Relinquishment Deed Name Mismatch in Uttarakhand
For heirs giving up or taking a share in a parent's house or land, where the late owner's name or an heir's name differs between the title papers, the death certificate and identity papers: which names a release deed carries, what to settle before it is signed, and how a slip in a registered deed is put right.
A relinquishment deed name mismatch is best settled before the deed is signed. Correct the death certificate, Aadhaar or the land record that differs, at its own office. Have the deed recite each party's present name with any earlier name beside it. A slip found after registration needs a rectification deed. A spelling needs no Gazette.

When a parent dies, the house or the land passes to all the children together. Often the others give up their shares so that one child holds the whole. The paper that does this is a release. A relinquishment deed name mismatch is found when three or four people's papers are laid beside a title deed forty years old. This page explains relinquishment deed name mismatch for families in Uttarakhand.
We do not draft or register deeds. That is a lawyer's work. We prepare the Gazette notification, where a name has in fact been changed. What a release is, who it can favour and that it has to be registered are as guides to the law set them out. We did not read the statutes for this page, and did not confirm the state's stamp duty. For a transfer to someone who has no share, read gift deed name mismatch.
What Is the Deed, and When Do Families Use It?
- What it is. A deed by which one co-owner gives up a share in a property in favour of another co-owner. It is also called a release deed.
- When it is used. Most often after a death without a will, when several heirs inherit together and want one of them to hold the whole.
- Who signs. The heir giving up the share, the heir receiving it, and two witnesses.
- Where it is made good. At the sub-registrar's office, where it is registered.
- What follows. Mutation, so that the land record or the house tax record shows the heir who now holds the whole.
A release does not create a title. It rests on the title the late owner had, and on the heirs' being who they say they are. So it carries more names than most deeds, and each has to tie back to an older paper.
What Do Guides to the Law Say?
From published guides by law and property writers. We did not read the Registration Act or the stamp law for this page, and a lawyer should be asked before any deed is drafted.
| Point | What guides say |
|---|---|
| Who can release | Only a person who has a share in the property |
| In whose favour | Only another co-owner. A release in favour of a person with no share is treated as a gift |
| Its effect | The releasing heir's share ends, and the other co-owners' shares grow by it |
| Registration | A release of rights in immovable property has to be registered under the Registration Act |
| If it is not registered | It cannot be relied on in court as affecting the property |
| Witnesses | Two, at registration |
| Going back on it | Not revocable at will. It can be challenged on grounds such as fraud or coercion |
One guide adds a caution from a court ruling: where there are several co-owners and one gives up a share to only one of them, the paper may be read as a gift. That affects the duty paid, not the names. Ask the drafting lawyer which form your case calls for.
Which Names Does a Release Carry?
| Name | Comes from | Read against |
|---|---|---|
| The late owner | The title deed, the allotment or the land record | The death certificate, and the heirs' papers naming a parent |
| The heir giving up a share | Identity papers shown at registration | The heirs' certificate or family register |
| The heir receiving it | Identity papers shown at registration | The same family papers, and later the land record |
| Each party's father or husband | The deed's description of the party | The party's own identity papers |
| The witnesses | Their identity papers | The office's own record of the registration |
The late owner's name is the oldest and the least flexible. It was written by a deed writer or a revenue clerk decades ago, and the owner is no longer here to say which spelling was meant.
What Kinds of Mismatch Are There?
The late owner's name
- The title deed, the land record and the death certificate give two or three forms
- Initials, a title, an old spelling, a surname added later
- The death certificate or the land record is corrected, or the deed recites both
An heir's name
- A married daughter in her husband's surname
- Or an heir whose Aadhaar differs from the family register
- The deed recites both names, with the linking paper
A slip in the deed itself
- A name, a father's name or the property's description typed wrongly
- Found after registration, usually at mutation
- Cured by a rectification deed, signed by the same parties
The first two are settled before the deed, at little cost. The third costs a second deed and a second visit by every party, some of whom may live far away.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The death certificate has a spelling slip against the title deed | The Registrar corrects the death certificate | No |
| The title deed has the owner in initials or a short form | The release recites both forms, with papers showing they are one person | No |
| The land record has an old spelling | Correct the land record at the tehsil, or recite both | No |
| A married daughter's Aadhaar is in her husband's surname | The deed describes her as daughter of the late owner. Her marriage certificate is kept ready | No |
| An heir's Aadhaar differs from the family register | Correct whichever is wrong, before drafting | No |
| An heir's name is missing from the heirs' certificate | A corrected certificate from the tehsil | No |
| The registered deed has a typing slip | A rectification deed | No |
| A party has changed a name by choice | Gazette, recited in the deed | Yes |
A Gazette appears once in eight rows, and only for a living party. Nothing can be gazetted for the parent who has died.
What Should You Settle Before the Deed?
This is the general method. The drafting lawyer and the sub-registrar's office decide what is needed.
Step 1: Take out the paper that shows the late owner's title
The sale deed, the allotment letter or the land record. Note the owner's name exactly as it stands there.
Step 2: Read the death certificate against it
The name, the father's or husband's name and the address.
Step 3: List every heir, and each one's name on Aadhaar and PAN
With the relationship to the late owner. A married daughter is listed in her present name.
Step 4: Get the paper that shows who the heirs are
An heirs' certificate, the family register or a succession paper, as the registering office asks.
Step 5: Correct the paper that differs, before drafting
The death certificate at the Registrar, Aadhaar at an Aadhaar centre, the land record at the tehsil.
Step 6: Have the deed drafted with each name written in full
As on that person's identity papers, with the parent's or spouse's name, and any earlier name recited beside it.
Step 7: Read the draft aloud, with every party present
The names, the shares, the property's description and its boundaries.
Step 8: Register it, and then apply for mutation
At the sub-registrar's office, with two witnesses. The land record or house tax record is changed on the registered deed.
What About the Late Owner's Name?
- Everything in a release hangs on one fact: that the person who died is the person who owned.
- The title deed may read "Shri P. D. Uniyal", the land record "Pitamber Dutt", and the death certificate "Pitambar Datt Uniyal".
- The death certificate is the easiest of the three to change. The Registrar corrects it on the dead person's own identity papers.
- The land record is corrected at the tehsil, on the title deed and other proof.
- An old registered sale deed is not rewritten. Later papers are brought to it, or the release recites its form of the name with the present form beside it.
- A recital reads on these lines: the late owner, also written in some papers in another form, being one and the same person. The lawyer drafts it.
Read name correction in a death certificate and legal heir certificate, name correction in khatauni and land records and father’s name change and correction.
What About a Married Daughter's Release?
- A daughter inherits from a parent as a son does. In many families she then gives up her share to a brother who lives in the house.
- She left the family register on marriage, and her Aadhaar now carries her husband's surname and address.
- So the heirs' certificate may name her as "Sunita, daughter", and her Aadhaar as "Sunita Bisht, wife of".
- The deed should describe her both ways: by her present name and husband, and as the daughter of the late owner.
- Her marriage certificate links the two. Where the marriage was never registered, her school certificate naming her father serves.
- She has to sign of her own will, before the sub-registrar. Nobody can sign for her without a proper power of attorney.
It is her share to keep or to give. A page about names takes no side on that. Read name change after marriage, name correction in marriage registration certificate and Kumari, Devi and the husband’s surname.
What Happens at the Sub-Registrar's Office?
- The deed is written on stamp paper of the value the state fixes, and presented for registration.
- Each party appears in person, or through an attorney, with identity papers. The office takes photographs and thumb impressions.
- The office reads the name on the deed against the identity paper shown. A difference there stops the registration on the day.
- Two witnesses sign, and show their own identity papers.
- An heir abroad acts through a power of attorney. The names on it have to match the heir's passport and the deed.
- The registered deed is returned with the office's endorsement. Keep the original with the title deed.
We did not confirm the state's present stamp duty, fee or online steps for a release. Ask the office or the lawyer. Read power of attorney name mismatch and name change for NRIs from Uttarakhand.
What If There Is a Slip in a Registered Deed?
- A registered deed cannot be corrected with a pen. Any overwriting on it spoils it.
- A slip of fact, such as a spelling, a father's name, a plot number or a boundary, is corrected by a rectification deed.
- The same parties sign it, and it is registered at the same office.
- It can put right what was wrongly written. It cannot change who got what.
- Where a party will not sign, or has died, the correction may need a court. That is a lawyer's matter.
- Do it as soon as the slip is seen. A deed lying uncorrected for years is harder to mend, and blocks a sale or a loan.
Read name change in property documents and encumbrance certificate name mismatch.
What About Mutation, After Registration?
- A registered release changes who owns. It does not by itself change the Government's records.
- For farm land, the heir applies at the tehsil for the land record to be changed.
- For a house in a town, the heir applies to the municipal body for the house tax record.
- The office reads the deed against its own record of the late owner. The old spelling in that record meets the deed here.
- Electricity and water connections follow, on the mutation.
- A release made and never followed by mutation leaves the dead owner's name on the record, to trouble the next generation.
Read municipal house tax name change, name change in electricity bill and partition deed name mismatch, for a family that divides the property instead.
How Does the Central Gazette Route Work?
Use this where a living party to the deed has changed a name by choice, so that the family papers and that party's identity papers carry two different names. It does nothing for the late owner's name, a spelling or a married surname.
Step 1: Confirm that it is a change of name, and not a spelling or a married surname
Those are handled by reciting both names in the deed, with the linking paper.
Step 2: Ask the lawyer drafting the deed what the registering office expects
For a party whose identity papers and family papers carry two different names by choice.
Step 3: Fix the exact new name
The spelling that will go on Aadhaar, PAN and the deed.
Step 4: Make the affidavit and publish the newspaper notice
Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then update Aadhaar and PAN before the deed
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Sign the deed in the name your identity papers then carry, with the Gazette recited.
Would the Uttarakhand Gazette Do?
Registration and land records are the state's. A state Gazette may well be accepted. The Gazette of India is still the safer paper for everything else.
Step 1: Remember that land and registration are the state's
The sub-registrar and the tehsil are state offices.
Step 2: Ask the drafting lawyer which Gazette the office accepts
A state Gazette may be accepted here.
Step 3: Think about Aadhaar, PAN and the bank
The Gazette of India serves those as well.
Step 4: Contact the Roorkee press if a state notice suits you
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
To weigh the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do Families Make?
| Mistake | What to do |
|---|---|
| Drafting the deed before comparing the papers | Lay the title deed, death certificate and identity papers side by side first |
| Writing the late owner's name as the family says it | Copy it from the title deed, and recite other forms |
| Describing a married daughter only by her husband | Add "daughter of" the late owner |
| Leaving an heir out to save trouble | Every heir has to join or release |
| A release on plain paper, never registered | Register it |
| Not reading the draft before the day | Read it aloud, with every party |
| Correcting a registered deed by hand | Never. Make a rectification deed |
| Stopping at registration | Apply for mutation |
| Asking for a Gazette in the dead parent's name | There is no such thing. Recite and link |
A typical case we handle: three children in Dehradun inherited their mother's house. Two sisters wished to release their shares to their brother. The sale deed of 1986 named the owner "Smt. Kamla Devi, wife of R. S. Negi". Her death certificate read "Kamala Negi". The elder sister's Aadhaar read "Rekha Rawat". The brother asked us for Gazettes for all three. None was needed. The Registrar corrected the death certificate on the mother's Aadhaar. Their lawyer drafted the deed with her name as in the sale deed and the other form recited, and described each sister as her daughter with her marriage certificate annexed. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
Drafting and registering the deed, advice on which kind of deed to use, stamp duty, a minor's share, a rectification and any dispute among heirs.
When you do not need us
For the late owner's name in a different form, a spelling, a married daughter's surname and a slip in a deed. The Registrar, the tehsil and the drafting lawyer settle those. We are useful only where a living party has changed a name by choice and a Gazette notification is asked for.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. The deed is registered at the sub-registrar's office for the place where the property lies. The Gazette file, where one is needed, is prepared on WhatsApp.

What a release is, that it can favour only a co-owner, that it has to be registered, the effect of not registering it, the two witnesses, that it is not revocable at will and the court ruling on a release to one of several co-owners are from published guides by law and property writers. We did not read the Registration Act, the stamp law or the ruling itself, and did not confirm the state's stamp duty, fee or online steps. Rectification, a minor's share, a power of attorney for an heir abroad and mutation are general guidance. This page is about names. It is not advice on which deed to make. The drafting lawyer and the sub-registrar's office are the authority.

Names in a Relinquishment Deed: The Short Version
A release rests on the late owner's title and on the heirs being who they say they are. Lay the title deed, the death certificate, the heirs' certificate and each heir's identity papers side by side before anything is drafted. Correct the paper that differs at its own office. Let the deed recite each present name with any earlier form, and describe a married daughter as the late owner's daughter. Register it, and then apply for mutation.
