Cheque Payee Name Mismatch in Uttarakhand

When a cheque written in your favour carries a name that differs from your bank account: what the bank reads on the payee line, why an altered cheque is refused, how the large-cheque check works, and what to do with a cheque in a maiden name, a trade name or a late relative's name.

Quick answer

A cheque payee name mismatch is cured by a fresh cheque from the person who wrote it, in the name on your bank account. The cheque is never altered. A branch may accept a small variation on identity papers, so ask before depositing. Where your account's name is the record that is wrong, the bank corrects the account.

A cheque is paid only into the account of the person it names, so read the payee name when it is handed over and ask for a fresh cheque rather than altering it.

A cheque is an order to pay a named person. The bank that collects it is answerable if it pays anyone else, so it reads the name with care. A cheque payee name mismatch is a small thing that wastes three weeks, because the cure lies with the person who wrote the cheque. This page explains cheque payee name mismatch for account holders in Uttarakhand.

We do not deal with banks, and this subject almost never needs a Gazette. How banks treat names on cheques is general practice, and each bank decides its own cases. The large-cheque check is as the central bank announced it. For the account itself, read name change in bank records.

What Is a Cheque, and Who Are the Parties to It?

The parties to a cheque and what each does
PartyWho it isWhat it does with the name
The drawerThe person or office that writes and signs the chequeWrites the payee's name
The payeeThe person named on the cheque as the one to be paidDeposits it in an account in that name
The collecting bankThe payee's bankCompares the name on the cheque with its account
The paying bankThe drawer's bankChecks the cheque against the drawer's instructions

Most cheques today are crossed "account payee". Such a cheque is collected only for the account of the person named. It cannot be signed over to a friend or a relative. That is why the name on it matters so much.

What Does the Bank Read on the Payee Line?

How a collecting bank commonly treats differences in the payee's name
What the cheque says against the accountWhat commonly happens
The same name, in a slightly different spellingOften accepted, sometimes on identity papers. The branch decides
Initials on one and the full name on the otherVaries. Many branches ask for proof that both are one person
A surname missing or addedVaries. The larger the cheque, the stricter the reading
A different surname, such as a maiden nameOften refused without a linking paper. A fresh cheque is the sure course
A trade name, with a personal accountRefused. The cheque needs an account in the trade name
Another person's nameRefused
Any overwriting on the nameRefused

This table describes practice, not a rule. A bank is protecting itself and the drawer, and is entitled to be careful. A clerk who knows you may take a cheque that a clearing centre in another city would return.

What Kinds of Mismatch Are There?

The cheque was written wrongly

  • The drawer misspelt the name, or wrote it as it is spoken
  • Your account is right
  • Cured by a fresh cheque

Your account is the odd one

  • The cheque carries your proper name, as on Aadhaar and PAN
  • The account was opened years ago in initials or a short form
  • Cured by correcting the account, which also saves every later cheque

The name on the cheque is not yours to collect under

  • A maiden name you no longer hold an account in, a trade name, or a late relative's name
  • No spelling correction answers it
  • Cured by the drawer reissuing, on the right papers

Ask which record is the true one before chasing anyone. People often trouble a drawer for a fresh cheque when their own account has been wrong for twenty years. Read short name and full name difference.

What Should You Do With a Cheque in the Wrong Name?

Step 1: Read the payee's name on the cheque against your passbook

Letter by letter, before you deposit it.

Step 2: Look at the date

A cheque is good for three months from its date. A correction has to fit inside that.

Step 3: If the difference is small, ask your branch before depositing

Some accept a small variation with your identity papers. Ask first, and do not assume.

Step 4: If the difference is real, go back to the person who wrote it

Ask for a fresh cheque in the name on your account, or a transfer to the account instead.

Step 5: Return the wrong cheque

The drawer will want it back before issuing another.

Step 6: Give the drawer your name in writing

A photo of the passbook's first page, or a cancelled cheque. Not a spoken name.

Step 7: Do not alter the cheque yourself

A cheque with a changed name is a spoiled cheque, and worse.

Step 8: Where the wrong name is in your own account, correct the account

So that the next cheque in your proper name is not the one that fails.

For the wording of a request to your bank, read name change request letter to the bank manager.

Why Is an Altered Cheque Refused?

  • Cheques are now cleared as images, read by machines and by people who never see the paper.
  • Guides to the present clearing system say no changes or corrections are accepted in the payee's name or the amount. Where either is wrong, a fresh cheque is used.
  • The old habit of striking out a name and signing beside the change therefore no longer works for these fields.
  • A change made by anyone other than the drawer is a different thing altogether. Altering the name on a cheque written by someone else can be treated as forgery.
  • So a payee who sees a wrong name has one honest course: hand the cheque back.

Do not add a letter, complete a surname or "tidy" a name, however obvious the slip. The cheque is the drawer's document until it is paid.

What Is the Check on Large Cheques?

From the central bank's announcement of the positive pay system, in force since January 2021, as news reports and banks set it out.

  • The person issuing a cheque gives the bank its key details: the date, the payee's name and the amount.
  • When the cheque is presented, its details are compared with what was given. A discrepancy is flagged to both banks.
  • Banks offer the facility for cheques of Rs 50,000 and above. Using it is the account holder's choice.
  • Banks may make it mandatory for cheques of Rs 5 lakh and above, and many have.

This adds a second place where a name can fail. A drawer may write the cheque correctly and then type the payee's name differently into the bank's app. The payee sees only a returned cheque. Where a large cheque comes back, ask the drawer to check what was entered.

What About Cheques From Offices, and Trade Names?

  • Government and court payments. A refund, a compensation or a deposit returned by cheque is written from the office's record. Where that record has an old spelling, so has the cheque. The office reissues on a written request, with proof of the name.
  • Insurers. A claim cheque is drawn in the name on the policy or of the nominee as recorded. Correct the policy record, and the next payment follows.
  • Employers. Arrears and final dues come in the name on the service record.
  • Trade names. A customer writes "Sharma Medical Store". The owner's savings account is in his own name. The cheque needs a current account in the shop's name.
  • Firms and societies. The cheque is written to the body, and paid only into the body's account.
  • Many offices now pay by transfer. Give them your account details in writing, from the passbook, and the question does not arise.

Read name change in Udyam and GST registration, name change in LIC policy and land acquisition compensation name mismatch.

What About a Cheque in a Late Person's Name?

  1. It cannot go into an heir's account. The cheque is payable to the person named, and to nobody else.
  2. It should not go into the late person's account either, once the bank knows of the death. The account is frozen for the claim.
  3. Tell the drawer. Return the cheque with the death certificate and ask for it to be reissued.
  4. What the drawer asks for. Proof of who the heirs are. An office or an insurer has its own list, and for a large sum may ask for a succession certificate.
  5. The fresh cheque. Written to the nominee or the heirs, in the names on their own accounts.

Families hold such cheques for months, hoping a branch will oblige. It will not, and the three months run out. Read nominee name mismatch in a bank claim and succession certificate name mismatch.

What About the Three Months, and a Returned Cheque?

  • A cheque is valid for three months from the date written on it. After that it is stale, and no bank will take it.
  • A payee who spends ten weeks arguing over a name has little time left. Ask for a fresh cheque early.
  • A cheque returned by the bank comes back with a memo stating the reason. Read it. A name is one reason among many.
  • A return over the name is not a return for want of funds. It does not carry the consequences the law attaches to a bounced cheque.
  • Banks commonly charge for a returned cheque. Ask your branch what it charges.
  • Keep the returned cheque and the memo, and show both to the drawer.

Cheque clearing has been getting faster. That shortens the wait for a good cheque. It does nothing for a wrong name.

What If You Are the One Writing the Cheque?

  • Ask the payee how the name reads on the bank account. Do not write it as you know the person.
  • For a business, ask for the name of the account, which may be a trade name, a firm or a company.
  • Write it in full, with no abbreviations, and cross the cheque "account payee".
  • For a large cheque, enter the same name in the bank's positive pay screen. Copy it from the cheque you have just written.
  • If you make a slip in the name, cancel that leaf and write another. Do not overwrite.
  • Where a cheque you issued comes back, take it back and reissue. It costs a leaf, and saves the payee weeks.

A landlord, a school and a shopkeeper are all known in town by names that are not on their accounts. One question before writing avoids the whole of this page.

Where Does a Gazette Come In?

Almost never for a cheque. It comes in where the payee has changed a name by choice, so that payments arrive in two names because the payee's own papers are in two names. The bank account then follows Aadhaar and PAN.

Step 1: Confirm that it is a change of name, and not a cheque written wrongly

A wrong cheque is replaced by the drawer.

Step 2: Do not hold a cheque while you wait

A Gazette commonly takes 3 to 7 weeks, and a cheque is valid for three months. Ask the drawer to reissue later.

Step 3: Fix the exact new name

The spelling that will go on Aadhaar, PAN and the bank account.

Step 4: Make the affidavit and publish the newspaper notice

Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.

Step 5: Type the form and sign the undertaking

Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.

Step 6: Prepare the CD, photographs and certificate

The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.

Step 7: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult. It is not refunded.

Step 8: Send the file yourself, then update Aadhaar, PAN and the bank

Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then tell everyone who pays you.

See gazette name change in Uttarakhand and alias name and the Gazette.

Does the Uttarakhand Gazette Matter Here?

Not to the cheque. The question is only which Gazette your bank, Aadhaar and PAN accept for your own change of name.

Step 1: Ask your bank which Gazette it accepts

It follows Aadhaar and PAN.

Step 2: Think about PAN and other accounts

The Gazette of India serves them all.

Step 3: Contact the Roorkee press

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.

Step 4: Ask for the papers, the format and the fee, and submit

Keep photocopies of everything.

Step 5: Download the notice

Search gazettes.uk.gov.in and save the PDF.

Telling people your name by word of mouthGive it in writing, from the passbook
Keeping an account in initials for decadesHave the bank bring it to your full name
Paying for a Gazette to fix a chequeA fresh cheque fixes it

A typical case we handle: a retired teacher in Almora received a cheque for his arrears, drawn in favour of "G. D. Pant". His pension account, opened afresh a few years earlier, was in the name "Ganga Dutt Pant". His branch would not take it, and he asked us if a Gazette would settle his name once and for all. It was not needed. His name had always been Ganga Dutt Pant, and the office had written from an old record. He returned the cheque with a copy of his passbook, and the office paid the arrears by transfer to the account. This is an illustrative example of the type of case we handle, not a named client review.

When you do not need us

For any cheque written wrongly, and for an account that needs correcting. The drawer and your bank settle those. We are useful only where your own name has in fact been changed and a Gazette notification is asked for.

People Also Ask About the Name on a Cheque

What if the name on a cheque is spelt wrongly?

Ask your branch. If it refuses, ask the drawer for a fresh cheque.

Can a cheque name be corrected by overwriting?

No. A fresh cheque is used.

Can I deposit a cheque in my maiden name?

Only into an account in that name, or as your branch allows.

Can a cheque in a dead person's name be encashed?

No. The drawer reissues it to the heirs.

Is a gazette needed for a cheque name mismatch?

No. A fresh cheque settles it.

How long is a cheque valid?

Three months from its date.

How fast are cheques cleared now?

The central bank moved cheque clearing from batches to continuous clearing from 4 October 2025, so a cheque is cleared within hours during business hours instead of up to two working days. A cheque in a wrong name comes back just as fast.

Who confirms a cheque under continuous clearing?

The paying bank. In the first phase, reports say it had to confirm each cheque, yes or no, by 7 pm. A name difference is one reason it can say no.

Is the second phase of fast clearing in force?

It was set for 3 January 2026. The central bank issued a further circular on the second phase on 24 December 2025. Ask your branch what timing applies to your cheque now.

What is the cheque truncation system?

The system in which cheques are scanned and presented to the paying bank as images, not carried as paper. The image is all the paying bank sees, which is why an altered name fails.

Can I check the payee's name before an NEFT or RTGS transfer?

Yes. The central bank told banks to offer a name look-up from 1 April 2025, which fetches the account holder's name from the account number and IFSC before you send the money.

Do UPI and IMPS show the receiver's name?

Yes. Reports note that UPI and IMPS already let the sender see the beneficiary's name before paying. Check it against the name the payee gave you.

A difference between the name written on a cheque as the person to be paid and the name on the bank account into which the cheque is deposited.

Some branches do, on identity papers, where it is plainly the same person. It is the bank's decision. Ask before you deposit.
Do I need a Gazette or an affidavit?+
Not for a cheque written wrongly. The drawer writes a fresh one. A Gazette is for a person whose own name has changed.

No. An altered cheque is not accepted, and changing a name on someone else's cheque is a serious matter.
Can the person who wrote the cheque correct the name and sign beside it?+
Guides to the present clearing system say no changes are accepted in the name or the amount. A fresh cheque is used.
The cheque is in my maiden name and my account is in my married name. What do I do?+

The cheque is in my late father's name. Can I deposit it in my account?+
No. It is payable to him. Ask the drawer to reissue it to the heirs, on the death certificate and the papers the drawer asks for.
The cheque is in my shop's name and I have only a personal account. Will it be paid?+
Usually not. A cheque in a trade name needs an account in that name.
What is an account payee cheque?+
A cheque crossed so that it is collected only for the account of the person named on it. It cannot be passed on to someone else.
What is positive pay?+
A system in which the person issuing a large cheque tells the bank its details, including the payee's name, and the bank checks the cheque against them when it is presented.
For which cheques is positive pay used?+
Banks offer it for cheques of Rs 50,000 and above, and may make it mandatory for cheques of Rs 5 lakh and above.
How long is a cheque valid?+
Three months from its date.
My cheque was returned for the name. Is that a bounced cheque?+
It is returned, but not for want of funds. The return memo states the reason. Ask the drawer for a fresh cheque.
A Government office sent me a cheque in a wrong spelling. Who corrects it?+
The office that issued it. Return the cheque with a written request and proof of your name.
Would a bank transfer avoid all this?+
Largely. A transfer goes by account number, though banks now show the account holder's name to the sender before payment.
Do you deal with banks?+
No. We prepare a Gazette only where a person's own change of name needs one.

The positive pay system, the details it compares and the amounts it applies to are from the central bank's announcement, as news reports and banks set it out. That no corrections are accepted in the payee's name or the amount is as guides to the present clearing system describe it. How a branch treats a small difference in a name, an account payee crossing, a cheque in a trade name or a late person's name, the validity of a cheque and a return memo are general banking practice, and banks differ. Your own branch is the authority.

The Name on a Cheque: The Short Version

A cheque is paid only into the account of the person it names. Read the name when the cheque is handed to you. Where it differs from your account, ask your branch before depositing, and where the branch will not take it, hand it back for a fresh one. Never alter it. A cheque lapses in three months. A cheque in a late person's name is reissued to the heirs. If your own account is the record that is wrong, have it corrected.

None of that needs a Gazette. To find out which record to correct, send photos on WhatsApp 9540005064, and we will reply in working hours.
