Name Change After Adoption in Uttarakhand
How an adopted child's new name reaches the birth certificate, Aadhaar, school and passport, which paper does the work, and when a Gazette is needed at all.
A name change after adoption usually needs no Gazette. The adoption order or the registered adoption deed is the proof. With it, the Registrar issues the child's birth certificate in the adoptive parents' names, and Aadhaar, the school and the passport office follow. A Gazette is needed only where an office refuses that paper.

A name change after adoption is different from every other change on this site, because the law that makes the adoption also gives the child a new place in a family, and with it a new name. This page explains name change after adoption in Uttarakhand: which paper does the work, how the records follow, and the few cases where a Gazette comes in.
We are a documentation desk, not a law firm, and we do not arrange adoptions. Adoption itself is done under the law, through the proper authority or by a registered deed. This page begins once that is complete.
Which Adoption Paper Do You Hold?
Adoptions in India are made in two main ways, and each ends in a different paper. Everything on this page depends on which one you hold.
| Point | Adoption order | Registered adoption deed |
|---|---|---|
| Law | The Juvenile Justice (Care and Protection of Children) Act, 2015, and the Adoption Regulations, 2022 | The Hindu Adoptions and Maintenance Act, 1956 |
| How it is made | Through an adoption agency and the central adoption authority | Directly between families, by giving and taking the child |
| Who issues the paper | The District Magistrate, under the 2022 Regulations | The deed is registered at the Sub-Registrar's office |
| Who can adopt this way | Persons of any religion | Persons to whom that Act applies |
Older adoption orders were passed by a court. Since the Adoption Regulations of 2022, the order is issued by the District Magistrate. Either is an adoption order for the purposes below.
Keep several certified copies of your order or deed. It is the base paper for the rest of the child's life, and you will hand over more than one.
How Does an Adopted Child's Name Change?
An adopted child becomes the child of the adoptive parents for all purposes. The child's new name, and the adoptive parents' names as father and mother, enter the child's records on the strength of the adoption paper.
- The adoption order or deed is the proof of the new family. It is the reason for the change, and offices ask for it.
- The birth certificate is then issued or altered to show the adoptive parents.
- Every later record, Aadhaar, school and passport, is made from that birth certificate.
- No affidavit, newspaper notice or Gazette is part of this in the ordinary case.
Check how your order or deed names the child. If it gives the child's new name, the path is straight. If it uses only the earlier name, ask the authority that issued it, or your lawyer, how the new name is to be recorded before you approach any other office.
What Happens to the Birth Certificate After Adoption?
This is the step that matters most, and it belongs to the Registrar of births, not to a Gazette.
Adoption by order
Under the Adoption Regulations, 2022, the Registrar issues a birth certificate for an adopted child on an application by the adoption agency or the adoptive parents, with the details set out in the adoption order.
Adoption by registered deed
Apply to the Registrar who holds the child's birth record, with the registered deed. Practice differs between offices, and some ask for more. A High Court has held that a District Magistrate's order is not required for an adoption made under the 1956 Act.
- If the birth was registered, go to the Registrar for the place where the child was born.
- If the birth was never registered, the Registrar will explain the procedure for registering it now.
- Carry the adoption order or deed, the earlier birth certificate if there is one, and the adoptive parents' identity proof.
- Read the new certificate at the counter: the child's name, both parents' names and the date of birth.
If a Registrar refuses, ask for the refusal in writing. That is a matter for the authority above the Registrar, or for a lawyer. A Gazette notification does not alter a birth record and is not the answer to a refusal.
How Do You Update the Child's Records After Adoption?
Step 1: Get certified copies of the adoption paper
The adoption order, or the registered deed. Check how it names the child and the parents.
Step 2: Fix the child's exact name
The full name, with spelling, spacing and order, as the child will carry it for life.
Step 3: Get the birth certificate in the adoptive parents' names
Apply to the Registrar with the adoption paper.
Step 4: Enrol or update Aadhaar
With the new birth certificate. UIDAI lists an adoption certificate among the supporting documents for a name change.
Step 5: Tell the school
Give the principal the new birth certificate and a written request to update the register. Share the adoption paper only as far as the school needs.
Step 6: Apply for the passport
With the papers on the Passport Seva list for an adopted child.
Do them in this order. A record made before the birth certificate is settled has to be changed later, and Aadhaar allows a name change only twice in a lifetime.
When Is a Gazette Needed After Adoption?
An office refuses the adoption paper
A board or another office says in writing that it wants a Gazette notification for the name.
The name goes beyond the adoption paper
The order or deed records one name, and the family now wants another.
Board records already exist
An older child was adopted after being registered with a board in the earlier name.
Old papers in the earlier name
An adult adopted long ago holds certificates in a birth name and needs them linked.
A later change
Years after the adoption, the child or the family wants a different name. That is an ordinary change of name.
If none of these fits, you do not need a Gazette, and you do not need us. For most adopted children the adoption paper and the birth certificate do everything.
Why Should You Think Before Using a Gazette for an Adopted Child?
A Gazette is a public record. A change of name notice prints the earlier name and the new name side by side, with the parent's name and address, and it stays on the Government's portal for good. The newspaper notice does the same in your own district.
For most changes of name that does not matter. For an adopted child it can. Many families keep the details of an adoption within the family, and the law treats adoption records with care.
- The birth certificate route keeps the earlier name out of public view. The Gazette route publishes it.
- So use a Gazette only where an office truly requires it, and after asking that office in writing if the adoption paper will do.
- Where a Gazette cannot be avoided, the notice gives no reason and does not mention adoption. It still shows both names.
- If keeping the earlier name private matters a great deal, take a lawyer's advice before you publish anything.
What About an Adult Who Was Adopted as a Child?
Some adults find that their school certificates carry a birth name or the names of birth parents, while their later papers carry the adoptive family's name.
- If the adoption was made by an order or a registered deed, that paper links the two sets of names. Keep certified copies with your certificates.
- An adult applies for his or her own updates, with the adoption paper and present identity proof.
- Board certificates follow the board's own rules and time limits. A board may not reissue an old certificate.
- Where an office will not accept the adoption paper alone, an adult can file a change of name in the Gazette, with the earlier name stated. That is the adult's own choice to make.
If no order or deed was ever made, read the next section.
What Is Not an Adoption in Law?
A child can be loved and raised by a family without having been adopted in law. The difference matters for the child's name, and for a great deal more.
| The arrangement | Is it an adoption? | What to do |
|---|---|---|
| A child raised by relatives, with no deed or order | No | See a lawyer about adopting the child properly |
| An agreement on stamp paper signed before a notary | No | A notary cannot make an adoption |
| A child taking a step-parent's surname | No | A surname is not adoption. It needs the other parent's consent or a court order |
| A guardianship order | No. It is guardianship | The guardian may act for the child, as the order allows |
| A child received from a hospital or a person directly | No, and it may be unlawful | See a lawyer at once |
We cannot prepare a "name change after adoption" where there has been no adoption. A Gazette notice that gives a child a new family's name does not make the child theirs in law. For a step-parent's surname, see child surname change after divorce.
How Does the Central Gazette Route Work After Adoption?
Use this only where an office has refused the adoption paper, or the name goes beyond it. The notice goes in Part IV of the Gazette of India.
Step 1: Ask the office in writing
Ask if the adoption paper and the birth certificate will do. Keep the reply.
Step 2: Fix the child's exact name
The full name, with spelling, spacing and order.
Step 3: Make the adoptive parents' affidavit
State the child's earlier name, present name and date of birth. Both adoptive parents sign before a notary.
Step 4: Publish the newspaper notice
In a daily local leading newspaper, with the parent's name and address. Keep the original newspaper.
Step 5: Type the minor's form
Two typed copies of the specimen for a minor, signed by the adoptive parent with two witnesses.
Step 6: Prepare the CD, photographs and supporting papers
The same text on a CD in MS Word, a certificate that both copies match, self-attested identity proof, and a certified copy of the adoption order or deed.
Step 7: Pay the minor's charge on BharatKosh
Commonly Rs 1,700. Confirm it before you pay. It is not refunded.
Step 8: Send the file yourself, then download the Gazette
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then check Part IV on egazette.gov.in each week.
Nothing sent to the Gazette office is returned. Send a certified copy of the adoption paper, never the original.
Can the Uttarakhand Gazette Be Used?
The Government Press at Roorkee sets its own practice. For a child, the Gazette of India is usually the safer choice, and the same caution about privacy applies.
Step 1: Ask which office wants a Gazette, and which one
A board or office outside the state may want the Gazette of India.
Step 2: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private notice for a minor is being accepted.
Step 3: Ask what it needs
The papers, the format, the language and the fee.
Step 4: Publish the notice and submit the file
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
To weigh the two, read Uttarakhand Gazette vs Gazette of India.
What Does It Cost, and How Long Does It Take?
| Item | With the adoption paper | Central Gazette route |
|---|---|---|
| Certified copies of the order or deed | The issuing office's charge | The same |
| Birth certificate | As the Registrar sets | The same |
| Affidavit and newspaper notice | None | Rs 100 to Rs 500, and Rs 800 to Rs 4,000 for each paper |
| Gazette charge | None | Commonly Rs 1,700 for a minor, Rs 1,100 for an adult |
| Time | As each office takes | Commonly 3 to 7 weeks more |
Our own charge applies only where we prepare a Gazette file. It is quoted per case and shown as a separate line.
Which Mistakes Should Adoptive Parents Avoid?
| Mistake | What to do |
|---|---|
| Paying for a Gazette when the adoption paper would have done | Ask the office in writing first |
| Publishing the earlier name without thinking of privacy | Use the birth certificate route where you can |
| Making Aadhaar or school records before the birth certificate is settled | Do the birth certificate first |
| Treating a notarised agreement as an adoption | It is not one. See a lawyer |
| Using a Gazette to give a child a family's name with no adoption | A Gazette does not make an adoption |
| Handing an original order or deed to an office | Give certified copies |
| Giving the whole adoption file to a school | Share only what the school needs |
| A spelling in the birth certificate that differs from the order | Read the certificate at the counter |
A typical case we handle: a couple in Haridwar who had adopted a little girl through an agency were told by a school clerk to "get a Gazette" for her name. They asked us to file one. Their adoption order named her, and the Registrar had already issued her birth certificate in their names. They gave the school the birth certificate, and nothing was published. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
Adoption itself, a Registrar's refusal, a step-parent or relative adoption, and any question about a child's status are a lawyer's work and the proper authority's decision. We do not arrange adoptions and we do not advise on them.
When you do not need us
If you hold an adoption order or a registered deed, you most likely need no Gazette. The Registrar, the Aadhaar centre, the school and the passport office each act on that paper and the birth certificate. Call us only where an office has refused it in writing.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. Whatever you send us about an adoption stays with the person handling your file.

Name Change After Adoption: The Short Version
An adoption order or a registered adoption deed is the proof of the child's new family and name. Take it to the Registrar for the birth certificate, then use that certificate for Aadhaar, the school and the passport. No affidavit, newspaper notice or Gazette is part of this in the ordinary case.
A Gazette prints the earlier name in public, so use one only where an office refuses the adoption paper in writing. To check your case, send your details on WhatsApp 9540005064, and we will reply in working hours.
