Consumer Complaint Name Mismatch in Uttarakhand: Bills and Warranties
For people who want to complain about a faulty product or a poor service and find that the bill or warranty is in another name, or that they do not know the seller's proper name: who can complain under the law, how a difference is explained, and why the other side's name matters as much as your own.
A consumer complaint name mismatch is explained inside the complaint, not cured by changing a name. The law treats a user of goods with the buyer's approval as a consumer. Say how you relate to the name on the bill, attach proof, and name the seller by its correct legal name. No Gazette is needed.

A washing machine fails in its first year, or an insurer refuses a fair claim, and the buyer decides to complain. Then someone notices that the bill is in a father's name, or says only "Sharma ji". A consumer complaint name mismatch stops many people before they begin, and it should not. This page explains consumer complaint name mismatch, and what the law says about who can complain.
We do not file consumer complaints, and this subject needs no Gazette. Who is a consumer, who can complain and the time limit are from the Consumer Protection Act, 2019, read in a published copy. For a slip in an order already passed, read name wrong in a court order or case papers.
Which Two Names Does Every Complaint Carry?
The complainant
- The person who bought, or who used with the buyer's approval
- Named as on an identity paper
- Tied to the purchase by the bill and the payment
- The person in whose favour an order is made
The opposite party
- The seller, the service provider, the manufacturer
- Named by its legal name, not its signboard
- With an address where a notice will reach it
- The party against whom an order runs
People worry about the first and forget the second. A complaint against "the showroom near the bus stand" is as weak as one by a person the bill does not name.
What Does the Act Say?
From the Consumer Protection Act, 2019, read in a published copy, and from accounts of the national e-filing portal.
| Point | What the Act says |
|---|---|
| A consumer of goods | A person who buys goods for consideration, and any user of the goods other than the buyer, when the use is made with the buyer's approval |
| Not a consumer | A person who obtains goods for resale or for a commercial purpose |
| How bought | Offline or online, by teleshopping or direct selling |
| After a death | The complainant can be the consumer's legal heir or legal representative |
| For a minor | The parent or legal guardian |
| Time | A complaint is filed within two years of the cause of action. Delay can be excused for recorded reasons |
The first row answers the commonest worry on this page. The law does not ask that the complainant be the name on the bill. It asks that she be the buyer, or a user with the buyer's approval.
Where Do Names Appear?
| Paper | Whose name | Written by |
|---|---|---|
| The bill or invoice | The buyer, and the seller with its tax number | The seller |
| The payment record | The person whose account or card paid | The bank |
| The warranty card or registration | Whoever filled it | The buyer, or nobody |
| The order and delivery record | The account holder, and the receiver | The platform |
| The complaint and its affidavit | The complainant, and the opposite party | The complainant |
| The commission's order | Both, copied from the complaint | The commission |
The last row is the reason to be exact in the one before it. An order is copied from the complaint. A cheque in a misspelt name, or a direction to a party that does not exist, is a victory that cannot be collected.
What Kinds of Mismatch Are There?
The bill names someone else
- A husband, a father, a friend whose account was used
- The complainant is the user
- Explained, with the buyer's approval shown
The bill names the buyer loosely
- A nickname, a surname only, a misspelling, or "cash"
- The same person as the complainant
- Supported by the payment record and other papers
The other side is named wrongly
- A shop's signboard, a brand, a call centre
- The legal seller or maker is someone else
- The correct name is found before filing
The third is the one that can lose a case. The first two are met by a sentence of explanation. The third sends a notice to nobody, or an order against a name that owns nothing.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The bill is in a spouse's or parent's name | Complain as the user, with the buyer's approval shown | No |
| The bill has a nickname or a spelling slip | Explain it, and attach the payment record | No |
| The bill has no name | The payment record, delivery and serial number | No |
| The order was placed through another's account | The account holder complains, or approves your use | No |
| The bill is in a maiden name, the identity paper a married one | The marriage certificate | No |
| The buyer has died | The legal heir complains | No |
| The seller's proper name is not known | The tax number on the bill, and the warranty card | No |
| The complainant changed a name by choice after the purchase | The Gazette notice, attached | Yes |
A Gazette appears once in eight rows, and only as a paper already held or needed for other reasons.
How Do You Put It Right?
This is the general method, for a simple complaint. For a large claim, take a lawyer's advice.
Step 1: Gather every paper of the purchase
The bill, the payment record, the warranty card, the order confirmation, messages with the seller.
Step 2: Read whose name each carries
The buyer on the bill may be you, a family member, a nickname or nobody.
Step 3: Decide who will complain
The person who paid, or the person who used the thing with the buyer's approval. One of them, named as on an identity paper.
Step 4: Explain any difference in a sentence, inside the complaint
"The bill is in my husband's name. I am the user of the machine, with his approval."
Step 5: Attach what proves that sentence
The buyer's short statement, a marriage certificate or family paper, the delivery at your address.
Step 6: Find the opposite party's correct legal name and address
From the bill's tax number, the warranty card and the company's own site. Not the signboard.
Step 7: Write to the seller first, and keep the proof
A dated complaint to its service address or grievance officer.
Step 8: File within time, in the commission for where you live
Online or in person. Read the names once more before you submit.
What If the Bill Is in a Relative's Name?
- In most homes one person pays and another uses. A husband's card buys the machine his wife runs.
- The Act counts as a consumer a user of the goods other than the buyer, when the use is with the buyer's approval.
- So the user can complain in her own name. She says so plainly in the complaint.
- The buyer's approval is shown by a short signed statement from him, and by their living at one address.
- Or the buyer himself complains. Then it is his name, as on his identity paper, throughout.
- Choose one of the two and keep to it. A complaint that slides between names invites an objection.
The same definition excludes a person who bought for resale or for a commercial purpose. A bill in a firm's name raises that question. Read name change in Udyam and GST registration.
What If the Bill Has a Loose Name, or None?
- A shop writes what it hears: a surname, a nickname, "Rawat ji, Tehri".
- A bill is evidence of a sale, not a certificate of identity. A loose name on it does not undo the sale.
- What ties you to it is everything else: the payment from your account, the delivery to your address, the serial number on the product in your house.
- Say in the complaint that the bill's "Rawat ji" is you, and give your full name as on your identity paper.
- Where there is no bill at all, a payment record, a delivery note or a service job sheet can stand in. Ask a lawyer how far.
- For the next purchase, ask the shop to write your full name and to give a printed bill with its tax number.
What About Online Orders and Warranties?
- The Act says in terms that buying includes online transactions.
- An online order is in the name on the account, which may be a son's or a neighbour's who "knows how".
- The invoice may show a different seller from the platform, with its own legal name and tax number. That seller is a party.
- A warranty usually follows the product, on proof of purchase. A card left blank is common, and seldom fatal.
- Where the maker asks for registration, register in the user's own name, with the invoice number.
- Save the order page, the invoice and every message. Platforms do not keep them for ever.
Read UPI name mismatch, on who a payment record names.
Why Does the Other Side's Name Matter?
- A commission's notice goes to the opposite party at the name and address in the complaint.
- Its order, if you win, directs that party to pay or to repair.
- A shop's signboard is a trade name. Behind it stands an owner, a firm or a company with a legal name.
- A brand is not a party. The company that makes or imports the product is.
- The tax number on a bill identifies the legal seller. The warranty card or the label names the maker and its address.
- Name both the seller and the maker where both are at fault, each correctly.
This is the point at which a lawyer earns a fee. An order against the wrong party is of little use, however just.
What About After a Death, and for a Child?
- Where the consumer has died, the Act lets a legal heir or legal representative complain.
- This arises most in insurance and medical cases, where the policy holder or patient is the one who died.
- The heir shows the death certificate and how she is related, with her own name as on her identity paper.
- The dead person's name should be the same on the policy or bill and on the death certificate. Where it is not, that is settled first.
- For a child, the parent or legal guardian complains, naming the child and herself.
- The two years still run. A family in grief should note the date.

Where Does a Gazette Come In?
Only where the complainant changed a name by choice between the purchase and the complaint. The notice is then one more paper attached. It has no part in a bill in a relative's name or a shopkeeper's nickname.
Step 1: Confirm that your own name has in fact changed
A bill in a relative's name, or a nickname on an invoice, is not a change of name.
Step 2: See if a linking paper already does the work
A marriage certificate joins a maiden name on a bill to a married name on an identity paper.
Step 3: Fix the exact new name
The spelling that will go on Aadhaar and every later paper.
Step 4: Make the affidavit and publish the newspaper notice
Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, and file the notice in the case
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. A copy of the notice goes with the complaint.
Which Gazette Should You Use?
A complaint may be read by a company far from the state. The Gazette of India is the one to prefer.
Step 1: Remember who reads the complaint
A consumer commission, and a company that may be anywhere in the country.
Step 2: Prefer the Gazette of India
It is recognised across the country.
Step 3: A state notice is still a public record
A commission may take it as evidence. Ask your lawyer.
Step 4: Contact the Roorkee press only if a state notice suits you
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do Complainants Make?
| Mistake | What to do |
|---|---|
| Giving up since the bill is in another name | Complain as the user, and say so |
| Hiding the difference | State it in the first paragraphs |
| Altering a bill to add your name | Never. That is forgery |
| Naming a signboard or a brand | The legal seller and maker |
| Writing your own name loosely | As on your identity paper |
| Complaining only by phone | Write, and keep proof of sending |
| Letting two years pass | Note the date of the fault |
| Throwing away the box and the card | Keep them through the warranty |
| Asking for a Gazette to match a bill | An explanation is what is needed |
A typical case we handle: a woman in Rishikesh wanted to complain about a refrigerator that failed in four months. The bill read "Mr Negi", her husband, who works abroad. The dealer had told her that only the person on the bill could complain. A relative asked us if her name could be "put on the bill" by Gazette. It could not, and nothing of the kind was needed. She complained as the user, attached her husband's signed approval and their marriage certificate, and named the dealer and the maker by the names on the bill's tax line and the warranty card. This is an illustrative example of the type of case we handle, not a named client review.

It is reviewed by Advocate Vipin Chauhan.
That a consumer of goods includes a user with the buyer's approval, that a person buying for resale or a commercial purpose is excluded, that buying includes online transactions, and that a complainant includes a legal heir or representative after a death and a parent or guardian for a minor, are from sections 2(5) and 2(7) of the Consumer Protection Act, 2019, read in a published copy. The two years, the power to excuse delay, filing where the consumer lives or works and the online portal are from accounts of the Act. We did not read the rules, the fee or any commission's practice. How a difference is explained, what supports a loose bill and how the other side is named are general guidance, and not a substitute for a lawyer's advice. The consumer commission is the authority.

Names in a Consumer Complaint: The Short Version
The law counts as a consumer both the buyer and a user with the buyer's approval. A bill in a relative's name does not bar a complaint. Decide who complains, name that person as on an identity paper, and explain the difference in a sentence with proof. A loose name on a bill is supported by the payment and delivery records. Name the seller and the maker by their legal names. File within two years.
No Gazette is needed. If you are unsure whose name a paper should be in, send photos on WhatsApp 9540005064, and we will reply in working hours.
