eMigrate and ECR Name Mismatch for Overseas Jobs From Uttarakhand
When your passport, class 10 certificate, job contract or visa carry different forms of your name: what ECR and ECNR mean, where a mismatch stops you, and how to put it right in time.
An ECR name mismatch is settled by making every paper follow the passport. For an overseas job, the contract, the visa and the emigration clearance are all issued in the passport name. If your class 10 certificate or other papers differ, correct the odd one, or link the names with a Gazette notification, before you apply.

Many people from Uttarakhand work in hotels, kitchens, shops and on sites in the Gulf, and an ECR name mismatch is one of the commonest reasons their papers are sent back. This page explains the ECR name mismatch for overseas jobs: what ECR and ECNR mean, where names are compared, and how to make them agree.
We do not arrange jobs, visas or emigration clearance. We prepare Gazette papers for names. For the passport itself, read name change in passport in Uttarakhand.
What Do ECR and ECNR Mean?
Under the Emigration Act, 1983, an Indian citizen going abroad for work needs emigration clearance from the Protector of Emigrants, an office of the Ministry of External Affairs. In practice the requirement applies to one group of passport holders and one group of countries.
| Point | ECR | ECNR |
|---|---|---|
| Stands for | Emigration Check Required | Emigration Check Not Required |
| How you know | The passport carries the words Emigration Check Required | No such endorsement in the passport |
| Going to an ECR country for a job | Emigration clearance is needed first | No clearance needed |
| Going there for a visit | No clearance needed | No clearance needed |
| Usual reason for the status | The holder had not passed class 10 when the passport was made | Class 10 or more, among other grounds |
Emigration clearance is applied for on the eMigrate portal of the Ministry. It is a separate step from the passport and from the visa.
ECR status matters only for employment in the listed countries. It has no bearing on a job in Europe, North America or elsewhere.
Which Are the 18 Countries?
These are the countries notified as Emigration Check Required, as commonly listed. Check the eMigrate portal for the list in force.
Most workers from Uttarakhand who meet this rule are going to the United Arab Emirates, Saudi Arabia, Qatar, Kuwait, Oman or Bahrain.
Where Are Names Compared?
An overseas job passes through several hands, and each one reads your name off a different paper.
| Stage | Who checks | Papers compared |
|---|---|---|
| Passport, and ECNR status | The passport office | Passport application and the class 10 certificate |
| Job offer and contract | The employer and the recruiting agent | Passport and your trade or experience papers |
| Medical test | The approved medical centre | Passport |
| Visa | The foreign country | Passport and the contract |
| Emigration clearance | The Protector of Emigrants, on eMigrate | Passport, visa, contract and insurance |
| Departure | Immigration at the airport | Passport, visa, ticket and the clearance |
The passport appears in every row. That is why the name in the passport, with its exact split into given name and surname, is the one every other paper has to follow.
What Kinds of Mismatch Turn Up?
| The mismatch | Example | Usual fix |
|---|---|---|
| A short form in one paper | Passport says Mohammad Arif. Certificate says Md Arif | Expand the short record, or link the two forms |
| A spelling differs | Bisht and Bist | Correct the odd paper at its own office |
| A surname is missing in one paper | Passport has a single name. Certificate has a surname | Bring the passport and the other papers to one form |
| The order of names differs | Rawat Suresh and Suresh Rawat | Fill forms as the passport has it |
| The contract or visa was typed wrongly | A letter wrong in the offer letter | Ask the employer or agent to reissue it as per the passport |
| A new name taken after the certificates were issued | A change of name by choice | The Gazette notification links the old papers to the new name |
The first four are corrections of records in India. The fifth is for the employer to put right. Only the last rests on a Gazette, though a Gazette with an alias can also help where two forms have been in use for years.
Why Is the Passport the Base?
Abroad, the passport is who you are. The visa, the residence permit, the labour card and the bank account in the country you go to are all made from it.
- Give your employer and your agent a clear copy of the passport, and ask that every paper be typed from it.
- Do not "correct" your name on a contract or a visa form to match another paper. Follow the passport as it stands.
- If the passport itself is wrong, correct the passport first. That is a re-issue, and it takes time.
- If the passport is right and an Indian certificate is wrong, correct the certificate, or keep a paper that links the two.
How Do You Check Your Papers Before You Apply for a Job Abroad?
Step 1: Read your passport
Note the given name, the surname, your father's name and the date of birth. See if it says Emigration Check Required.
Step 2: Lay out every paper the job will need
Class 10 certificate, trade or skill certificates, experience letters, Aadhaar and PAN.
Step 3: Compare each with the passport, letter by letter
Mark every paper where the name, your father's name or the date of birth differs.
Step 4: Decide which paper is wrong
The passport, or the other paper. Your class 10 certificate usually settles it.
Step 5: Correct what can be corrected
At the office that issued it. Aadhaar and PAN first, since the passport office looks at them.
Step 6: Link what cannot be corrected
An old certificate that will stay as it is can be linked to your present name by a correction affidavit or a Gazette notification, as the employer or the office accepts.
Step 7: Only then give your papers to an employer or an agent
Once a contract and a visa are typed, a correction costs time you may not have.
What If Your Class 10 Certificate Is in a Different Name From Your Passport?
This matters in two ways. A class 10 pass certificate is the usual ground for a passport without the ECR endorsement. And an employer abroad may ask for it as proof of schooling.
- Where the passport office is asked to treat a holder as ECNR on the strength of a class 10 certificate, the certificate has to be shown to belong to that person.
- If the certificate has a short form, a different spelling or no surname, the officer may ask for something to connect it to the passport name.
- The clean fix is to make the two agree: correct the certificate through the board where that is still possible, or reissue the passport in the name on the certificate.
- Where neither can be changed, a Gazette notification that states both forms, with "alias", is the public paper that connects them.
Ask the passport office what it will accept before you choose. See short name and full name difference and Md, Mohd and Mohammad name spelling.
What About the Contract, the Visa and Other Papers?
Made by others, from your passport
- Offer letter and contract. Ask for them to be typed exactly as the passport
- Visa. Check it the day you receive it. A wrong letter is for the employer to get corrected
- Medical report. Give the passport at the centre, not another identity paper
- Insurance for emigrants. The policy is in the passport name and number
Your own, from India
- Trade and skill certificates. Corrected by the institute or board that issued them
- Experience letters. Ask the earlier employer to issue them in the passport name
- Police clearance. Applied for through Passport Seva, in the passport name
- Aadhaar and PAN. Not asked for abroad, but they support the passport in India
If a paper made abroad is wrong, the remedy is abroad, with the employer or the embassy of that country. A Gazette published in India does not correct a foreign visa.
What If the Job Date Is Close?
| The fix | How long to allow |
|---|---|
| A contract or offer letter retyped by the employer | As the employer takes. Often quick |
| Aadhaar corrected at a centre | As UIDAI takes |
| A Gazette notification | Commonly 3 to 7 weeks |
| A passport re-issue | Depends on the office and police verification |
| A board certificate corrected | The slowest. Often not possible after the time limit |
- If your papers already satisfy the employer and the clearance, do not start a change of name now. Go, and do it on a visit home.
- If the mismatch is stopping the process, fix the smallest thing that removes it. That is usually one paper, not your whole name.
- If nothing can be fixed in time, ask the employer for a later joining date. A delayed start is better than a refused clearance.
For people already working abroad, see name change for NRI from Uttarakhand.
What Should You Know About Agents?
- Recruitment for overseas jobs is regulated. Recruiting agents are registered under the Emigration Act, and the eMigrate portal lets you check a registration.
- Do not hand your original passport to anyone who is not a registered agent or your employer's authorised office.
- Be wary of anyone who offers to "manage" a name mismatch by altering a certificate or making a second passport. Both are offences, and the worker carries the consequences abroad.
- Keep copies of everything you sign, and read the name on each page.
We are not a recruiting agent and have no link with any. Our work stops at the Gazette notification.
How Does the Central Gazette Route Work?
Use this where two forms of your name have to be linked, or where you are taking a new name before applying. For papers read by embassies and offices outside the state, the Gazette of India is the one to use.
Step 1: Confirm that a Gazette is what is asked for
Ask the passport office, the employer or the agent in writing which paper will settle the mismatch.
Step 2: Fix the name as your passport has it, or will have it
List every other form that appears on your papers, to be joined by alias.
Step 3: Make the affidavit
State the forms in use and the one you will use from now on. Sign before a notary.
Step 4: Publish the newspaper notice
In a daily local leading newspaper, in the same wording. Keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult, with Rs 250 more for each alias. It is not refunded.
Step 8: Send the file yourself, then use the Gazette
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Download the published Gazette from egazette.gov.in and give a printed copy where it was asked for.
If the Gazette is for use abroad, ask the employer or the embassy if it has to be attested or apostilled.
Is the Uttarakhand Gazette of Use for an Overseas Job?
Rarely. The papers here are read by the passport office, an embassy and an employer abroad. The Gazette of India is the safer choice.
Step 1: Ask who will read the notification
If it is an embassy, an employer abroad or an office outside the state, use the Gazette of India.
Step 2: Ask that office which Gazette it accepts
In writing, before you choose.
Step 3: If a state notice is accepted, contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 4: Ask for the papers, the format and the fee, and submit
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do People Make?
| Mistake | What to do |
|---|---|
| Checking papers after the visa is issued | Compare everything with the passport before you apply |
| Writing a name on a form as another paper has it | Follow the passport, letter by letter |
| Changing the passport name in the middle of the process | A re-issue changes the passport number. Finish, or start again |
| Letting an agent alter a certificate | That is an offence. Correct or link it properly |
| Applying for a second passport | Never. A person holds one passport |
| Expecting a Gazette to correct a foreign visa | A visa is corrected by the country that issued it |
| Using a short form such as Md in a new passport | Write the name in full |
| Handing over the original passport to an unregistered agent | Check the registration on eMigrate |
| Starting a board correction a month before joining | Use a linking paper, and correct the certificate later |
A typical case we handle: a cook from Tehri had "Md" before his name on his passport and the full word on his class 10 and hotel management certificates. His employer in the Gulf asked why the certificates did not match. There was no time to reissue the passport. He filed a Gazette notice stating both forms, the employer accepted it with his certificates, and his contract and visa were made in the passport name. This is an illustrative example of the type of case we handle, not a named client review.
When you do not need us
If the wrong paper is a contract or a visa, the employer corrects it. If it is Aadhaar, the centre does. We are useful only where two forms of your name have to be linked by a Gazette, or where you are taking a new name before you apply. Send us your passport and the paper that differs, and we will tell you, free, which it is.

People Also Ask About ECR and Name Mismatch
What is ECR in a passport?
Emigration Check Required. The holder needs emigration clearance before taking a job in one of 18 countries.
Which name is used for emigration clearance?
The name in the passport. The contract, the visa and the insurance follow it.
My certificate and passport names are different. Can I still go abroad for work?
Often yes, once the two are linked or one is corrected. Ask the employer what it accepts.
Can I change my passport name after my visa is issued?
A re-issue gives a new passport number, so the visa would need attention too. Avoid it in the middle of a job process.
How do I get ECNR on my passport?
Through Passport Seva, with proof of eligibility such as a class 10 pass certificate.
Does a gazette notification help with a visa name mismatch?
It links Indian papers to your passport name. It does not correct a visa issued by another country.
Is the Emigration Act, 1983 being replaced?
The Ministry of External Affairs has proposed the Overseas Mobility (Facilitation and Welfare) Bill, 2025 to replace the Emigration Act, 1983. Until a new law is passed and in force, follow the eMigrate portal for the current rules.
When was the draft overseas mobility bill released?
The Ministry made the draft public on 10 October 2025 and asked for comments by 7 November 2025.
What would the new bill set up?
An Overseas Mobility and Welfare Council, meant to bring the ministries together on policy for Indians working abroad.
Would ECR workers get compulsory insurance under the new bill?
An analysis of the draft says it proposes compulsory insurance of Rs 10 lakh for all ECR-category workers. Check the final law when it is passed. The policy will be in your passport name.
Does the new bill act against illegal recruiting agents?
As reported, the draft includes provisions against irregular emigration and human trafficking, with severe penalties for overseas placement agencies that break the rules.
Will the new system keep worker records digitally?
As reported, the draft provides for an Integrated Information System and data-based policy. One more reason to keep the same name on every paper.
