Not in the middle, when two offices hold two halves of the file.

Step 3: Fix the exact new name

The spelling that will go on Aadhaar, the licence and the registration record.

Step 4: Make the affidavit and publish the newspaper notice

Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.

Step 5: Type the form and sign the undertaking

Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.

Step 6: Prepare the CD, photographs and certificate

The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.

Step 7: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult. It is not refunded.

Step 8: Send the file yourself, then update the licence and the registration

Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054.

See gazette name change in Uttarakhand.

Which Gazette Should You Use?

Two states' offices read the papers, with an insurer and perhaps a lender. The Gazette of India is the one to use.

Step 1: Remember that two states are involved

A notice in one state's Gazette may mean little in the other.

Step 2: Use the Gazette of India

It is recognised by every transport office.

Step 3: Remember the insurer and the lender

They are not state offices at all.

Step 4: Contact the Roorkee press only if a state notice suits another purpose

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.

Step 5: Download the notice

Search egazette.gov.in and save the PDF.

For the difference between the two, read Uttarakhand Gazette vs Gazette of India.

Which Mistakes Do Owners and Buyers Make?

Common mistakes with names in an inter-state vehicle re-registration
MistakeWhat to do
Taking the certificate without reading itRead it before leaving that state
Leaving a slip to be "fixed in Uttarakhand"It can only be fixed in the first state
Paying for a car before seeing the seller's papersPapers first, money after
Carrying a loan entry acrossClear it, or take the lender's no objection
No receipt for the applicationTake it. It fixes the thirty days
Proof of address in someone else's nameA paper in the owner's own
Running on the old number for yearsThe law gives twelve months
Forgetting the insurer after the new numberHave the policy endorsed
Asking for a Gazette for a dealer's slipThe registering office corrects it

A typical case we handle: a man who had moved to Dehradun for work applied to register his car, brought from another state. The no objection certificate named the owner "Sanjay Kr". His Aadhaar and his rent agreement read "Sanjay Kumar Sharma". The office here asked which was right. He asked us if a Gazette would settle it. It would not. He had changed no name, and the slip lay in the first state's record. He had that record corrected through that state's office, took a fresh certificate, and was registered here. This is an illustrative example of the type of case we handle, not a named client review.

When you do not need us

For a slip, a short name, a loan entry, proof of address and a seller's papers. The transport offices and the lender settle those. We are useful only where an owner's own name has changed by choice and a Gazette notification is asked for.

Which Areas of Uttarakhand Do We Cover?

All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. A new registration is given by the transport office for where you live. Send photos of the papers on WhatsApp and we will tell you which name to settle, and in which state.

Is the financier's consent needed to move a vehicle?

Yes, where the vehicle is under a loan.

What is the BH series number plate?

A Bharat series registration mark notified by the Ministry of Road Transport and Highways in August 2021. A vehicle bearing the BH mark does not need a new registration mark when its owner moves from one state to another.

Who can get a BH series registration?

Reports of the notification say it is open, voluntarily, to defence personnel, central and state government employees, central and state public sector undertakings, and private organisations with offices in four or more states or union territories.

How is road tax paid on a BH series vehicle?

The motor vehicle tax is levied for two years, or in multiples of two, in place of the full tax paid upfront on an ordinary registration.

How long is a vehicle NOC valid?

Guides say a no objection certificate is valid for six months from issue. If it is not used to re-register the vehicle in that time, a fresh one has to be applied for. Read it the day it is issued.

Can the NOC be applied for online?

Guides say the application can be made online on the Parivahan Sewa portal, with Form 28. The certificate is issued by the original registering authority.

Is an NOC needed for a short stay in Uttarakhand?

Guides say no NOC is needed for a stay of less than three months. Section 47 of the Motor Vehicles Act requires re-registration once the vehicle has been kept here for more than twelve months.

Vehicle NOC Name Mismatch: Frequently Asked Questions

What is a vehicle NOC name mismatch?+
A difference in the owner's name between a vehicle's registration certificate, the no objection certificate from its original state, and the owner's identity or address papers in Uttarakhand, which holds up a new registration here.
When does a vehicle from another state need a new registration?+
Section 47 of the Motor Vehicles Act says that where a vehicle registered in one state has been kept in another for more than twelve months, the owner applies there for a new registration mark.
What is the no objection certificate?+
A certificate from the registering authority that first registered the vehicle, saying it has no objection to a new registration mark being assigned, or to a transfer being recorded, in another state.
Can the original office refuse it?+
Section 48 says it shall not refuse unless it records its reasons in writing and gives the applicant a copy. If it neither refuses nor communicates a refusal within thirty days, the certificate is deemed granted.
Which forms are used?+
State transport pages name Form 28 for the no objection certificate and Form 27 for the new registration mark, under the Central Motor Vehicles Rules.
Do I need a Gazette or an affidavit?+
Not a Gazette, for a slip or a short name. The office that registered the vehicle corrects it. A Gazette is for an owner whose own name has changed.
The certificate has my name in a short form and my Aadhaar the full one. Will Uttarakhand register it?+
It may ask. Have the name corrected in the original state before the certificate is issued, so that it comes out right.
I bought the vehicle from another state. In whose name is the certificate?+
In the registered owner's, who is the seller. The transfer to you is then recorded here, on his papers and yours. His name has to match across them.
The vehicle has a loan on it. Does that matter?+
Yes. Section 47 asks for a no objection certificate from the financier as well, where the vehicle is under a loan agreement.
My proof of address in Uttarakhand is in my husband's name. Is that a problem?+
The transport office asks for proof of residence. Ask it what it accepts where the paper is in a spouse's name, and carry the marriage certificate.
The seller cannot be found, and the certificate has lapsed. What now?+
A fresh certificate needs the registered owner. Ask the original office what it does where the owner cannot be traced. This is the hardest position to be in.
Do I get back the tax paid in the first state?+
States have procedures for a refund of tax for the unexpired period. We did not read them. Ask the original office when you take the certificate.
Can I keep driving on the old number meanwhile?+
Section 47 speaks of twelve months. Carry the registration certificate, insurance and the papers of your application, and ask the transport office.
Does the insurance change?+
The policy is tied to the vehicle's number and owner. Tell the insurer when the new number is assigned, and have the policy endorsed.
What about challans on the old number?+
They stay against the vehicle and its registered owner. Clear them before applying for the certificate.
Do you arrange vehicle transfers?+
No. The transport offices do. We prepare a Gazette where an owner's own change of name needs one.

The twelve months, the application for a new registration mark with the no objection certificate or its receipt, the financier's no objection, who issues the certificate, refusal only for recorded reasons and the deemed grant after thirty days, are from sections 47 and 48 of the Motor Vehicles Act, 1988, read in a published copy. The form numbers and the list of papers are from other states' transport pages. We did not read the Central Motor Vehicles Rules, Uttarakhand's own procedure or fees, or any state's rules on refund of tax. Why a name is corrected in the first state, what a buyer should check and what follows the new number are general guidance. The transport offices of the two states are the authority.

Names in a Vehicle NOC: The Short Version

A vehicle kept in Uttarakhand for more than twelve months needs a new registration mark, on a no objection certificate from the office that first registered it. That certificate copies the old record. So correct the owner's name there first, clear any loan entry, and read the certificate before leaving. Give proof of address here in the same name. A buyer should see the seller's papers agree before paying. Afterwards, update the insurer and the toll tag.
