Trademark Registration Name Mismatch in Uttarakhand
For shop owners, makers and small firms whose trade mark application or registration carries the owner's name differently from PAN, identity papers or business registrations: what the law allows to be corrected, on which request, and how a change of name differs from a change of owner.
A trademark registration name mismatch is corrected at the trade marks registry. Before registration, the applicant asks for a correction or amendment of the application. After registration, the proprietor asks for an error in the name to be corrected or a change of name to be entered. A sale or an inheritance is recorded separately, as a change of owner.

A trade mark protects a brand for the person named as its owner. Where that name is wrong, the protection is hard to use. A trademark registration name mismatch tends to surface when the owner tries to stop a copier, list on a marketplace or sell the business. This page explains trademark registration name mismatch for small businesses in Uttarakhand.
We do not file trade mark applications. We prepare the Gazette notification, where an owner's own name has been changed. What can be corrected is from the Trade Marks Act, 1999, as published guides quote it. The forms, fees and times are for a trade marks agent or the registry to confirm. For other business papers, read name change in Udyam and GST registration.
What Is a Trade Mark, and Who Owns It?
- What it is. A name, a logo or another sign that marks one trader's goods or services from another's.
- Who registers it. The trade marks registry, a central office, on an application.
- The stages. An application is filed, examined, advertised for objections and then registered.
- The owner. Called the applicant while the application is pending, and the registered proprietor after registration.
- How long it lasts. A registration runs for a term and is renewed, so the record may be read decades later.
Two names appear in every record and are easily confused. One is the mark, such as the name over a sweet shop. The other is the person who owns it. This page is about the second.
What Does the Act Allow?
From the Trade Marks Act, 1999, as published guides quote it, with the forms those guides name.
| Stage | What the Act says | Request |
|---|---|---|
| Before registration | The Registrar may, at any time, before or after acceptance, permit the correction of any error in or in connection with the application, or permit an amendment of the application | The form for amendment of an application, which guides name as TM-M |
| After registration: an error | On the registered proprietor's application, the Registrar may correct any error in the name, address or description of the registered proprietor | The post-registration form, which guides name as TM-P |
| After registration: a change | The Registrar may enter any change in the name, address or description of the person registered as proprietor | |
| A change of owner | An assignment or a transmission is entered in the register on a separate application, with proof of title | The application to register the new owner |
The law is generous about names. A wrong name can be put right at every stage. What it does not allow is using a "correction" to slip in a different owner. That is why the last row is kept apart.
How Is the Owner's Name Recorded?
- The name. Of the individual, the firm or the company that owns the mark.
- The status. What kind of owner it is: an individual, a sole proprietor, a partnership, a company and so on.
- "Trading as". A proprietor is often entered with the person's name followed by the trade name of the business.
- The address. Of the owner's place of business, and an address for service.
- The agent. Where one filed the application, on an authority from the owner.
Each of these is typed at filing, usually by an agent, from a message or a visiting card. A shop owner known in the market as "Pappu Bhai" may find that name in the record. The person on PAN is someone else.
What Kinds of Mismatch Are There?
A slip in the record
- A spelling, a missing surname, a nickname or a wrong status
- The owner was always the same person
- Corrected on proof of the true name
The owner's name has changed
- An individual married or changed a name. A firm or a company was renamed
- The same owner, under a new name
- Entered as a change, with the paper that shows it
The owner has changed
- The business was sold, a partner left, a proprietorship became a company, or the owner died
- A different person or body now owns the mark
- Recorded as an assignment or a transmission, never as a correction
The third is the one families get wrong. A father registers the mark, the son runs the shop for twenty years, and nobody records that the business passed. On paper the mark still belongs to a man who has retired or died.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| A pending application has a spelling slip in the applicant's name | A request to correct the application, with PAN and identity proof | No |
| A registered mark has a slip in the proprietor's name | A request to correct the register, with proof | No |
| A nickname or trade name was entered as the owner | A correction, on proof of who the owner always was | No |
| The proprietor married and has a new surname | A change of name, on the marriage certificate and updated identity papers | No |
| The proprietor changed a name by choice | A change of name, with the Gazette notification | Yes |
| The firm or company was renamed | A change of name, on the firm's or company's own papers | No |
| The business was sold or handed to a son or daughter | An assignment, entered in the register | No |
| The proprietor has died | A transmission to the heirs, entered in the register | No |
A Gazette is the proof in one row: an individual who has changed a name by choice. In every other row another paper does the work.
How Do You Put It Right?
This is the general method. A trade marks agent or a lawyer files the request.
Step 1: Find the application or registration number
And look up the record on the registry's public search.
Step 2: Read the applicant's or proprietor's name, status and address
Exactly as the record has them.
Step 3: Put PAN, Aadhaar and the business registrations beside it
Correct Aadhaar first if it is the odd one. And the firm deed or the company's certificate, where the owner is a firm or a company.
Step 4: Decide what kind of difference it is
A typing slip, a change in the same owner's name, or a different owner altogether.
Step 5: See whether the mark is still pending or already registered
The request, and its form, depend on that.
Step 6: File the request on the right form, with proof
A correction or amendment before registration. A correction or change of the proprietor's particulars after it.
Step 7: Where the owner has changed, record the transfer
An assignment by deed, or a transmission on death, is entered on its own application.
Step 8: Check the record again, and keep the order
Then bring every licence, listing and label to the same name.
Individual, Proprietor, Firm or Company?
| Owner | Name in the record | Read against |
|---|---|---|
| An individual | The person's own name | PAN and Aadhaar |
| A sole proprietor | The person's name, trading as the business name | PAN, and the business registrations in the trade name |
| A partnership | The firm's name, with its partners | The partnership deed and the firm's PAN |
| A company | The company's name | Its certificate of incorporation |
A proprietorship is not a separate person. The mark belongs to the individual, and the trade name only describes how that person trades. An application filed in the trade name alone, as if the shop were the owner, is a common slip. So is an application marked as an individual's when the business is in fact a firm of two brothers.
Fee concessions depend on the status claimed. Proof of that status, such as a small enterprise registration, has to be in the applicant's own name. Read name change in Udyam and GST registration.
What If a Firm or a Company Changes?
- A firm is renamed. The same firm, under a new name. A change in the proprietor's name is entered, on the amended deed and the firm's papers.
- Partners come and go. The record lists partners. A retirement or an admission is entered, on the deed that records it.
- A company is renamed. Entered on the fresh certificate the company registry issues.
- A proprietorship becomes a firm or a company. This is a new owner. The mark has to be assigned to it in writing, and the assignment entered.
- A firm is dissolved. The deed of dissolution says who takes the mark. That person applies to be entered.
- Brothers divide a business. Only one can own a given mark. Settle it in the family arrangement, in so many words.
Read name change in partnership firm records and director and company records name change.
What Happens When the Owner Dies?
- A mark is property. It passes with the business, under a will or to the heirs.
- An applicant who dies before registration. The rules provide for the application to be carried on by the person entitled.
- A registered proprietor who dies. The person who takes the mark applies to have the transmission entered in the register.
- The proof. The death certificate, and the paper that shows title: a will with probate where needed, a succession paper or the heirs' agreement.
- The names. The dead owner's name on the death certificate against the register, and the heir's on the heir's own papers.
- Renewal. A mark still in a dead person's name can lapse unrenewed, because the notice goes to an old address.
Read name correction in a death certificate and legal heir certificate, will and probate name mismatch and succession certificate name mismatch.
What Is the Agent's Part, and Yours?
- Most applications are filed by an agent or a lawyer, on a signed authority from the owner.
- The authority itself names the owner. A slip there is repeated in the application.
- Give the agent a copy of PAN and of the business registration, and say "the owner is this person, in this spelling".
- Ask for the filed application and read the owner's name, status and address the same day.
- The record is public. Anyone can look up an application number on the registry's search and see what was entered.
- Low-cost online filing services type hundreds of applications a day. Their errors are ordinary ones, and are yours to catch.
A slip found in the first week is a small request. The same slip found when a copier's lawyer points to it is a weakness in your case.
Where Is the Owner's Name Read Later?
- In a dispute. A notice or a suit against a copier is brought by the registered proprietor. The other side reads the register first.
- On a marketplace. Online marketplaces that protect brands ask for the registration, and compare its owner with the seller's account.
- In a licence or a franchise. Only the owner can permit another to use the mark.
- At a sale of the business. The buyer's lawyer checks that the seller is the person on the register.
- At a bank. A lender valuing a business looks at who owns its name.
- At renewal. Notices go to the proprietor at the address on record.
None of these readers will accept "it is the same person, really". They accept the register, or a certified entry correcting it. Read name change in trade licence and shop establishment and FSSAI licence name change.
How Does the Central Gazette Route Work?
Use this where an individual owner has changed a name by choice. The Gazette is then the proof filed with the request to enter the change. It does nothing for a slip in the record, or for a change of owner.
Step 1: Confirm that it is the owner's own name that has changed
A slip in the record is corrected by the registry on proof of the true name.
Step 2: Fix the exact new name
The spelling that will go on PAN, Aadhaar, the business registrations and the trade marks record.
Step 3: Make the affidavit
State the old name, the new name, your father's or husband's name and your address. Sign before a notary.
Step 4: Publish the newspaper notice
In a daily local leading newspaper. Keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then update in order
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then PAN and Aadhaar, the business registrations, and the trade marks record with the Gazette as proof.
Would the Uttarakhand Gazette Do?
The trade marks registry is a central office, and a mark may be enforced anywhere in the country. The Gazette of India is the one to prefer.
Step 1: Remember that the registry is a central office
It reads central identity papers.
Step 2: Think about PAN, the tax registration and a court in another state
The Gazette of India serves them all.
Step 3: Contact the Roorkee press only if a state notice suits you
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 4: Ask for the papers, the format and the fee, and submit
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do Owners Make?
| Mistake | What to do |
|---|---|
| Never reading the filed application | Read the owner's name, status and address at once |
| Filing in the shop's name as if it were a person | The proprietor is the owner, trading as the shop |
| Giving the agent a nickname | Give PAN, and the spelling on it |
| Calling a sale or a handover a "correction" | Record an assignment |
| Leaving the mark in a late father's name | Have the transmission entered |
| Turning a shop into a company and forgetting the mark | Assign the mark to the company |
| Changing your own name and not telling the registry | Enter the change, with proof |
| Getting a Gazette to fix a typing slip | The registry corrects a slip on identity proof |
| Letting the address go stale | Keep it current, for renewal notices |
A typical case we handle: a woman in Haldwani ran a pickle business and had registered its name as a mark. The register showed the proprietor as "Meenu", the name everyone used. Her PAN and food licence read "Meenakshi Bisht". An online marketplace refused to accept her as the brand's owner, and she asked us for a Gazette. Her name had never been changed, so a Gazette had nothing to record. Her agent filed a request to correct the proprietor's name, with her PAN and licence, and the register was corrected. This is an illustrative example of the type of case we handle, not a named client review.
What is an agent's or a lawyer's job, not ours
Every filing with the registry, an assignment deed, a transmission on death, and any dispute over who owns a mark.
When you do not need us

That an application can be corrected or amended before registration, and that after registration an error in the proprietor's name can be corrected or a change entered, are from sections 22 and 58 of the Trade Marks Act, 1999, as published guides quote them. The form names are as those guides give them, and the rule numbers differ between guides, so we cite none. That an assignment or transmission is entered separately, and that the rules provide for an applicant's death, are from the index of the Trade Marks Rules, 2017. Fees, times and which office serves the state we did not confirm. A trade marks agent or the registry is the authority.

The Owner's Name in a Trade Mark: The Short Version
A trade mark record names the mark and its owner. The owner's name should be the one on PAN, with the right status. A slip can be corrected before registration and after it. A change in the same owner's name is entered with the paper that proves it. A sale, a handover within the family or a death changes the owner, and is recorded as an assignment or a transmission. Read the filed application the day your agent files it.
A slip needs no Gazette. To find out if your case needs one, message us on WhatsApp 9540005064, and we will reply in working hours.
