E-Stamp Paper Bought in Wrong Name in Uttarakhand: What to Do
For people in Uttarakhand who have bought an e-stamp certificate for an affidavit, a rent agreement or a property deed, and found a name typed wrongly, a party left out or the parties swapped: whether it can be used, when it is better replaced, how a refund is asked for, and how long the law allows.
An e-stamp paper bought in wrong name should not be used for the instrument. For a small affidavit stamp, buy a fresh one. For a large stamp, apply to the Collector of stamps for a refund with the original certificate, within the six months the Stamp Act allows. No Gazette is needed.

Every affidavit, rent agreement and property deed in Uttarakhand begins with a stamp. Today that is usually an e-stamp certificate, typed by a vendor from what the buyer says at the counter. An e-stamp paper bought in wrong name is a typing slip, a swapped party or a missing surname found after payment. This page explains what to do with an e-stamp paper bought in wrong name.
We do not sell stamps, and this subject needs no Gazette. The refund sections and time limits are from the Indian Stamp Act, 1899 and court rulings on them. We did not read Uttarakhand's own stamp rules. For the affidavit itself, read name change affidavit.
What Is an E-Stamp Certificate, in Brief?
- What it is. An electronic certificate showing that stamp duty has been paid for an instrument.
- Who sells it. Authorised centres and vendors, on the state's behalf.
- What it carries. A unique number, the date, the amount, the purpose, and the names of the purchaser and the parties.
- What follows. The deed, agreement or affidavit is printed on it or attached to it.
- Who answers for refunds. The Collector of stamps, under the Indian Stamp Act, 1899.
The certificate is a receipt and a record, not a form to be edited. Once issued with a wrong name, it stays that way. The choice is between using it, replacing it, or asking for the money back.
What Do the Act and the Courts Say?
From the Indian Stamp Act, 1899, a Supreme Court judgment of 2008, and Delhi High Court judgments, as reported. Delhi's rulings are given for their reasoning. Ask the Collector here how they are applied.
| Point | What is said |
|---|---|
| Spoiled stamps | Section 49 provides for an allowance by the Collector for stamps that are spoiled, in the cases it lists |
| Time for a spoiled stamp | Section 50 sets the time for applying, commonly six months, counted as the section provides |
| Stamps not needed | Section 54 lets the purchaser seek an allowance for a stamp not spoiled but not required for use, within six months of purchase |
| Use after six months | The Supreme Court held in 2008 that the six months in section 54 is only for a refund, not for using the stamp paper |
| A lost e-stamp | The Delhi High Court held in a 2016 case that a lost e-stamp could be treated as spoiled and refunded, after an enquiry |
| A late claim | The Delhi High Court has also allowed refund beyond six months where the buyer could not have known within that time |
The Act is about duty paid, not spelling. A wrong name is a problem because the office that receives the instrument may not accept it, and a wrong certificate cannot be quietly corrected.
Which Names Does a Certificate Carry?
| Field | Whose name | Should match |
|---|---|---|
| Purchased by | The person who paid | That person's identity paper |
| First party | The deponent, the seller, the landlord, the donor | The name in the instrument |
| Second party | The buyer, the tenant, the donee. Sometimes not applicable | The name in the instrument |
| Stamp duty paid by | The party who bears the duty | The instrument's terms |
| Purpose and article | Not a name, but often wrong too | The kind of instrument |
The first party matters most. It should be the person whose affidavit or deed is printed on the certificate, in the name on that person's identity paper.
What Kinds of Mistake Are There?
A slip in a name
- A letter wrong, a surname missing, a home name
- The right person, written loosely
- Replaced, or refunded if large
The wrong person named
- The parties swapped, or a relative named as first party
- The certificate does not fit the deed
- Not used. Refund, and a fresh one
A name that has changed since
- Bought before marriage or a change of name, used after
- The right person, under an older name
- Ask the office, or buy afresh
The second is the one to stop at once. A deed printed on a certificate naming the wrong parties is a poor foundation for a property.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| A small affidavit stamp with a slip | Buy a fresh one | No |
| A large deed stamp with a slip | Ask the office that will register it. If not accepted, refund and buy afresh | No |
| The parties are swapped | Do not use it. Refund, and buy afresh | No |
| A relative's name as first party | The same | No |
| The deed was printed on it already | Ask the Collector about a spoiled stamp, in time | No |
| The certificate is lost | Ask the Collector, with proof of purchase | No |
| Bought in a maiden name, used after marriage | Ask the office, with the marriage certificate | No |
| The buyer changed a name by choice | Use the new name on later stamps, after the Gazette | For the person, not the stamp |
No stamp needs a Gazette. A Gazette changes a person's name, and stamps bought afterwards follow it.
What Should You Do, Step by Step?
This is the general method. Ask the Collector's office for its present procedure.
Step 1: Read the certificate before you leave the counter
The purchaser, the first party, the second party, the purpose and the amount.
Step 2: Compare each name with the identity paper of that person
Letter by letter. A vendor types what he hears.
Step 3: If it is wrong and the instrument is not yet written, stop
Do not print a deed or an affidavit on it.
Step 4: For a small affidavit stamp, buy a fresh one
A refund of a few rupees is rarely worth an application.
Step 5: For a large stamp, ask the vendor whether it can be cancelled the same day
Practice varies. Ask before you assume.
Step 6: Otherwise apply to the Collector of stamps for a refund, in time
With the original certificate, an affidavit that it was not used, and identity papers.
Step 7: Buy a fresh certificate in the right names
And read it again at the counter.
Step 8: Keep the original wrong certificate safe until the refund is settled
A refund is not given without the original.
What About a Stamp for an Affidavit?
- An affidavit is usually printed on a stamp of small value.
- The deponent, the person who swears it, is the first party.
- A slip in that name means the affidavit begins with a wrong name.
- For a name change or spelling affidavit, that defeats its purpose. It is the paper that states your names.
- Buy a fresh stamp in your present name, as on your identity paper, and have the affidavit printed again.
- A refund of a small stamp is seldom worth the application and the visit.
Read name change affidavit, name spelling correction affidavit and affidavit vs newspaper vs Gazette.
What About a Stamp for a Deed?
- A sale, gift, partition or lease deed may carry a stamp of large value.
- The parties' names on the certificate should be those in the deed, as on their identity papers.
- A registering office reads the deed, the stamp and the identity papers together.
- Where a name is loose, ask the office before the deed is printed whether it will accept the certificate.
- If not, apply for a refund of the large stamp, and buy one in the right names.
- Do not print the deed first and ask afterwards. A printed stamp is harder to recover.
Read name change in property documents, gift deed name mismatch, partition deed name mismatch and rent agreement name mismatch.
How Is a Refund Asked For?
- The Collector of stamps decides refunds under the Stamp Act.
- Apply in writing, with the original certificate, an affidavit that it was not used, and your identity papers.
- Say why it was not used: a wrong name, swapped parties, a deal that fell through.
- For an unused stamp, section 54 gives six months from purchase. For a spoiled one, section 50 sets the time.
- A refund may be paid less a deduction. Ask the office what applies.
- Keep the acknowledgment. A refund can take time.
We did not read Uttarakhand's stamp rules or confirm the present form or deduction. The district's Collector of stamps is the person to ask.
What About a Lost or Unused Certificate?
- A certificate bought for a deal that never happened is a stamp not required for use.
- Section 54 lets the purchaser seek an allowance within six months of purchase.
- The Supreme Court held in 2008 that a stamp can be used after six months. The six months limit only the refund.
- A lost certificate is harder. The Delhi High Court held in a 2016 case that it could be treated as spoiled and refunded, after an enquiry.
- Report a loss promptly, with the certificate number and the receipt.
- Any certificate can be verified by its number on the issuing agency's site. Keep a photograph of every one you buy.
Read power of attorney name mismatch and will and probate name mismatch, two more instruments that start on a stamp.
What If Your Name Has Changed Since?
- A stamp bought in a maiden name, used after marriage, names the right person under an older name.
- Ask the office that will receive the instrument whether it accepts it with the marriage certificate.
- Where your name has changed by Gazette, buy later stamps in the new name.
- The affidavit for a change of name itself is printed on a stamp in your present name, before the change.
- Do not buy that stamp in the new name you have not yet taken.
- Keep the paper that links the two names with any instrument that carries the older one.
Where Does a Gazette Come In?
Never for a stamp. It comes in only where a person has changed a name by choice. The stamps bought after it carry the new name.
Step 1: Confirm that your own name has in fact changed
A vendor's typing slip on a stamp is not a change of name.
Step 2: Remember the stamp paper for the affidavit
The affidavit for a change of name is printed on stamp paper. Buy it in your present name, as on your identity paper.
Step 3: Fix the exact new name
The spelling that will go on Aadhaar and every later paper.
Step 4: Make the affidavit and publish the newspaper notice
Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then use the new name on later stamps
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054.
Which Gazette Should You Use?
Stamp duty is the state's, but the papers read with an instrument are central. The Gazette of India serves both.
Step 1: Remember who collects stamp duty
The state, through its Collector of stamps.
Step 2: Remember what else reads your name
Aadhaar, PAN and the bank, which are central.
Step 3: Prefer the Gazette of India
It serves both.
Step 4: Contact the Roorkee press only if a state notice suits you
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
For the difference between the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do Buyers Make?
| Mistake | What to do |
|---|---|
| Saying the names aloud to the vendor | Show the identity papers |
| Not reading the certificate at the counter | Read every field before leaving |
| Printing the deed on a wrong certificate | Stop, and ask first |
| Writing over the name by hand | Never. It spoils the stamp |
| Throwing away a wrong large stamp | Keep it for a refund |
| Waiting past six months | Apply promptly |
| Swearing an affidavit on a stamp in a short name | Buy one in your full name |
| Buying the change of name affidavit's stamp in the new name | Your present name |
| Asking for a Gazette for a stamp | Replace or refund the stamp |
A typical case we handle: a man in Dehradun bought an e-stamp certificate for a name change affidavit. The vendor typed "Mohd Arif", his name as spoken. His Aadhaar read "Mohammad Arif Khan". He asked us whether the affidavit would still serve. We told him to buy a fresh stamp in his full name, since the affidavit is the paper that states his names. The first stamp was of small value, and he did not trouble to seek a refund. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
A refund of a large stamp that has been refused, a deed already registered on a wrong certificate, and a dispute between the parties.
When you do not need us
For a stamp bought in a wrong name. The vendor and the Collector of stamps settle that. We are useful only where a person has changed a name by choice and a Gazette notification is asked for.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. A refund is asked of the Collector of stamps for your district. Send a photo of the certificate on WhatsApp, and we will tell you whether to use it or replace it.

The allowances for spoiled and unused stamps, and their time limits, are from sections 49, 50 and 54 of the Indian Stamp Act, 1899, as set out in reported judgments. That the six months in section 54 limit only a refund is from the Supreme Court's judgment of 2008 in Thiyagarajan v. Navaneethammal, as reported. That a lost e-stamp may be treated as spoiled, and that a late claim may be allowed where the buyer could not have known in time, are from Delhi High Court judgments, as reported. We did not read Uttarakhand's stamp rules, its refund form or its deductions. Which certificates an office accepts, and when to replace one, are general guidance. The Collector of stamps and the registering office are the authority.

An E-Stamp in a Wrong Name: The Short Version
An e-stamp certificate cannot be edited. Read every name at the counter. For a small affidavit stamp in a wrong name, buy a fresh one. For a large deed stamp, ask the registering office before printing, and if it will not accept it, apply to the Collector of stamps for a refund with the original, within six months. A stamp itself does not expire. A Gazette changes a person's name, not a stamp's.
No Gazette is needed. To find out whether to use or replace a certificate, send a photo on WhatsApp 9540005064, and we will reply in working hours.
