A Single Mother's Child: Documents and the Father's Name in Uttarakhand
For mothers raising a child alone, and for those children when grown, where a form asks for a father's name: what the courts and the passport rules say, which papers can be made in the mother's name alone, what a widow or a divorced mother should and should not ask for, and when the child's own name is changed.
A single mother's child can have papers in the mother's name alone. The Supreme Court has said a birth certificate is issued on a single mother's affidavit, and the passport rules ask for one parent's name. No Gazette is needed for that. A Gazette comes in only if the child's own name is changed.

Almost every form a child meets has a box that says "father's name". A mother raising a child alone meets that box at the hospital, the school, the Aadhaar centre and the passport office. A single mother's child is not without rights at any of them. This page explains what a single mother's child needs on paper, and what the law has said about the father's name.
We prepare Gazette notifications for a change of name. Most of what is on this page needs none, and some of it needs a lawyer. The court ruling is from published reports of the judgment, and the passport rule from the foreign ministry's announcement. For a father's name that is merely misspelt, read father’s name change and correction.
Who Is This Page For?
- An unmarried mother. The father was never part of the child's life, or of any paper.
- A mother who was left. The husband went away and has not been heard of.
- A divorced or separated mother. The child lives with her, by a court's order or by agreement.
- A widow. The father has died. His name is on the papers, and she now signs alone.
- A mother who adopted alone. The adoption paper names her as the only parent.
- The grown child. An adult whose papers have a blank, or a name he or she would rather not carry.
These are six different positions on paper, though the daily life may look the same. What one may ask for, another should not. The sections below keep them apart.
What Do the Court and the Rules Say?
From published reports of the Supreme Court's judgment of 6 July 2015 in a case on an unwed mother's guardianship, a High Court report that refers to it, and the foreign ministry's announcement of 23 December 2016.
| Point | What was held or announced |
|---|---|
| A birth certificate | Where a single parent or unwed mother applies for a birth certificate for a child born to her, the authorities may only require her affidavit to that effect, and must then issue it, unless a court directs otherwise |
| Guardianship | An unwed mother can apply to be her child's guardian without giving notice to the father or disclosing his identity, in suitable cases |
| The Registrars | A High Court report says the central Government directed all Chief Registrars that the single parent's name be written, and the other parent's left blank, where so requested |
| A passport | The application asks for the name of father or mother or legal guardian: only one parent, not both |
| On request | A passport can be issued where the name of either the father or the mother is not printed, at the applicant's request |
| After separation | The passport form does not require the name of a spouse from a separated or divorced person |
The principle behind all six is one. A child's papers need a parent. They do not need two, and they do not need the father in particular.
Where Is a Father's Name Asked For?
| Paper | What is asked | For a single mother |
|---|---|---|
| The birth certificate | Both parents' names | Issued on her affidavit, with the other column blank on request |
| The school admission | A parent or guardian | Follows the birth certificate. Ask the school which rule it applies |
| A child's Aadhaar | A parent or guardian who signs | The mother signs. Ask the centre what it records |
| The passport | One parent or a legal guardian | The mother's name alone |
| PAN | A parent's name | Ask what the present form allows. We did not confirm it |
| Caste and residence certificates | Usually the father's particulars | Decided on the facts. See the section below |
The first and the fourth rows rest on published law. The rest follow in practice from the birth certificate, which is why it comes first.
What Are the Three Positions?
No father was ever recorded
- The child's first papers are still to be made, or have a blank
- The mother wants them in her name alone
- Her affidavit, and the papers follow
The father is recorded, and stays
- A widow, or a separated mother who does not mind the entry
- She only needs to sign alone
- A death certificate or a custody paper, and nothing changes in the record
The father is recorded, and she wants him removed
- A divorced or deserted mother, or the grown child
- This is not a correction, since the entry was true when made
- A court's order, on a lawyer's advice
The first is settled law and a short visit. The second is no change at all. The third is the hard one, and no office will do it on an application across a counter.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| An unmarried mother, and a birth not yet registered | The Registrar, on her affidavit | No |
| A birth certificate with a blank father's column | Nothing to correct. Use it as it is | No |
| A widow whose child's papers name the late father | Nothing to change. She signs, with his death certificate | No |
| A passport for the child | An application with the mother's name alone | No |
| A school that insists on a father's name | The birth certificate, and a written question to the school | No |
| The child is to take the mother's surname | A change of the child’s name | Yes |
| A recorded father's name is to be removed | A court, on a lawyer's advice | No |
| A grown child wants a different name altogether | An adult's own change of name | Yes |
A Gazette appears in two rows of eight, and in both it is for the child's own name. No Gazette puts in, takes out or changes a parent.
How Do You Make the Child's Papers?
This is the general order, for a mother whose child's father was never recorded. Each office has its own form.
Step 1: Write down which of the three positions is yours
The father was never recorded. He is recorded and you want the entry left as it is. Or he is recorded and you want it removed.
Step 2: Start with the birth certificate
It is the first paper, and every later one is made from it.
Step 3: Where no father is to be shown, give your affidavit to the Registrar
Saying that you are the child's mother and a single parent. Ask for the father's column to be left blank.
Step 4: Take the birth certificate to the school
Ask for the admission record to follow it, with your name as parent.
Step 5: Make the child's Aadhaar on the same paper
With you as the parent who signs.
Step 6: Apply for the passport with one parent's name
The passport rules ask for the name of one parent, not both.
Step 7: Keep the papers that show you are the lawful guardian
A decree, a custody order, or an order of a guardianship court, where there is one.
Step 8: Use one form of your own name on every paper of the child's
A mother named three ways raises more questions than a blank column.
What About the Birth Certificate?
- A birth is registered by the Registrar for the place where the child was born: a municipal office in a town, the village office elsewhere.
- The Supreme Court held that a single parent or unwed mother need only give an affidavit that the child was born to her. The certificate is then issued, unless a court has directed otherwise.
- A High Court report records that Chief Registrars were told to write the single parent's name and leave the other blank, on request.
- A clerk who has not met this may still ask for a father's name. Ask, politely and in writing, for the request to be put before the Registrar.
- A birth registered late needs the papers for late registration as well. Those are about the date, not about the father.
- A certificate already issued with a father's name is a different matter. See the third position above.
Read name change in birth certificate and mother’s name correction in a birth certificate, since her own name has to be right on it.
What About School and Board Records?
- A school admits a child on the birth certificate, and copies the parents' names from it.
- Where the certificate has the mother alone, the admission record should too.
- The name a school enters travels to the board, and from there to the class 10 certificate, which lasts for life.
- So settle it at admission. Changing a parent's entry on a board certificate later is slow and governed by the board's own rules.
- Where a school's printed form has no way to leave the father's box empty, write to the principal and keep the reply.
- A scholarship or fee form that asks for a father's income can be filled for the parent the child lives with. Ask the office that runs it.
Read child name change in school records and CBSE and ICSE marksheet name correction.
What About the Passport?
- The rules announced in December 2016 say the application asks for the name of father or mother or legal guardian. One, not both.
- The announcement says this was meant to let single parents apply for their children.
- It also allows a passport on which the name of either parent is not printed, at the applicant's request.
- A separated or divorced person is not required to give a spouse's name on her own passport form.
- For a minor's passport the office asks who has the right to apply for the child. A mother applying alone should carry what shows it: the birth certificate, a custody order, or the declaration the form provides.
- We did not read the present form and its annexures. The passport office's site has them.
Read name change in passport and visa application name mismatch, since a consulate may ask about a parent who is not travelling.
What About a Widow, and a Divorced Mother?
A widow
- Her husband is the child's father, and remains so on every paper
- Nothing is removed or left blank
- She signs as the surviving parent, with his death certificate
- The child's rights through him, to pension or property, depend on his name being there
A divorced or separated mother
- The decree ends the marriage. It does not end his being the father
- She can sign alone where she has custody
- Removing his name from a paper already made needs a court
- The child's claims on him also rest on that name
Think before asking for a father's name to be taken out. It can close doors for the child as well as open them. That is a decision for the mother, and later the child, with a lawyer. Read child surname change after divorce, name change after divorce and name change in pension and family pension records.
What About Caste and Residence Certificates?
- A caste certificate, and often a residence certificate, is issued on the father's particulars: his caste, his village, his papers.
- A child with no recorded father has none of those to show.
- How such a child's status is decided depends on how and where the child was raised. It is a question of fact, and courts have ruled on it case by case.
- We did not read those rulings, and a general page cannot say what a tehsil will decide.
- Apply at the tehsil with the mother's own certificates and the child's birth and school records, and ask for a written decision.
- Take a lawyer's advice before a refusal becomes a record on the file.
Read name change in caste certificate and name change in residence certificate.
What About the Child's Own Name?
This is the one place a Gazette comes in: where the child is to carry a different name or surname from the one already on record. It does nothing about the father's column.
Step 1: Confirm what is to change
A child's surname is a change of name. Leaving a father's column blank is not, and no Gazette does it.
Step 2: See who has to consent
For a minor, the department's guideline asks for the parents or the guardian. A parent acting alone should have the papers that show why.
Step 3: Fix the child's exact new name
The spelling that will go on the birth record, Aadhaar and the school.
Step 4: Make the affidavit and publish the newspaper notice
As the child's parent or guardian. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form for a minor, and sign the undertaking
Two typed copies of the specimen for a minor, signed with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,700 for a minor. It is not refunded.
Step 8: Send the file yourself, then update the child's records
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054.

Which Gazette Should You Use?
A child's papers are read for decades, by boards, universities and passport offices across the country. The Gazette of India is the one to prefer.
Step 1: Think about where the child will study and travel
A board, a university and a passport office read the paper.
Step 2: Prefer the Gazette of India
It is the one recognised across the country.
Step 3: A state notice may serve the school and the tehsil
Ask them first.
Step 4: Contact the Roorkee press only if a state notice suits you
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do Mothers Make?
| Mistake | What to do |
|---|---|
| Writing a made-up father's name to fill the box | Never. Leave it blank, as the rules allow |
| Writing a grandfather's or an uncle's name as father | Never. It is a false record of parentage |
| Starting with the school, not the birth certificate | The birth certificate first |
| A widow asking for her husband's name to be removed | It stays. She signs alone |
| Asking a clerk to delete a recorded father | That needs a court |
| Asking for a Gazette to change the father's column | A Gazette is for the child's own name |
| Giving her own name three ways on the child's papers | One form, everywhere |
| Accepting a spoken refusal | Ask for the rule in writing |
| Keeping no copy of the affidavit | Keep it with the birth certificate |
A typical case we handle: a nurse in Dehradun was raising her daughter alone. The birth certificate named the mother and had no father. The school had taken that. At the passport office an agent told her she needed a Gazette "to remove the father's name". There was no father's name to remove, and no Gazette does that in any case. We told her she did not need us. She applied for the child's passport with her own name as the one parent, as the rules allow, and carried the birth certificate. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
Custody, guardianship, removing a recorded parent's name, a caste certificate refused, and anything a father disputes.
When you do not need us
For a birth certificate, school record, Aadhaar or passport in the mother's name alone. The published rules settle those. We are useful only where the child's own name or surname is to be changed and a Gazette notification is needed.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. A birth is registered where the child was born. The Gazette file for a child's change of name is prepared on WhatsApp.
People Also Ask About a Single Mother's Child's Papers
Can a birth certificate be made without the father's name?
Yes, on a single mother's affidavit, as the Supreme Court held.
Is the father's name mandatory on a passport?
No. One parent's name is enough.
Can a child use the mother's surname?
Yes. For a recorded child it is a change of name.
Can a divorced mother remove the father's name from documents?
Not at a counter. It needs a court's order.
Is a gazette needed to leave the father's name blank?
No. A Gazette is for the child's own name.
Should a widow remove her husband's name from her child's papers?
No. He remains the father.
Is the father's name mandatory on a PAN application?
No, where the mother is a single parent. The Central Board of Direct Taxes amended the income tax rules in November 2018 so that the father's name is not mandatory in that case, with effect from 5 December 2018.
Can a PAN card show the mother's name instead of the father's?
Yes. The form lets the applicant choose whether the father's or the mother's name is printed on the card. Where no father's name is given and the mother is a single parent, the mother's name is printed.
Is the mother's name compulsory on PAN when the father's is left out?
Yes. Under the amended form, the mother's name is mandatory where the father's name is not furnished and the mother is the single parent.
Can an adult whose mother raised him alone use only her name on PAN?
Yes. The 2018 change applies to any individual applicant whose mother is a single parent, so an adult applicant can give the mother's name alone.
Is the mother a natural guardian under Hindu law?
The Act names the father and, after him, the mother. The Law Commission recommended in 2015 that both parents be regarded together as natural guardians, though the Act's text has not been changed.
Which documents now allow one parent's name?
The passport since the December 2016 rules, PAN since December 2018, and a birth certificate on a single mother's affidavit since the Supreme Court's 2015 judgment.

That a birth certificate is issued on a single or unwed mother's affidavit, and that she can seek guardianship without notice to the father or disclosing his identity, are from published reports of the Supreme Court's judgment of 6 July 2015. That Chief Registrars were told to leave the other parent's column blank on request is from a report of a later High Court judgment. That a passport application asks for one parent's name, that a parent's name can be left off, and that a separated person need not name a spouse, are from the foreign ministry's announcement of 23 December 2016. A Single Mother's Child's Papers: The Short Version
A child's papers need a parent, not two. The Supreme Court has said a birth certificate is issued on a single mother's affidavit, and the passport rules ask for one parent's name. Start with the birth certificate, and let the school, Aadhaar and the passport follow it. A widow's child keeps the father's name. Removing a recorded father needs a court. Never fill the box with a name that is not true.
No Gazette is needed for any of that. For a change in the child's own name, message us on WhatsApp 9540005064, and we will reply in working hours.
