Name Change After Divorce in Uttarakhand
Your choices once the decree is final, how to take back your maiden name with the decree, when a Gazette is needed, and the order in which to update each record.
A name change after divorce in Uttarakhand is a choice, not a duty. To go back to your maiden name, the certified decree of divorce is the main proof for Aadhaar, PAN and the bank. A Gazette notification is needed only where an office refuses the decree or you want a new name altogether.

After a divorce, the last thing anyone wants is another round of offices. A name change after divorce in Uttarakhand can be short if it is done in the right order, with the right paper. This page explains name change after divorce in Uttarakhand: your choices, the decree route, the Gazette route and the order of updates.
We are a documentation desk, not a law firm. The divorce itself, custody and any dispute about a name are matters for your lawyer and the court. This page begins where the court's work ends, with a decree in your hand.
Do You Have to Change Your Name After Divorce?
No. A divorce ends the marriage. It does not change anyone's name, and no office changes your name because a decree has been passed.
- If you never changed your name at marriage, there is nothing to change now.
- If you took your husband's surname, you may go back to your maiden name. Many women do.
- You may also keep the surname you have used for years. Women often do this because their children carry it or their work is known by it.
- We know of no rule that makes going back compulsory.
One caution. If your decree, your settlement or any order of the court says something about the name you are to use, follow it and ask your lawyer. That is a legal question, and it comes before everything on this page.
What Are Your Choices of Name After Divorce?
| Choice | Example | What it involves |
|---|---|---|
| You never changed your name | Kavita Bisht stayed Kavita Bisht | Nothing for the name. Update marital status and nominees |
| Go back to your maiden name | Kavita Negi becomes Kavita Bisht again | Usually the decree route |
| Keep the married surname | Kavita Negi stays Kavita Negi | Nothing for the name |
| Take a new name altogether | Kavita Negi becomes Kavya Sharma | A change of name. The Gazette route |
| Marry again and take a new surname | Kavita Negi becomes Kavita Rawat | The new marriage certificate, or the Gazette route |
The second row is the common one, and it is where a Gazette is most often sold without need. Before you choose, count your records. Going back means updating every record you changed at marriage. Staying as you are means updating none.
Aadhaar allows a name change only twice in a lifetime. A woman who changed her surname at marriage and changes it back after divorce has used both. Think about that before you decide, most of all if you may marry again.
What Makes a Divorce Decree Usable for a Name Change?
The decree is to a divorced woman what the marriage certificate is to a bride. Offices read it closely.
It should be
- A certified copy from the court, not a plain photocopy
- The decree itself, along with the judgment or order where the office asks for it
- Final, which means the time to appeal has passed, or an appeal has been decided
- Readable, complete and with the court's seal on every page it should be on
Check on it
- Your name, as the court recorded it
- Your former husband's name
- Your father's name, if it appears
- The case number and the date of the decree
- Any line about your name, your children or their custody
Look at how the decree names you. If it gives your married name and also your maiden name or your father's name, it links the two for any office. If it gives only the married name, an office may ask for one more paper to show what your maiden name was, such as your class 10 certificate or the marriage certificate.
Ask the court's copying section for several certified copies while the file is fresh. You will hand over more than one.
How Do You Register the Decree in Uttarakhand?
Under the Uniform Civil Code of Uttarakhand, a decree of divorce is itself to be registered. The Rules give the time limit as 60 days from the date the decree becomes final, for a decree that becomes final after the Code began on 27 January 2025. For older decrees, check the current time limit on the portal.
Step 1: Wait until the decree is final
The Rules treat a decree as final when there is no right of appeal, when the time to appeal has passed with no appeal, or when the appeal has been dismissed with no further appeal.
Step 2: Collect the details
The court's name and address, the case number and the CNR number if you have it, the date of the decree, the date it became final, and your marriage registration number if the marriage was registered under the Code.
Step 3: Apply on the state portal or to the Sub-Registrar
Use the service for registration of divorce on ucc.uk.gov.in, or give the form to the Sub-Registrar. Either spouse can apply alone, or both together.
Step 4: Upload the papers
A duly attested copy of the order and decree, the final order of the appeal court if there was an appeal, a self-declaration that the decree is final, and the children's birth certificates if there are children.
Step 5: Answer any query in time
The Sub-Registrar checks the decree against the court's online records and may ask for more. Reply within five days.
Step 6: Collect the acknowledgement certificate
The Sub-Registrar is to decide within 15 days, by issuing an acknowledgement certificate or a reasoned rejection, which can be appealed to the Registrar within 30 days.
Registering the decree does not change your name. It records the divorce with the state. But the acknowledgement certificate is a second official paper that shows you are divorced, and it is useful to carry with the decree.
Decree Route or Gazette Route: Which One Is Yours?
| Point | Decree route | Gazette route |
|---|---|---|
| Main proof | The certified decree of divorce | A Gazette change of name notification |
| Fits when | You are going back to your maiden name, and the decree is final | You want a new name, an office refuses the decree, or your papers cannot be linked |
| Cost | Certified copies, and each office's own fee | Usually Rs 2,500 to Rs 6,000 in all, self-done |
| Time before updates can start | As soon as the decree is final and in your hand | Commonly 3 to 7 weeks |
| Accepted | By the offices that list a decree as proof | Everywhere, for the Gazette of India |
A simple test
- Is your decree final, with a certified copy in your hand?
- Are you going back to the exact name on your school certificates?
- Do your papers show how the married name and the maiden name are linked?
Three times yes: start with the decree route. Any no: read the section on when you need a Gazette. Either way, we will tell you which route fits before you pay anything.
How Do You Take Back Your Maiden Name With the Decree?
You take the certified decree to each office as proof. There is no newspaper notice and no Gazette fee on this route.
Step 1: Get certified copies of the decree
Ask the court for several. Check your name and the case details on them.
Step 2: Register the decree with the state
Do this within the time limit, and keep the acknowledgement certificate with the decree.
Step 3: Fix the exact name you are going back to
Use the spelling on your class 10 certificate, so your degrees and your identity papers agree again.
Step 4: Update Aadhaar first
Visit an Aadhaar Seva Kendra with the decree and proof of your maiden name. UIDAI's own answer on name changes lists a divorce decree among the supporting documents.
Step 5: Update PAN
File the PAN correction application once Aadhaar shows the new name. Never apply for a second PAN.
Step 6: Update the bank, then the passport and the rest
Take the updated Aadhaar and PAN and the decree to your branch. Then apply for a passport re-issue, and update the voter ID, driving licence and employer records.
If an office asks for more than the decree, ask it to say in writing what it wants. A written answer tells you if a Gazette is truly needed, or only one more supporting paper.
When Do You Need a Gazette After Divorce?
A new name altogether
You want neither the married name nor the maiden name. A decree does not prove a name you have never held.
An office refuses the decree
An employer, a bank or another office says in writing that it wants a Gazette notification.
The papers cannot be linked
The decree carries only your married name, and you have nothing else that shows the two names are one person.
Your first name changed at marriage
You were given a new first name then and want the old one back. That is more than a surname.
Several names are in use
Papers from before, during and after the marriage carry different names, and you need one notice to tie them together.
Papers for use abroad
A visa or a foreign office wants one clear proof of the name that it can verify.
If none of these describes you, you probably do not need a Gazette, and you do not need us. We would sooner say that on the phone than take a fee for a notification you could have done without.
What Does Each Office Ask for After Divorce?
This is the usual position for a woman going back to her maiden name with a final decree. Each office keeps its own list and can change it, so check that office's current list before you go.
| Office | With a certified, final decree | When a Gazette helps |
|---|---|---|
| Aadhaar | A divorce decree is on UIDAI's list of supporting documents for a name change | A new name, or names that the decree does not link |
| PAN | Correction application with the updated Aadhaar and proof of the change | Where the decree is not accepted as proof |
| Bank | Updated Aadhaar and PAN, the decree and the bank's request form | Where the branch asks for it |
| Passport | Re-issue with the papers on the Passport Seva list for a change after divorce | Check the list for your case |
| Voter ID | Form 8 with proof of the change | Rarely |
| Employer and service record | Ask the establishment section | Often asked for in Government service |
| Degrees and marksheets | Nothing. They are already in your maiden name | Not needed |
The last row is the good news of going back. Your school and college certificates never changed, so once your identity papers return to the maiden name, everything you own agrees again.
How Does the Central Gazette Route Work After Divorce?
Use this where the decree route does not fit. The notice goes in Part IV of the Gazette of India, which is accepted across the country.
Step 1: Confirm that you need it
Check your case against the list above, or get the refusing office to say in writing that it wants a Gazette.
Step 2: Read the Department's guideline for your case
The Department of Publication publishes a guideline for a change of name, and lists separate guidelines for some surname cases, including one on adopting a maiden surname. Read the one that fits before you prepare anything.
Step 3: Publish the newspaper notice
Print the change in a daily local leading newspaper, with your father's name and your address. Keep the original newspaper.
Step 4: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and an undertaking showing the old and the new name.
Step 5: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 6: Pay the charge on BharatKosh
Confirm the charge for your wording, pay online and print the receipt. It is not refunded.
Step 7: Send the file yourself
In person or by post, with a request letter, to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. We add a copy of the decree as supporting proof, though the Department's list does not ask for it.
Step 8: Download the Gazette
Check Part IV on egazette.gov.in each week and download the PDF.
The full route is on our gazette name change in Uttarakhand page.
Can You Use the Uttarakhand Gazette After Divorce?
The state Gazette is printed by the Government Press at Roorkee, which sets its own practice. It can serve where every record you own stays inside the state.
Step 1: Ask where the name will be used
For a passport, a central job or a move out of the state, choose the Gazette of India.
Step 2: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 3: Ask for the papers, the format and the fee
Ask if the press wants a copy of the decree, and how the fee is paid.
Step 4: Publish the notice and submit the file
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
Many women move after a divorce, for work or to a parent's home. If that is likely, read Uttarakhand Gazette vs Gazette of India before you choose the state route.
Which Wording and Charges Matter in a Gazette Notice After Divorce?
A notice for going back to a maiden name follows the change of name specimen. This is an illustration, with made-up names.
I hitherto known as KAVITA NEGI, daughter of Shri MOHAN SINGH BISHT, residing at 5, Subhash Nagar, Haldwani, District Nainital, Uttarakhand 263139, have changed my name and shall hereafter be known as KAVITA BISHT.
"Daughter of"
A divorced woman identifies herself by her father. The Department lists Rs 250 more where both "daughter of" and "wife of" are given in one notice, so use one.
Sign in the old name
The guideline says the form is signed in the old name. Here that is the married name, if your identity proof still carries it.
Marrying again
The Department's list of additional charges has its own entry for re-marriage after divorce with a change of name, at Rs 1,100 more. Ask the Department how your case is counted before you pay.
Several names in use
Where papers carry the maiden name, the married name and perhaps a third, the old names can be joined with an alias, at Rs 250 for each. See alias name in a gazette notification.
A plain change of name notice like this one gives no reason and does not mention the divorce. What is printed is the two names, your father's name and your address.
What About Your Children's Names?
Your decree does not change your child's name, and your own change of name does not carry over to the child. A child's name is a separate matter with its own papers.
- For a child under 18, a Gazette change of name is applied for by the parents or the legal guardian.
- Where only one parent applies, a custody or guardianship order is needed.
- If the parents do not agree about the child's surname, that is for the court to settle, not the Gazette office.
- A mother's name in the child's records can stay as it was at the time. If you take back your maiden name, keep the decree with the child's papers to explain the difference.
Ask your lawyer what your decree and custody order allow before you plan any change to a child's name. Once that is clear, we can prepare the papers.
What Does a Name Change After Divorce Cost, and How Long Does It Take?
| Item | Decree route | Central Gazette route |
|---|---|---|
| Certified copies of the decree | The court's copying charge | The same |
| Registering the decree with the state | The fee shown on the portal | The same |
| Newspaper notice | None | Rs 800 to Rs 4,000 |
| Gazette charge | None | Commonly Rs 1,100 for an adult, more for some wordings |
| Each record update | That office's own fee | That office's own fee |
| Time before updates can start | Once the decree is final | Commonly 3 to 7 weeks more |
The Gazette charge is paid on BharatKosh, is revised from time to time and is not refunded. Our own charge, where we prepare a Gazette file, is quoted per case and shown as a separate line. For the decree route there is usually nothing for us to do, and nothing to charge.
The order of updates
On either route: Aadhaar first, then PAN, then bank accounts, insurance and investments, then the passport, then the voter ID, driving licence and employer records. Update your nominees at the same time. Many women find their former husband still named as nominee years later.
Which Mistakes Should You Avoid After Divorce?
| Mistake | How to avoid it |
|---|---|
| Starting updates before the decree is final | Wait until the time to appeal has passed |
| Using a plain photocopy of the decree | Get certified copies from the court |
| Not registering the decree with the state | Register it within the time limit under the Code |
| Paying for a Gazette when the decree would have done | Run the three-question test first |
| Going back to a spelling that differs from the class 10 certificate | Use the certificate's spelling |
| Updating the bank before Aadhaar and PAN | Keep the order |
| Changing a child's surname on the strength of your own decree | A child's name needs its own papers, and both parents or a court order |
| Leaving the former spouse as nominee | Update nominees with every account |
| Using the last Aadhaar name change without thought | Decide the final name before you go |
A typical case we handle: a woman in Dehradun wanted her maiden name back after her decree. She had been quoted for an affidavit, two newspapers and a Gazette. Her decree was final and named her with her father's name as well. She registered the decree on the state portal, updated Aadhaar with a certified copy, then PAN and the bank, and paid for no Gazette at all. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
Getting the decree, appeals, custody, maintenance and any order about a name are a lawyer's work. So is any case where a divorce was not granted by a court. We prepare Gazette papers after the court's part is done.
When you do not need us
If your decree is final and you are going back to your maiden name, you most likely need no Gazette and no service. Take certified copies to the Aadhaar Seva Kendra and work down the list. Call us if you want a new name, if an office has refused the decree, or if your papers cannot be linked.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. Your decree comes from the Family Court for your district, or from the District Court where there is no separate Family Court. Everything after that can be done from where you now live.
