Bail Surety Name Mismatch in Uttarakhand: Surety Bond Papers

For people in Uttarakhand who are asked to stand surety for a relative's bail, and find that their name on Aadhaar, the land record or the vehicle registration does not agree: what a court reads, what the law asks of a surety, how a difference is explained, and when it is better to find another surety.

Quick answer

A bail surety name mismatch is met by explaining it, not by changing a name. Fill the bond in the surety's identity paper name, and say in the surety's affidavit how the land record or vehicle paper refers to him. If bail is urgent and the papers differ badly, choose a surety whose papers agree. No Gazette is needed.

A surety fills the bail bond in his identity paper's name, and explains in his affidavit how the land record or vehicle paper refers to him.

When a court grants bail, it usually asks for one or two sureties: relatives or neighbours who sign a bond and show they are good for its amount. In the hills that is often a khatauni, written years ago in a short name. A bail surety name mismatch is the gap between that record and the surety's Aadhaar. This page explains bail surety name mismatch for families in Uttarakhand.

We do not arrange sureties, and bail is a lawyer's work. The sections cited are from the Bharatiya Nagarik Suraksha Sanhita, 2023, which replaced the old Code on 1 July 2024. Each court's practice on surety papers is its own. For a slip in the court's order, read name wrong in a court order or case papers.

What Is a Surety, in Brief?

  • The bond. A promise to pay a sum if the person on bail does not appear.
  • The accused's bond. Signed by the person released.
  • The surety's bond. Signed by a relative, friend or neighbour who answers for him.
  • Sufficiency. The court satisfies itself that the surety can pay the sum, commonly from a land record or other property paper.
  • Identity. The surety is identified from an identity paper, and often in person.

So a surety's name is read on at least three papers: the bond he signs, the identity paper he shows, and the paper that proves his means. They were made at different times, by different offices.

What Does the Law Say?

From the Bharatiya Nagarik Suraksha Sanhita, 2023, as published, with the old Code's matching sections in brackets.

What the Bharatiya Nagarik Suraksha Sanhita says about bail bonds and sureties
PointWhat the law says
The bondSection 485 (441): before release, a bond is executed by the person and by one or more sufficient sureties, that he will attend as directed
Fitness of suretiesSection 485(4): to decide whether sureties are fit or sufficient, the court may accept affidavits on those facts, or hold an enquiry, or have one made
DeclarationSection 486 (441A): every surety declares before the court the number of persons for whom he has stood surety, including the accused, with particulars
DischargeSection 489 (444): the procedure for discharging sureties
Deposit insteadSection 490 (445): a court may accept a deposit of money in place of a bond, except a bond for good behaviour
ForfeitureSection 491 (446): the procedure when a bond is forfeited

The second row is the useful one here. A court may take an affidavit about the surety. That affidavit is where a difference in names is explained.

Where Is the Surety's Name Written?

Papers that carry a surety's name and where each is corrected
PaperWritten byWhere it is corrected
The surety bondFilled for the surety, in courtFilled correctly in the first place
The identity paperAadhaar, a voter card or similarIts own office
The land recordThe revenue office, often long agoThe tehsil
A vehicle registrationThe transport officeThe transport office
The surety's affidavit and declarationSworn by the suretyWritten correctly in the first place

The bond and the affidavit are under the family's own control. The others take days or weeks to correct. That decides what can be done in time.

What Kinds of Mismatch Are There?

A loose name in the land record

  • A short form, a home name, a missing surname
  • The same person as on Aadhaar
  • Explained in the affidavit, corrected later

The land is not yet in the surety's name

  • Still in a father's or grandfather's name, awaiting succession
  • Not a spelling at all
  • Another paper, or another surety

The identity papers disagree

  • Aadhaar in one form, the voter card in another
  • The bond follows one, the clerk reads the other
  • The bond is filled from one, and the other explained

The second is common in the hills, and it is a question of ownership, not of spelling. No explanation makes a father's land the son's on paper.

How Do You Put It Right?

This is the general method. Follow the lawyer's directions for the particular court.

Step 1: Ask the lawyer what the court will want from each surety

The amount of the bond, the number of sureties, and the papers to show sufficiency.

Step 2: Have each surety lay out his identity paper and the paper of his means

Aadhaar or a voter card, and a land record, vehicle registration or other paper.

Step 3: Read the surety's name on each, letter by letter

With his father's name and address.

Step 4: Where they differ, choose a surety whose papers agree, if time is short

Bail is often needed in days. A correction takes longer.

Step 5: Otherwise correct the odd paper first

The land record at the tehsil, the registration at the transport office, Aadhaar at its centre.

Step 6: Fill the bond and the surety's declaration in the name on the identity paper

And say in the affidavit how the other paper's name refers to him, where it differs.

Step 7: Bring the originals to court

The court or its verifying officer may ask to see them.

Step 8: Keep copies of everything filed

A surety remains bound until discharged.

What About the Land Record?

  • Many sureties in Uttarakhand show a khatauni to prove their means.
  • Hill land records were written long ago, often with a home name or a father's name alone.
  • Where it is plainly the same person, a court may take an affidavit that explains it.
  • Where the land stands in a dead parent's name, the surety is not yet the recorded owner.
  • A mutation at the tehsil puts it in the heirs' names. It takes time, and is worth doing for its own sake.
  • Ask the lawyer whether the court will verify the record through the tehsil. Some courts do.

Read name correction in khatauni and land records and name change in property documents.

What About Vehicle and Other Papers?

  • Where land is not available, a surety may offer other papers of his means, as the court allows.
  • A vehicle registration, a fixed deposit or a salary slip are offered in practice.
  • Each carries the surety's name as its office wrote it.
  • Read each against the identity paper before going to court.
  • A Government employee standing surety should check what his service rules say.
  • Which papers a court accepts is for that court. Ask the lawyer.

Read vehicle RC name correction and name change in Aadhaar card.

What Goes in the Surety's Affidavit?

  • The law lets a court accept an affidavit on the surety's fitness and sufficiency.
  • Write the surety's name as on his identity paper, with his father's name and address.
  • Where the land record or another paper names him differently, say so plainly, and that both names are his.
  • Attach copies of the papers that show it: Aadhaar, the record, a family register entry.
  • Make the separate declaration of how many persons he stands surety for. It is required.
  • Do not swear what is not true. A false affidavit is an offence, and a surety's is read closely.

Read name change affidavit, on what an affidavit is, and the family register.

What If Bail Is Urgent?

  • An order for bail does not release a person until the bonds are accepted.
  • Every day spent correcting a surety's papers is a day more in custody.
  • So where one surety's papers are tangled, find another whose papers agree.
  • The law allows a deposit of money in place of a bond in some cases. Ask the lawyer.
  • Correct the tangled papers afterwards, for their own sake.
  • Carry originals and copies of everything to court. A missing paper costs a day.

Read name change with a pending court case.

What Does a Surety Take On?

  • A surety promises that the person released will appear when called.
  • If he does not, the bond can be forfeited and the surety asked to pay.
  • A surety who no longer wishes to answer for him can apply to the court to be discharged.
  • So stand surety only for someone you trust, and keep in touch with the case.
  • Keep a copy of the bond, with the case number and the court.
  • Being named as a surety is a matter of record. Your name on it should be your own, correctly.

Read same name as another person, on being confused with someone of the same name.

Where Does a Gazette Come In?

Not in bail. It comes in only where a surety has changed a name by choice, and it should have been done long before. A surety who has one shows it with his older papers.

Step 1: Confirm that the surety's own name has in fact changed

A spelling or a short form in a land record is not a change of name.

Step 2: Remember the calendar

Bail is needed in days. A Gazette takes weeks.

Step 3: Fix the exact new name

The spelling that will go on Aadhaar, the land record and other papers.

Step 4: Make the affidavit and publish the newspaper notice

Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.

Step 5: Type the form and sign the undertaking

Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.

Step 6: Prepare the CD, photographs and certificate

The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.

Step 7: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult. It is not refunded.

Step 8: Send the file yourself, then update in order

Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then Aadhaar, the land record and other papers.

Which Gazette Should You Use?

A surety's papers are partly the state's and partly central. The Gazette of India serves both.

Step 1: Remember who reads a surety's papers

A court, with the state's land records and central identity papers.

Step 2: Remember that the land record is the state's

It may accept a state Gazette.

Step 3: Prefer the Gazette of India

It serves Aadhaar as well as the state's offices.

Step 4: Contact the Roorkee press only if a state notice suits you

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.

Step 5: Download the notice

Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do Families Make?

Common mistakes with names in a bail surety's papers
MistakeWhat to do
Bringing a surety without reading his papersRead them the night before
Offering land still in a dead father's nameAnother paper or another surety
Filling the bond in the land record's short nameThe identity paper's name, with an explanation
Hiding a differenceState it in the affidavit
Forgetting the declaration of other suretyshipsMake it, truthfully
Leaving originals at homeBring them to court
Waiting to correct a record before bailChoose a surety whose papers agree
Standing surety for a stranger for moneyNever. You answer for him
Asking for a Gazette for a suretyAn affidavit explains it

A typical case we handle: a man in Pauri was to stand surety for his nephew. His khatauni read "Kundan", his name as a boy. His Aadhaar read "Kundan Singh Bisht". A clerk raised it, and a relative rang us about a Gazette. None was needed, and it would have taken weeks. The lawyer had him file an affidavit stating both forms were his, with his Aadhaar and family register entry. He corrected the khatauni at the tehsil afterwards. This is an illustrative example of the type of case we handle, not a named client review.

What is a lawyer's job, not ours

The bail application, the bond and affidavit, the court's verification, and any discharge or forfeiture.

When you do not need us

For a surety's spelling, a short name in a land record and a vehicle paper. The lawyer, the tehsil and the transport office settle those. We are useful only where a person has changed a name by choice and a Gazette notification is asked for.
