Name Change Affidavit for a Minor in Uttarakhand

The affidavit parents make for a child's change of name: who signs it, what it must say, a sample format, where to get it notarised and what it cannot do alone.

Quick answer

A name change affidavit for a minor is a sworn statement made by the parents or the legal guardian, because a child under 18 cannot make one. It gives the child's old name, new name and date of birth, and is signed by both parents before a notary. It supports the Gazette step. It is not proof by itself.

Both parents in Uttarakhand signing a name change affidavit for their minor child before a notary
A minor cannot swear an affidavit, so both parents or the legal guardian sign it before a notary; it starts the Gazette step but is not proof by itself.

A name change affidavit for a minor is the first paper in a child's change of name, and the one where most files go wrong, usually because only one parent has signed. This page explains the name change affidavit for a minor in Uttarakhand: who signs, what it must say, a sample format and what follows it.

For the whole process for a child, read minor name change in Uttarakhand. For stamp paper and the notary in general, see name change affidavit in Uttarakhand.

What Is a Name Change Affidavit for a Minor?

It is a written statement, sworn before a notary public, in which the parents declare that they are changing their child's name. It is typed on non-judicial stamp paper.

It differs from an adult's affidavit in three ways.

  • The parents speak, not the child. A person under 18 cannot swear an affidavit, so the parents or the legal guardian make it for the child.
  • Two people usually sign. Where both parents are alive, both sign.
  • It identifies the child. It carries the child's date of birth and, usually, the birth certificate number.
A false statement in an affidavit is an offence. Do not state that the other parent consents unless he or she has signed, and do not leave a living parent out.

Who Signs a Minor's Affidavit?

Who signs the name change affidavit for a minor
Family situationWho signsWhat goes with it
Both parents, living togetherBoth, on one affidavitIdentity proof of both
Both parents, in different townsOne on the main affidavit, the other on a separate consent affidavitIdentity proof of both
One parent has diedThe surviving parentThe death certificate
Parents divorced or separatedBoth, or one with a court orderThe custody or guardianship order
Child with a legal guardianThe guardianThe guardianship order
Adopted childThe adoptive parentsThe adoption deed or order

The child does not sign. An older child's wish matters a great deal in the family's decision, but it is not recorded by a signature on the affidavit.

If the other parent refuses, or cannot be found, the answer is a court order and not a cleverly worded affidavit. See child surname change after divorce.

When Is the Affidavit Needed, and When Is It Not?

It is needed when

  • You are changing the child's name through the Gazette
  • A school asks for an affidavit with its own form for a change in its register
  • An office asks for the parents' statement on oath

It is usually not needed when

Ask the office first. Some have their own format, and a general affidavit will not replace it. The Registrar of births and Passport Seva both use their own forms and declarations.

What Must a Minor's Affidavit Contain?

Step 4: Type the draft and read it aloud

Check the child's old name and date of birth against the birth certificate, one letter at a time.

What Can a Minor's Affidavit Not Do?

It cannot

  • Change the child's name in Aadhaar, a board record or a passport by itself
  • Stand in for the Gazette where a Gazette is asked for
  • Stand in for the other parent's signature or a court order
  • Alter the birth register

It can

A shop that calls the affidavit a "name change certificate" for your child is misdescribing it. For a real change of name, the Gazette notification is the proof offices rely on.

What Comes After the Affidavit on the Central Gazette Route?

The notice goes in Part IV of the Gazette of India.

Step 1: Publish the newspaper notice

Print the child's change of name in a daily local leading newspaper, with the parent's name and address, in the same words as the affidavit. Keep the original newspaper.

Step 2: Type the minor's form

Two typed copies of the Department's specimen for a minor. The parent or guardian signs, with two witnesses.

Step 3: Prepare the CD and the certificate

The same text on a CD in MS Word, and a certificate that the hard and soft copies match.

Step 4: Add the supporting papers

The child's birth certificate and photographs, the parents' self-attested identity proof, and any court order.

Step 5: Pay the minor's charge on BharatKosh

Commonly Rs 1,700. Confirm it before you pay. It is not refunded.

Step 6: Send the file yourself

In person or by post, with a request letter, to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054.

Step 7: Download the Gazette

Check Part IV on egazette.gov.in each week and download the PDF.

The Department publishes a separate guideline for a minor. Read the current one before you file.

What Comes After the Affidavit on the Uttarakhand Gazette Route?

The Government Press at Roorkee sets its own practice. For a child, the Gazette of India is usually the safer choice.

Step 1: Think about the child's future

For college, a passport or a job outside the state, choose the Gazette of India.

Step 2: Contact the Roorkee press

Take the contact from govtpress.uk.gov.in and ask if a private notice for a minor is being accepted.

Step 3: Ask what it needs

Ask if it wants the parents' affidavit, in which language, and the fee.

Step 4: Publish the notice and submit the file

Keep photocopies of everything.

Step 5: Download the notice

Search gazettes.uk.gov.in and save the PDF.

To weigh the two, read Uttarakhand Gazette vs Gazette of India.

Which Mistakes Do Parents Make With the Affidavit?

Common mistakes in a name change affidavit for a minor
MistakeWhat to do
Only one parent signsBoth sign, or add a consent affidavit or a court order
The child's old name is typed from memoryCopy it from the birth certificate
The date of birth differs from the school recordSort that out first, at the school or the Registrar
The adult format is used, with the child as "I"The parents are the ones who declare
The child is made to signA minor does not sign an affidavit
Signed at home, then taken for a sealSign in front of the notary
The two parents' affidavits use different spellingsType both from one draft
Stopping at the affidavitGo on to the newspaper notice and the Gazette

A typical case we handle: a mother in Haldwani made an affidavit for her son's change of name while the father was posted in another state. Only she had signed, and the file could not go forward. The father signed a consent affidavit before a notary where he was posted and sent the original by post. With both on record, the Gazette file was complete. This is an illustrative example of the type of case we handle, not a named client review.

When you do not need us

A typist and a notary at any court can make this affidavit from the samples on this page. If the Registrar or the school is correcting its own record, you may not need an affidavit at all. We are useful when the parents are in different places, when a court order is involved, or when you want the whole Gazette file prepared. Our charge is quoted per case.
