Name Change With Pending Court Case, Loan or Criminal Record in Uttarakhand

For people who wish to change a name while a court case is pending, a loan is running, or a past record exists: what a change of name does and does not alter, whom you have to tell, what a form's question about earlier names means, and why a name changed to hide something does not work.

Quick answer

A name change with pending court case, a running loan or a past record changes only the name. The case, the debt and the record stay with the person. Tell the court through your lawyer, and tell every lender. Answer truthfully wherever a form asks about earlier names. A change made to hide something does not hide it.

A person in Uttarakhand with court case papers, loan documents and a Gazette name change notice laid out on a desk
A change of name alters only the name: a pending case, a loan and any record stay with the person, so tell the court and every lender.

People ask if they can change a name while something is pending against them. Some have an ordinary reason and fear it will be blocked. A few hope the new name will leave the matter behind. A name change with pending court case or loan is possible for the first, and useless for the second. This page explains name change with pending court case, loan or record.

This page is general information, not legal advice, and no substitute for the lawyer who is handling a case. What the Gazette office does is from our page on its undertaking. The rest is general principle, stated cautiously. For a wrong name in a police report, read FIR name correction.

What Does a Change of Name Alter?

What changes

  • The name you are known by
  • The name on each record you update afterwards
  • The name on papers issued to you later

What does not

  • Who you are in the eyes of the law
  • What you owe, and what is owed to you
  • Cases you have brought, and cases against you
  • Any order, sentence or condition that binds you
  • Papers and judgments already written in the old name

The law looks at the person, and a name is a label for the person. Change the label and the person, with everything attached to the person, is where it was.

What Can Be Said With Confidence?

What can be said about a change of name while a case, loan or record exists
PointPosition
The Gazette officeIt does not hold an inquiry. It prints what the applicant declares, and the applicant signs an undertaking of responsibility for the facts
A bar on applyingWe found none in the Gazette procedure for a person with a pending case or a loan. A particular court order or condition may say otherwise in a particular case
Debts and casesThey attach to the person, and continue under either name
Old recordsThey stay in the name used at the time. The Gazette links the two names
DeceptionUsing a new name to deceive, or to avoid a legal process, can be an offence in itself
FormsWhere a form asks about earlier names or past proceedings, the truthful answer is owed

None of this replaces advice on your own matter. A bail order, a decree or a loan agreement may carry a term that bears on you. Only someone who has read it can say.

Whom Do You Have to Tell?

Who should be told of a change of name while a matter is pending
WhoHowWhy
A court where you are a partyThrough your lawyer, by applicationSo that the record and any decree match your identity papers
A lenderThe Gazette and updated identity papers, at the branchSo that the loan account, the security and your papers agree
A person whose loan you guaranteed, and that lenderIn writingA guarantee stays yours
The police station or court concerned, if you are on bail or under a conditionAs your lawyer advisesThey should hear it from you first
An employerWith the GazetteService and verification records carry the old name
Any office whose form asksOn the formThe question is put so that the two names can be joined

Telling is what separates a change of name from a concealment. A person who has told the court and the bank has nothing to explain later.

What Kinds of Pending Matter Are There?

A civil case

  • A property, family, money or service dispute
  • You are a plaintiff, a defendant or a party
  • The court is told, and the record shows both names

Money owed

  • A loan, a credit card, a guarantee, a cheque case
  • The lender's record, the security and the credit report are in the old name
  • The lender is told, and the account updated

A criminal case or a past record

  • An accused on bail, a person convicted, or a person acquitted
  • Police and court records carry the old name and other identifying details
  • Your lawyer's advice first. Then truthful disclosure wherever asked

The third calls for the most care. Not since a change is forbidden, but since the consequences of doing it carelessly fall on your liberty and not on your pocket.

Which Case Is Yours?

Situations of a person changing a name while a matter is pending and what to do
The situationWhat to do
A woman changing a surname on marriage, with a home loan runningChange it. Tell the lender, with the marriage certificate or Gazette
A party to a property suit, changing a name for an ordinary reasonTell your lawyer first. The court is informed by application
A borrower in default who hopes a new name gives a fresh startIt does not. The debt and the credit record follow the person and the PAN
An accused on bailYour lawyer's advice before anything
A person acquitted, who wants to leave the matter behindYou may change your name. Answer forms truthfully afterwards
A person with an old conviction applying for a jobDisclose as the form asks, in both names
A person who wants safety from someoneKnow that the notice is public. Take advice first
A wrong name in a police report, not a change at allA correction, through the police or the court

Many people asking are in the first two rows, and have nothing to fear but a missed step.

How Is It Done Properly?

This is the general order. The third step comes before the fourth, not after.

Step 1: Be clear with yourself why you want the change

A new name is yours to take. It is not a way out of anything that already binds you.

Step 2: List what is pending in your present name

Court cases, loans, guarantees, bail or other conditions, and police matters.

Step 3: Speak to the lawyer who is handling any case

Before you publish. Ask if any order or condition bears on a change of name, and how the court is to be told.

Step 4: Publish the change honestly

The affidavit and the notice carry both names. You take responsibility for what they say.

Step 5: Tell the court, through your lawyer

So that the record shows your present name beside the old one.

Step 6: Tell every lender and anyone you have guaranteed

Give the Gazette and updated identity papers, and have the loan account updated.

Step 7: Disclose the earlier name wherever a form asks

A passport application, a job form, a police verification form.

Step 8: Keep the Gazette with your case papers and loan papers

It is the link between the two names, for as long as either matter lasts.

What About a Pending Court Case?

  • A case is between persons. Your change of name does not end it, pause it or alter your position in it.
  • The court's record names you as you were when the case began.
  • If you win, a decree in the old name has to be acted on by offices that now see your new one. That is the practical reason to tell the court.
  • The court is told by an application through your lawyer, with the Gazette. How the name is then shown is for the court.
  • Commonly the old and new names appear together, so that nobody is in doubt who is meant.
  • Do this soon after publication. A change mentioned for the first time at the end of a case invites questions.

We give no opinion on procedure in any court. Your lawyer will know the form. Read a name wrong in a court order or case papers and succession certificate name mismatch.

What About a Loan or a Guarantee?

  • A loan is owed by you. It is not owed by your name.
  • The lender's record, the mortgage or hypothecation, and the credit bureau's report all carry the old name, tied to your PAN.
  • After a change, your identity papers move to the new name. The loan account should move with them.
  • Give the lender the Gazette and updated Aadhaar and PAN, and ask for the account, and any security papers, to be noted.
  • When the loan is repaid, the release of a mortgage or of a vehicle's loan entry is then in a name that matches your papers.
  • A guarantee you gave for another person's loan binds you in the same way. Tell that lender too.

A new name does not clear a default or raise a credit score. Read name mismatch in a credit report, home loan name mismatch and name change in bank records.

What About a Criminal Case or Record?

  • A police or court record identifies a person by more than a name: parentage, address, photograph and often fingerprints.
  • A change of name does not alter that record, and does not separate you from it.
  • A person on bail is released on conditions, as a named person. Ask your lawyer before changing a name, and how the court is to be told.
  • A person acquitted, or who has served a sentence, may change a name like anyone else. The earlier record stays where it is.
  • A police verification for a job or a passport asks about earlier names and past cases. The truthful answer joins the two names.
  • Using a new name so that a past case is not found is concealment, and a wrong in itself.

We did not read any law on this for the page, and say nothing about your own case. Read name mismatch in police verification and character certificate.

What About Forms That Ask About Earlier Names?

  • Many forms ask if you have ever been known by another name, or changed your name.
  • A passport application asks this, and asks separately about criminal proceedings.
  • Job applications, security clearances and visa forms ask the same in their own words.
  • The question exists so that records in the two names can be found and joined.
  • Answer yes, give the old name, and attach the Gazette. That is all that is needed.
  • An answer of no, when the truth is yes, is a false statement on that form. It can cost the passport or the job by itself, whatever lay behind it.

Read name change in passport and visa application name mismatch.

Why Does It Matter That a Change of Name Is Public?

  • A change of name is made by telling the public. That is what the newspaper notice and the Gazette are for.
  • Both print the old name and the new name together, with an address.
  • The Gazette is published online and can be searched.
  • So a change of name is the opposite of a disguise. Anyone who looks can connect the two names.
  • This matters to a person hoping to hide from a creditor or a court: the hope is misplaced.
  • It matters differently to a person who wants distance from someone dangerous. The notice publishes where you live. Take advice from a lawyer or a support organisation before publishing.

We could not confirm any procedure for keeping an address out of a notice. Ask the Gazette office. Read the newspaper notice and downloading a Gazette copy.

What Are the Steps of the Gazette of India Route?

The ordinary steps. What is particular here is the truthfulness of the affidavit, and what you do after publication.

Step 1: Fix the exact new name

The spelling that will go on Aadhaar, PAN and every later paper.

Step 2: Make the affidavit, stating the old name, the new name and the true reason

Sign before a notary. Say nothing in it that is not so.

Step 3: Publish the newspaper notice

In a daily local leading newspaper. Keep the full original page.

Step 4: Type the form and sign the undertaking

Two typed copies, signed in your old name with two witnesses. The undertaking is your responsibility for the facts.

Step 5: Prepare the CD, photographs and certificate

The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.

Step 6: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult. It is not refunded.

Step 7: Send the file yourself

To the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054.

Step 8: Update Aadhaar and PAN, then tell the court and the lenders

In that order, so that the papers you give them already agree.

See gazette name change in Uttarakhand and documents to update after a Gazette name change.

Which Gazette Should You Use?

A court, a bank and the passport office may all read the notice. The Gazette of India is the one to use.

Step 1: Count who will read the notice

A court, banks, the passport office and the police may each do so.

Step 2: Use the Gazette of India

It is the one recognised by all of them, in any state.

Step 3: Do not choose a little-read notice in the hope it goes unseen

A notice meant not to be noticed defeats its own purpose, and looks like concealment.

Step 4: Contact the Roorkee press only if a state notice suits another purpose

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.

Step 5: Download the notice

Search egazette.gov.in and save the PDF.

For the difference between the two, read Uttarakhand Gazette vs Gazette of India.

Which Mistakes Are Made?

Common mistakes when changing a name while a matter is pending
MistakeWhat to do
Thinking a new name clears a debtThe debt follows the person
Publishing before speaking to your lawyerThe lawyer first
Not telling the courtAn application, soon after publication
Leaving the loan account in the old nameTell the lender
Answering "no" to a question about earlier namesYes, with the Gazette
Giving a false reason in the affidavitThe true reason, plainly
Believing the Gazette "approved" the change after checking youIt printed what you declared
Using old and new names for different dealingsOne name, from the date of the change
Forgetting that the notice is publicWeigh that before you publish

A typical case we handle: a shopkeeper in Roorkee, whose business loan had gone bad, asked us to change his name so that he could "start again" with another bank. We told him plainly that it would not work. His PAN would stay the same, the credit record would follow it, and the notice would print both names side by side. We did not take the work. He was better served by speaking to his lender about the loan itself. This is an illustrative example of the type of case we handle, not a named client review.

When we will not help

Where the purpose of a change is to mislead a court, a lender, an employer or the police. We prepare a Gazette file for a person changing a name for an honest reason, and that includes people with a case or a loan pending.

Name Change With Pending Court Case, Loan or Record: Frequently Asked Questions

Can I make a name change with pending court case?+
We found no rule in the Gazette procedure that bars it. The change does not affect the case. You remain the same party, and the court should be told of the new name through your lawyer. Take your lawyer's advice before publishing.
Does a change of name end a debt or a loan?+
No. A loan is owed by the person, not by the name. It stays yours under either name.
Does a change of name remove a criminal record?+
No. Police and court records stay as they are, in the name used then, and are linked to you by other details. A new name does not make a new person.
Will the court's papers be changed to my new name?+
The court decides how its record is shown, on an application. Commonly both names appear, the old with the new. Ask your lawyer.
Do I have to tell my bank?+
Yes. Give it the Gazette and updated identity papers. A loan account left in the old name while your papers change causes trouble for you, not for the bank.
Will my credit report follow me?+
Yes. A credit record is tied to your PAN and your lenders' reports, not to the spelling of your name.
Does the Gazette office check if I have a case or a loan?+
As our page on the undertaking explains, the Gazette office does not hold an inquiry. It prints what you declare, and you take responsibility for it.
Is it an offence to change a name to avoid a creditor or the police?+
Using a new name to deceive someone, or to avoid a legal process, can amount to an offence, whatever the Gazette says. The change itself is lawful. The deception is not.
I was acquitted. Can I change my name to leave the matter behind?+
You may change your name for any honest reason. The old record remains, and forms that ask about earlier names or past proceedings still have to be answered truthfully.
I am on bail. Does a change of name affect it?+
Ask your lawyer before doing anything. Bail is granted to a named person on conditions, and the court should not learn of a new name from someone else.
Does a passport application ask about this?+
A passport application asks about changes of name and about criminal proceedings. Answer both truthfully. A false answer is a separate wrong.
I want a new name to be safe from someone. Will the notice give me away?+
A change of name is published. The newspaper notice and the Gazette print the old name, the new name and an address, and the Gazette is searchable online. If your safety is the reason, take advice first.
I stood guarantor for someone's loan. Does that change?+
No. A guarantee binds you as a person. Tell that lender too.
Will my new name appear in old judgments?+
No. A judgment already given stays as it was written. The Gazette is the link, if anyone needs to connect the two.
Can a name be changed while a property dispute is pending?+
The dispute is not affected. Tell your lawyer, so that the court's record and any later decree carry a name that matches your identity papers.
Do you advise on pending cases?+
No. This page is general information. For a pending case, your own lawyer's advice comes first. We prepare the Gazette file.

Who Wrote and Reviewed This Page?

This page is written by the Documentation Desk Team of UttarakhandNameChange.com, the team that prepares Gazette files for people across Uttarakhand.

It is reviewed by Advocate Vipin Chauhan.

That the Gazette office holds no inquiry and prints what an applicant declares on an undertaking of responsibility is from our page on the undertaking, which names its source. That a notice prints the old and new names with an address, and is published online, is from the Gazette of India itself. That debts, cases and records attach to the person and continue under either name, that deception by a new name can be an offence, and how courts and lenders are told, are general principle, stated cautiously and not from any statute or judgment read for this page. We found no bar in the Gazette procedure on a person with a pending matter, and did not search court rules. Nothing here is advice on any case. Your own lawyer is the authority on yours.

A Name Change With Something Pending: The Short Version

A change of name alters the name and nothing else. A case, a loan, a guarantee and a record stay with the person. If you have an honest reason, speak to the lawyer handling any case, publish truthfully, then tell the court and every lender, and disclose the earlier name wherever a form asks. A notice prints both names and an address, so a change of name hides nothing.
