Building Plan Approval Name Mismatch in Uttarakhand
For plot owners whose house map is held at the development authority because the name on the application does not match the deed, the mutation or identity papers: what the ownership check reads, which paper to put right first, and what co-owners, heirs and buyers of a sanctioned plot should know.
A building plan approval name mismatch is cured before the plan is filed. The applicant has to be the owner the deed and the mutation name. Correct a deed by a deed of rectification, have the mutation made at the tehsil, and bring identity papers to the same name. A spelling needs no Gazette.

A house map is passed in the name of the plot's owner, after the authority has checked who that is. A building plan approval name mismatch stops a file at that first check, before anyone looks at the drawings. This page explains building plan approval name mismatch for plot owners in Uttarakhand.
We do not deal with development authorities or architects, and this subject seldom needs a Gazette. What the ownership check reads is from the Dehradun development authority's own service note. Other authorities, fees and time limits we did not confirm. For the deed itself, read name change in property documents.
What Is the Approval, and Who Gives It?
- What it is. Permission to build, given on drawings of the proposed house. People call it map approval, or getting the naksha passed.
- Who gives it. The development authority of the area. One covers Dehradun and Mussoorie, another Haridwar and Roorkee, and there are others.
- Who prepares the file. A registered architect or engineer, with the owner.
- How it is filed. The Dehradun authority takes applications on its online portal, and the Haridwar authority has an online system of its own.
- What it ends in. A sanction, issued in the owner's name for that plot.
Two questions are asked of every file. May a house of this kind be built on this land? And does this land belong to the person asking? The second is answered from names alone.
What Does the Ownership Check Read?
From the Dehradun development authority's published note on its building plan service.
| Point | What the note says |
|---|---|
| Who applies | The architect and the applicant submit the plan on the authority's portal, on its map submission form |
| Ownership papers | The sale deed, gift deed, will or any other deed, and the mutation |
| Earlier sanction | A sanctioned plan, if there is one already |
| The check | Ownership is verified alongside the check of land use |
| If it fails | Where ownership is in order the file moves on. Where it is not, the file is sent up for a decision and can be rejected |
Two papers stand out: the deed and the mutation. The deed shows how the plot came to the owner. The mutation shows that the public record agrees. An applicant whose name is on neither, or on only one, has a problem no drawing can solve.
Which Names Are in a Plan File?
| Paper | Name on it | Written by |
|---|---|---|
| The title deed | The buyer, donee or heir who took the plot | The deed writer, at the time of the transfer |
| The mutation | The recorded holder | The tehsil or the municipal office, from the deed |
| The application form | The applicant | The architect's office, or the owner |
| The drawings | The owner, in the title block | The architect's draftsman |
| Identity papers | The applicant | The identity and tax offices |
| Affidavits and undertakings | The owner | Whoever typed them |
Half of these are typed in an architect's office from a phone message. The owner's part is simple: hand over the deed, say "copy the name from here", and read the form before it goes.
What Kinds of Mismatch Are There?
A spelling
- The deed, the mutation or an identity paper spells the same owner differently
- Or the form was typed wrongly
- Corrected at the office whose paper is wrong
A mutation never made
- The deed is in the applicant's name, and the record still shows the seller or a late parent
- The two ownership papers disagree
- Cured by mutation, before applying
The applicant is not the recorded owner
- A son applying on a father's plot, a husband on a wife's, one brother on a joint plot
- Or a buyer relying on an agreement, with no registered deed yet
- Not a correction. The owner applies, or the title is first brought to the applicant
Families often arrive at the third kind without knowing it. The son is paying for the house and takes it for granted that the map will be in his name. The plot is his father's, and so is the map.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The deed has a spelling slip against identity papers | A deed of rectification, or correct the identity paper if it is the one that is wrong | No |
| The mutation spells the owner differently from the deed | A correction at the tehsil or the municipal office | No |
| No mutation has been made since the purchase | Apply for mutation first | No |
| The plot is in a late parent's name | Mutation by succession, or a deed among the heirs | No |
| The plot is jointly owned | All apply, or one with the others' consent | No |
| The form or the drawings were typed wrongly | The architect corrects and resubmits | No |
| The sanction letter has a slip | An application to the authority, with the deed | No |
| The owner has changed a name by choice since the deed | Gazette, kept with the deed and attached to the file | Yes |
A Gazette appears once in eight rows. The rest are settled at the sub-registrar's office, the tehsil or the architect's desk.
What Should You Do Before the Plan Is Filed?
Step 1: Take out the title deed of the plot
Read the owner's name, and the father's or husband's name, as the deed has them.
Step 2: Take a current copy of the mutation
The land record for the plot, or the house tax record in a town.
Step 3: Put Aadhaar and PAN beside them
The applicant's, and every co-owner's.
Step 4: Decide what kind of difference it is
A spelling, a mutation never made, or an applicant who is not the recorded owner.
Step 5: Put the root paper right first
A deed by a deed of rectification, the land record at the tehsil, an identity paper at its own office.
Step 6: Get the other owners' consent, where there are any
Or apply in all the owners' names.
Step 7: Give the architect the name from the deed
So the drawings and the form carry it exactly.
Step 8: Read the form before it is submitted, and the sanction when it is issued
The sanction is the paper a bank and later offices will read.
For correcting a deed, read gift deed name mismatch. For the land record, read name correction in khatauni and land records.
What About Co-owners and Heirs?
- A plot held by two or more people is built on with the consent of all. The authority wants every owner on the file, as applicant or by written consent.
- Each co-owner's name is read against the deed in the same way. One brother's missing surname can hold the file for all three.
- A plot in a late parent's name belongs to the heirs together until it is divided. One heir cannot have a map passed on the whole of it alone.
- The heirs first bring the plot to their names, by mutation on succession. Where one is to build, the others give their share up by a registered deed, or the plot is partitioned.
- A married sister is an heir. Her present name is linked to the family's papers by her marriage certificate.
- A plot in a wife's name is hers. The plan is hers too, even where her husband deals with the architect.
Read partition deed name mismatch and name correction in a death certificate and legal heir certificate.
What About a Plot Bought With a Sanctioned Plan?
- Plots are often sold with a map already passed, as a selling point. The sanction is in the seller's name.
- A sanction is given to an owner, for a plot, for a period. Ask the authority what it requires when the owner changes: a record of the change, or a fresh application.
- A buyer who builds on the seller's sanction, without asking, has a house whose papers name someone else.
- The same holds for a half-built house bought from its first owner. The completion papers will be issued to whoever the authority's record names.
- Before paying, a buyer should see the sanction, check that it matches the seller's name on the deed, and ask the authority about its validity.
We could not confirm any authority's procedure for a change of owner after sanction. Ask it directly.
What Does the Bank Read for a Construction Loan?
- A bank lending to build a house asks for the title deed, the mutation and the sanctioned plan.
- It reads the three against each other and against the borrower's identity papers. Its lawyer writes a report on the title.
- A sanction in a father's name with a loan asked for by the son does not fit. The owner joins as borrower, or the plot is first transferred.
- A spelling the authority let through may still be stopped by the bank's lawyer. Banks are the strictest readers of a property file.
- Money is released in stages, against progress on the sanctioned drawings. A house built off the sanctioned plan raises a different problem, which no name will cure.
Read home loan name mismatch.
What Follows the Sanction?
- The sanction letter and the stamped drawings. Read the owner's name on both the day they are issued. A slip is corrected by the authority on application.
- Completion or occupancy papers. Issued at the end to the same owner, where the authority gives them.
- Electricity and water. A new connection is taken in the owner's name, on ownership papers.
- House tax. The new building is assessed in the owner's name.
- Regularising an unapproved house. An owner who built without sanction and applies to have it regularised gives the same proof of ownership.
- A later sale. A buyer's bank will ask for the sanction in the seller's own name.
Read name change in electricity bill, name change in water connection and municipal house tax name change.
What About Places Outside the Development Authorities?
- Development authorities cover the notified areas around the larger towns. Their limits have changed more than once.
- Outside them, a municipal body, a panchayat or a district-level office may be the one to approve a plan. Ask at the tehsil or the local body which applies to your plot.
- In the hills, much land is recorded in a family's joint name going back generations. The first step there is to see whose name the plot actually stands in.
- Land use matters as much as ownership. Farm land cannot simply be built on, and that question has nothing to do with names.
- A homestay, a shop or a guest house is a different kind of building from a home, with its own permissions.
Where Does a Gazette Come In?
Only where the owner is alive and has changed a name by choice since the deed, so that the deed carries the old name and every identity paper the new one. The Gazette links the two. It does nothing for a spelling or a missing mutation.
Step 1: Confirm that it is a change of name, and not a spelling or a missing mutation
Those are settled at the sub-registrar's office or the tehsil.
Step 2: Plan around the time
A Gazette commonly takes 3 to 7 weeks. Do not book a builder for next month.
Step 3: Fix the exact new name, and copy the name as the deed has it
Letter by letter.
Step 4: Make the affidavit and publish the newspaper notice
Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then apply with the Gazette beside the deed
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Update Aadhaar and PAN, and attach the Gazette to the application.
Would the Uttarakhand Gazette Do?
A development authority is under the state and may accept it. A bank, Aadhaar and PAN are the reasons to prefer the Gazette of India.
Step 1: Ask the development authority which Gazette it accepts
It is a body under the state.
Step 2: Think about the bank, Aadhaar and PAN
The Gazette of India serves them all.
Step 3: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 4: Ask for the papers, the format and the fee, and submit
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
To weigh the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do Plot Owners Make?
| Mistake | What to do |
|---|---|
| Paying the architect before reading the deed against identity papers | Check the names first |
| Applying before mutation | Have the mutation made |
| A son applying on a father's plot | The owner applies |
| One co-owner applying alone | All apply, or the others consent in writing |
| Letting the architect type the name from a message | Give the deed, and read the form |
| Not reading the sanction letter | Read it the day it is issued |
| Building on a seller's sanction | Ask the authority what a new owner must do |
| Paying for a Gazette to fix a spelling | The deed, the record or the identity paper is corrected |
| Paying a tout to "get the map passed" | The file moves on papers |
A typical case we handle: a schoolteacher in Dehradun bought a plot and had drawings made. His sale deed read "Naveen Chandra", and his Aadhaar, PAN and the mutation read "Naveen Chandra Pant". The authority held the file at the ownership check, and he asked us for a Gazette. He did not need one, since his name had never changed. The deed writer had left out the surname. The seller joined him in a deed of rectification at the sub-registrar's office, and the plan was then filed with both deeds. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
A deed of rectification, a deed among heirs or co-owners, a dispute over the plot, and a refusal by the authority.
When you do not need us
For a spelling, a missing mutation, a joint plot or a late parent's plot. A lawyer, the sub-registrar, the tehsil and the architect settle those. We are useful only where an owner has changed a name by choice since the deed, and a Gazette notification is needed to link the two names.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. The plan is filed with the authority for your own area. The Gazette file, where one is needed, is prepared on WhatsApp.

The ownership papers asked for, that ownership is verified alongside land use, and what happens where it is not in order are from the Dehradun development authority's published note on its building plan service. That the Haridwar authority has an online system is from a public services listing. We did not read any other authority's procedure, the state's planning law or building rules, or confirm fees, time limits, the treatment of co-owners or a change of owner after sanction. Names in a Building Plan File: The Short Version
A house map is passed in the name of the plot's owner. The authority checks ownership on the deed and the mutation, and the applicant's identity papers have to agree with both. Before paying an architect, lay the three side by side. Correct a deed by a deed of rectification, have the mutation made, and bring identity papers to the same name. Co-owners apply together. A plot in a parent's name is built on in the parent's name, or transferred first.
A spelling needs no Gazette. To find out which paper to correct, send photos on WhatsApp 9540005064, and we will reply in working hours.
