Gift Deed Name Mismatch in Uttarakhand

When a registered gift deed for land or a house carries a name that differs from identity papers, from the earlier title or from the land record: which names a deed carries, how a deed of rectification works, what to do if the giver has died, and the one case where a Gazette has a part.

Quick answer

A gift deed name mismatch is cured by a deed of rectification, signed by the same giver and receiver and registered at the same sub-registrar's office. A name that changed after the gift needs no correction, only the paper that links the two names. A Gazette is for a real change of name, and does not alter the deed.

A registered gift deed cannot be edited, so a slip in it is corrected by a deed of rectification signed by the same giver and receiver while the giver is alive.

A gift deed is usually made inside a family, in a morning, by people who trust each other and do not read it twice. A gift deed name mismatch is found years later by a bank, a buyer or the tehsil. This page explains gift deed name mismatch for families in Uttarakhand, and why it should be put right while the giver can still sign.

Drafting and registering a deed is a lawyer's and the sub-registrar's work, and we do neither. We prepare a Gazette notification, where a party's name has in fact changed. The law cited is from the published text of the central Acts. We did not confirm the state's stamp duty or fees. For deeds in general, read name change in property documents.

What Is a Gift Deed, and What Makes It Valid?

  • What it is. A deed by which an owner gives property to another person, willingly and without payment.
  • Who the parties are. The giver, called the donor, and the receiver, called the donee.
  • How it is made. For land or a house, by a registered instrument, signed by the giver and attested by at least two witnesses.
  • Acceptance. The receiver has to accept the gift while the giver is alive.
  • Where it is registered. At the sub-registrar's office for the place where the property lies.
  • Who uses it. Mostly families: a father to a daughter, a husband to a wife, a grandmother to a grandson.

Once registered and accepted, a gift is complete. The property is the receiver's. That finality is why a mistake in it cannot be rubbed out, and has to be corrected by a second document.

What Does the Law Say?

From the published text of the central Acts. Your lawyer will apply it to your deed.

Provisions of central law on gifts of immovable property and the rectification of instruments
LawProvisionWhat it says
Transfer of Property Act, 1882Section 122A gift is a transfer made voluntarily and without consideration, accepted by or on behalf of the receiver during the giver's lifetime
Transfer of Property Act, 1882Section 123A gift of immovable property is made by a registered instrument, signed by or on behalf of the giver and attested by at least two witnesses
Transfer of Property Act, 1882Section 126A gift cannot be revoked at the giver's mere will. It can be only on the limited grounds the section gives
Transfer of Property Act, 1882Section 129The chapter does not affect any rule of Muslim law on gifts
Registration Act, 1908Section 17An instrument of gift of immovable property has to be registered
Specific Relief Act, 1963Section 26A court may rectify an instrument that, through fraud or a mutual mistake, does not express the parties' real intention

Two things follow. A gift deed is a signed and witnessed record, so nobody can edit it. And the law does provide for a record that says something the parties never meant: they correct it together, or a court does.

Which Names Does a Gift Deed Carry?

The names written in a gift deed and what each is read against
NameRead againstWhy it matters
The giverThe earlier title paper and the land record, and the giver's identity papersIt shows that the person giving is the person who owned
The giver's father or husbandThe same papersIt tells this owner apart from others of the same name
The receiverThe receiver's identity papers, and every later recordIt is the name the property now stands in
The receiver's father or husbandThe receiver's identity papersA married daughter may be described either way
The relationshipPapers that show itMany deeds state that the receiver is the giver's daughter, son or wife
The witnessesTheir identity papers, at registrationThey prove the signing, if it is ever questioned

The giver's name is read backwards, against the past. The receiver's name is read forwards, against everything to come. A slip in either breaks the chain at a different place.

What Kinds of Mismatch Are There?

A slip in this deed

  • A spelling, a dropped surname or a wrong father's name, typed by the deed writer
  • The identity papers were right on the day
  • Cured by a deed of rectification

A break in the chain

  • The giver is named one way here and another way in the deed or land record by which the giver held the property
  • Both may match some paper of the giver's
  • Cured by rectifying, or by a statement that both forms are one person, as a lawyer advises

A name that changed later

  • The deed was right on its date. The receiver has since married, or changed a name
  • Nothing in the deed is wrong
  • Cured by keeping the linking paper with the deed: a marriage certificate, or a Gazette

Only the first two are mistakes. The third is ordinary life, and treating it as a mistake leads families to ask for corrections nobody can give.

How Do You Put It Right?

This is the general method. The drafting is a lawyer's, and the sub-registrar's office will tell you its fee.

Step 1: Get a certified copy of the gift deed

From the sub-registrar's office where it was registered. Work from that, not from a photocopy.

Step 2: Mark every name in it

The giver, the receiver, each one's father or husband, and the witnesses.

Step 3: Put the earlier title paper and the identity papers beside it

The deed or land record by which the giver held the property, and both parties' Aadhaar and PAN.

Step 4: Decide what kind of difference it is

A slip in this deed, a difference from the earlier title, or a name that changed after the deed.

Step 5: See a lawyer about a deed of rectification

Where the deed itself is wrong, the same giver and receiver sign a short correcting deed.

Step 6: Register the rectification deed

At the same sub-registrar's office, with both parties present and their identity papers.

Step 7: Keep the two deeds together

The rectification deed is read with the gift deed from then on.

Step 8: Carry both to the land or tax record

So that mutation is made, or corrected, in the right name.

What Is a Deed of Rectification?

  • A short deed that refers to the gift deed by its date and registration number, states what was written wrongly, and states how it should read.
  • It is signed by the same giver and receiver, since it corrects what both executed.
  • It is registered at the office where the gift deed was registered, and noted against it.
  • It corrects the record of what was agreed. It does not change the gift: not the property, not the share, not the person.
  • From then on the two deeds are read as one. Anyone asking for the gift deed is given both.
  • Some call it a correction deed or a supplementary deed. The name matters less than what it says.

We could not confirm the state's stamp duty or fee on such a deed. Ask the sub-registrar's office. Where the deed also touches a loan or a later transfer, the lawyer will look at who else has to join.

What If the Giver Has Died?

  1. The problem. A deed of rectification needs the giver's signature. A dead giver cannot give it.
  2. The heirs. The giver's heirs can sometimes join a correcting deed in the giver's place. That depends on their willing consent, and on what a lawyer advises for the mistake in question.
  3. The court. The law lets a court rectify an instrument that, through a mutual mistake, does not say what the parties meant. The receiver sues, and the heirs are parties.
  4. The proof. Papers from the time of the gift that show the right name: the identity papers filed at registration, the earlier title paper, the draft.
  5. The risk. Heirs who resent the gift may use a spelling as their opening.

This is why a deed should be corrected while the giver is alive. An elderly parent who gifted a house last year should be asked to sign the rectification this year. Read succession certificate name mismatch and will and probate name mismatch.

What About a Name That Changed Afterwards?

  • A deed speaks as of its date. If the receiver was "Meena Rawat, daughter of" on that date, the deed is right, whatever she is called now.
  • A daughter who married later and took her husband's surname keeps her marriage certificate with the deed. That is the link.
  • In the land or tax record she can be entered in her present name, on the deed and the marriage certificate together.
  • A receiver who has changed a name by choice keeps the Gazette with the deed in the same way.
  • When she sells or mortgages, the new deed describes her by both names: the present one, and the one in the gift deed.
  • Nobody should ask the sub-registrar to "update" a registered deed for a later name. There is no such correction.

Read name change after marriage and name correction in marriage registration certificate.

What Should Be Checked Before a Gift Deed Is Signed?

  • Read the giver's name in the earlier title paper and in the current land record. The new deed should describe the giver the same way.
  • Where the giver's identity papers differ from that, have the deed mention both forms as one person, or correct the paper first.
  • Copy the receiver's name from the receiver's Aadhaar and PAN, not from how the family says it.
  • Decide how a married daughter is to be described, and use the form her identity papers carry.
  • Check the father's or husband's name of each party with the same care as the party's own.
  • Read the final print, not the draft, before signing. Deed writers retype.
  • Read it again at the counter, when the office's own summary is shown.

Ten minutes of reading before registration is worth a second deed and a second visit after it. Read short name and full name difference and name change in Aadhaar card.

Which Land and Tax Records Follow the Deed?

  • A gift deed does not change the land record by itself. The receiver applies for mutation, at the tehsil for land and at the municipal office for a town house.
  • The office copies the receiver's name from the deed. A slip in the deed becomes a slip in the record.
  • Where mutation was already made in the wrong name, give the office the rectification deed and ask for the entry to follow it.
  • A bank lending on the property reads the whole chain: the giver's title, the gift deed, any rectification and the present record.
  • The water and electricity connections follow the tax record in their turn.

Read name correction in khatauni and land records, municipal house tax name change and home loan name mismatch.

How Does the Central Gazette Route Work?

Use this where a party to the deed is alive and has changed a name by choice since it was registered. The Gazette links the two names. It does nothing for a slip in the deed.

Step 1: Confirm that it is a change of name, and not a slip in the deed

A slip is cured by a deed of rectification.

Step 2: Fix the exact new name, and copy the name as the gift deed has it

Letter by letter.

Step 3: Make the affidavit

State the old name, the new name, your father's or husband's name and your address. Sign before a notary.

Step 4: Publish the newspaper notice

In a daily local leading newspaper. Keep the original newspaper.

Step 5: Type the form and sign the undertaking

Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.

Step 6: Prepare the CD, photographs and certificate

The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.

Step 7: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult. It is not refunded.

Step 8: Send the file yourself, then keep the Gazette with the deed

Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Update Aadhaar and PAN, and give the land or tax office a copy.

Would the Uttarakhand Gazette Do?

The tehsil and the municipal office are under the state and may accept it. A bank or a buyer from elsewhere is the reason to prefer the Gazette of India.

Step 1: Ask the tehsil or the municipal office which Gazette it accepts

They keep the record the deed feeds.

Step 2: Think about Aadhaar, PAN, a bank and a later buyer

The Gazette of India serves them all.

Step 3: Contact the Roorkee press

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.

Step 4: Ask for the papers, the format and the fee, and submit

Keep photocopies of everything.

Step 5: Download the notice

Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do Families Make?

Common mistakes with a name in a gift deed
MistakeWhat to do
Signing without reading the final printRead every name before you sign
Describing the giver differently from the earlier titleFollow the earlier paper, or mention both forms
Leaving a slip because "it is all in the family"Rectify while the giver can sign
Writing a correction on the deed by handNever. Make a deed of rectification
Asking the sub-registrar to correct the deedThe parties correct it by a further deed
Asking for the deed to be "updated" after marriageKeep the marriage certificate with it
Paying for a Gazette to fix a typing slipA Gazette does not alter a deed
Making a fresh gift deed to fix the firstThe property was already given. Rectify
Skipping mutation after the giftApply at the tehsil or the municipal office

A typical case we handle: a father in Haridwar gifted a plot to his daughter. The deed named her "Pooja Chauhan, daughter of Rajender Singh". Her Aadhaar and PAN read "Puja Chauhan", and her father's own sale deed named him "Rajendra Singh Chauhan". A bank refused a loan on the plot. She asked us for a Gazette. Her name had not changed, so none was needed. A lawyer drew a deed of rectification, her father signed it with her, and it was registered at the same office. This is an illustrative example of the type of case we handle, not a named client review.

What is a lawyer's job, not ours

Drafting a gift deed or a deed of rectification, advising where the giver has died, a suit to rectify, and any dispute over the gift.

When you do not need us

For a slip in the deed, a wrong identity paper or a married surname. A lawyer, the sub-registrar and the identity office settle those. We are useful only where a party has changed a name by choice since the deed, and a Gazette notification is needed to link the two names.

People Also Ask About a Name in a Gift Deed

How do I correct a name in a registered gift deed?

By a deed of rectification, signed by both parties and registered.

Can a gift deed be corrected after the donor's death?

It is harder. A lawyer advises, and a court may be needed.

Does a gift deed need to be changed after marriage?

No. Keep the marriage certificate with it.

Is a gazette needed for a gift deed name mismatch?

No. Only where a party has changed a name by choice.

Can the sub-registrar correct a spelling in a gift deed?

No. The parties correct it by a further registered deed.

Is mutation needed after a gift deed?

Yes. The land or tax record changes only on application.

Can parents cancel a gift deed if the child does not look after them?

It can happen. Under section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, a tribunal can declare void a gift made on condition of care that the receiver failed to give. In January 2025 the Supreme Court quashed such a gift by a mother to her son.

Does the care condition have to be written in the gift deed?

Courts have differed. The Supreme Court in Urmila Dixit (2025) read the provision broadly, while a 2025 Karnataka High Court ruling said the conditions must be expressly stated. If care is a condition, have it written clearly in the deed.

Can possession be given back if a gift is cancelled for neglect?

Yes. In the same 2025 case the Supreme Court held that tribunals under the 2007 Act can restore possession when a gift is declared void, and ordered it restored to the mother.

Is stamp duty lower on a gift within the family in Uttarakhand?

Guides say Uttarakhand gives a rebate on gifts of property among family members. They differ on the rate, so ask the sub-registrar's office before you buy the stamp.

Who pays the stamp duty on a gift deed?

Guides say the giver pays it, not the receiver, at the time of registration. The giver must also sign any later rectification.

Can a gift deed be cancelled by the giver alone?

Not at will. The Transfer of Property Act allows revocation only on the limited grounds in section 126. A spelling slip is corrected, never a reason to cancel.

A difference between a name written in a registered gift deed and the same person's name on identity papers, on the earlier title paper, or in the land or tax record.
Can a name in a registered gift deed be corrected?+
Yes. The usual way is a deed of rectification, signed by the same giver and receiver and registered at the same office.
Do I need a Gazette or an affidavit?+
Not for a slip in the deed. A Gazette is for a person who has in fact changed a name, and it is kept with the deed. It does not alter the deed.
Can the sub-registrar correct the deed on my application?+
A registered deed records what the parties signed. The office does not rewrite it. The parties correct it by a further deed.
Does the giver have to sign the rectification deed?+
Yes. Both the giver and the receiver sign, since it corrects what both of them executed.
The giver has died. How is the deed corrected?+
Ask a lawyer. The law allows a court to rectify an instrument that does not express the parties' real intention through a mistake, and the giver's heirs are brought in.
My name changed after the gift, by marriage. Is the deed wrong?+
No. It was right on its date. Keep your marriage certificate with it, and use your present name in the land record.
The deed spells my father's name differently from the earlier sale deed. Does that matter?+
It can, to a bank or a buyer reading the chain of title. A rectification deed, or a statement in it that both forms are one person, settles it.
Can a rectification deed change the property or the share given?+
A rectification corrects a mistake in recording what was agreed. It is not a way to change the bargain. Ask a lawyer where the line falls.
Is stamp duty paid again?+
Ask the sub-registrar's office. We could not confirm the state's charge on a deed of rectification.
Does a gift of land or a house have to be registered?+
Yes. The Transfer of Property Act requires a registered instrument, signed by the giver and attested by at least two witnesses.
Does the receiver have to accept the gift?+
Yes. The Act requires acceptance by or on behalf of the receiver while the giver is alive. Deeds usually record it.
Is a gift under Muslim law different?+
The Act's chapter on gifts does not affect the rules of Muslim law on gifts. Ask a lawyer about your case.
After the gift, whose name is on the land record?+
The giver's, until mutation is made. Apply at the tehsil or the municipal office with the deed.
A witness's name is misspelt. Does that matter?+
Rarely. It is the parties and the property that are read. Mention it to your lawyer if a rectification deed is being made anyway.
Do you draft or register deeds?+
No. That is a lawyer's and the sub-registrar's work. We prepare a Gazette only where a person's own change of name needs one.

A Name in a Gift Deed: The Short Version

A registered gift deed cannot be edited. A slip in it is corrected by a deed of rectification, signed by the same giver and receiver and registered at the same office. Do it while the giver is alive, since a dead giver's signature means heirs and possibly a court. A name that changed after the gift needs no correction, only the marriage certificate or Gazette kept with the deed. Then see that the land or tax record follows.

A slip needs no Gazette. To find out if your case needs one, send photos on WhatsApp 9540005064, and we will reply in working hours.
