Encumbrance Certificate Name Mismatch in Uttarakhand
When a bank or a buyer points to an encumbrance certificate that spells the owner differently, shows a stranger's mortgage or leaves out a deed: how the search is made, why names decide what it finds, and how a wrong entry, a missing entry and a namesake's entry are each put right.
An encumbrance certificate name mismatch is cured at its source. The certificate copies registered deeds, so a wrong name in a deed is corrected by a deed of rectification. A wrong or missing entry in the search is put right by a fresh application at the sub-registrar's office, giving every form of the name. No Gazette is needed.

An encumbrance certificate is the paper a bank asks for before it lends against a house, and a careful buyer before paying. An encumbrance certificate name mismatch usually comes to light in a lawyer's title report, a week before a loan is due. This page explains encumbrance certificate name mismatch for property owners in Uttarakhand.
We do not obtain certificates or deal with sub-registrars, and this subject seldom needs a Gazette. That the certificate is issued on a search of registers and indexes is from the registration law and the state department's published service list. How searches go wrong is general guidance. For deeds themselves, read name change in property documents.
What Is the Certificate, and Who Issues It?
- What it is. A statement of the registered transactions found against a property for a stated period, or a statement that none was found.
- Who issues it. The sub-registrar's office where deeds for that property are registered, under the state's department of stamps and registration.
- What it rests on. The registration law opens the registers and their indexes to inspection on a fee, and lets certified copies be taken.
- In this state. The department's published service list includes a non-encumbrance certificate under its registration manual, and the search and inspection of records.
- Who asks for it. Banks, buyers and their lawyers.
The certificate adds nothing of its own. It is a list drawn from deeds already registered. That is the first thing to understand about any wrong name on it.
How Is the Search Made?
- The application. The applicant states the property, the names of the owners and the period to be searched.
- The indexes. Registration offices keep indexes to their registers: of the persons who executed or took under each deed, and of the properties.
- The search. The office, or its computer system, looks up the names and the property in those indexes for the years asked.
- The registers. Each entry found is checked against the copy of the deed.
- The certificate. The entries are listed, with the date, the kind of deed, the parties and the property.
The search goes by name and by description of the property. A name spelt one way in 1998 and another way in the application may not be found. A plot described by an old number, or by boundaries only, may not be found either. The certificate then looks clean when it is merely incomplete.
Which Names Appear on the Certificate?
| Name | Comes from | Can it be wrong? |
|---|---|---|
| The applicant | The application | Rarely matters. Anyone may apply |
| The first party to each deed | The deed: the seller, the giver, the borrower | As the deed has it |
| The second party to each deed | The deed: the buyer, the receiver, the lender | As the deed has it |
| The names searched | The application | Yes. This decides what is found |
A reader compares the parties in each entry with the owner's deeds and identity papers. A reader also looks down the list for a name that should not be there: a lender, a second buyer, a relative given a share.
What Kinds of Problem Are There?
Your entry, in a wrong spelling
- The certificate shows your deed, with your name or your father's name misspelt
- Usually the deed itself carries the slip
- Cured by correcting the deed, or the index where only that is wrong
An entry that is missing
- A deed in your chain does not appear
- The search was made under another spelling, another description or too few years
- Cured by a fresh search, asked for properly
An entry that is not yours
- A mortgage or a sale by a person of the same name, or a previous owner's old charge
- The bank reads it as a claim on your property
- Cured by showing the difference, or by a registered release where the charge was real
The second kind is the dangerous one, because it does not look like a problem. A certificate with nothing on it reassures everyone until the missing deed turns up.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The certificate has a spelling slip, and so has the deed | A deed of rectification, then a fresh certificate | No |
| The deed is right, and the certificate is wrong | An application to the sub-registrar's office, with a certified copy | No |
| A deed of yours is missing | A fresh search, with every form of the name and the property | No |
| A stranger's entry appears | Show the difference. A certified copy of that deed helps | No |
| A repaid mortgage still shows | A registered release from the lender | No |
| The father's name differs between two of your deeds | A lawyer's advice. Usually a rectification, or a recital that both are one person | No |
| The owner married after the deed and has a new surname | No correction. The marriage certificate links the names | No |
| The owner has changed a name by choice since the deed | Gazette, kept with the deeds | Yes |
A Gazette appears once. It links an owner's two names. It does not change what a certificate lists.
How Do You Put It Right?
This is the general method. Ask the sub-registrar's office for its form and fee.
Step 1: Read the certificate entry by entry
The date, the kind of deed, the parties and the property in each line.
Step 2: Put your title deeds beside it
Every deed in your chain should appear, in the names the deeds carry.
Step 3: Mark what is wrong, and how
A name spelt differently, an entry that is not yours, or a deed of yours that is missing.
Step 4: Take a certified copy of any deed in question
From the same sub-registrar's office. It shows what was actually registered.
Step 5: If the deed itself carries the wrong name, correct the deed
By a deed of rectification, with the other party. The certificate copies the deed.
Step 6: If the deed is right and the certificate or index is wrong, apply to the office
In writing, with the certified copy, for a fresh search and a corrected certificate.
Step 7: For an entry that is not yours, show how it differs
A different father's name, a different plot, a different village.
Step 8: Apply again, giving every form of each name and the full description of the property
A search is only as good as what it is asked to look for.
For correcting a deed, read gift deed name mismatch and partition deed name mismatch.
What If the Entry Belongs to a Namesake?
- In the hills a handful of first names and surnames are shared by a great many people. Two men called the same in one village is ordinary.
- A search by name therefore brings up other people's deeds, especially where the property was described loosely.
- A registered deed identifies a person by more than a name: the father's or husband's name, the address, and now an identity number and a photograph.
- Take a certified copy of the deed behind the stray entry. It will show whose it is.
- Put the differences in writing for the bank or the buyer: the father's name, the plot number, the village, the date.
- Where the office agrees the entry does not concern your property, ask for a certificate on a search limited to your plot.
The same thing happens in reverse. Your own mortgage may be sitting on a namesake's certificate. A full description of the property in every deed is what keeps the two apart.
What About an Old Mortgage That Still Shows?
- A mortgage made by a registered deed is entered in the registers. Repaying the loan does not remove the entry.
- It is cleared by a further registered deed from the lender, releasing the property.
- Borrowers collect their title deeds and a no-dues letter, and stop there. The entry stays on the record for the next search to find.
- Ask the bank for the release, and register it. A bank that has merged or moved still has to give it.
- The release names the borrower as the mortgage did. Where your name has since changed or been corrected, tell the bank before it is drafted.
- A previous owner's uncleared mortgage is the seller's to clear before a sale, not the buyer's to inherit.
Read home loan name mismatch.
How Do You Apply So That the Search Finds Everything?
- Every owner in the chain. Give the names of the present owner and of earlier owners for the period, as each deed has them.
- Every form of each name. With and without the surname, with initials, in the old spelling and the new.
- The father's or husband's name of each, which separates namesakes.
- The full description of the property. Village or ward, plot or khasra number, area and boundaries, as in the latest deed.
- Old numbers. Where plots were renumbered or a village came into a town, give the earlier description as well.
- The period. Ask the bank or your lawyer how many years it wants before you apply.
- The right office. Where the area was once under another sub-registrar, older deeds lie there.
The department's site carries an application for inspection or search, and guides describe an online search of registered deeds. Older years may be only in the office's books. Ask the office how far back its computer record goes.
What Does a Clean Certificate Not Show?
| Not shown | Where to look |
|---|---|
| Who is recorded as holding the land | The khatauni, at the tehsil |
| A mortgage made by depositing title deeds with a lender | Ask to see the original deeds. Lenders also record such charges in a central registry |
| An unregistered agreement, will or family arrangement | Ask the seller and the family |
| A pending court case or an attachment not registered at that office | The courts, and the seller's declaration |
| Dues of house tax, water or electricity | The offices concerned |
| Deeds registered at another office, or under another description | A wider search |
Certificates of this kind commonly carry a note that the office is not responsible for errors in the search. Treat the certificate as one check among several, never as a guarantee. Read name correction in khatauni and land records and municipal house tax name change.
How Does a Bank Read the Certificate?
- The chain. Its lawyer lists every deed by which the property passed, back for the period the bank requires.
- The match. Each deed in the chain should appear on the certificate, with the same parties.
- The link. The buyer in one deed should be the seller in the next, in the same name. A change of spelling between the two is noted.
- The strays. Any entry outside the chain has to be explained or cleared.
- The borrower. The last owner on the certificate should be the person asking for the loan, as on identity papers.
A lawyer's report that says "name discrepancy to be clarified" is asking for one of three things: a rectification, a linking paper, or a fresh certificate. Ask the lawyer which. Read building plan approval name mismatch.
Where Does a Gazette Come In?
Only where the owner is alive and has changed a name by choice since the deed, so that the certificate rightly shows the old name and identity papers the new one. The Gazette links the two for the bank or the buyer. It does nothing for a slip or a stray entry.
Step 1: Confirm that it is a change of name, and not a slip in a deed or a search
Those are settled at the sub-registrar's office.
Step 2: Fix the exact new name, and copy the name as your deeds have it
Letter by letter.
Step 3: Make the affidavit
State the old name, the new name, your father's or husband's name and your address. Sign before a notary.
Step 4: Publish the newspaper notice
In a daily local leading newspaper. Keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then keep the Gazette with your deeds
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Give the bank or the buyer a copy with the certificate.
Would the Uttarakhand Gazette Do?
It may, for a local buyer. A bank, or a lender from another state, is the reason to prefer the Gazette of India.
Step 1: Ask the bank or the buyer which Gazette it accepts
They are the readers of the certificate.
Step 2: Think about Aadhaar, PAN and a lender from elsewhere
The Gazette of India serves them all.
Step 3: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 4: Ask for the papers, the format and the fee, and submit
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
To weigh the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do Owners Make?
| Mistake | What to do |
|---|---|
| Applying under one spelling of the name | Give every form the deeds carry |
| Describing the property loosely | Copy the description from the latest deed |
| Taking a blank certificate as proof of a clean title | Check that your own deeds appear on it |
| Asking the office to change a name the deed carries | Correct the deed |
| Ignoring a stranger's entry | Get the deed's copy and show the difference |
| Not registering a release after repaying a loan | Ask the bank for it |
| Applying for too few years | Ask the bank what period it wants |
| Paying for a Gazette to fix a certificate | A Gazette does not alter the record |
| Paying a tout for a "clean" certificate | Apply at the office, and keep the receipt |
A typical case we handle: a shopkeeper in Rishikesh applied for a loan on his house. The certificate listed a mortgage of 2009 by "Rajesh Kumar". He was Rajesh Kumar Agarwal, and had never mortgaged anything. The bank's lawyer held the file, and a friend told him to get a Gazette declaring his full name. It would have proved nothing. He took a certified copy of the 2009 deed, which named a different father and a plot in another ward, and the bank accepted a fresh certificate on a search limited to his own plot. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
A title report, a deed of rectification, a release of mortgage, and any dispute over an entry.
When you do not need us
For a wrong spelling, a missing deed, a stranger's entry or an old mortgage. The sub-registrar's office, a lawyer and the lender settle those. We are useful only where an owner has changed a name by choice since the deed, and a Gazette notification is needed to link the two names.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. The certificate is issued by the sub-registrar's office for your property. The Gazette file, where one is needed, is prepared on WhatsApp.

That registers and indexes are open to inspection and search is from the Registration Act, 1908. That the state's department issues a non-encumbrance certificate under its registration manual, and its timeline, are from the department's published service list. That its site carries an application for inspection or search is as guides describe it. How a search is made, why entries are missed or strangers' entries appear, how a mortgage is cleared and what a certificate does not show are general guidance. We could not confirm the office's form or fee. A lawyer should read any title.

Names on an Encumbrance Certificate: The Short Version
An encumbrance certificate lists registered deeds, found by a search under names and a property description. It copies the deeds, so a wrong name in a deed is corrected in the deed. A missing entry means the search was asked for too narrowly: apply again with every form of every name and the full description. A stranger's entry is answered with a certified copy of that deed. A repaid mortgage needs a registered release. A clean certificate is one check, not a guarantee.
None of that needs a Gazette. To find out which paper to correct, send photos on WhatsApp 9540005064, and we will reply in working hours.
