Maintenance Order Name Mismatch in Uttarakhand: Wife and Children

For women and children in Uttarakhand who have a court's order for maintenance, and find a name in it that differs from Aadhaar, a birth certificate or the bank account: why it matters for payment and enforcement, who corrects the order, and what to do when a name changes after it is made.

Quick answer

A maintenance order name mismatch is corrected by the court that made the order, on an application through the lawyer, where the slip is in the order. Where an identity paper is wrong, that office corrects it. Give the payer a bank account in the exact name in the order. No Gazette is needed.

A mother in Uttarakhand checking the names of herself and her child in a court maintenance order against their identity papers and bank passbook
A maintenance order copies the names in the petition, so read each name against the identity papers, and have the court correct any slip in its own order.

A woman who wins an order for maintenance for herself and her children has a paper that must work for years: at the bank, month after month, and in court if payment stops. Its names come from the petition, often typed in a hurry. A maintenance order name mismatch is one of those names differing from Aadhaar or the bank. This page explains maintenance order name mismatch in Uttarakhand.

We do not handle maintenance cases. That is a lawyer's work. The sections cited are from the Bharatiya Nagarik Suraksha Sanhita, 2023, and the Supreme Court's 2020 judgment in Rajnesh v. Neha. For slips in any court order, read name wrong in a court order or case papers.

What Is a Maintenance Order, in Brief?

  • What it is. A court's order that a person pay a monthly sum to support his wife, children or parents.
  • Who makes it. A family court, or a magistrate, or the court hearing a marriage case.
  • Who it names. The person who pays, and each person to be paid, with their relationship.
  • How long it runs. Until changed or ended by the court, or as the order says.
  • How it is paid. As the order says. Often into a bank account.

The order is read by a bank every month, and by a court whenever it has to be enforced. A name that does not match is a small obstacle in the first place and a larger one in the second.

What Do the Law and the Court Say?

From the Bharatiya Nagarik Suraksha Sanhita, 2023, and the Supreme Court's judgment of November 2020 in Rajnesh v. Neha, as reported.

What the law and the Supreme Court say about maintenance of wives and children
PointWhat is said
The provisionSection 144 of the Sanhita provides for orders of maintenance of wives, children and parents. It replaced section 125 of the old Code on 1 July 2024
Other lawsPersonal laws and the marriage Acts also provide for maintenance, in their own proceedings
DisclosureThe Supreme Court directed in 2020 that both sides file an affidavit disclosing assets and liabilities in maintenance proceedings
From whenThe same judgment held that maintenance be awarded from the date of the application
EnforcementThe section provides for enforcing an order where payment is not made, on an application within the time it allows

The disclosure affidavit is the first paper in which names matter. Fill it in the name on your identity paper, and the order is likely to follow.

Which Names Does an Order Carry?

Names in a maintenance order and what each is read against
Name in the orderRead againstWhere it matters
The wifeHer Aadhaar and bank accountEvery payment
Each childThe birth certificate, school record and AadhaarA child's share, and later claims
The husband or payerHis Aadhaar and addressEnforcement against him
Fathers' names and addressesThe same papersTelling one person from another

The order copies the petition. So a slip made in the petition, by whoever typed it, appears in the order unless someone reads it in time.

What Kinds of Mismatch Are There?

A slip in the order

  • A letter wrong, a surname missing, "Smt. Rawat" with no first name
  • Copied from the petition
  • Corrected by the court

A slip in an identity paper

  • A child's birth certificate or the wife's Aadhaar
  • The order is right, the paper is not
  • Corrected at that paper's office

A name that changed after the order

  • A child's surname changed, or the mother's name restored
  • The order is true for its date
  • The linking paper is carried with it

The first is cheapest to fix soon after the order. Years later, with a bank and a school asking, it is the same application with more at stake.

How Do You Put It Right?

This is the general method. The lawyer who ran the case is the person to start with.

Step 1: Read the order for every name in it

The wife, each child, the husband, and their fathers' names and addresses.

Step 2: Put each person's identity paper beside it

Aadhaar for the wife and husband, a birth certificate or Aadhaar for each child.

Step 3: Decide which paper is wrong

The order follows the petition. A slip in the petition travels into the order.

Step 4: For a slip in the order, ask the lawyer to apply to the same court

A clerical slip in a name is corrected by the court that made the order.

Step 5: For a slip in an identity paper, correct it at its office

Aadhaar at its centre, a birth certificate with the Registrar.

Step 6: Give the payer the bank account in the payee's exact name

Where payment is made to an account, the account's name should be the name in the order.

Step 7: Keep a record of every payment received and missed

With dates. It is what the court reads if the order is to be enforced.

Step 8: Where a child's name is later changed, tell the court through the lawyer

Carry the linking paper with the order.

What About the Wife's Name?

  • A wife may be named in the petition in her married name, while her Aadhaar and bank account carry her maiden name.
  • Or the order may give "Smt." and a surname, with no first name at all.
  • A bank paying into her account reads the name the payer gives it against the account's name.
  • So have the order name her as her identity paper does, or bring the account to the order's name.
  • Where she has gone back to her maiden name after a divorce, keep the decree and the order together.
  • The disclosure affidavit she files should be in the same name, from the start.

Read name change after divorce, divorce decree as proof for a name change and name change after marriage.

What About a Child's Name?

  • A child is named in the order as the petition gave it, often a home name or a name before school.
  • The birth certificate, school record and Aadhaar may carry another form.
  • Where a child's share is paid or claimed separately, the names should agree.
  • A child who reaches majority may need the order, or a later one, read with his own papers.
  • Have the court correct a slip in the order, or the Registrar correct a wrong birth certificate.
  • The father's name in the child's papers should be the payer's, as the order gives it.

Read name change in birth certificate, single mother and the father's name in child documents and child name change in school records.

What About the Bank Account?

  • Payment by bank transfer leaves a record. That record is the best proof of what was paid and missed.
  • Give the payer an account in the payee's own name, the name in the order.
  • A joint account with a relative, or an account in another form of the name, invites argument later.
  • Where a child's share is paid separately, ask the lawyer whose account it should go to.
  • Keep the bank statements. They are the evidence if the order is to be enforced.
  • Where payment is in cash, give and keep receipts.

Read name change in bank records.

What Happens When Payment Stops?

  • The law provides for enforcing an order where payment stops, on an application to the court.
  • The section sets a time within which the application is to be made. Act promptly.
  • The court reads the order, the record of payments, and the identity of the person who is to pay.
  • A payer may try to make something of a slip in his name. A slip that leaves no doubt who he is is unlikely to help him.
  • Still, correct it before you need to enforce, not after.
  • Keep the order, its corrections, the bank statements and your identity papers together.

Enforcement is a lawyer's work. Read same name as another person, where a payer claims to be someone else.

What If a Name Changes Later?

  • An order is true for the date it was made. A later change of name does not undo it.
  • A child's surname may be changed to the mother's, or a mother may take back her maiden name.
  • Keep the paper that links the names with the order: a Gazette notice, a corrected birth certificate, a decree.
  • Tell the bank, and ask the lawyer whether the court should be told.
  • Remarriage is not a name question. It can affect a wife's own maintenance under the law. Ask the lawyer.
  • A change of name does not change who is owed, or who owes.

Read child surname change after divorce.

Where Does a Gazette Come In?

Only where a mother or child has changed a name by choice. A slip in the order is the court's to correct. A Gazette never changes an order.

Step 1: Confirm that a name has in fact changed

A slip in the petition, or a home name, is not a change of name.

Step 2: Ask the lawyer whether the court needs anything for it

The order stands in the names it was made in. A linking paper may be enough.

Step 3: Fix the exact new name

The spelling that will go on Aadhaar and the bank account.

Step 4: Make the affidavit and publish the newspaper notice

Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.

Step 5: Type the form and sign the undertaking

Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.

Step 6: Prepare the CD, photographs and certificate

The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.

Step 7: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult. It is not refunded.

Step 8: Send the file yourself, then update the bank and tell the court

Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054.

Which Gazette Should You Use?

The order is read with Aadhaar and the bank, which are central. The Gazette of India is the one to use.

Step 1: Remember who reads the order

A family court or magistrate, and the bank that receives payment.

Step 2: Remember the papers it is read with

Aadhaar and the bank's record, which are central.

Step 3: Prefer the Gazette of India

It is accepted by courts and banks alike.

Step 4: Contact the Roorkee press only if a state notice suits you

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.

Step 5: Download the notice

Search egazette.gov.in and save the PDF.

Which Mistakes Do Families Make?

Common mistakes with names in a maintenance order
MistakeWhat to do
Not reading the petition before it is filedCheck every name against identity papers
Not reading the order when it comesRead it the same week
A child named by a home nameThe name on the birth certificate
An account in another form of the nameAn account in the order's name
Taking payments in cash without receiptsA bank transfer, or receipts
Waiting to correct a slip until payment stopsCorrect it now
Changing a child's name and telling no oneKeep the linking paper, tell the lawyer
Letting the time for enforcement passAct promptly
Asking for a Gazette to correct the orderThe court corrects its order

A typical case we handle: a woman in Haridwar had an order for maintenance for herself and her son. The order named the boy "Golu", the name the family used. His birth certificate and Aadhaar read "Aryan Rawat". When his share was to be paid into an account of his own, the bank hesitated. A relative suggested a Gazette for the child. None was needed. Her lawyer applied to the same court, and the order was corrected to his name on the birth certificate. This is an illustrative example of the type of case we handle, not a named client review.

What is a lawyer's job, not ours

The petition, the order, its correction, any change in its terms, and its enforcement.

When you do not need us

For a slip in the order, a birth certificate and a bank account. The court, the Registrar and the bank settle those. We are useful only where a mother or child has changed a name by choice and a Gazette notification is asked for.

Which Areas of Uttarakhand Do We Cover?

All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. An order is corrected by the court that made it. Send photos of the order and the identity papers on WhatsApp, and we will tell you which names differ.

Names in a Maintenance Order: The Short Version

A maintenance order names the payer and each person to be paid, copied from the petition. Read it against each person's identity paper. A slip in the order is corrected by the court that made it. A wrong identity paper is corrected at its office. Give the payer a bank account in the payee's exact name, and keep every statement. A name that changes later does not undo the order: keep the linking paper with it.
