Allotment Letter Name Mismatch in Uttarakhand: Builder Flats and Plots
For buyers of a flat or a plot from a builder or a development authority whose allotment letter or agreement for sale carries a name that differs from Aadhaar and PAN: which papers copy the name, who corrects them, what adding a co-allottee means, and why it has to be settled before the final deed.
An allotment letter name mismatch is corrected by the builder or authority that issued the letter, on a written request with Aadhaar and PAN. Do it before the agreement for sale is registered if you can, and in any case before the final deed. A registered agreement needs a registered correction. A spelling needs no Gazette.

A flat bought from a builder is paid for over years, on a chain of papers that begins with a form filled at a sales office. The name written there is copied onto everything that follows. An allotment letter name mismatch is that first entry disagreeing with the buyer's identity papers. This page explains allotment letter name mismatch for buyers in Uttarakhand.
We do not deal with builders or draft deeds. That is a lawyer's work. We prepare the Gazette notification, where a name has in fact been changed. What the real estate Act requires is from its text as a state authority publishes it. How a builder corrects its records is general practice. For a house already registered, read name change in property documents.
Which Papers Run From Booking to Deed?
- The booking or application form. Filled at the sales office, with the buyer's name, PAN and a first payment.
- The allotment letter. The builder's letter allotting a particular unit to the named buyer.
- The agreement for sale. Signed by both sides and registered.
- Demand letters and receipts. For each instalment, over the years of construction.
- The loan papers. The bank's sanction, and its agreement with the builder and the buyer.
- The possession letter. When the unit is handed over.
- The conveyance deed. The final registered deed that makes the buyer the owner.
Seven kinds of paper, and the name on the first sets the name on the last. Until the seventh is registered, the buyer owns a contract, not a flat.
What Does the Act Say?
From the text of the Real Estate (Regulation and Development) Act, 2016, as a state real estate authority publishes it.
| Point | What the Act says |
|---|---|
| At booking | The promoter makes stated information available to the allottee at the time of booking and issue of the allotment letter |
| The agreement for sale | A promoter shall not accept more than ten per cent of the cost as an advance or application fee without first entering into a written agreement for sale and registering it |
| The final deed | The promoter shall execute a registered conveyance deed in favour of the allottee |
| Cancellation | The promoter may cancel an allotment only in terms of the agreement for sale. An aggrieved allottee may approach the Authority |
The Act uses one word throughout: the allottee. The person named in the allotment and the agreement is the person in whose favour the deed is made. That is why a slip in that name matters more than it looks.
Where Does the Buyer's Name Appear?
| Paper | Made by | Corrected by |
|---|---|---|
| The booking form and allotment letter | The builder's sales office | The builder, on a written request |
| The agreement for sale | The builder's lawyers, signed by both and registered | A registered correction, signed by both |
| Receipts and the account statement | The builder's accounts | Follow the builder's record |
| The loan sanction and bank agreement | The bank | The bank, on Aadhaar and PAN |
| The possession letter | The builder | Follows the builder's record |
| The conveyance deed | Drafted from the agreement, registered | A rectification deed, after the event |
The first row costs a letter to correct. The last costs a second registered deed, with the builder's authorised signatory brought back to sign it. Everything in between gets harder as the months pass.
What Kinds of Mismatch Are There?
The same buyer, written differently
- A spelling, initials, a missing surname, a maiden name
- The allottee is the same person throughout
- A correction of the builder's record
A different set of allottees
- A wife or a parent to be added, or a name dropped
- The allottee itself changes
- Not a correction. A substitution or transfer, on the builder's terms
An allottee who has died
- The buyer died before the final deed
- The contract passes to the heirs
- Not a correction. A substitution of the legal heirs, on proof
Builders use the phrase "name change" for all three, and charge for the second. Be clear which you are asking for. A spelling corrected is not a transfer, and should not be billed as one.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The allotment letter has a spelling slip | A written request to the builder, with Aadhaar and PAN | No |
| It has initials or a short form | The same | No |
| It is in a maiden name, and identity papers are in a married one | The builder, on the marriage certificate | No |
| The registered agreement for sale has the slip | A registered correction, drafted by a lawyer | No |
| The bank's papers differ from the builder's | Correct the one that differs from Aadhaar and PAN | No |
| A spouse is to be added as co-allottee | Substitution, on the builder's form, with the bank's consent | No |
| The allottee has died | Substitution of the legal heirs | No |
| The buyer has changed a name by choice | Gazette, then Aadhaar and PAN, the builder and the bank | Yes |
A Gazette appears once in eight rows. The builder's customer desk settles most of the rest.
How Do You Put It Right?
This is the general method. Each builder and authority has its own form.
Step 1: Gather every paper the builder has given you
The booking form, the allotment letter, the agreement for sale, the demand letters and the receipts.
Step 2: Read the allottee's name on each
And the co-allottee's, the father's or husband's name, and PAN where printed.
Step 3: Put Aadhaar and PAN beside them
The final deed will be registered on these, at the sub-registrar's office.
Step 4: Find where the difference began
Usually the booking form, filled by a sales agent in a hurry. Everything after copied it.
Step 5: Write to the builder asking for the correction
With copies of Aadhaar and PAN. Ask for a corrected allotment letter, or a written note of correction.
Step 6: If the agreement for sale is registered, ask how it will be put right
A registered paper is corrected by a registered one, signed by both sides.
Step 7: Tell the bank, where there is a loan
Its sanction and its agreement with the builder carry the same name.
Step 8: Read the draft of the final deed before the day of registration
It is the last and cheapest moment to catch a slip.
Why Is Early Cheap?
- Before the agreement for sale is registered, the builder's record is only a record. A letter and a fresh printout correct it.
- Once the agreement is registered, the name is in a public register. It is corrected by another registered paper, with stamp duty and both sides present.
- Once the bank has lent on the agreement, the bank's papers carry the name too, and the bank has to agree.
- Once the final deed is registered, the correction is a rectification deed, and the builder may by then have closed its project office.
- So read the booking form before you sign it, and the allotment letter the day it arrives.
- The Act asks for the agreement to be registered before large payments. That is also the natural point to check every name.
Read encumbrance certificate name mismatch, for what a registered slip looks like to the next buyer.
What About Adding or Dropping a Co-Allottee?
- A flat booked in a husband's name, with the wife added later for the loan or for the family's sake, is very common.
- That changes who the allottee is. It is a substitution, and builders have a form and often a charge for it.
- Where there is a loan, the bank has to consent, and its own papers change.
- Before the final deed, the simplest course is to settle the names on the builder's record, so that the deed is made once, in the names wanted.
- After the final deed, adding a name is a transfer of a share in the property, by a gift or another deed, with its own duty.
- Ask the stamp office or a lawyer about duty where a woman is a buyer. We did not confirm the state's present rules.
Read gift deed name mismatch and relinquishment deed name mismatch, for a share moved after registration.
What About the Bank's Papers?
- A home loan for a flat under construction is given on the allotment letter and the agreement for sale.
- The bank reads those against the borrower's Aadhaar, PAN and income papers. A difference stops the sanction, or the next instalment.
- The bank and the builder sign an agreement about the loan, in which the borrower is named as the allottee.
- Every co-allottee is usually a co-borrower, and the reverse. The two lists of names have to be the same.
- The bank holds the title papers until the loan is repaid. A slip found at the end is corrected with the bank's knowledge.
- Tax deducted on payments to the builder, where it applies, is deposited against the buyer's and the builder's PAN. Ask a tax adviser.
Read home loan name mismatch, name change in PAN card and name mismatch on the income tax e-filing portal.
What If the Allottee Has Died?
- A buyer who dies before the final deed leaves a contract, part paid, and usually a loan.
- The heirs tell the builder and the bank in writing, with the death certificate.
- The builder substitutes the legal heirs as allottees, on proof of who they are and, where there are several, the others' consent.
- A loan insured on the borrower's life may be cleared by the insurer. Ask the bank at once.
- The name on the death certificate is read against the allotment letter. A difference there holds up the substitution.
- The final deed is then made in the heirs' names. It is never made in a dead allottee's name.
Read name correction in a death certificate and legal heir certificate and succession certificate name mismatch.
What About a Development Authority's Allotment?
- Plots and flats are also allotted by development authorities and the state's housing board, by draw or by application.
- The allottee's name comes from the application form, and the papers that follow are the authority's own.
- A correction is asked for at the authority's office, on identity papers, under its own rules.
- A transfer, where the authority allows one at all, has its own conditions, fees and waiting periods.
- Many old allotments were never turned into a registered deed. The allotment letter of thirty years ago is the only paper the family holds.
- There the original allottee's name is the root, and heirs have to tie themselves to it before any deed is made.
We did not read any authority's rules for this page. Ask its office. Read building plan approval name mismatch and municipal house tax name change.
Where Does a Gazette Come In?
Only where the buyer has changed a name by choice, so that the builder's papers and today's identity papers carry two different names. It has no part in a spelling, a co-allottee added or an allottee who has died.
Step 1: Confirm that it is a change of name, and not a spelling or a new allottee
A spelling is corrected by the builder. A new allottee is a transfer.
Step 2: Ask the builder and the bank what they need for a changed name
Many ask for a Gazette for a change of name by choice.
Step 3: Fix the exact new name
The spelling that will go on Aadhaar, PAN, the agreement and the final deed.
Step 4: Make the affidavit and publish the newspaper notice
Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then update in order
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then Aadhaar and PAN, the builder's record and the bank, all before the final deed.
Would the Uttarakhand Gazette Do?
Registration is the state's, and a state Gazette may be accepted there. A bank usually wants the Gazette of India, and that settles it for most buyers.
Step 1: Remember who reads the paper
The builder, the bank and the sub-registrar's office.
Step 2: Ask the bank first
A bank follows Aadhaar and PAN, and usually wants the Gazette of India.
Step 3: Ask the drafting lawyer what the registering office accepts
A state Gazette may be accepted there.
Step 4: Contact the Roorkee press if a state notice suits you
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
To weigh the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do Buyers Make?
| Mistake | What to do |
|---|---|
| Letting the sales agent fill the booking form | Fill or read it yourself, against Aadhaar |
| Filing the allotment letter unread | Read it the day it comes |
| Asking for a correction on the phone | Write, and keep the reply |
| Signing the agreement for sale with a known slip | Have it corrected before registration |
| Paying a transfer charge for a spelling | A correction is not a transfer. Say so in writing |
| Adding a co-allottee with the builder and not the bank | Both lists of names must match |
| Reading the final deed on the day of registry | Ask for the draft a week before |
| Paying for a Gazette to fix initials | The builder corrects them on identity papers |
| Leaving an old authority allotment unregistered | Ask the authority how to complete it |
A typical case we handle: a couple in Dehradun booked a flat in a project on the Haridwar road. The booking form, filled by an agent, named the buyer "Ankit K Sharma". His PAN read "Ankit Kumar Sharma", and the bank would not sanction the loan on the allotment letter. The builder's desk asked for a Gazette and a transfer charge. Neither applied. He had not changed his name, and the allottee was the same person. He wrote to the builder with his PAN and Aadhaar, asked for a corrected allotment letter before the agreement was registered, and declined the charge in writing. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's job, not ours
Drafting a correction to a registered agreement, a rectification deed, a substitution, a complaint to the real estate authority and any dispute with a builder.
When you do not need us

That a promoter may not accept more than ten per cent without a registered agreement for sale, that the conveyance deed is executed in favour of the allottee, the information given at booking and the limits on cancellation are from the text of the Real Estate (Regulation and Development) Act, 2016, read on a state real estate authority's site. We did not read the state's own real estate rules, any authority's allotment rules or the stamp law, and did not confirm duty for women buyers. Names on an Allotment Letter: The Short Version
A flat bought from a builder runs on a chain of papers, and the name on the booking form is copied down the chain to the final deed. Read every paper against Aadhaar and PAN. Ask the builder in writing to correct a slip, before the agreement for sale is registered if you can. A registered agreement needs a registered correction. Adding a co-allottee, or heirs after a death, is a substitution and not a correction. Tell the bank, and read the draft deed before the registry.
A spelling needs no Gazette. To find out which paper to correct, send photos on WhatsApp 9540005064, and we will reply in working hours.
