Divorce Decree as Proof for a Name Change in Uttarakhand
What the decree proves and what it does not, which copy offices accept, when it counts as final, how the state registers it, and what to do when it is not enough.
A certified, final decree of divorce is the main proof for taking back a maiden name in Uttarakhand. It shows that the marriage has ended and how the court recorded your name. It does not prove a new name or change a child's name. Under the Uniform Civil Code, the decree itself must also be registered.

A divorce decree as proof for a name change works only when it is the right copy, at the right stage, with the right names on it. This page explains the divorce decree as proof for a name change in Uttarakhand: what the decree proves, what offices check, how the state registers it, and what to do when it is not enough.
For your choices of name and the order of record updates, read name change after divorce in Uttarakhand. We are a documentation desk, not a law firm. Getting the decree, and any question about its meaning, is your lawyer's work.
What Is a Decree of Divorce?
A decree of divorce is the court's formal order that a marriage is dissolved. It comes at the end of a divorce case, from the Family Court or the court that does the Family Court's work in your district.
People use three words for the papers at the end of a case. They are not the same thing.
| Paper | What it is | Asked for as proof? |
|---|---|---|
| Judgment | The court's reasons, often many pages long | Sometimes, along with the decree |
| Order | The operative direction of the court | The state's Rules ask for the order and the decree together |
| Decree | The formal sheet that states the result: the marriage stands dissolved | Yes. This is the paper offices mean |
When you ask the court for copies, ask for the judgment or order and the decree. Some offices are content with the decree sheet. Others, and the state when it registers the decree, want the order as well.
What Does the Decree Prove, and What Does It Not?
The decree proves
- That your marriage has been dissolved by a court
- The date from which it stands dissolved
- Who the two parties were, as the court recorded their names
- Anything the court has ordered about children, where the decree says so
The decree does not prove
- Your maiden name, unless it appears in the decree
- A new name that you have never held
- That any record has been updated
- A change in a child's name
- That the decree is final, which is a separate fact
So the decree supports one kind of change well: dropping a surname that came with the marriage and going back to the name you had before. For that, it is the natural proof. For anything else, it is only background.
A decree also does not change your name by itself. Unless the court has said something about your name, the decree is silent on it. You apply to each office, and the decree is what you show.
Which Papers Count as a Decree, and Which Do Not?
Not every paper that ends a marriage in practice is a decree. Check yours against this table.
| Your paper | Is it a decree? | Note |
|---|---|---|
| Decree of divorce by mutual consent | Yes | A decree like any other |
| Decree of divorce after a contested case | Yes | Check if an appeal has been filed |
| Ex parte decree | Yes | Passed when the other side did not appear. Ask your lawyer when it can be treated as final |
| Decree of nullity of marriage | Yes, of a different kind | The state's Rules register it in the same way as a divorce |
| Decree of judicial separation | No, not a divorce | The marriage continues. We did not find it among the decrees the state's Rules register |
| Divorce under customary law before 27 January 2025 | Not a court decree | The Rules allow it to be registered with proof of the dissolution |
| Divorce outside a court after 27 January 2025 | No | The Rules do not allow it to be registered. Speak to a lawyer |
| A notarised agreement or an affidavit of separation | No | A notary cannot dissolve a marriage |
| Decree of a court outside India | Ask a lawyer | The Rules speak of a decree passed by a court in India |
If your paper is in one of the last four rows, do not take it to an Aadhaar centre or a bank as a decree. Find out from a lawyer where you stand first.
How Do You Get a Certified Copy of the Decree?
Offices want a certified copy. That is a copy issued by the court itself, with its seal and a line certifying it as a true copy. A photocopy made by you, or a printout from a website, is not one.
Step 1: Note the case details
Keep the case number and year, the court, the names of the parties and the date of the decree. The CNR number, if you have it, helps.
Step 2: Apply to the court's copying section
You or your lawyer apply in the court where the decree was passed. The section will tell you its form and its charge.
Step 3: Ask for the order and the decree
Ask for both, so you have what the state and the stricter offices want.
Step 4: Ask for several copies
You will give one to more than one office. It is easier to get five now than one more later.
Step 5: Check each copy when you collect it
Every page should be there and readable, with the seal and the certifying line. Read the names and the case number.
Step 6: Keep one set aside
Do not laminate it. Keep one certified set that never leaves your folder, and scan it.
When Is a Decree Final, and Why Does It Matter?
A decree can be challenged in a higher court for a set time. Until that time has passed, the result is not settled, and a record changed on the strength of it may have to be changed back.
The Uniform Civil Code Rules of Uttarakhand describe a decree as final in three situations:
- There is no right of appeal against it.
- There is a right of appeal, and the time to appeal has passed with no appeal filed.
- An appeal was filed and dismissed, and no further appeal lies.
The time allowed for an appeal depends on the law under which your case was decided. Do not guess it. Ask your lawyer for the date on which your decree became final, and write it down. You will be asked for that date when you register the decree.
| Your case | How finality is shown |
|---|---|
| No appeal was filed | The date the appeal time ran out, and your own declaration that the decree is final |
| An appeal was filed and decided | The final order of the appeal court |
| An appeal is pending | It cannot be shown. The decree is not final yet |
For the state's registration, the Rules ask for a self-declaration that the decree has become final, and for the appeal court's final order where there was an appeal.
How Do the Names on the Decree Affect Its Use?
An office compares the name on your decree with the name on its own record, and with the name you now want. How the court wrote your name decides how much work the decree can do alone.
| The decree names you as | What it links | What to add |
|---|---|---|
| Married name, with your father's name | Your married name to your father's family | Usually your class 10 certificate, to show the maiden name itself |
| Married name, also known by the maiden name | Both names, directly | Often nothing more |
| Married name only | Nothing beyond the marriage | A paper that shows your maiden name, such as the class 10 certificate or the marriage certificate |
| Maiden name only | Nothing to the married name on your records | The marriage certificate, to show you are the same person |
| A spelling that differs from your records | It raises a doubt | See the section on a wrong name in the decree |
The class 10 certificate does a lot of work here. It is usually the oldest paper in your maiden name, and the name you go back to should match it letter for letter.
If you are still in the middle of your case, ask your lawyer to make sure the papers filed in court give your name in both forms, with your father's name. A decree written that way saves you trouble for years.
What Does the State Check When It Registers the Decree?
Under the Uniform Civil Code, a decree of divorce or nullity is itself to be registered, on ucc.uk.gov.in or with the Sub-Registrar. The steps are on our name change after divorce page. Here is what happens to the decree once you apply.
What the Sub-Registrar checks
- That the decree is real and final, on the websites of eCourts, the High Court and the Supreme Court, using the case, CNR or diary number
- If only one spouse applies, the other spouse, by phone or otherwise, to confirm the decree is final
- The papers for a customary divorce that took place before the Code began
- The information you gave in the application
Grounds for rejection in the Rules
- The decree was not passed by a competent court
- An appeal against it is pending
- The time to appeal has not yet passed
- The decree was reversed in appeal
- The divorce was under customary law after the Code began
- A false statement or a forged paper
- A query not answered within five days
| Stage | Time limit in the Rules |
|---|---|
| Applying, for a decree that became final after 27 January 2025 | Within 60 days of the decree becoming final |
| Applying, for an older decree | Within six months of the Code beginning. Check the portal for the current position, and expect a late fee |
| Sub-Registrar asking for more information | Within 5 days |
| Your reply | Within 5 days |
| Decision | Within 15 days |
| Appeal against a rejection | To the Registrar, within 30 days |
If the application is in order, you get an acknowledgement certificate for the decree. It does not change your name. But it is the state's own confirmation that the decree is real and final, and an office that doubts your decree will find that hard to argue with.
After registration, the Rules ask you to update a change of address, phone number, email or religion online within 30 days.
Where Is the Decree Used as Proof?
The first three rows come from the state's Rules and portal and from UIDAI's own answer. The rest are the usual position, and each office keeps its own list.
| Where | How the decree is used | What usually goes with it |
|---|---|---|
| Registering the decree with the state | A duly attested copy of the order and decree is uploaded | Self-declaration of finality, case details, children's birth certificates |
| Aadhaar | A divorce decree is among the supporting documents UIDAI lists for a name change | Proof of the maiden name, and your existing Aadhaar |
| Registering a later marriage in Uttarakhand | The decree is the proof asked for where a spouse is a divorcee | The papers for the new marriage |
| PAN | Proof of the change, with the correction application | The updated Aadhaar |
| Bank | Shown with the request to change the account name | Updated Aadhaar and PAN |
| Passport | As the Passport Seva list for your case says | The current passport and updated identity proof |
| Employer, pension and insurance | To change marital status, name and nominees | The office's own form |
The third row surprises people. If you marry again in Uttarakhand, the decree of your earlier divorce is one of the papers the marriage registration asks for. So keep a certified copy for good, even after every record has been updated.
What If the Decree Has a Wrong Name, or Is Lost?
A wrong name in the decree
Do not take it to offices and hope. A court can correct a clerical mistake or an accidental slip in its own decree, under Section 152 of the Code of Civil Procedure. Ask your lawyer to apply to the same court, with proof of the right spelling. Then get fresh certified copies.
A lost decree
The court keeps the record. Apply to its copying section for a fresh certified copy, with the case number, the year and the names of the parties. If you have no case number, the eCourts service lets you search by party name.
A decree from another state
A decree of a court anywhere in India is a decree. The state's Rules cover decrees passed in the state or outside it. The certified copy comes from the court that passed it.
An old decree, never used
A decree does not expire. Check that it has been registered with the state, get fresh certified copies if yours are worn, and start the updates in order.
What you must never do is alter a copy, write over a name or have the decree retyped. A changed court paper is a serious matter, and offices check decrees against the court's own records.
When Is the Decree Not Enough?
| Your situation | Why the decree falls short | What to do |
|---|---|---|
| You want a name you never held | The decree is about a marriage, not a new name | Gazette change of name |
| Your first name changed at marriage and you want it back | Offices may treat it as more than dropping a surname | Ask the office. Gazette if it wants one |
| The decree and your records cannot be linked | Nothing shows the two names are one person | Add a linking paper. Gazette if there is none |
| An office refuses the decree in writing | Its list asks for a Gazette | Gazette change of name |
| Papers carry three or more names | The decree explains one step, not all | Gazette with an alias |
| The decree is not final | The result is not settled | Wait |
| A child's name is to change | The decree is not about the child's name | A separate process, with both parents or a court order |
The Gazette route does not depend on the decree. The Department of Publication's list of papers for a change of name does not include one. So where the decree falls short, the Gazette can carry the change by itself, and the decree stays in your folder as background.
Where several names are in use, see alias name in a gazette notification.
How Does the Central Gazette Route Work When the Decree Is Not Enough?
The notice goes in Part IV of the Gazette of India, following the Department of Publication's guideline for a change of name.
Step 1: Confirm that the decree will not do
Get the refusing office to say so in writing, or check your case against the table above.
Step 2: Publish the newspaper notice
Print the change in a daily local leading newspaper, with your father's name and your address. Keep the original newspaper.
Step 3: Type the form and sign the undertaking
Two typed copies of the change of name specimen, signed in your old name with two witnesses, and an undertaking showing the old and the new name.
Step 4: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 5: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult, with more for some wordings. It is not refunded.
Step 6: Send the file yourself
In person or by post, with a request letter, to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054.
Step 7: Download the Gazette
Check Part IV on egazette.gov.in each week and download the PDF.
The full route is on our gazette name change in Uttarakhand page.
Can the Uttarakhand Gazette Be Used in Its Place?
Where every record you own stays inside the state, it may serve. The Government Press at Roorkee sets its own practice.
Step 1: Check where the name will be used
For a passport, a central job or a move out of the state, use the Gazette of India.
Step 2: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 3: Ask for the papers and the fee
Ask if the press wants a copy of the decree, and how the fee is paid.
Step 4: Publish the notice and submit the file
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do People Make With the Decree?
| Mistake | What to do |
|---|---|
| Taking a photocopy or a website printout to an office | Take a certified copy from the court |
| Using the decree before it is final | Wait until the appeal time has passed |
| Guessing the date of finality | Ask your lawyer and write it down |
| Not registering the decree with the state | Register it within the time limit in the Rules |
| Treating a notarised separation agreement as a divorce | Only a court can dissolve the marriage |
| Getting only one certified copy | Ask for several at the start |
| Going back to a spelling that is not on the class 10 certificate | Use the certificate's spelling |
| Using a decree with a wrong name | Have the court correct it first |
| Expecting the decree to support a brand new name | That needs a Gazette |
| Throwing the decree away once records are updated | Keep a certified copy for life |
A typical case we handle: a woman in Haridwar took a printout of her decree from the court's website to an Aadhaar centre and was sent back. The time to appeal had also not yet passed. She applied for certified copies at the court, waited until her lawyer confirmed the decree was final, registered it with the state and went back with a certified copy and her class 10 certificate. This is an illustrative example of the type of case we handle, not a named client review.
When you do not need us
Certified copies come from the court, and registering the decree is done by you on the state portal. If your decree is final and you are going back to your maiden name, you most likely need no Gazette and no service. Call us only where the decree is not enough and a Gazette is needed. Our charge for that is quoted per case.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. The decree comes from the court that heard your case. Everything after that can be done from where you now live.
People Also Ask About the Divorce Decree as Proof
Is a divorce decree enough to change my name?
Usually, for going back to a maiden name, if it is certified and final. It is not enough for a brand new name.
What is a certified copy of a divorce decree?
A copy issued by the court itself, with its seal and a line certifying it as a true copy.
Can I use a photocopy of my divorce decree?
No. Offices ask for a certified copy from the court.
When does a divorce decree become final?
When there is no right of appeal, when the time to appeal has passed, or when an appeal has been finally decided.
Is a mutual divorce agreement on stamp paper valid?
It is not a decree. A notary cannot dissolve a marriage. Speak to a lawyer.
Do I need to register my divorce decree in Uttarakhand?
Yes, under the Uniform Civil Code. A decree that becomes final after the Code began is to be registered within 60 days.
How long is the time to appeal against a divorce decree?
Under the Hindu Marriage Act, Section 28(4) was amended in 2003 to allow 90 days, after the Supreme Court found the earlier 30 days insufficient. A full bench of the Bombay High Court held that the 90 days applies to Family Court decrees too.
When can a divorced person marry again?
Section 15 of the Hindu Marriage Act makes it lawful once there is no right of appeal, or the time to appeal has expired without an appeal, or an appeal has been dismissed.
Is there still a one-year wait before remarrying?
No. The Marriage Laws (Amendment) Act, 1976 omitted the proviso that required a year to pass from the date of the decree.
Is the time taken to get the certified copy counted in the appeal period?
Commentators note that under Section 12 of the Limitation Act, the time needed to obtain a copy of the decree is excluded from the period of limitation. Ask your lawyer for your own final date.
Can a party set aside an ex parte divorce decree?
Lawyers note that besides an appeal, a party may apply to the same court under Order 9 Rule 13 of the Code of Civil Procedure to set aside an ex parte decree, within 30 days. That is one more reason to wait before using one.
What if someone remarries before the appeal time ends?
In Savitri Pandey, the Supreme Court suggested a 90-day appeal period and said a marriage solemnised during that period should be deemed void. Do not treat a decree as final until the time has run.

Divorce Decree as Proof: The Short Version
A decree works as proof when four things are true. It is a decree of a court, not an agreement. It is a certified copy. It is final. And the names on it can be linked to the name you are going back to. In Uttarakhand, register the decree with the state as well.
With that in hand, the decree supports a return to your maiden name at Aadhaar and then at the other offices. It does not support a brand new name, which needs a Gazette. To have your decree looked at, send the first and last page on WhatsApp 9540005064, and we will reply in working hours.
