Gender Change in Documents in Uttarakhand
How gender and name are changed in official records: the certificate of identity from the District Magistrate, what it does, and when a Gazette public notice is still asked for.
A gender change in documents in Uttarakhand starts with a certificate of identity from the District Magistrate, under the Transgender Persons (Protection of Rights) Act, 2019. That certificate is the basis for changing gender, name and photograph in official records. A Gazette public notice is a separate paper, needed only where an office still asks for one.

A gender change in documents is a matter of right under the law, and the law now gives a direct way to do it that does not depend on a newspaper or a Gazette. This page explains gender change in documents for people in Uttarakhand: the certificate of identity, the records that follow it, and the place a Gazette still has.
We are a documentation desk. We prepare Gazette papers, and for most readers of this page the certificate of identity will do the work without us. Anything you tell us is kept with the person handling your file.
What Does the Law Provide?
The Transgender Persons (Protection of Rights) Act, 2019 recognises a person's right to self-perceived gender identity. The Rules made under it in 2020 set out how that identity is recorded.
- A transgender person applies to the District Magistrate of the district where he or she lives for a certificate of identity.
- The application can be made online, on the National Portal for Transgender Persons, or by post.
- The District Magistrate issues the certificate, and an identity card with it.
- The Rules say the certificate is the basis for changing gender, and the name and photograph where needed, in official documents.
- A person who had officially recorded a change of gender before the Act came into force is not required to apply again.
So the starting point is the District Magistrate, not a notary, a newspaper or the Gazette office. That is a change from how these matters were handled some years ago, and many agents and even some offices have not caught up with it.
What Are the Two Certificates?
| Point | Certificate of identity | Revised certificate of identity |
|---|---|---|
| Records the gender as | Transgender | Male or female |
| Based on | The person's own declaration | A medical intervention towards a gender-affirming procedure |
| Medical paper | None asked for | A certificate from the Medical Superintendent or Chief Medical Officer of the institution |
| Issued by | The District Magistrate | The District Magistrate |
| Needed first? | It is the first certificate | The Ministry's own guidance says the first certificate is not mandatory before applying for the revised one |
Which certificate fits you is your own decision, and it depends on how you want your gender recorded. Nobody at a counter is entitled to decide it for you.
How Do You Get the Certificate of Identity?
There is no fee to us in this, and no need for a middleman. You apply yourself.
Step 1: Decide which certificate you are applying for
The certificate of identity, or the revised certificate that records the gender as male or female.
Step 2: Decide the name you will use
If your name is changing too, fix its spelling, spacing and order now. The certificate carries it.
Step 3: Collect what the form asks for
The application form with its declaration, proof of your address, photographs, and the medical certificate if you are applying for the revised certificate. The portal shows the current list.
Step 4: Apply on the National Portal, or by post
To the District Magistrate of the district where you live.
Step 5: Track the application
The Rules give the District Magistrate 30 days from a complete application to issue the certificate of identity.
Step 6: Collect the certificate and the identity card
Check the name, the gender and the photograph on both.
Step 7: Keep certified copies
Every office you approach next will ask for one.
If an application is refused, the Rules provide for an appeal. Ask the District Magistrate's office for the order in writing, and take advice.
What Does the Certificate of Identity Do?
What the Rules say
- The certificate is the basis for changing the gender, and the name and photograph where needed, in official documents
- The authority that issued a document is to make the change within 15 days of an application
- An identity card is issued along with the certificate
- A revised certificate, where applied for, records the gender as male or female
What still falls to you
- Applying to each office, one by one. The certificate does not update records by itself
- Using each office's own form and paying its own fee
- Keeping proof of the date you applied, in case of delay
- Carrying the old document and the certificate until the new one arrives
In practice, offices differ in how well they know these Rules. Where a counter asks for a paper the Rules do not require, a short written application that names the Act and the Rules, with a copy of the certificate, is often enough. Ask for any refusal in writing.
How Is Each Record Updated?
This is the usual position. Each office keeps its own list and can change it, so check that office's current list before you go.
| Record | Where | Note |
|---|---|---|
| Aadhaar | An Aadhaar Seva Kendra, in person | Carry the certificate of identity. Aadhaar limits how often a name and a gender can be updated, so settle both before you go |
| PAN | The PAN correction application | After Aadhaar, so the two agree |
| Bank accounts | The branch | With updated Aadhaar and PAN |
| Passport | Passport Seva, as a re-issue | Its own list of papers for a change of gender applies |
| Voter ID | Form 8 | With the certificate |
| Driving licence | The transport office | With the certificate and updated identity proof |
| School and college certificates | The board or university, through the institution | Each has its own rules. Ask early |
| Birth certificate | The Registrar of births | Ask the Registrar how it records the change |
Do Aadhaar first, then PAN, then the bank. The rest can follow in any order. Boards and universities are the slowest, so start those early and keep copies of everything you send.
Where Does a Gazette Come In?
The Department of Publication's guideline for a public notice in Part IV of the Gazette of India covers a change of sex, and the Department gives a format of undertaking for a change of gender. So a Gazette notice can still be published. Under the 2020 Rules, though, the certificate of identity is what the law names as the basis for changing records.
An office asks for it in writing
A board, a university or another office says it wants a Gazette notification as well as the certificate.
A change recorded before the Act
You changed your records some years ago, and a later office wants one public proof.
If none of these applies, you do not need a Gazette, and you do not need us. Before you agree to one, ask the office to say in writing why the certificate of identity will not do.
Why Think Before Using a Gazette?
A Gazette is a public record. A notice prints your earlier name, your present name, the change of gender, your father's name and your address, and it stays on the Government's portal for good. The newspaper notice puts the same facts in front of your own town.
- The certificate of identity is issued to you. It is not published.
- A Gazette notice is published to the world, and cannot be withdrawn.
- For some people that is no concern. For others it is a real risk at work, at home or in the neighbourhood.
- So use the Gazette only where an office truly requires it, and decide with open eyes.
How Does the Central Gazette Route Work?
Use this only where an office has asked for a Gazette. The notice is a public notice in Part IV of the Gazette of India.
Step 1: Get the certificate of identity first
It is the legal or medical document the public notice rests on.
Step 2: Read the Department's guideline and format
The public notice guideline, and the format of undertaking for a change of gender, are on the Department of Publication's website.
Step 3: Sign the undertaking
In the Department's format, with your details and the change.
Step 4: Publish the newspaper notice
In a daily local leading newspaper, showing the details of the case. Keep the original newspaper.
Step 5: Type the form
Two typed copies of the specimen, signed by you and by two witnesses.
Step 6: Prepare the CD, photographs and supporting papers
The same text on a CD in MS Word, two self-attested photographs with identity proof, a certificate that both copies match, and an attested copy of the certificate of identity or the medical document.
Step 7: Pay the public notice charge on BharatKosh
Commonly Rs 1,400. Confirm it before you pay. It is not refunded.
Step 8: Send the file yourself, then download the Gazette
Send it, with a request letter, to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then check Part IV on egazette.gov.in each week.
For the public notice in general, see public notice fee and undertaking.
Can the Uttarakhand Gazette Be Used?
The Government Press at Roorkee sets its own practice. Ask the office that wants a Gazette which one it accepts before you choose.
Step 1: Ask which Gazette the office accepts
A passport office, a central body or an office outside the state may want the Gazette of India.
Step 2: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if it accepts a private notice of this kind.
Step 3: Ask for the papers, the format and the fee
Ask what supporting document it wants and in which language the notice is to be.
Step 4: Publish the notice and submit the file
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
To weigh the two, read Uttarakhand Gazette vs Gazette of India.
What If the Name Is Changing Along With Gender?
Most people change both. The Rules provide for it: the certificate of identity is the basis for changing the name as well as the gender, where the person needs that.
- Give the new name in the application for the certificate, in its final form.
- The same certificate then supports the change of name and of gender at each office.
- You do not need a separate change of name notice in the Gazette only because the name is changing too.
- If a later office insists on a Gazette for the name, ask it in writing why the certificate does not serve.
Decide the name once. Aadhaar allows a name change only twice in a lifetime, and a second set of record updates is slow and tiring.
Your degrees and older papers may stay in the earlier name if the board or university will not reissue them. Keep a certified copy of the certificate of identity with them. It links the two names for anyone who needs to check.
What Does It Cost, and How Long Does It Take?
| Item | Certificate of identity | Gazette public notice, where asked for |
|---|---|---|
| Application | As the portal shows | Not applicable |
| Time for the certificate | 30 days from a complete application, under the Rules | The certificate comes first |
| Newspaper notice | None | Rs 800 to Rs 4,000 |
| Gazette charge | None | Commonly Rs 1,400 for a public notice |
| Each record update | That office's own fee | That office's own fee |
| Time for the Gazette | None | Several weeks after a complete file reaches the Department |
Our own charge applies only where we prepare a Gazette file. It is quoted per case and shown as a separate line. For the certificate of identity there is nothing for us to do.
Which Mistakes Should You Avoid?
| Mistake | What to do |
|---|---|
| Starting with an affidavit and a Gazette, as agents often advise | Start with the certificate of identity from the District Magistrate |
| Paying a middleman to apply on the portal | Apply yourself |
| Publishing a Gazette notice without thinking about privacy | Use it only where an office requires it in writing |
| Changing the name in a separate process from the gender | The certificate covers both |
| Deciding the new name at the counter | Fix it before you apply |
| Updating the bank before Aadhaar and PAN | Keep the order |
| Accepting an oral refusal | Ask for it in writing, naming the Act and the Rules |
| Leaving board and university records to the end | Start them early |
A typical case we handle: a young person in Dehradun was told by a shop near the court that a gender change needed an affidavit, two newspapers and a Gazette, and was given a price. We explained the certificate of identity. They applied on the national portal themselves, received the certificate from the District Magistrate, and updated Aadhaar, PAN and the bank from it. Nothing was published. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
A refusal by an authority, an appeal, a dispute with a board or an employer, and any question of safety are matters for a lawyer. We do not appear before any authority.
When you do not need us
For the certificate of identity and the record updates that follow it, you need no service. We are useful only where an office has asked in writing for a Gazette public notice. Our charge for that is quoted per case.

All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. Gender Change in Documents: The Short Version
Start with the District Magistrate, not with a notary or a Gazette. Apply on the national portal for a certificate of identity, which the Rules say is to be issued in 30 days. That certificate is the basis for changing gender, and name where needed, in every official record. You then apply to each office: Aadhaar first, then PAN, the bank and the rest.
