Guardian's Name in a Child's Documents in Uttarakhand: Children Raised by Grandparents
For grandparents and relatives raising a child while the parents work far away, or after the parents have died: who is a guardian in law, which box each name goes in, what to do where a grandparent was written as the father, and when a court's order is needed.
A guardian's name in a child's documents goes in the guardian's box, never in the father's or mother's. The parents' names stay as the birth certificate gives them. A grandparent acts on the living parents' written authority, or on a court's guardianship order where both have died. No Gazette is needed for any of this.

In village after village in the hills, the children are with their grandparents. The parents are in Delhi, in the plains or in the Gulf, or they are gone. The grandfather takes the child to school and signs. This page explains where a guardian's name in a child's documents belongs, and what goes wrong when a guardian's name in a child's documents is written as a parent's.
We prepare Gazette notifications for a change of name, and this subject needs none. We wrote the page since families bring us the tangle it leaves. Who is a natural guardian is from the published text of the Hindu Minority and Guardianship Act, 1956. For a single mother's position, read a single mother’s child and the father’s name.
Why Are So Many Children With Grandparents?
- Work elsewhere. A father, and often both parents, earn in a city or abroad, and the child stays in the village.
- Schooling. A child is sent to a town to study, and lives with an uncle or an aunt.
- A death. One parent or both have died, by illness, on the road, or in service.
- A broken marriage. A parent has left, and the other cannot manage alone.
- The daily fact. In each case another adult feeds the child, pays the fees and signs the forms.
That adult is doing a parent's work. On paper, though, a caretaker and a guardian are two things, and neither is a parent.
Who Is a Guardian in Law?
From the published text of the Hindu Minority and Guardianship Act, 1956, and the foreign ministry's announcement of passport rules in December 2016. Other communities have their own personal law.
| Point | What the Act or the rules say |
|---|---|
| Natural guardians | For a boy or an unmarried girl, the father, and after him, the mother |
| Step-parents | The words father and mother do not include a stepfather and a stepmother |
| Other guardians | A guardian appointed by the will of the minor's father or mother, or a guardian appointed or declared by a court |
| Grandparents | Not named among the natural guardians |
| The other Act | The Act of 1956 is in addition to the Guardians and Wards Act, 1890, under which courts appoint guardians |
| A passport | The application asks for the name of father or mother or legal guardian |
So a grandmother who has raised a child from birth is, in law, a relative with whom the child lives. She becomes a guardian by a parent's will or a court's order. Until then she acts with the parents' authority, or by the kindness of the office in front of her.
Which Box Does Each Name Go In?
| Paper | Parents' names | A grandparent's name |
|---|---|---|
| The birth certificate | Always the parents | Nowhere, except as the person who reported the birth |
| The school admission record | In the father's and mother's boxes | As local guardian, where the form has that box |
| The child's Aadhaar | As the centre records them | As the guardian who signs, where the centre accepts one |
| The ration card | Not shown as such | As head of the household the child is listed in |
| A minor's bank account | A parent as guardian, by default | As guardian, on the bank's rules or a court's order |
| The passport | One parent's name is enough | As legal guardian, with the paper that shows it |
| Caste and residence certificates | The father's, or the parents', particulars | As a relative whose papers show the family |
Forms have two kinds of box. One asks who the child's parents are, which is a fact of birth. The other asks who is acting for the child, which is a fact of today. Trouble begins when one name is written in both.
What Are the Three Situations?
Parents alive, and away
- The parents remain the guardians
- The grandparent acts on their authority
- A letter for the school. The parents' own signatures for the large things
One parent has died
- The surviving parent is the guardian
- If that parent is away, as above
- The late parent's name stays on every paper
Both parents have died
- No natural guardian is left
- A grandparent is a guardian only by a parent's will or a court's order
- Small things pass without one. A bank, a passport and property do not
The first is by far the commonest, and needs only good housekeeping. The third needs a lawyer early, before a crisis forces it.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The school wrote the grandfather as father | A correction in the school record, on the birth certificate | No |
| The child's Aadhaar names a grandparent as parent | Ask the centre to correct it, on the birth certificate | No |
| The parents are away, and the school wants a signature | The parents' written authority to the grandparent | No |
| The parents are away, and a passport is wanted | The parents apply or consent, as the form requires | No |
| One parent has died | The other acts, with the death certificate | No |
| Both parents have died, and a bank or a passport is in question | A guardianship order from the court | No |
| A birth was never registered, and the parents are gone | Late registration, with the parents named as they were | No |
| The child is to take a new name or surname | A minor’s change of name, by a parent or a guardian with the paper to show it | Yes |
A Gazette appears once in eight rows, and it is for the child's own name. Guardianship is never made or shown by a Gazette.
How Do You Put the Child's Papers in Order?
This is the general method. Each office has its own form and its own idea of a guardian.
Step 1: Take out the child's birth certificate
It names the parents. That entry is the fixed point, whoever is raising the child.
Step 2: Write down where the parents are
Alive and away, one dead, or both dead. The route differs for each.
Step 3: Read every paper of the child's for the parents' names
The school record, Aadhaar, the ration card. See if a grandparent has been written in a parent's place.
Step 4: Have a wrong parent's entry corrected
At the school or the office concerned, on the birth certificate and the parents' own papers.
Step 5: Where the parents are alive, get their written authority
A letter or a sworn paper saying the grandparent may act for the child, with copies of their identity papers.
Step 6: Where both parents have died, collect their death certificates
And ask a lawyer about a guardianship order, before a bank, a passport or property is in question.
Step 7: Give each office the right paper for its box
A parent's name in the parent's box. The grandparent's in the guardian's box, with the paper that supports it.
Step 8: Keep the child's file together
Birth certificate, the parents' papers or death certificates, the authority or the order.
What If a Grandparent Was Written as Father or Mother?
- A grandfather takes a child for admission. The clerk asks "father's name?" and writes down the man in front of him.
- Or the family says it on purpose, thinking it simpler, since the old man will be signing everything.
- The school record now names a father who is not the father. It will not match the birth certificate or any later paper.
- From the school it goes to the board, and onto a class 10 certificate that lasts for life.
- It is corrected at the school, on the birth certificate and the real parents' identity papers. The earlier it is caught, the easier.
- This is a correction of a parent's name in the child's record. It is not a change of anybody's name, and no Gazette is involved.
A wrong parent on a certificate has consequences far from school: a caste certificate, a passport, an inheritance. Read father’s name change and correction, mother’s name change and correction and father’s name correction in an Uttarakhand Board marksheet.
What If the Parents Are Alive, and Away?
- The parents are the child's guardians, wherever they live. A grandparent is their stand-in.
- For the school, a letter from the parents naming the grandparent as local guardian is usually enough.
- Give the school the parents' phone numbers as well as the grandparent's. Notices should reach both.
- For a passport, a bank account or a hospital consent, expect to be asked for a parent's own signature.
- Parents abroad can sign before the Indian mission there, or send a sworn authority. Ask the office what form it accepts.
- Renew the letter every year or two. A school secretary changes, and an old letter is doubted.
Read child name change in school records, name change for NRIs from Uttarakhand and power of attorney name mismatch.
What If Both Parents Have Died?
- The child's papers go on naming the parents. Nothing is removed, and no one is written in their place.
- Keep both death certificates with the child's birth certificate. Together they explain every blank signature.
- A school will usually carry on with the grandparent as guardian, on those papers.
- For money and for a passport, an office will want a legal guardian. Under the Act that means one named in a parent's will or appointed by a court.
- A grandparent applies to the court for a guardianship order, through a lawyer. It names the guardian and says what he or she may do.
- Do it while the grandparent is in good health. An order in the name of someone who then dies has to be sought again.
We could not confirm the state's present schemes for orphaned children. Ask the district's child welfare office. Read name correction in a death certificate and legal heir certificate.
What About a Bank Account, Benefits and Property?
- A minor's bank account is opened and run by a guardian. Banks take a parent readily. For anyone else they follow their own rules, and may ask for a court's order.
- A pension, compensation or insurance paid to a child after a parent's death is released to a guardian the payer recognises.
- Property that comes to a child cannot be sold or mortgaged by a relative. Even a parent may need a court's leave for that.
- A scholarship or a benefit is credited to the child's own account, opened with a guardian.
- Each of these reads the guardian's name against identity papers, and against the paper that makes him or her the guardian.
- A grandparent's own name should be the same on all of them. An old man with three spellings is asked to prove himself at each counter.
Read name change in PPF and Sukanya Samriddhi accounts, which covers a guardian's name on a child's account, and name change in pension and family pension records.
What Happens When the Child Turns 18?
- Guardianship ends at 18. The young adult signs for himself or herself from that day.
- A minor's bank account is converted, with the account holder's own signature and KYC.
- Aadhaar is updated with the person's own mobile number, and biometrics where the centre asks.
- The parents' names on the papers stay as they are, for life.
- Any wrong parent's entry not corrected in childhood is now the adult's own to correct, and harder.
- A young person who wants a different name can then change it in his or her own right.
Read signature change after name change and name change in Aadhaar card.
What About the Child's Own Name?
A Gazette comes in only if the child's own name or surname is to change. A grandparent can apply for that only as a guardian with the paper to show it, or with the parents.
Step 1: Confirm what is to change
A child's own name or surname is changed by Gazette. A parent's or guardian's entry is not.
Step 2: See who can apply for the child
The guideline asks for the parents or a guardian. A grandparent applying should hold the paper that makes him or her the guardian.
Step 3: Fix the child's exact new name
The spelling that will go on the birth record, Aadhaar and the school.
Step 4: Make the affidavit and publish the newspaper notice
As the child's parent or guardian. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form for a minor, and sign the undertaking
Two typed copies of the specimen for a minor, signed with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,700 for a minor. It is not refunded.
Step 8: Send the file yourself, then update the child's records
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054.

Which Gazette Should You Use?
A child's papers are read for decades and far from home. The Gazette of India is the one to prefer.
Step 1: Think about where the child will study
A board and a university outside the state may read the paper.
Step 2: Prefer the Gazette of India
It is the one recognised across the country.
Step 3: A state notice may serve the school and the tehsil
Ask them first.
Step 4: Contact the Roorkee press only if a state notice suits you
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
To weigh the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do Families Make?
| Mistake | What to do |
|---|---|
| Writing a grandparent as father or mother | Never. Parents in the parents' box |
| Thinking a ration card makes the grandfather a guardian | It shows a household, nothing more |
| Admitting the child without the birth certificate | Take it to the school |
| Leaving a wrong entry until class 10 | Correct it in the school years |
| Parents away, and no written authority left behind | Leave a signed letter, and renew it |
| Both parents dead, and no guardianship order | See a lawyer before it is urgent |
| Calling an informal arrangement an adoption | Adoption has its own law |
| Asking for a Gazette to make someone a guardian | Only a will or a court does that |
| A grandparent's name spelt three ways | One form, on every paper |
A typical case we handle: a boy in Bageshwar had been raised by his grandfather since he was three. His parents worked in a factory in Gujarat. At admission the school had entered the grandfather, "Govind Singh", as father. In class 9 the boy's Aadhaar, which named his real father "Kundan Singh Koranga", did not match the school's list for the board. A relative asked us for a Gazette to "change the father's name". No Gazette does that. The school corrected its record on the birth certificate and the father's Aadhaar, and entered the grandfather as local guardian. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
A guardianship order, a child's property, adoption, and any dispute over who should have the child.
When you do not need us
For everything about a guardian's or a parent's entry. The school, the centre and the court settle those. We are useful only where the child's own name is to change and a Gazette notification is needed.

All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. A school record is corrected at the school. Send photos of the birth certificate and the paper that differs on WhatsApp, and we will tell you where to go.
People Also Ask About a Guardian's Name on a Child's Papers

Yes, by a parent's will or a court's order.
Can a grandfather's name be written as father in school?
No. He is entered as guardian.
Who is the natural guardian of a Hindu minor?
The father, and after him the mother.
How do I correct a guardian written as father in school records?
At the school, on the birth certificate.
Is a gazette needed to add a guardian's name?
No. A Gazette is for the child's own name.
Can a passport show a legal guardian?
Yes. The rules ask for a parent or a legal guardian.
Which court do grandparents apply to for guardianship?
An application for guardianship of the child's person is made to the District Court where the minor ordinarily resides, under section 9 of the Guardians and Wards Act, 1890. For property, it may also be made where the child has property.
What does the court look at when appointing a guardian?
The welfare of the minor is the paramount consideration in appointing or declaring a guardian. Courts have held that this includes where the child actually lives.
Who has custody of a child under five?
The Act says the custody of a minor who has not completed five years shall ordinarily be with the mother. Courts treat this as a presumption that can be displaced.
Can a guardian sell a child's land?
Not freely. A natural guardian needs the court's previous permission to mortgage, charge, sell or lease any immovable property of the minor. The court applies the procedure of section 29 of the Guardians and Wards Act.
Can a parent name a guardian for the child in a will?
Yes. The Act lets a Hindu parent entitled to act as natural guardian appoint a guardian for the minor by will. This is the simplest way to settle who will look after a child raised by grandparents.
Can an older brother or sister below 18 act as guardian?
No. A minor is incompetent to act as guardian of the property of any minor. An elder sibling can sign for the child only after turning 18 and being made guardian.

That the natural guardians of a Hindu boy or unmarried girl are the father and after him the mother, that a stepfather and stepmother are not included, the other kinds of guardian, and that the Act is in addition to the Guardians and Wards Act, 1890, are from the published text of the Hindu Minority and Guardianship Act, 1956. That a passport application asks for a parent or a legal guardian is from the foreign ministry's announcement of December 2016. We did not read the Guardians and Wards Act, the law of other communities, any bank's rules on a minor's account, or the state's schemes for orphaned children. A Guardian's Name on a Child's Papers: The Short Version
A child raised by grandparents still has the parents named on the birth certificate, and every later paper follows it. The grandparent is written as guardian, never as father or mother. Where the parents are alive and away, the grandparent acts on their written authority. Where both have died, a court's order makes the guardian. A grandparent wrongly written as a parent is corrected at the school, early.
No Gazette is needed for any of that. To find out where to go, send photos on WhatsApp 9540005064, and we will reply in working hours.
