Senior Citizen Maintenance Tribunal Name Mismatch in Uttarakhand
For elderly parents in Uttarakhand claiming maintenance from their children under the 2007 Act, and families answering such claims, where a parent's or child's name differs across Aadhaar, birth records, the family register or a property deed: what the tribunal reads, and how to keep a claim from stalling on a name.
A senior citizen maintenance name mismatch is a parent's or child's name that differs across their papers. The Maintenance Tribunal reads the relationship and the property deed. Name everyone as their own papers do, prove the relationship with birth records or the family register, and link any old forms. No Gazette is needed for a short name or estimated age.

Many elderly parents in Uttarakhand live alone in the hills while their children work in the plains or abroad. The 2007 Act lets a parent who cannot manage claim maintenance from children before a tribunal. An elderly parent's papers often carry a short name or an estimated age. A senior citizen maintenance name mismatch is that difference stalling the claim. This page explains senior citizen maintenance name mismatch.
We do not file claims, and this subject needs no Gazette. The law is the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. For a wife's and children's maintenance, read maintenance orders for wife and children.
What Is the Act, in Brief?
- The law. The Maintenance and Welfare of Parents and Senior Citizens Act, 2007.
- Who claims. A parent or senior citizen who cannot maintain themselves.
- Against whom. Children, and in some cases relatives who will inherit.
- Where. A Maintenance Tribunal, usually at the sub-division.
- Property. A transfer made on the promise of care can be undone if care is not given.
The claim names the parent and each child. The tribunal reads those names against their papers.
What Does the Act Provide?
From the Act as published, in outline. Uttarakhand's rules under it add detail.
| Point | What the Act provides |
|---|---|
| Duty | Children's duty to maintain a parent who cannot maintain themselves |
| Tribunal | Maintenance Tribunals set up by the state to hear claims |
| Time | A time limit for deciding a claim, with a short extension in exceptional cases |
| Amount | A maximum monthly maintenance as enacted. Ask the tribunal for the current limit |
| Property | Section 23: a transfer made on condition of care may be declared void if the care is not given |
| Appeal | To an appellate tribunal |
The first and fifth rows depend on who is related to whom, and who gave what to whom. Names prove both.
Where Are the Names Written?
| Record | Whose name | Where it is corrected |
|---|---|---|
| Aadhaar | Parent and children | An Aadhaar centre |
| Birth certificates and school records | The children, naming the parent | The Registrar and the school |
| The family register | The household | The village or ward office |
| A gift deed or transfer | Parent and child | Rectified through the registrar |
| The parent's bank account | The parent | The branch |
An elderly parent may have the loosest papers of all. Use the family register to tie them together.
What Kinds of Mismatch Are There?
The parent's papers
- Aadhaar with a first name only, or an estimated age
- Children's certificates with a fuller name
- Linked, or Aadhaar corrected
A child's papers
- A son known by one name at home, another on papers
- The claim names him loosely
- Named as his papers do
The property deed
- A gift deed naming the parent or child loosely
- Read under section 23
- Linked, or rectified
None of these should stop a claim. They need papers that link them.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The parent's Aadhaar is loose | Link it, or correct at an Aadhaar centre | No |
| The parent's age on Aadhaar is estimated | Aadhaar date of birth rules | No |
| A child's name differs | Name them as their papers do | No |
| The relationship needs proof | The family register or birth records | No |
| A gift deed names someone loosely | Gift deed | No |
| The parent's account differs | The branch | No |
| The parent's old-age pension differs | The pension office | No |
| Someone changed a name by choice | Linking papers now, Gazette later | Not for the claim |
No claim waits for a Gazette. The tribunal can read linking papers.
How Do You Put It Right?
This is the general method for names. The claim itself is for the tribunal.
Step 1: Read the parent's name on Aadhaar and other papers
The application names the parent as these do.
Step 2: Read each child's name as their papers carry it
The children are named as respondents.
Step 3: Gather proof of the relationship
Birth certificates, the family register, school records.
Step 4: Correct a parent's Aadhaar slip where needed
An older person's Aadhaar often has an estimated age or a short name.
Step 5: If property was given, read the deed
Its names should match both sides' papers.
Step 6: Apply to the Maintenance Tribunal in matching names
At the sub-division, with the papers.
Step 7: Give a bank account in the parent's own name
For the maintenance to be paid into.
Step 8: Keep copies of the order and payments
For enforcement if payments stop.
What About the Parent's Own Papers?
- Many elderly people in the hills got Aadhaar late, with a short name and an estimated age.
- Their children's papers may name them more fully.
- The claim should name the parent as Aadhaar does, with other forms explained.
- The family register often shows the fullest form.
- Correcting Aadhaar helps, but is not required before claiming.
- A parent's old-age pension record may help show identity.
Read Aadhaar date of birth limits and old-age pension records.
How Is the Relationship Proved?
- The tribunal must see that the respondent is the parent's child.
- A child's birth certificate or school record names the parent.
- The family register lists the household.
- Where the parent's name there differs from Aadhaar, link them.
- For a relative who will inherit, the land record or family register helps.
- Give the tribunal what it asks for, and keep copies.
Read family register and birth certificate.
What About Property Given to Children?
- Parents often give land or a house to a child, expecting care in return.
- Section 23 lets such a transfer be declared void if the care is not given.
- The deed names the giver and the receiver.
- Its names should match both sides' papers.
- A loosely named deed can still be linked by other papers.
- Whether a transfer can be undone is for the tribunal and a lawyer.
Read gift deed name mismatch and khatauni.
What About Payment?
- A maintenance order is best paid into the parent's own bank account.
- The account should be in the parent's name as on the order.
- An old account in another form of the name can delay payment.
- Keep a record of every payment.
- If payments stop, the tribunal can enforce its order.
- A child abroad can pay by bank transfer.
Read bank records and inoperative accounts.
What About Appeal and Other Routes?
- The Act provides an appeal to an appellate tribunal.
- A parent may also have other remedies under other laws.
- Which suits is a question for a lawyer or the tribunal.
- The Act limits lawyers before the tribunal. Ask how it treats them.
- Elderly people can get help from legal services authorities.
- Whatever the route, names must match.
Where Does a Gazette Come In?
Not for a short name or estimated age. Only where a person has changed a name by choice.
Step 1: Confirm that a name has in fact changed
A short form on an old card is not a change of name.
Step 2: Do not let it delay the claim
A Gazette takes weeks. The tribunal can read linking papers.
Step 3: Fix the exact new name
The spelling that will go on Aadhaar and the bank.
Step 4: Make the affidavit and publish the newspaper notice
Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then update in order
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then Aadhaar and the bank.
Which Gazette Should You Use?
The tribunal is the state's, Aadhaar and the bank central. The Gazette of India serves all.
Step 1: Remember whose law this is
A central Act, run by tribunals set up by the state.
Step 2: Remember what else is read
Aadhaar and the bank, which are central.
Step 3: Prefer the Gazette of India
It serves Aadhaar and the bank as well as the state.
Step 4: Contact the Roorkee press only if a state notice suits you
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 5: Download the notice
Search egazette.gov.in and save the PDF.
For the difference between the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Happen?
| Mistake | What to do |
|---|---|
| Naming a child by a home name | As on their papers |
| No proof of relationship | Bring the family register |
| Waiting to correct Aadhaar first | Claim with linking papers |
| A maintenance account in another name | Use the parent's own account |
| Losing the gift deed | Get a certified copy |
| Not keeping payment records | Keep them |
| Thinking a Gazette is needed | It is not |
| Paying an agent to "fix" the claim | Go to the tribunal |
| Giving up because papers differ | Link them |
A typical case we handle: an elderly widow in Almora claimed maintenance from her two sons working in Delhi. Her Aadhaar read only "Kamla". Her sons' school records named their mother "Kamla Devi Joshi". One son had given her land to him by a gift deed naming her "Smt. Kamla". Her nephew asked us whether a Gazette was needed. It was not. The family register showed her and both sons, and linked the forms of her name for the tribunal. This is an illustrative example of the type of case we handle, not a named client review.
