Child Surname Change After Divorce in Uttarakhand
Who can decide a child's surname after the parents divorce, when the other parent must agree, what a court order does, and how the Gazette step works.
A child's surname does not change when the parents divorce or when the mother changes her own name. For a child under 18, a change of surname needs both parents to agree, or a court order where only one parent applies. The change is then published in the Gazette, at a fee of Rs 1,700.

A child surname change after divorce is the hardest name question a parent brings to us, because two parents and a court may all have a say. This page explains child surname change after divorce in Uttarakhand: who can decide, when the other parent's consent is needed, what a court order does, and how the Gazette step works.
We are a documentation desk, not a law firm. Custody, guardianship and any disagreement between parents are for your lawyer and the court. We prepare the Gazette papers once it is clear who may sign them. For your own name, read name change after divorce in Uttarakhand.
Does a Child's Surname Change When the Parents Divorce?
No. Three things that parents often expect to carry over do not.
- The decree of divorce ends the marriage. It does not change the name of either parent or of any child.
- The mother's own change of name, back to her maiden name or to a new one, is hers alone. It does not pass to the child.
- Custody decides who the child lives with. A custody order does not by itself rename the child.
So after a divorce a mother may be Kavita Bisht again while her son is still Aarav Negi on every paper. That is normal, and it is lawful. Parents and children carry different surnames in many families.
You do not have to change the child's surname at all. If the child keeps the name on the birth certificate, there is nothing to do. This page is for parents who want a change, and it starts with whether one is possible.
Who Can Decide a Child's Surname After Divorce?
It depends on the child's age and on what the two parents, or a court, have said.
| Situation | Who applies | What is needed |
|---|---|---|
| Child under 18, both parents agree | The parents | An affidavit signed by both parents |
| Child under 18, only one parent applies | That parent | A custody or guardianship order from a court |
| Child under 18, the parents disagree | Nobody yet | The court decides first |
| Child under 18, in the care of a legal guardian | The guardian | The guardianship order |
| Son or daughter aged 18 or above | The son or daughter | Nothing from either parent. It is an adult's own change of name |
The Gazette office does not hear both sides or weigh what is best for a child. It takes the papers in front of it. That is why, for a child, the papers must show that the person signing has the right to sign: both parents together, or one parent with a court's order.
How Do You Work Out If You Can Change Your Child's Surname?
Step 1: Check the child's age
Under 18, a parent or guardian applies. At 18 or above, the young person applies alone.
Step 2: Read your decree and every order about the child
Look for who has custody, who is guardian, and any line about the child's name.
Step 3: Ask the other parent
If the other parent agrees and will sign, the way is open, and it is the simplest route by far.
Step 4: If there is no agreement, see your lawyer
Ask what order you have and what order you would need. This step is the court's, not the Gazette's.
Step 5: Fix the exact new name
Decide the spelling, spacing and order of the child's full name, and write it down.
Step 6: List the child's records
Birth certificate, Aadhaar, school record, passport and any bank account. Each will need attention after the Gazette.
Step 7: Only then prepare the Gazette file
With the consent or the order in hand, the Gazette step is routine.
What Is Needed When Both Parents Agree?
When the mother and the father both agree, a child's surname change after divorce is handled like any other change of name for a minor. The divorce does not make it harder.
- Both parents sign the affidavit for the child, before a notary. Where they live in different towns, it is common for the other parent to sign a separate consent affidavit before a notary there.
- Both give self-attested copies of their identity and address proof.
- One parent makes the statement on the Gazette form for the child, and signs it. The child does not sign.
- The newspaper notice names the child, the old and new name, and the parent.
Get the consent in writing and on oath while relations allow it. A spoken "do what you like" is not consent that any office can see, and it can be withdrawn.
What Is Needed When Only One Parent Applies?
Where only one parent signs, a custody or guardianship order from a court is needed. The parent with the child cannot fill the gap with a personal affidavit saying the other parent does not care.
| The order you hold | What it settles | For the surname |
|---|---|---|
| Custody order, silent on the name | Who the child lives with | An office may still ask for the other parent's consent |
| Guardianship order in your favour | Who may act for the child | Stronger. It shows you may sign for the child |
| An order that expressly allows the change of name | The very question | The clearest paper to hold |
| Visitation or maintenance order only | Contact and money | Nothing on the name |
| No order about the child at all | Nothing | Both parents must sign, or you go to court |
If you are going to court in any case, ask your lawyer to seek a line that speaks of the child's name in plain words. An order that names the new surname leaves no room for an office to doubt.
Which order is enough for a given office is a question that office decides. Send us the order before you spend on anything else, and we will tell you how it is usually read.
Which Situation Is Closest to Yours?
Mother's maiden surname for the child
The mother has gone back to her maiden name and wants the child to carry it. Both parents sign, or she holds a court order.
Step-father's surname
The mother has married again. A new surname does not make the step-father the legal father. The natural father's consent or a court order is still needed. Adoption is a separate legal process.
The other parent cannot be traced
Absence is not consent. This is exactly the case for a court order. Take advice.
The other parent has died
The surviving parent acts for the child. Keep the death certificate with the file, and check if anyone else has been named guardian.
The child is 16 or 17
It may be simpler to wait. At 18 the young person can change the name alone, as an adult.
A very young child
Fewer records exist, so a change touches less. The rule on who must agree is the same.
For a mother who marries again and changes her own name along with her minor child's, the Department of Publication's list of additional charges has its own entry. Ask the Department how your notice will be counted before you pay.
What About the Child's Own Say, and Turning 18?
A surname is the child's, for life. Before any paper is typed, it is worth asking a child who is old enough what he or she wants to be called, and why.
- A school-going child is known by a name to friends and teachers. A change in the middle of school years is felt more than adults expect.
- Where a court is asked, it looks at the child's welfare, and an older child's wishes are heard.
- A child whose name is changed at 10 can change it again at 18. It is kinder, and cheaper, to get it right once.
Waiting until 18
At 18 a person is an adult and decides his or her own name. No parent's consent and no court order is needed. The adult Gazette fee is commonly Rs 1,100.
So where the parents cannot agree and the child is in the later teens, waiting is a real choice. It avoids a court case, and the decision is made by the person who will carry the name.
One point on timing the other way. Boards and schools grow strict about names once a child is registered for board examinations. If a change is going to be made for a younger child, it is easier before that stage. Ask the school what its board allows.
Which Records Carry a Child's Surname, and What Does Each Need?
The Gazette is supporting proof. It does not correct any record by itself. Each office is applied to, one by one. This is the usual position, and each office keeps its own rules.
| Record | Who updates it | Usually asked for |
|---|---|---|
| Aadhaar | An Aadhaar Seva Kendra | The Gazette, the child's existing Aadhaar and the parent's identity proof |
| School record | The school | The Gazette, an application by the parent and the school's own form |
| Board record | The board, through the school | The board's own process. Ask early |
| Passport | Passport Seva, as a re-issue | The papers on its list for a minor, with its own declarations where one parent applies |
| Bank account of the minor | The bank | The child's updated Aadhaar and the guardian's papers |
| Birth certificate | The Registrar who issued it | Ask the Registrar what is possible. A Gazette does not alter the birth register |
The last row matters. Many families keep the birth certificate as it is and keep the Gazette with it. Read together, the two show the name at birth and the name now.
Which Documents Go in a Child's Gazette File?
The Department of Publication publishes a separate guideline for a minor. Read the current one on its website before you file. This is the usual list.
About the child
- The child's birth certificate
- A school record or bonafide certificate, if the child is in school
- The child's Aadhaar, if issued
- Two passport size photographs of the child
From the parents or guardian
- An affidavit signed by both parents, or by the legal guardian
- Identity and address proof of both parents or the guardian
- A custody or guardianship order, where only one parent applies
- The death certificate, where a parent has died
To these are added the papers every Gazette file carries: the original newspaper, the typed form in two copies with two witnesses, the same text on a CD, a certificate that the two match, the fee receipt and a request letter.
A certified copy of the decree of divorce is worth adding where the parents' surnames now differ. It explains at a glance why the mother signs in one surname and the child has another. For the decree itself, see divorce decree as proof for a name change.
Documents must not be older than one year, and nothing sent to the Gazette office is returned. Never post an original court order. Send a certified copy and keep the original.
How Does the Central Gazette Route Work for a Child?
The notice goes in Part IV of the Gazette of India. The parent or guardian applies, since a child cannot.
Step 1: Settle who signs
Both parents, or one parent with a court order, or the legal guardian.
Step 2: Make the affidavit for the child
State the child's old name, new name and date of birth, and the parents' details. Sign before a notary.
Step 3: Publish the newspaper notice
Print the child's change of name in a daily local leading newspaper, with the parent's name and address. Keep the original newspaper.
Step 4: Type the minor's form
Use the Department's specimen for a minor, in two copies. The parent or guardian signs, with two witnesses.
Step 5: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, the child's photographs, the parent's self-attested identity proof, and a certificate that both copies match.
Step 6: Pay the minor's charge on BharatKosh
Commonly Rs 1,700 for a minor. Confirm it before you pay. It is not refunded.
Step 7: Send the file yourself
In person or by post, with a request letter, to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054.
Step 8: Download the Gazette
Check Part IV on egazette.gov.in each week and download the PDF.
For each paper in detail, see documents required for gazette name change in Uttarakhand, which has a list for a child under 18.
Can the Uttarakhand Gazette Be Used for a Child?
The Government Press at Roorkee sets its own practice. For a child, think harder than usual about where the name will be used in years to come.
Step 1: Think about the child's future
College, a passport, a job outside the state. For any of these, the Gazette of India is the safer choice.
Step 2: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice for a minor is being accepted.
Step 3: Ask what it needs for a minor
Ask about both parents' signatures, a court order, the format and the fee.
Step 4: Publish the notice and submit the file
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
A child's papers are used for decades and in places nobody can guess today. To weigh the two Gazettes, read Uttarakhand Gazette vs Gazette of India.
What Does a Child's Surname Change Cost, and How Long Does It Take?
| Item | Typical cost | Note |
|---|---|---|
| Central Gazette charge, minor | Rs 1,700 | Paid on BharatKosh. Revised from time to time |
| Affidavit | Rs 100 to Rs 500 | More if the two parents sign before different notaries |
| Newspaper notice | Rs 800 to Rs 4,000 for each paper | Depends on the paper and the edition |
| Court order, where needed | Lawyer's and court costs | Outside our work, and usually the larger cost |
| Each record update | That office's own fee | Aadhaar, school, passport |
| Our assistance | Quoted per case | Shown as a separate line |
Where both parents agree, the Gazette commonly takes 3 to 7 weeks from the affidavit to the published notice. Where a court order is needed, the court's time comes first, and nobody can promise how long that will be.
If the young person is close to 18, compare this with waiting. The adult charge is commonly Rs 1,100, and no consent or order is needed.
What Does a Surname Change Not Affect?
Parents on both sides worry about what a new surname means. A surname is a name. It does not by itself change who the child's parents are.
It does not by itself change
- Who the child's father and mother are in law
- What the birth certificate records about the parents
- Custody or visiting arrangements
- Any order about the child's maintenance
It does change
- The name the child is known by, on the records you update
- The name that goes forward into board certificates and the passport
- How easily the child's papers and the parent's papers are read together
These are general points and not advice on your case. Questions about maintenance, inheritance or adoption by a step-parent are legal questions. Put them to your lawyer before a surname is changed, not after.
Which Mistakes Should Parents Avoid?
| Mistake | What to do |
|---|---|
| Assuming the child's name follows the mother's decree or her new name | The child's name is a separate matter with its own papers |
| One parent signing alone, with no court order | Get the other parent's signature, or an order |
| Treating a custody order as permission to rename | Read what the order says. Ask your lawyer |
| Writing the new surname on a school form before any Gazette | Keep the recorded name until the change is published |
| Giving the step-father's surname as if he were the father | A surname is not adoption. Take advice |
| Using the child's Aadhaar name change without thought | The child gets only two in a lifetime |
| Changing a 17 year old's name through a court fight | Consider waiting until 18 |
| Paying for a state Gazette for a child headed for college elsewhere | Use the Gazette of India |
| Posting the original court order | Send a certified copy |
A typical case we handle: a mother in Dehradun had custody of her seven year old son and had gone back to her maiden name. She wanted him to carry it too. The father agreed and signed a consent affidavit before a notary in the city where he worked. With both parents on record the file went in as an ordinary minor's case, and the school updated its record from the Gazette. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
Custody, guardianship, the other parent's objection, a parent who cannot be traced and adoption by a step-parent are all a lawyer's work and a court's decision. We do not advise on them and we do not appear in court. We prepare the Gazette papers once the right to sign is settled.
When you do not need us
If the child is keeping the surname on the birth certificate, there is nothing to do. If the young person is 18, he or she can file as an adult. And if both parents agree and are at ease with forms, the guideline and this site are enough to file it yourselves.
Which Areas of Uttarakhand Do We Cover?

The two parents often live in different places after a divorce. Each can sign an affidavit before a notary where he or she lives.
