Name Change Affidavit After Marriage in Uttarakhand

When a married woman needs an affidavit and when she does not, which kind to make, what it must say, a sample format and where to get it notarised.

Quick answer

A name change affidavit after marriage is a sworn statement that gives your maiden name, your married name, your husband's name and the date of marriage. You sign it before a notary. Many women do not need it, because a registered marriage certificate is usually enough for Aadhaar, PAN and the bank.

A married woman in Uttarakhand signing a name change affidavit on stamp paper before a notary
With a registered marriage certificate and only a surname change, most women need no affidavit; where one is needed, it is sworn before a notary in the name on your identity proof.

A name change affidavit after marriage is the paper most newly married women are told to get first, often before anyone has asked if they need it. This page explains when a name change affidavit after marriage is useful in Uttarakhand, which kind to make, what it must say and what it cannot do by itself.

For the wider picture, read name change after marriage in Uttarakhand. For stamp paper, the notary and the general format, see name change affidavit in Uttarakhand.

What Is a Name Change Affidavit After Marriage?

It is a written statement, sworn before a notary public, in which a married woman declares the name she used before marriage and the name she uses after it. It is typed on non-judicial stamp paper.

It differs from an ordinary name change affidavit in one way. It ties the change to an event: the marriage. So it carries the husband's name, the date and place of the marriage, and the registration details of the marriage where there are any.

  • It is your own statement. No office issues it to you.
  • It is made in your own district.
  • It supports other papers. It is not the proof of a completed change.
A false statement in an affidavit is an offence. Give the real date of marriage and the name you actually use. Do not sign a ready-made draft with someone else's details left in it.

When Do You Need This Affidavit, and When Do You Not?

You usually do not need it when

  • Your marriage is registered and you hold the certificate
  • Only your surname is changing, to your husband's surname
  • You are updating Aadhaar, which lists a surname change after marriage with the marriage certificate among the updates that need no Gazette
  • You are keeping your maiden name

It is useful when

  • You are taking the Gazette route, and want the change on oath as the first step
  • The marriage is not registered, and you have no certificate to show
  • An office asks for an affidavit along with the marriage certificate
  • Your papers are split between the maiden name and the married name
  • Your first name is changing as well as your surname

So ask the office first what it wants. If it says "the marriage certificate", you have saved the cost of an affidavit. If it says "an affidavit", ask if it has its own format. Some offices do, and a general affidavit will not replace it.

Passport applicants, note this. Passport Seva publishes its own declaration formats for matters connected with marriage and names. Use the format on its website for a passport, not a general affidavit.

Which Kinds of Affidavit Are Used After Marriage?

Kinds of affidavit used after marriage and when each fits
KindWho signsWhat it saysFits when
Wife's name change affidavitThe wifeI was known by my maiden name and shall be known by my married nameThe Gazette route, or an office asks for the change on oath
Joint affidavit of husband and wifeBoth spousesWe were married on this date at this place, and the wife now uses this nameThere is no marriage certificate, and an office accepts a joint statement
One and the same person affidavitThe wifeThe maiden name and the married name belong to one personPapers are in both names and no change is being made now

These are three different papers. People often ask a typist for "a marriage affidavit" and receive whichever one the typist has saved. Read the heading and the numbered lines before you sign, and check that it says what your case needs.

A joint affidavit does not register a marriage. If your marriage is not registered, registering it under the Uniform Civil Code of Uttarakhand, on ucc.uk.gov.in, is usually the better course, because the certificate then does the work.

What Must a Name Change Affidavit After Marriage Contain?

What a name change affidavit after marriage must contain
PartWhat to writeCommon error
Maiden nameExactly as on your identity proof before the changeA spelling that differs from your certificates
Father's nameIn full, where the affidavit identifies you as "daughter of"Left out, so old papers cannot be linked
Husband's nameIn full, as on his own identity proofA short form or a pet name
Date and place of marriageThe real date, and the town or villageA date that differs from the marriage certificate
Registration detailsThe marriage registration number and date, if registeredLeft blank when a certificate exists
Married nameThe spelling, spacing and order you want for lifeDecided at the notary's table

One and the same personThat both names are yoursLeft out
Future useThat you will be known by the married name from now onLeft out
Verification, place, date, signatureThat the contents are true, signed before the notaryNo date, or signed at home

If your first name is also changing, say so in a separate numbered line. A reader should not have to work out from the two names that more than the surname has changed.

What Is the Format of the Wife's Affidavit?

This sample shows the usual layout. It is not an official form, and a notary may word it a little differently. The names and address are made up.

AFFIDAVIT

I, Kavita Bisht, daughter of Shri Mohan Singh Bisht and wife of Shri Ankit Negi, aged 27 years, resident of 22, Kusumkhera, Haldwani, District Nainital, Uttarakhand 263139, do hereby solemnly affirm and declare as under:

1. That before my marriage my name was Kavita Bisht, as recorded in my Aadhaar card and educational certificates.

2. That I was married to Shri Ankit Negi on [date] at Haldwani, District Nainital. The marriage is registered at number [number] dated [date].

3. That after my marriage I have changed my name from Kavita Bisht to Kavita Negi.

4. That Kavita Bisht and Kavita Negi are the names of one and the same person, that is, myself.

5. That in future I shall be known as Kavita Negi for all purposes.

If the marriage is not registered, leave out the second sentence of line 2. Do not write a registration number that does not exist.

What Is the Format of a Joint Affidavit of Husband and Wife?

A joint affidavit is made by both spouses together. It is used where there is no marriage certificate and an office is willing to take a sworn statement of the marriage. This is also only the usual layout, with made-up names.

JOINT AFFIDAVIT

We, Ankit Negi, son of Shri Govind Singh Negi, aged 30 years, and Kavita Negi, formerly Kavita Bisht, daughter of Shri Mohan Singh Bisht, aged 27 years, both residents of 22, Kusumkhera, Haldwani, District Nainital, Uttarakhand 263139, do hereby solemnly affirm and declare as under:

1. That we were married to each other on [date] at [place], according to [rites], and have been living together as husband and wife since then.

2. That before the marriage the name of the wife was Kavita Bisht.

3. That after the marriage the wife is known as Kavita Negi.

  • Both spouses sign before the notary, on the same day.
  • Photographs of both are often pasted and signed across, where the office asks for it.
  • Ask the office, before you make it, if a joint affidavit is acceptable. Many now ask for the marriage certificate and nothing else.

In Which Name Do You Sign the Affidavit?

Sign in the name that is on your identity proof on the day you sign. For most women making this affidavit, that is the maiden name.

Which name to sign in on an affidavit after marriage
Your identity proof showsSign asWhy
Maiden nameMaiden nameThe notary matches your signature and identity to that proof

The same rule carries into the Gazette form. The Department of Publication's guideline says the form is signed in the old name. If you sign the affidavit one way and the Gazette form another, the two papers stop matching.

How Do You Make a Name Change Affidavit After Marriage?

Step 1: Ask the office what it wants

Find out if the marriage certificate alone will do, and if the office has its own affidavit format.

Step 2: Choose the kind of affidavit

The wife's affidavit, a joint affidavit, or a one and the same person affidavit.

Step 3: Fix the married name

Decide the exact spelling, spacing and order, and write it down.

Step 4: Collect the details

Your identity proof, your husband's identity proof, the date and place of marriage, and the marriage certificate if you have one.

Step 5: Type the draft and read it aloud

Check every name against the papers, one letter at a time.

Step 6: Print it on stamp paper and sign before the notary

Buy non-judicial stamp paper in your name. Sign in front of the notary, who signs, seals and enters it in the register.

Step 7: Keep copies

Scan it, take photocopies and keep the original safe. Make a second original if more than one office will keep one.

The stamp paper, the notary and what to check on the finished paper are covered on our name change affidavit in Uttarakhand page.

Where Is It Made in Uttarakhand, and What Does It Cost?

At the district court of your own district, or at a tehsil where a notary sits. Stamp vendors and typists are usually found in the same place. A woman who has moved to her husband's town makes it there, with her present address.

The charge differs from one notary to another, so ask before the work starts. The stamp vendor or the notary will tell you the current stamp value for an affidavit in the state.

Our associate office is at the Dehradun District Court on Haridwar Road, near Prince Chowk. For other districts, we draft the affidavit on WhatsApp and you sign it before a notary near you.

What Can This Affidavit Not Do?

It cannot

It can

  • Put the change on oath, with a date
  • Support the marriage certificate where an office asks for both
  • Start the Gazette route, as the first step in practice
  • Explain, years later, how two names belong to one woman

One point about the Gazette. The Department of Publication's list of papers for a change of name names an undertaking signed by the applicant. It does not list a notarised affidavit. The affidavit is still made first in practice, because newspapers and the offices that later update your records often ask to see it.

What Comes After the Affidavit on the Central Gazette Route?

Take this route only if your case needs a Gazette. The notice goes in Part IV of the Gazette of India.

Step 1: Publish the newspaper notice

Print the change in a daily local leading newspaper, with your husband's name and your address, in the same words as the affidavit. Keep the original newspaper.

Step 2: Type the form

Use the Department's change of name specimen, computer typed, in two copies. Sign in your old name, with two witnesses.

Step 3: Sign the undertaking

It shows your old name and your new name.

Step 4: Prepare the CD, photographs and certificate

The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that the hard and soft copies match.

Step 5: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult. Giving both "daughter of" and "wife of" adds Rs 250 on the Department's list of additional charges.

Step 6: Send the file yourself

In person or by post, with a request letter, to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054.

Step 7: Download the Gazette

Check Part IV on egazette.gov.in each week and download the PDF.

The full route is on our gazette name change in Uttarakhand page.

What Comes After the Affidavit on the Uttarakhand Gazette Route?

The Government Press at Roorkee prints the state Gazette and sets its own practice. Ask before you prepare anything beyond the affidavit.

Step 1: Check where the new name will be used

For a passport, a central job or a move out of the state with your husband's work, use the Gazette of India.

Step 2: Contact the Roorkee press

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.

Step 3: Ask for the papers and the fee

Ask if the press wants the affidavit, in which language, and how the fee is paid.

Step 4: Publish the newspaper notice and submit the file

Use the same wording as the affidavit, and keep photocopies.

Step 5: Download the notice

Search gazettes.uk.gov.in and save the PDF.

To weigh the two, read Uttarakhand Gazette vs Gazette of India.

A typical case we handle: a woman in Rudrapur paid for a "marriage affidavit" at the court and took it to her bank, which refused it and asked for her marriage certificate. Her marriage had been registered two years earlier. She had not needed the affidavit at all. She updated Aadhaar with the certificate, and the bank followed. This is an illustrative example of the type of case we handle, not a named client review.

When you do not need us

If your marriage is registered and only your surname is changing, you most likely need no affidavit and no service. If you do need one, the samples on this page, a typist and a notary are enough. We are useful when the Gazette route is needed, when your first name is changing too, or when your papers are split between two names. Our charge is quoted per case.

All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. We draft the affidavit on WhatsApp, and you sign it before a notary in your own district.

People Also Ask About the Affidavit After Marriage

Is an affidavit required for a name change after marriage?

Often not. A registered marriage certificate is usually enough for a surname change on Aadhaar, PAN and bank records.

What is a joint affidavit for name change after marriage?

A sworn statement by both husband and wife about their marriage and the wife's name. It is used where there is no marriage certificate and an office accepts it.

Can I change my surname with only an affidavit?

No. An affidavit supports other papers. Offices ask for the marriage certificate, or the Gazette where that applies.

Which stamp paper is used for a marriage name change affidavit?

Non-judicial stamp paper. The stamp vendor or notary will tell you the current value in the state.

Does my husband have to sign my name change affidavit?

Not for the wife's own affidavit. Both spouses sign a joint affidavit.

Is the affidavit needed for the Gazette?

The Department's list for the Gazette file names an undertaking. An affidavit is still made first in practice, because newspapers and other offices often ask for it.

Is there a passport form in place of a joint affidavit?

Yes. For a woman's surname change following marriage, Passport Seva accepts the marriage certificate or a joint photo declaration signed by both husband and wife, on Annexure J.

Can Annexure J be used to add my husband's name?

Passport Seva lists the marriage certificate or the Annexure J joint photo declaration for adding a spouse's name in the passport.

What if my first name also changes after marriage?

Passport Seva says that for a full change of name after marriage, the standard name change procedure should be followed, not the marriage route.

Does an unregistered marriage need an affidavit?

The marriage is not invalid only because it is unregistered, as the government clarified at the launch of the Code. Registering it within 60 days usually removes the need for a joint affidavit.

What happens if false identity details are given at marriage?

The 2025 amendment bill added a provision allowing annulment or a penalty where either party gave false information about identity at the time of the marriage. An affidavit must carry only true details.

Can I swear the affidavit in my husband's town?

Yes. Make it before a notary in the district where you now live, with your present address.

Ask first if you need it. With a registered marriage certificate and only a surname change, most women need no affidavit. Where you do, pick the right kind: the wife's own affidavit, a joint affidavit of both spouses, or a one and the same person affidavit.

It must carry your maiden name, your married name, your husband's name and the real date of marriage, and you sign it before a notary in the name on your identity proof. It supports other papers and is not proof by itself. To check your case, message us on WhatsApp 9540005064, and we will reply in working hours.
