Power of Attorney Name Mismatch in Uttarakhand

When a power of attorney names the person giving it, or the person holding it, differently from the property papers or their identity proof: where it is stopped, how it is cured, and why it has to be done while the giver is alive.

Quick answer

A power of attorney name mismatch is cured by the person who gave the power, by signing a fresh one that states each name as on identity proof and as on the property record. It cannot be amended by the holder. Where the giver's own papers carry two names, a marriage certificate or a Gazette notification links them.

A power of attorney has to name the giver as on identity proof and as on the property record, and only the giver can cure a wrong name, by a fresh power.

Families in this state often use a power of attorney: a son abroad for his father's land, a brother in the village for a sister in the city. A power of attorney name mismatch is found when the holder presents it and the office compares names. This page explains power of attorney name mismatch for families in Uttarakhand.

We do not draft or register deeds. A power of attorney is a lawyer's document, and this page is general guidance, not legal advice. We prepare the Gazette notification, which helps where a living person's own papers carry two names. For the property's other papers, read name change in property documents in Uttarakhand.

What Is the Document, and Who Are the Two People in It?

The two people in a power of attorney and the papers each name is checked against
PersonWho that isName is checked against
The giver, also called the principal or the executantThe owner, who authorises another to actThe property deed and land record, and the giver's own identity proof
The holder, also called the attorney or the agentThe person authorised to actThe holder's identity proof, at every office where it is used
  • A general power covers a range of acts. A special power covers one act or one property.
  • It is signed by the giver, usually before a notary or a registering officer, with witnesses.
  • A power to deal with immovable property is one that offices expect to be stamped and registered. Your lawyer will tell you what the state's law requires for yours.
  • The holder acts in the giver's name. A deed the holder signs is the giver's deed.

What Is a Power of Attorney Not?

  • It is not a transfer. The courts have said plainly that a power of attorney does not pass ownership. The holder owns nothing by it. A property "bought on a power of attorney" has not been bought.
  • It is not permanent. As a rule it ends when the giver dies, and the giver can cancel it earlier.
  • It is not the holder's to change. Only the giver can correct, replace or cancel it.
  • It is not a change of name. A power of attorney cannot alter how the giver is recorded anywhere.

These limits shape everything about a wrong name in one. The cure lies with the giver, and has to come while the giver is alive and able to sign.

Where Are the Names Compared?

  1. At the sub-registrar, when the power itself is registered. The giver's identity proof is read against the name in the draft.
  2. At the sub-registrar again, when the holder signs a sale deed, a gift or a lease for the giver. The power is read against the title deed and the holder's identity proof.
  3. By the buyer's lawyer and lender, who read the whole chain.
  4. At the tehsil, for a mutation or a certificate applied for by the holder.
  5. At a bank, which has its own strict form for a holder to operate an account.
  6. In court, where the holder files or defends a case for the giver.

The second checkpoint is the one that stops sales. The title deed says one name, the power another, and the giver is in another country.

The second and fourth rows are where our service comes in. The giver is alive, and it is the giver's own two names that need a public paper between them.

What If the Giver's Name Is the Problem?

The giver is identified twice: as the person on the identity proof shown when signing, and as the owner on the property record. Both have to be the same person on paper.

How the gap opens

  • Land recorded decades ago in a home name or without a surname
  • A passport issued later in a fuller or different form
  • A woman who bought before marriage and now carries a married name
  • A name changed abroad, on a foreign passport
  • A draft typed from the passport with nobody checking the deed

How it is closed

  • The power names the giver as on identity proof, and adds the name as on the property record with "also known as" or "recorded as"
  • It describes the giver by father's or husband's name and address, as the property record does
  • It describes the property exactly as the deed and the land record do
  • The paper that links the two names is recited and attached: a marriage certificate, or a Gazette notification
  • Where the property record is simply wrong, that record is corrected first

An "also known as" in a document a person drew up for himself is weaker than a public paper. Where a buyer's lender is involved, expect to be asked for the marriage certificate or the Gazette. Read alias name in a gazette notification.

What If the Holder's Name Is the Problem?

  • The holder proves identity at every office. The name in the power has to be the name on the holder's Aadhaar or other proof, letter for letter.
  • A holder named by a home name, or with a wrong father's name, is turned away, however well known in the village.
  • The giver cures it by a fresh power in the right name. The holder cannot.
  • A holder who has changed a name since the power was made shows the marriage certificate or the Gazette notification for that change. A fresh power is cleaner.
  • Where there are two holders, the power should say if they act together or each alone, and name each in full.

Give the lawyer a copy of the holder's identity proof before the draft is typed, not the name over the phone.

How Do You Make One Whose Names Hold?

These steps are for the giver, with a lawyer.

Step 1: Collect the property papers

The title deed, the latest land record or tax receipt, and any earlier deed in the chain.

Step 2: Collect both people's identity proof

The giver's passport or Aadhaar, and the holder's.

Step 3: Compare the giver's name on the property papers and on the identity proof

Letter by letter, with the father's or husband's name.

Step 4: Close any gap at its source first

Correct a wrong record, or obtain the marriage certificate or Gazette notification that links two names.

Step 5: Have a lawyer draft the power

With each person named as on identity proof, the giver's other name added, and the property described as in the deed.

Step 6: Read the draft against the papers before signing

Names, father's names, addresses, plot numbers and areas.

Step 7: Sign, stamp and register it as the lawyer advises

With witnesses. Abroad, before the Indian mission.

Step 8: Give the holder the original with copies of the linking papers

So that every office sees the same set.

What About a Power of Attorney Made Abroad?

Many powers used in this state are signed in another country, by a son or daughter settled there.

  • It is usually signed before an officer of the Indian mission, or before a notary there with the further attestation that country's arrangement with India requires.
  • On reaching India it has to be stamped within a limited time before it can be used. Ask the lawyer here what the collector's office needs.
  • The mission identifies the giver by passport. So the name in the power will be the passport name, and the property record may say something else.
  • A person who has taken a foreign citizenship, or changed a name under a foreign law, should attach that country's paper for the change, and say so in the power.
  • Fixing a wrong name means signing again at the mission. Get the draft checked in India before the appointment, not after.

What If an Old Power of Attorney Has a Wrong Name?

The giver is alive and able

  • A fresh power is the clean answer. It can recite and replace the old one
  • A deed correcting the old one is possible where it was registered. Ask the lawyer which is simpler
  • Acts already done under the old one can be confirmed by the giver in writing
  • Cancel the old one formally, so that two do not circulate

A deed was already signed under it

  • The buyer's title now rests on a power with a wrong name
  • The giver can sign a deed confirming the sale, or a deed correcting the earlier one
  • Where the giver has died, the heirs may have to confirm it, or a court declare it
  • This is a lawyer's work, and worth doing before the property is sold again

Never write a correction onto a signed power, and never use one you know to be wrong in the hope that nobody looks. A deed built on it carries the flaw forward.

When Does a Power of Attorney End?

  • On the giver's death, as a rule. The holder's authority stops that day. Anything signed afterwards is open to challenge.
  • On cancellation by the giver, which should be in writing, registered where the power was, and told to the holder and to those who dealt with him.
  • On the purpose being done, for a special power.
  • On the giver losing the capacity to understand, in the ordinary case. A lawyer will advise on what then replaces it.

So a wrong name in a power has a deadline that nobody can see. An elderly parent's power should be read, and corrected if need be, this month and not next year. After a death, the family is in the law of succession. Read will and probate name mismatch and name correction in a death certificate and legal heir certificate.

How Does the Central Gazette Route Work?

Use this where the giver is alive and the giver's own papers carry two names that no certificate links: a home name on the land and a full name on the passport, or a name changed by choice. It is the giver who applies.

Step 1: Ask the lawyer drafting the power if a Gazette is wanted

A marriage certificate may already link the names.

Step 2: Copy the name exactly as the property record has it, and as identity proof has it

With the father's or husband's name in each.

Step 3: Make the affidavit

State both forms and the address. Sign before a notary, or abroad before the Indian mission.

Step 4: Publish the newspaper notice

In a daily local leading newspaper. Keep the original newspaper.

Step 5: Type the form and sign the undertaking

Two typed copies of the specimen, signed with two witnesses, and the undertaking.

Step 6: Prepare the CD, photographs and certificate

The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.

Step 7: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult in India, with Rs 250 more for each alias. A different charge applies to an applicant abroad. It is not refunded.

Step 8: Send the file yourself, then recite the Gazette in the power

Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. The lawyer then names the published notification in the power of attorney and attaches a copy.

Allow for it. A Gazette commonly takes 3 to 7 weeks, so start before a buyer is waiting.

Would the Uttarakhand Gazette Do?

A sub-registrar and a tehsil in the state may accept it. A buyer's lender, a passport and a mission abroad are the reasons to prefer the Gazette of India.

Step 1: Ask the lawyer and the buyer's lender which Gazette they accept

Before you choose.

Step 2: Think about the passport

A giver abroad will want the passport to follow, and it is a central record.

Step 3: Contact the Roorkee press

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.

Step 4: Ask for the papers, the format and the fee, and submit

Keep photocopies of everything.

Step 5: Download the notice

Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do Families Make?

Common mistakes with names in a power of attorney
MistakeWhat to do
Typing the draft from the passport without reading the deedCompare the two first
Giving the holder's name over the phoneSend a copy of the identity proof
Signing abroad before the draft is checked in IndiaCheck first. Signing again means another appointment
The holder writing a correction on itOnly the giver can correct it, by a fresh document
Using a power after the giver's deathIt has ended. The heirs act
Treating a power of attorney as a purchaseIt transfers nothing
Relying on "also known as" where a lender is involvedHave the marriage certificate or Gazette ready
Leaving an elderly parent's power unreadRead it now, while it can be remade
Getting a Gazette for a typing slip in the powerA fresh power cures that

A typical case we handle: a man from Pauri, settled abroad, gave his brother a power of attorney to sell their late father's plot, which had been mutated in his own name years before as "Bhagwan Singh". His passport, and so the power, said "Bhagwan Singh Rawat". The buyer's bank would not lend on it. He took out a Gazette of India notice stating both forms, which we prepared with papers sent by courier, and signed a fresh power at the mission reciting it. The sale was then registered. This is an illustrative example of the type of case we handle, not a named client review.

What is a lawyer's job, not ours

Drafting, stamping and registering a power of attorney, cancelling one, a deed confirming or correcting a sale, and any matter where the giver has died or lost capacity.

When you do not need us

For a typing slip in the power, which a fresh one cures. For a woman's maiden and married names, which a marriage certificate links. We are useful only where the giver is alive and carries two forms of a name, or has changed it, and a public paper is wanted between them.

People Also Ask About a Name Mismatch in a Power of Attorney

Can a name in a power of attorney be corrected?

Yes, by the giver, through a fresh power or a correcting deed.

Can the attorney holder correct the name himself?

No. Only the person who gave the power can.

My name in the power of attorney matches my passport but not my land record. What do I do?

State both in a fresh power, with the paper that links them.

Is a power of attorney valid after the giver's death?

As a rule, no. It ends with the giver.

Is a gazette needed for a power of attorney?

Only where the giver's own papers carry two names with no certificate linking them.

Does a power of attorney transfer ownership?

No. It only authorises the holder to act for the owner.

How long do I have to stamp a power of attorney signed abroad?

Three months from when it first reaches India, under Section 18 of the Indian Stamp Act, 1899. The stamp duty is paid in the state where the property is.

What if a power of attorney from abroad is not stamped in time?

A High Court has held that the authority can impound it, collect the stamp duty and a penalty, and then validate it. It is far simpler to stamp it within the three months.

Must a power of attorney be registered to sign a sale deed?

Where the power lets the holder present a document for registration, such as a sale deed, the power itself has to be registered under the Registration Act. Your lawyer will confirm the form needed.

What did the Supreme Court decide in the Suraj Lamp case?

That property sales by general power of attorney have no legal sanctity, and that only a registered sale deed conveys title. A power of attorney authorises an act; it does not pass ownership.

Can a power of attorney be Apostilled instead of attested at the mission?

Yes, in a country that follows the Apostille arrangement. Guides say a power properly executed abroad and Apostilled or consular-attested, then stamped in India, can be used without the giver coming to India.

How long can a document signed abroad wait before it is registered in India?

Guides say the Registration Act counts four months from its receipt in India, with a further four months on a penalty. Ask the sub-registrar what applies to yours.
