Rent Agreement Name Mismatch in Uttarakhand
When a rent agreement spells the tenant or the landlord differently from their identity proof, or names a landlord who is not the owner on record: where it is refused, how the two parties put it right themselves, and the rare case where a Gazette comes in.
A rent agreement name mismatch is cured by the landlord and the tenant signing a corrected or fresh agreement, with each name written exactly as on identity proof. It is a private contract between two living people, so nothing has to be published. A Gazette comes in only where one of them has changed a name.

A rent agreement is typed in ten minutes and then used for years, as proof of address at a bank, a passport office or a tax return. A rent agreement name mismatch is noticed at one of those counters. This page explains rent agreement name mismatch for tenants and landlords in Uttarakhand, and how simply it is usually put right.
We do not draft rent agreements, and this subject almost never needs our service. We say so plainly so that nobody pays for a Gazette to fix a typing slip. This is general guidance, not legal advice. For an owner's own papers, read name change in property documents in Uttarakhand.
What Is the Agreement, and Whose Names Are in It?
| Name | Who that is | Checked against |
|---|---|---|
| The landlord | The owner, or a person with the owner's authority to let | The landlord's identity proof and PAN, and the property's ownership papers |
| The tenant | The person, or the business, taking the premises | The tenant's identity proof |
| Other occupants | Family members living there, where listed | Each one's own identity proof, when one of them uses the agreement |
| The witnesses | Two people who saw it signed | Rarely checked |
- The agreement also carries the address of the premises, which is what most people want it for.
- It is a contract between two private parties. No office issues it, and no office has to approve a correction.
- It runs for a fixed period. Many are for eleven months and are then renewed, which gives a natural moment to put names right.
Where Is a Rent Agreement Used, and Refused?
| Where | What it is used for | What is compared |
|---|---|---|
| A bank | Proof of address for an account or a loan | The tenant's name against identity proof |
| Aadhaar, passport and other identity offices | Proof of address, where their lists accept a rent agreement | The applicant's name, letter by letter, and often that the agreement is registered |
| An employer and the tax return | A claim for house rent | The tenant's name, and the landlord's name against the landlord's PAN |
| A tax registration for a business | Proof of the place of business | The tenant's name against PAN, and the landlord's against the ownership proof |
| The police | Tenant verification | Both parties' identity proof |
| A school, a gas agency, a vehicle office | Proof of local address | The applicant's name |
| A court or rent authority | A dispute between the two | Who the parties are |
Each office has its own list of what it accepts as proof of address, and those lists change. Check the office's current list before relying on an agreement at all.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The agreement misspells the tenant or the landlord | A corrected or fresh agreement signed by both | No |
| It uses a short form, initials or a home name | A fresh agreement in the name on identity proof | No |
| The tenant married and changed her surname during the tenancy | A fresh agreement at renewal, or the marriage certificate with the old one | No |
| A party changed a name by choice during the tenancy | A fresh agreement in the new name. The Gazette notification links the old one | Yes, for that person's own records |
| The landlord in the agreement is not the owner on the property papers | The owner signs, or the signer's authority is attached | No |
| The owner's own papers carry two forms of the name | That is the owner's property question, settled on the owner's side | Sometimes |
| The landlord has died | A fresh agreement with the heirs | No |
Six rows of seven are settled with a pen and a fresh sheet of stamp paper. Be wary of anyone who tells a tenant that a rent agreement needs an affidavit, a newspaper notice or a Gazette.
How Do You Put It Right?
Step 1: Find out exactly what the office objected to
The tenant's name, the landlord's, the address, or that the agreement is not registered.
Step 2: Put both parties' identity proof beside the agreement
Aadhaar for each, and the landlord's PAN where rent is claimed for tax.
Step 3: Check the landlord against the ownership papers
The latest electricity bill or house tax receipt for the premises shows whose name the property is in.
Step 4: Speak to the other party
A correction needs both signatures. Most landlords agree readily, since a wrong name does them no good either.
Step 5: Prepare a fresh agreement, or a short correcting one
With each name exactly as on identity proof, the father's or husband's name, and the full address of the premises.
Step 6: Sign it with two witnesses
On stamp paper of the proper value.
Step 7: Have it notarised or registered, as the purpose needs
Ask the office you want it for which it accepts.
Step 8: Keep the old agreement with the new one
Together they show an unbroken tenancy.
What About the Tenant's Name?
- Use the name on Aadhaar, in full, with the father's or husband's name as Aadhaar has it. That one choice prevents most refusals.
- List the family members who live there, each in the name on that person's own identity proof. A wife or a grown child can then use the agreement for an address proof of their own, where an office allows it.
- A woman who married during the tenancy and changed her surname has the new name written at the next renewal. Until then her marriage certificate links the two.
- A tenant who has changed a name by choice has a fresh agreement made in the new name. The Gazette notification is for Aadhaar and the bank, not for the landlord.
- Students and paying guests often have no agreement at all, or one in a parent's name. Ask the owner for an agreement in the occupant's own name.
- A company or a firm as tenant is named as registered, with the person signing for it and that person's authority.
Where your own identity papers disagree with each other, sort those out first. An agreement cannot be right for both. Read name change in Aadhaar card in Uttarakhand.
What About the Landlord's Name?
Common troubles
- The agreement is signed by a son, a wife or a caretaker, while the property is in someone else's name
- The owner has died and nobody has updated anything
- The landlord's name in the agreement differs from the landlord's PAN
- The house's electricity bill is in a third name
- Several brothers own it jointly and one signs alone
What a tenant can ask for
- The owner on record to sign, in the name on the owner's identity proof
- Where someone signs for the owner, a copy of the authority to do so
- A copy of the latest house tax receipt or electricity bill for the premises
- The landlord's PAN, where rent is to be claimed for tax
- After a death, an agreement with the heirs who now own the house
A tenant cannot correct a landlord's papers, and does not have to. The tenant only needs the agreement to name the true owner as the owner's papers do. Where the owner's own title papers and identity proof carry two forms of a name, that is the owner's question. Read name change in electricity bill and power of attorney name mismatch.
Notarised or Registered: Does It Matter for a Name?
- A lease for a year or more is one the law expects to be registered. Shorter lettings are commonly put on stamp paper and notarised.
- Several offices accept only a registered agreement as proof of address. A correct name on an unregistered one is still refused there.
- At registration, the sub-registrar checks each party's identity proof against the draft. A mismatch is caught at the counter, which is the best place for it.
- A registered agreement is corrected by a further registered document, or replaced by a fresh registered one. It is not altered by hand.
- A notarised agreement is simply replaced by a fresh one.
- The state has its own law on tenancies and its own stamp duty. A lawyer or a deed writer will tell you what applies to yours.
Do not write over a name on a signed agreement. An office that sees a correction in ink will refuse the whole paper.
What About Rent Receipts and Tax?
- An employee claiming house rent gives the employer the agreement or rent receipts, and above a certain yearly rent the landlord's PAN.
- The landlord's name on the receipts and in the agreement should be the name on that PAN. A difference invites a question.
- Pay rent by bank transfer to the landlord's own account. The account name then supports the agreement.
- The receipts should be in the name of the employee who claims, not a spouse or a parent, unless that person is the tenant.
- The landlord has to show the rent as income. A landlord named wrongly in the tenant's claim may be asked about it by the tax office.
We do not give tax advice. Ask your employer's accounts office or an accountant what it needs. Read name mismatch on the income tax e-filing portal.
What About a Shop or Office on Rent?
- A business registering for tax gives proof of its place of business. For rented premises that is the rent agreement, with proof that the landlord owns the place.
- The tenant's name in the agreement should be the legal name on PAN: the proprietor's own name for a proprietorship, the firm's or company's name for those.
- The landlord's name should match the ownership proof given, such as the house tax receipt or the electricity bill.
- A trade licence, a food licence and a shop registration read the same agreement.
- Where a proprietor changes a name, the agreement is renewed in the new name along with the other registrations.
What About Tenant Verification?
- Landlords in the state are asked to have their tenants verified by the police. Ask the local police station or the state police's online service for the current procedure.
- The form takes both parties' particulars from their identity proof.
- The names in the verification, the agreement and the identity proof should be the same. A tenant with papers from another state should give the name exactly as on Aadhaar.
- A tenant known by two names should state both on the form, so that a home-state enquiry finds the right person.
Read name mismatch in police verification and character certificate.
How Does the Central Gazette Route Come In?
Almost never for a rent agreement. It comes in where a tenant or a landlord has changed a name by choice, and that person's Aadhaar, PAN and bank need a Gazette. The next agreement is then simply written in the new name.
Step 1: Confirm that it is your own name that has changed
A typing slip in the agreement needs a fresh agreement, and nothing else.
Step 2: Fix the exact new name
The spelling that will go on Aadhaar and then on the agreement.
Step 3: Make the affidavit
State the old name, the new name, your father's or husband's name and your address. Sign before a notary.
Step 4: Publish the newspaper notice
In a daily local leading newspaper. Keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then renew the agreement in the new name
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Update Aadhaar and PAN, then sign a fresh agreement.
Does the Uttarakhand Gazette Matter Here?
Not to a rent agreement, which follows identity proof. The question is only which Gazette Aadhaar and PAN accept.
Step 1: Ask the Aadhaar centre which Gazette it accepts
The agreement follows Aadhaar.
Step 2: Think about PAN, the bank and the passport
The Gazette of India serves them all.
Step 3: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 4: Ask for the papers, the format and the fee, and submit
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do Tenants and Landlords Make?
| Mistake | What to do |
|---|---|
| Paying for an affidavit or a Gazette to fix a typing slip | Sign a fresh agreement |
| Writing names from memory | Copy them from identity proof |
| Correcting a name in ink on a signed agreement | Never. Make a fresh one |
| Letting a relative sign as landlord with no authority | Have the owner sign, or attach the authority |
| Carrying on with a dead landlord's agreement | Sign afresh with the heirs |
| Assuming every office accepts a notarised agreement | Check that office's list. Some want it registered |
| Rent receipts in a name different from the landlord's PAN | Use the PAN name |
| Leaving the wife and children off the agreement | List the occupants |
| Throwing away old agreements | Keep them. They show how long you have lived there |
A typical case we handle: a young engineer renting in Dehradun was refused an address update because his agreement said "Rohit Kr. Verma" and his Aadhaar "Rohit Kumar Verma". A shop near the office told him he needed an affidavit and a Gazette. He asked us, and we told him he needed neither. His landlord signed a fresh agreement with the name written out in full, they had it registered, and the update went through. He paid us nothing. This is an illustrative example of the type of case we handle, not a named client review.
