Forest Rights Title Name Mismatch in Uttarakhand
For forest-dwelling families in Uttarakhand who have claimed, or hold, rights under the Forest Rights Act, 2006, where a name on the claim or title differs from Aadhaar, the caste certificate or the family register: how a claim is decided, why both spouses should be on the title, who corrects a slip, and what heirs do.
A forest rights title name mismatch is corrected through the committees that decide claims: the forest rights committee for a pending claim, and the sub-divisional committee for an issued title, with Aadhaar and other proof. A married couple's title should carry both names. No Gazette is needed for a home name or spelling.

Forest-dwelling families in Uttarakhand, among them Van Gujjar herders and hill villages that have long depended on the forest, can claim their rights under a 2006 Act. A claim is written in the village and decided by committees, and a title follows. A forest rights title name mismatch is a name on that title differing from Aadhaar or the family register. This page explains forest rights title name mismatch.
We do not file claims, and this subject needs no Gazette in the ordinary case. What the Act says is from the Act as published. We did not read Uttarakhand's own instructions. For the revenue record, read khatauni and land records.
What Is the Act, in Brief?
- The law. The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006.
- Who it recognises. Forest-dwelling Scheduled Tribes, and other traditional forest dwellers who meet its test.
- What it recognises. Individual rights, such as land under cultivation, and community rights, such as grazing and forest produce.
- How. A claim through the gram sabha, decided by committees at the sub-division and district.
- What results. A title in the right holders' names.
The claim is often written by hand, in the village, from what the family says. That is where a home name or a missing surname enters the record.
What Does the Act Say?
From the Forest Rights Act, 2006, as published.
| Point | What the Act says |
|---|---|
| Joint title | The rights are registered jointly in the names of both spouses in the case of married persons, and in the name of the single head where a household has one |
| Heritable | The rights are heritable, but not alienable or transferable |
| Other traditional forest dwellers | Those who for at least three generations before 13 December 2005 primarily resided in and depended on the forest. A generation is 25 years |
| The gram sabha | Starts the process of determining rights |
| The committees | A sub-divisional level committee examines the gram sabha's resolution, and a district level committee gives final approval |
The first row matters most for names. A title in only the husband's name is not what the Act provides for a married couple.
Where Are the Names Written?
| Record | Made by | Where it is corrected |
|---|---|---|
| The claim | The claimant, with the forest rights committee | The committee, before the gram sabha passes it |
| The title | On the district committee's approval | Through the sub-divisional committee |
| Aadhaar | The identity authority | An Aadhaar centre |
| The caste certificate | The tehsil | The tehsil |
| The family register | The village office | The village office |
A title is used for years and passed to heirs. Its names should be the names on the holders' other papers.
What Kinds of Mismatch Are There?
A home name on the claim
- Written as the village says it
- Aadhaar carries a fuller name
- Corrected by the committee
A spouse left out
- The title names only the husband
- The Act provides for both
- Both names recorded
A holder who has died
- The rights are heritable
- The heirs are not yet recorded, or heirship is disputed
- Recorded through the committee
The second is not a spelling at all. It is a matter of who holds the rights, and the Act is clear on it.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| A pending claim has a home name | The forest rights committee | No |
| An issued title has a slip | The sub-divisional committee | No |
| The wife is not on the title | The sub-divisional committee, under the Act's joint rule | No |
| Aadhaar is the wrong paper | An Aadhaar centre | No |
| The caste certificate differs | The tehsil | No |
| The holder has died | The committee, with the death certificate | No |
| The family register differs | The village office | No |
| The holder changed a name by choice | Gazette, then Aadhaar and the title | Yes |
A Gazette appears once in eight rows. The committees and the tehsil settle the rest.
How Do You Put It Right?
This is the general method. Ask the committee for its own form.
Step 1: Read the names on the claim or the title
The claimant, the spouse, and the father's names.
Step 2: Put each person's Aadhaar beside it
And any caste certificate the claim relied on.
Step 3: Decide which paper is wrong
A claim written by hand in a gram sabha may carry a home name.
Step 4: Correct Aadhaar or the caste certificate first, where they are the odd ones
At their own offices.
Step 5: For a slip on a pending claim, tell the forest rights committee in writing
Before the gram sabha passes it on.
Step 6: For a slip on an issued title, apply to the committee that recommended it
Through the sub-divisional committee, with proof.
Step 7: See that a married couple's title is in both names
The Act provides for joint registration.
Step 8: Keep the title with the family register entry
Heirs will need both.
What About the Claim and the Gram Sabha?
- The Act makes the gram sabha the body that starts the process.
- Its forest rights committee helps families prepare claims and verify them.
- The claim names the claimant, the spouse and other details.
- Give the committee Aadhaar for each person, so names are copied from it.
- Read the claim before the gram sabha passes it.
- A slip caught at this stage is corrected in a minute.
Read family register and panchayat voter list.
What About Both Spouses on the Title?
- The Act provides that rights are registered jointly in the names of both spouses in the case of married persons.
- A title in the husband's name alone leaves the wife without a recorded right.
- Ask the sub-divisional committee to record both names.
- The wife's name should be as on her Aadhaar.
- A household headed by one person, such as a widow, is recorded in that person's name.
- Keep the marriage certificate, or the family register entry, with the title.
What About the Caste Certificate and Residence?
- A forest-dwelling Scheduled Tribe claimant may be asked for a caste certificate.
- Other traditional forest dwellers must show three generations of residence and dependence, a generation being 25 years.
- That evidence often names parents and grandparents.
- Their names in old records may differ from today's papers.
- Correct the caste certificate at the tehsil where it differs.
- Explain old forms of ancestors' names with the family register.
What About Heirs?
- The Act makes forest rights heritable.
- It also says they cannot be sold or transferred.
- When a holder dies, the heirs apply to the committee to be recorded.
- Take the death certificate and the family register entry.
- The dead holder's name should match on all three.
- Do not try to sell or transfer the land. The Act forbids it.
What About Community Rights?
- The Act also recognises community rights, such as grazing and the collection of forest produce.
- A community title is in the community's name, not a person's.
- The village's name and boundaries should match the revenue records.
- These are not the same as Uttarakhand's van panchayats, which are village forest councils under separate rules.
- A community claim is made through the gram sabha too.
- Ask the committee how community titles are recorded.
Where Does a Gazette Come In?
Only where a holder has changed a name by choice. A home name on a claim needs the committee.
Step 1: Confirm that a name has in fact changed
A home name on a claim is not a change of name.
Step 2: Remember the order
Aadhaar and the caste certificate first, then the title.
Step 3: Fix the exact new name
The spelling that will go on Aadhaar and the title.
Step 4: Make the affidavit and publish the newspaper notice
Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then update in order
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then Aadhaar, the caste certificate and the title.
Which Gazette Should You Use?
The title is issued under a central Act by state committees, and read with Aadhaar. The Gazette of India serves both.
Step 1: Remember whose title this is
Issued under a central Act, by committees in the state.
Step 2: Remember what it is read with
Aadhaar, and the state's caste certificate.
Step 3: Prefer the Gazette of India
It serves Aadhaar and the state's offices.
Step 4: Contact the Roorkee press only if a state notice suits you
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 5: Download the notice
Search egazette.gov.in and save the PDF.
For the difference between the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do Families Make?
| Mistake | What to do |
|---|---|
| Saying names aloud for the claim | Show each person's Aadhaar |
| Not reading the claim before the gram sabha | Read it |
| A title in the husband's name alone | Ask for both names |
| A caste certificate in another spelling | Correct it at the tehsil |
| Heirs not recorded after a death | Apply to the committee |
| Trying to sell the land | The Act forbids it |
| Losing the title | Keep it with the family register entry |
| Paying someone to "speed up" a claim | Go through the gram sabha |
| Asking for a Gazette for a claim | The committee corrects it |
A typical case we handle: a Van Gujjar family near the Rajaji forest received a title in the husband's name alone, written as "Nooru". His Aadhaar read "Noor Mohammad", and his wife was not named. His son asked us about a Gazette. None was needed. With help from a local support group, they applied to the sub-divisional committee with both Aadhaar cards, asking that the title carry the husband's full name and the wife's name as the Act provides. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's or support group's work, not ours
A rejected claim, a petition against a committee's decision, and a dispute over a boundary.
When you do not need us
For a home name, a spouse's name, an heir or a caste certificate. The committees and the tehsil settle those. We are useful only where a person has changed a name by choice and a Gazette notification is asked for.
Which Areas of Uttarakhand Do We Cover?
All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. Claims are made through the gram sabha of your village. Send photos on WhatsApp, and we will tell you which name differs.

That rights are registered jointly in both spouses' names, that they are heritable but not alienable or transferable, the definition of other traditional forest dwellers, the gram sabha's role, and the sub-divisional and district committees, are from the Forest Rights Act, 2006, as published. We did not read the rules as amended, or Uttarakhand's instructions on correcting titles or recording heirs. How names come to differ, and the order of correction, are general guidance. The committees under the Act are the authority.
