Three names, three links • Changing is a choice • One Gazette can tie them together

Name Change After Remarriage in Uttarakhand

For a woman who marries again after a divorce or her husband's death, with papers scattered across a maiden name, a first married name and now a third: which certificates link them, when one Gazette notification is simpler, and what to check before changing anything.

Quick answer

A name change after remarriage is optional. Where a woman does take a new surname, the new marriage certificate links it to the name she had. Papers in an earlier name need the earlier links too: the first marriage certificate, and the divorce decree or the first husband's death certificate. One Gazette notification can state every name.

A woman in Uttarakhand laying out her two marriage certificates, Aadhaar card and degree in her maiden name to link her names after remarriage
Changing a name on remarriage is a choice, and where a link in the chain of certificates is missing one Gazette notification can state every name used.

A first marriage leaves a woman with two names across her papers. A second can leave her with three. A name change after remarriage is therefore less about the new name than about the chain behind it. This page explains name change after remarriage for women in Uttarakhand, and what a man who remarries has to update as well.

We prepare the Gazette notification, which is one way to tie several names together. This page is general guidance, and parts of it touch family law and pension rules, on which a lawyer or the pension office should advise. For a first marriage, read name change after marriage in Uttarakhand.

Which Three Names, and Where Does Each Sit?

The three names a remarried woman may carry and the papers each usually sits on
NameExamplePapers usually still in it
Maiden nameRekha BishtBirth certificate, class 10 and later certificates, degree, sometimes PAN
First married nameRekha NegiAadhaar, bank accounts, passport, the children's records, property bought in that marriage
New married nameRekha RawatThe new marriage certificate, and whatever she updates from now on
  • Education certificates are not reissued in a married name. They stay in the maiden name for life.
  • So even a woman who changes everything she can ends with at least two names on her papers, and needs a link between them.
  • Some women went back to the maiden name after a divorce. For them the chain has four steps, not three.

Write your own table before doing anything: every paper you hold, and the name on it. It usually takes ten minutes and saves weeks.

Does She Have to Change Her Name at All?

No. No law makes a woman take a husband's surname, at a first marriage or a second. She can keep the name she has, whichever it is.

Keeping the present name

  • Nothing has to be re-made
  • Her papers stay as consistent as they were
  • The new marriage certificate shows her husband, where an office asks
  • The first husband's surname stays on her papers, which some women do not want

Taking the new surname, or the maiden name again

  • Every identity paper has to be updated, in order
  • The chain behind the new name has to be kept ready
  • Her children's records will show a mother's name different from hers, unless explained
  • It is a clean break from the earlier name

A third course is to return to the maiden name, which already matches her education certificates. Many women find that the simplest end state. Read is a name change compulsory after marriage.

What Is the Order of Work?

Step 1: List every paper and the name on it

Identity, money, property, education, pension and the children's records.

Step 2: Decide the name you will use from now on

The present one, the new surname or the maiden name. Decide once.

Step 3: Collect the links

Both marriage certificates, and the decree or the death certificate. Note which is missing.

Step 4: Ask the pension office and any benefit office first

Where you draw a family pension or a widow's benefit, find out what remarriage does to it before you report anything else.

Step 5: If a link is missing, or the new name is not a husband's surname, get the Gazette

Naming every form you have used.

Step 6: Update Aadhaar, then PAN

Each on the new marriage certificate or the Gazette, with the chain.

Step 7: Update the bank, the passport and the employer

Including a private employer's records, with the spouse's name where the record carries one.

Step 8: Renew every nomination, and read your will

Old ones may still name the first husband or his family.

When Is One Gazette Notification Simpler?

  • Where a link is missing. A first marriage that was never registered, or a decree that cannot be traced, leaves a gap no certificate fills.
  • Where the chain is long. Four names and four certificates will be read correctly by a patient officer and wrongly by a hurried one.
  • Where the new name is not a husband's surname. A return to a maiden name, or a fresh name, is a change by choice.
  • Where a paper has to be shown abroad, or to an office far from the state, that cannot weigh local certificates.

A notification can state the present name and each earlier name as an alias, so that one page says "formerly known as" for all of them. It records the change of name only. It does not prove a marriage, a divorce or a death, and the certificates are still needed where those facts are in question. Read alias name in a gazette notification.

What About the Passport, and the Spouse's Name?

  • A passport carries the holder's name and, in its records, the spouse's name. Remarriage changes the second even where the first stays.
  • The passport office asks for proof that the earlier marriage ended, and proof of the new one. Read the passport rules' current list for a change in a spouse's name on remarriage.
  • A change of the holder's own surname is asked for in the same reissue application.
  • Apply for reissue well before any travel. A passport with a former husband named in its records raises questions at a visa desk.
  • Children's passports name their parents. A mother's changed name is updated in theirs at their next reissue, on the chain.

What Happens to Family Pension and Other Benefits?

This is the part to get advice on before anything else. We do not advise on pension rules.

  • A widow drawing a family pension, a widow's pension from the state, or a benefit as a deceased employee's dependant holds it on conditions. Remarriage is commonly one of them.
  • The rules differ between central and state service, the forces, banks and welfare schemes, and some treat a childless widow differently. Ask the office that pays it, in writing, what remarriage does to the benefit and to the children's share.
  • Remarriage has to be reported to that office. Drawing a benefit after it has ceased leads to recovery, and worse.
  • A job given on compassionate grounds, a ration card category and a health scheme card may each carry their own condition.
  • A change of name does not alter any of this in either direction. The fact of remarriage does.

Read name change in pension and family pension records.

What About Children From the First Marriage?

  • A child's name does not change because the mother's does. Their birth certificates and school records stay as they are.
  • Their records name their father. A stepfather does not become the father on paper by marrying the mother. That happens only through adoption, which has its own law and procedure.
  • The mother's name on the children's records will now differ from her present name. Her chain of certificates, or her Gazette notification, explains it.
  • A change of a child's surname is a separate decision. For a minor it needs the parents' consent as the rules require, and where the father is living and does not consent, it becomes a matter for a court.
  • Do it, if at all, before class 10, and think about what the child will want at eighteen.

Read child surname change after divorce and name change after adoption.

What About Nominations, Property and a Will?

  • Nominations on bank accounts, insurance, provident fund and investments made during the first marriage may still name the first husband, or his relatives. A nomination is not usually cancelled by a divorce or a remarriage, though some funds treat an old one as void on marriage. Either way, make fresh ones.
  • Property in her first married name stays hers. The deed is not re-made. The chain, or the Gazette, links it to her present name when she sells or mortgages.
  • Property inherited from the first husband raises questions of succession, not of names. See a lawyer.
  • A will made before the remarriage should be read again, for the names in it and for what it now means.
  • Joint accounts and loans with the first husband have to be closed or changed with the bank, on the decree or the death certificate.

Read nominee name mismatch in a claim, name change in property documents and will and probate name mismatch.

What Does a Man Who Remarries Have to Update?

  • His own name does not change, so his identity papers stay as they are.
  • The spouse's name does, in his passport records, his service record, his provident fund and pension nomination, and his insurance.
  • Each asks for proof that the first marriage ended and proof of the second.
  • A Government employee reports the marriage to his office under the service rules.
  • His children's records name their mother. They do not change.

No Gazette is involved for him, unless he also changes his own name.

How Does the Central Gazette Route Work?

Use this where a link in the chain is missing, where you are returning to a maiden name or taking a fresh one, or where you want one paper stating every name you have used.

Step 1: Check which links you hold

If both marriage certificates and the decree or death certificate are in hand, and the new name is your husband's surname, you may not need this.

Step 2: Fix the exact new name, and list every earlier name

Each as it appears on some paper, letter by letter.

Step 3: Make the affidavit

State the earlier names, the new name, your husband's or father's name and your address. Sign before a notary.

Step 4: Publish the newspaper notice

In a daily local leading newspaper. Keep the original newspaper.

Step 5: Type the form and sign the undertaking

Two typed copies of the specimen, signed in your present name with two witnesses, and the undertaking.

Step 6: Prepare the CD, photographs and certificate

The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.

Step 7: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult, with Rs 250 more for each alias. It is not refunded.

Step 8: Send the file yourself, then update in order

Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. With the published Gazette, update Aadhaar, PAN, the bank and the passport.

Would the Uttarakhand Gazette Do?

Offices in the state may accept it. The passport, PAN and banks are the reasons to prefer the Gazette of India.

Step 1: List the offices you have to satisfy

Passport, PAN, banks, an employer, a pension office.

Step 2: Ask the strictest of them which Gazette it accepts

Usually the passport office.

Step 3: Contact the Roorkee press

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.

Step 4: Ask for the papers, the format and the fee, and submit

Keep photocopies of everything.

Step 5: Download the notice

Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do People Make?

Common mistakes with a name change after remarriage
MistakeWhat to do
Changing a name because it is assumed to be requiredIt is a choice. Decide first
Showing only the new marriage certificate for a paper in the maiden nameCarry the whole chain
Not registering the new marriageRegister it
Updating Aadhaar and stopping thereCarry it through PAN, the bank and the passport
Not telling the pension office about the remarriageAsk it in writing what changes, and report
Leaving old nominations in the first husband's nameMake fresh ones
Putting the stepfather as father on a child's recordsThat needs adoption, not a correction
Expecting a Gazette to prove a divorce or a marriageIt records a name only
Throwing away the earlier certificatesKeep every link for life

A typical case we handle: a schoolteacher in Haldwani, widowed young, married again some years later. Her degrees were in her maiden name, her Aadhaar, bank account and service record in her first husband's surname, and she wished to use her second husband's. Her first marriage had never been registered. With no certificate for that step, each office asked for something different. We prepared one Gazette of India notice stating her present name and both earlier ones, and she used it with her new marriage certificate everywhere. She took her department's advice on her service matters separately. This is an illustrative example of the type of case we handle, not a named client review.

What is a lawyer's or a pension office's job, not ours

Divorce, a child's custody or surname where a parent objects, adoption, succession to a first husband's property, and what remarriage does to any pension or benefit.

When you do not need us

If you are keeping your present name. And if you are taking your husband's surname with every certificate in hand. We are useful where a link is missing, the chain is long, or the new name is one no certificate gives you.

Name Change After Remarriage: The Short Version

Changing a name on remarriage is a choice. If you do, the new marriage certificate links the new surname to your last name, and the earlier certificates link the rest. Where a link is missing, or you are returning to a maiden name, one Gazette notification can state every name. Ask the pension office what remarriage changes before reporting anything. Renew every nomination.

A child's surname is a separate matter. To find out if your case needs a Gazette, message us on WhatsApp 9540005064, and we will reply in working hours.
