Workplace Injury Claim Name Mismatch in Uttarakhand: Employee Compensation
For workers injured on the job in Uttarakhand, and families of workers who died at work, where the worker's name on the employer's or contractor's records, the death certificate or the claim differs from Aadhaar, or a dependant's name differs from their papers: which law now applies, what a claim reads, and how to link the names without delay.
A workplace injury claim name mismatch is met by linking the names, not changing them. Show the worker's Aadhaar with the employer's records, ask the employer to confirm in writing that both name one person, and correct the death certificate where it is wrong. Compensation now falls under the Social Security Code, 2020. No Gazette is needed.

Construction sites, hydro projects, factories and hotels in Uttarakhand employ many workers through contractors, often from other states. When one is hurt or killed, the family claims compensation. The contractor's register may know him by a nickname, and his death certificate by another. A workplace injury claim name mismatch is that difference. This page explains workplace injury claim name mismatch.
We do not file claims, and this subject needs no Gazette. The change of law is from official notifications of November 2025. A claim is a lawyer's or the labour office's work. For workers covered by ESI, read ESIC records name change.
What Is the Law, in Brief?
- The idea. An employer compensates a worker hurt, or the family of a worker killed, by an accident at work.
- The old law. The Employee's Compensation Act, 1923.
- The present law. Chapter VII of the Code on Social Security, 2020, in force from 21 November 2025.
- ESI cases. Workers covered by employees' state insurance claim through that scheme instead.
- Who decides. The authority under the Code for the area.
Whatever the law, the claim reads names: the worker's, as the employer knew him, and the family's, as their papers show.
What Changed in 2025?
From reports of the labour ministry's notifications of 21 November 2025.
| Point | What is reported |
|---|---|
| The Codes | The four labour codes came into force on 21 November 2025 |
| The old Act | The Employee's Compensation Act, 1923 was repealed from that date |
| Where it went | Employee compensation is now in Chapter VII of the Code on Social Security, 2020 |
| Who it covers | Employers and employees to whom the employees' state insurance provisions do not apply |
| Other repeals | The Code also repealed the ESI, gratuity and unorganised workers' Acts, among others |
Claims arising before the change may be treated under transitional rules. That is a lawyer's question. The names needed are the same either way.
Where Are the Names Written?
| Record | Whose name | Where it is corrected |
|---|---|---|
| The contractor's register and wage slips | The worker | The employer, by a written confirmation |
| The worker's Aadhaar | The worker | An Aadhaar centre |
| The death certificate | The worker | The Registrar |
| The police report, if any | The worker | Through the police |
| The dependants' papers | Widow, children, parents | Their own offices |
| The claim | All of these | Filed correctly, with linking papers |
The contractor's register is often the loosest record. It is also the one the employer relies on to admit the worker was employed.
What Kinds of Mismatch Are There?
The worker's name on site
- A nickname in the register
- Aadhaar with the full name
- Linked by the employer's confirmation
The death certificate
- Written from what a co-worker said
- A short name, or a wrong father's name
- Corrected by the Registrar
A dependant's name
- A widow named by a home name
- Children with no papers yet
- Each person's own papers
All three are about proving that the person in each record is the same. None needs a Gazette.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The register has a nickname | The employer's written confirmation | No |
| The death certificate differs | The Registrar | No |
| The worker's Aadhaar is the wrong paper | An Aadhaar centre, or linking papers | No |
| A dependant's name differs | That person's own papers | No |
| The worker was covered by ESI | ESIC | No |
| Provident fund or gratuity is due too | EPFO and gratuity | No |
| The employer denies employment | A lawyer and the authority | No |
| A claimant changed a name by choice | Linking papers now, Gazette later | Not for the claim |
No claim waits for a Gazette. Linking papers do the work.
How Do You Put It Right?
This is the general method for names. The claim itself is for a lawyer or the labour office.
Step 1: Collect the worker's papers from the employer
Attendance, wage slips, the appointment letter, any identity card.
Step 2: Read the worker's name on each, against Aadhaar
Contractors often enter a short or home name.
Step 3: For a death, read the death certificate too
The worker's name there should match Aadhaar and the employer's record.
Step 4: Read each dependant's name against that person's Aadhaar
Widow, children, parents.
Step 5: Correct the odd paper at its own office
Aadhaar at its centre, the death certificate with the Registrar.
Step 6: File the claim in names that match
With a short note linking any form that still differs.
Step 7: Give a bank account in the claimant's own name
Where payment is made by transfer.
Step 8: Keep copies of everything filed
Claims can take time.
What About Contractors' Records?
- Many workers on dams, roads, tunnels and buildings are hired through contractors.
- Registers are often kept by a supervisor who knows the worker as "Chhotu" or by his village.
- Ask the employer or contractor for a written confirmation that the person in the register is the person on the Aadhaar.
- Wage slips, bank transfers of wages and an identity card from the site help too.
- Collect them quickly. Sites close and supervisors move on.
- A worker still working should ask now for his record to carry his Aadhaar name.
Read e-Shram and labour card.
What About a Worker Who Died?
- A death certificate after an accident may be written from what a co-worker or contractor said.
- A nickname, a wrong father's name or a wrong village is common.
- The Registrar who issued it can correct it, on the worker's Aadhaar and other papers.
- A post-mortem or police report may also carry the name. Read it.
- Under the old Act, compensation for a death was deposited with the authority and paid out to dependants from there. Ask how this is done now.
- Do not accept a private settlement without advice.
What About the Dependants?
- The law defines who counts as a dependant: a widow and children, and in some cases parents and others.
- Each dependant is named in the claim as on that person's own papers.
- A widow known by a home name should use her Aadhaar name, linked by the marriage certificate or family register.
- Young children may need birth certificates.
- Payment goes to an account in the claimant's own name.
- Who exactly qualifies is a lawyer's question.
Read bank records and guardian name in child documents.
What About Workers From Other States?
- Many workers on Uttarakhand's projects come from other states.
- The family may live hundreds of kilometres away, with papers in their own state's offices.
- The worker's name may be spelt one way at home and another on site.
- Where to file the claim is a question for a lawyer.
- Send the family's papers to the lawyer early.
- Keep everything in writing. Phone promises are easily forgotten.
What About Other Records?
- A worker may also have provident fund, gratuity or ESI entitlements.
- Each reads the worker's and nominee's names in its own record.
- The Code on Social Security now governs all of these too.
- Correct each record, or link the names, on the same papers.
- A building worker may have welfare board benefits as well.
- Ask the employer for every record kept in the worker's name.
Read EPFO and UAN, ESIC and gratuity.
Where Does a Gazette Come In?
Not in a claim. It comes in only where a person has changed a name by choice, and even then the claim proceeds on linking papers.
Step 1: Confirm that a name has in fact changed
A contractor's short form is not a change of name.
Step 2: Do not let it hold up the claim
A Gazette takes weeks. File the claim with linking papers.
Step 3: Fix the exact new name
The spelling that will go on Aadhaar and the bank.
Step 4: Make the affidavit and publish the newspaper notice
Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then update in order
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then Aadhaar and the bank.
Which Gazette Should You Use?
The Code is central and read with Aadhaar and the bank. The Gazette of India is the one to use.
Step 1: Remember whose law this is
A central Code, administered through the state.
Step 2: Remember what it is read with
Aadhaar and the bank, which are central.
Step 3: Prefer the Gazette of India
It serves Aadhaar and the bank.
Step 4: Contact the Roorkee press only if a state notice suits another purpose
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 5: Download the notice
Search egazette.gov.in and save the PDF.
For the difference between the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do Families Make?
| Mistake | What to do |
|---|---|
| Not collecting the employer's records quickly | Ask at once, in writing |
| Accepting a death certificate unread | Read the name and father's name |
| A widow claiming in a home name | Her Aadhaar name |
| Waiting for a Gazette | File with linking papers |
| A private settlement without advice | Take advice first |
| Forgetting provident fund and gratuity | Ask for every record |
| Payment to a relative's account | The claimant's own account |
| Relying on phone promises | Get it in writing |
| Citing the 1923 Act for a new claim | Ask a lawyer about the Code |
A typical case we handle: a labourer from another state died in an accident at a hydro project in Chamoli. The contractor's register had him as "Pappu". His Aadhaar read "Pramod Kumar Yadav". The death certificate, written from a co-worker's account, read "Pappu Yadav". His widow's lawyer asked us whether a Gazette was needed. It was not. The Registrar corrected the death certificate on his Aadhaar, and the contractor confirmed in writing that "Pappu" was Pramod. This is an illustrative example of the type of case we handle, not a named client review.
What is a lawyer's work, not ours
The claim, who qualifies as a dependant, the amount, any dispute with the employer, and transitional questions under the new Code.
When you do not need us
For linking a worker's names, correcting a death certificate or a dependant's papers. The employer, the Registrar and the Aadhaar centre settle those. We are useful only where a person has changed a name by choice and a Gazette notification is asked for.

Workplace Injury Claims and Names: The Short Version
Compensation for a workplace injury or death now falls under Chapter VII of the Code on Social Security, 2020, which replaced the 1923 Act in November 2025. Workers covered by ESI claim through it. Where the contractor's register, the death certificate and Aadhaar name the worker differently, link them: the employer's written confirmation, a corrected death certificate, and each dependant's own papers. The claim itself is for a lawyer or the labour office.
