Gratuity Nomination and Claim Name Mismatch in Uttarakhand
For employees of factories, companies, schools and shops, and their families, where the employee's or a nominee's name on the gratuity papers differs from identity papers: who is named, how a nomination is corrected or replaced, and what a widow or an heir files after a death in service.
A gratuity nomination and claim name mismatch is put right at the employer. An employee has the employer correct its record on Aadhaar and PAN, and files a fresh or modified nomination naming each nominee as on that nominee's Aadhaar. After a death, the nominee claims with the death certificate and identity papers. A spelling needs no Gazette.

Gratuity is one payment at the end of a working life, made on papers filled at its beginning. A gratuity nomination and claim name mismatch is usually a nomination form signed in the first month of a job and never looked at again. This page explains gratuity nomination and claim name mismatch for employees and their families in Uttarakhand.
We do not deal with employers or labour offices, and this subject seldom needs a Gazette. The law on nomination is from the Code on Social Security, 2020, as published summaries set it out. The forms depend on which rules apply to an establishment, which we could not confirm for this state. For an employer's records in general, read name change in private job and employer records.
What Is Gratuity, and Who Pays It?
- What it is. A lump sum an employer pays an employee for long service, on retirement, resignation, disablement or death.
- Who pays. The employer. It is not a fund the employee contributes to, like the provident fund.
- Who is covered. Employees of factories, mines, shops and establishments above a size, and others the law brings in.
- When. Ordinarily after a qualifying period of service. On death or disablement the period is not required.
- To whom, on death. The nominee, or the heirs where there is no nomination.
Because the employer pays from its own pocket, it reads the papers closely. A name it cannot match is a reason to wait, and a family in the weeks after a death is in no position to argue.
What Does the Law Say About Nomination?
From published summaries of section 55 of the Code on Social Security, 2020. The Code is reported in force from 21 November 2025, and carries the provisions that were in the Payment of Gratuity Act, 1972.
| Point | What the Code provides |
|---|---|
| Who nominates, and when | Every employee who has completed one year of service makes a nomination |
| Family first | An employee who has a family nominates one or more members of the family. A nomination in favour of anyone else is void |
| Acquiring a family | An employee who had no family and later acquires one makes a fresh nomination in favour of family members |
| Changing it | A nomination may be modified at any time by written intimation to the employer |
| A nominee who dies first | The nominee's interest reverts to the employee, who makes a fresh nomination |
| Custody | Every nomination, fresh nomination and alteration is sent to the employer, who keeps it in safe custody |
Two of these rows are about validity, and they matter more than any spelling. A nomination made as a bachelor, or one naming a friend or a brother while a wife and children exist, may not be a nomination at all.
Which Three Names Are on the File?
The employee
- As the employer holds it: on the appointment letter, payslips and the nomination
- Read against PAN, Aadhaar and the bank account at payment
- Usually written from the joining form
The nominee
- As the employee wrote it on the nomination, with the relationship and the share
- Read against the nominee's own identity papers on the day of a claim
- Usually written from memory
The claimant
- The person who applies: the employee, the nominee or an heir
- Named on the claim, the identity papers and the bank account given for payment
- All three should read alike, and should match the name on the file
An employee can put the first two right with a letter and a form, in an afternoon, at any time in service. After the employee's death nobody can change either. They can only be explained.
What Kinds of Problem Are There?
The employee's own name
- The employer's record has a short form, an old spelling or a maiden name
- PAN, Aadhaar and the bank carry another
- Cured by correcting the employer's record
A nominee's name
- A wife written by her home name, or a child by a pet name or without a surname
- The nominee's Aadhaar reads differently
- Cured by a modified nomination, while the employee is alive
The nomination itself
- None was ever filed, or it predates marriage, or its nominee has died, or it names someone outside the family
- Not a mismatch. There is no valid nominee to match
- Cured by a fresh nomination. After a death, the heirs claim
The third is the commonest of all. Many employees have no nomination on file, and learn it only when an employer says so to a widow.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The employer's record has a spelling slip in your name | A written request, with Aadhaar and PAN | No |
| The nominee's name is misspelt or a home name | A modified nomination | No |
| You married after nominating | A fresh nomination | No |
| A woman employee has taken a married surname | The employer's record, on the marriage certificate and updated identity papers | No |
| The nominee has died | A fresh nomination | No |
| The employee has died, and the nominee's papers differ from the nomination | The claim, with the paper that links the two names | No |
| The employee has died with no nomination | The heirs claim, with proof of heirship | No |
| The employee has changed a name by choice | Gazette, then identity papers and the employer's record | Yes |
A Gazette appears once. The rest is a form at the personnel desk, or a claim with the right certificates.
What Should You Do While You Are in Service?
Step 1: Ask your employer for a copy of your nomination
The duplicate you were given when you filed it, or a copy from the personnel file.
Step 2: Read your own name in the employer's record
On the appointment letter, a recent payslip and the nomination.
Step 3: Read each nominee's name, relationship and share
Against that nominee's own Aadhaar.
Step 4: Check that the nomination is still valid
A nomination made before marriage, or in favour of someone who has died, needs replacing.
Step 5: Correct your own name in the employer's record first
By a written request with Aadhaar and PAN. Provident fund and insurance records follow.
Step 6: File a fresh or modified nomination
On the form in use at your establishment, in duplicate, with each nominee named as on Aadhaar.
Step 7: Get the employer's acknowledgement on your copy
Dated and stamped. Keep it at home, where your family can find it.
Step 8: Tell your family where it is
A nomination nobody knows of helps nobody in the first weeks after a death.
Which Forms Are Used?
The forms depend on which rules apply to the establishment. Guides describe two sets. Ask your employer which it uses.
| Purpose | Under the central rules of 1972 | Under the rules made for the Code |
|---|---|---|
| Nomination | Form F, in duplicate | Guides report a single nomination form, Form III |
| Fresh nomination and modification | Separate forms for each | Through the same nomination form, as guides describe it |
| Claim by the employee | Form I | Guides report a further set of forms for claims, notices and disputes. We did not read them |
| Claim by a nominee | Form J | |
| Claim by a legal heir | Form K |
Guides also say that a state makes its own rules for establishments under it, and that the older forms continue where new rules are not yet notified. We could not confirm the position in this state. Whatever the form, the rule for names is the same: each as on that person's Aadhaar.
What About Claiming Your Own Gratuity?
- An employee who retires or resigns after the qualifying service applies to the employer, and the employer states the amount and pays.
- Payment is made to a bank account. The account's name should match the employer's record.
- Any tax treatment is recorded against PAN. A PAN in a different form of the name sends that record astray.
- An employee who joined twenty years ago as "R. K. Verma" and banks as "Rajesh Kumar Verma" should have the employer's record brought to the full name before the last working day.
- The provident fund and the state insurance records are separate, each with its own correction. They usually carry the same slip, since all were filled from one joining form.
Read name change in EPFO and UAN records, name change in ESIC records and name change in PAN card.
What Happens After a Death in Service?
- Who claims. The nominee, where there is a valid nomination. The legal heirs, where there is none.
- What is filed. A claim to the employer on the form for a nominee or an heir, with the death certificate, identity papers and bank details.
- What is compared. The dead employee's name on the death certificate with the employer's record. The claimant's name on the nomination with the claimant's own papers.
- Where they differ. A widow named by her maiden name in the nomination brings her marriage certificate. A wrong death certificate is corrected by the Registrar.
- Where there is no nomination. The employer asks who the heirs are. An heirs' certificate usually answers that. For a large sum or a divided family it may ask for a succession certificate.
- A minor nominee. The share is not handed to the child. The rules provide how it is held or invested.
Read nominee name mismatch in a bank claim, name correction in a death certificate and legal heir certificate and succession certificate name mismatch.
What If the Employer Does Not Pay?
- Ask the employer for its reason in writing. "The name does not match" should say which name, against which paper.
- Give the paper that answers it: a corrected death certificate, a marriage certificate, an heirs' certificate.
- Where the employer still refuses, or disputes the amount or the person, the law provides an authority to decide. It is usually an officer of the labour department.
- Two people claiming the same gratuity, such as a widow and the employee's parents, is a dispute for that authority, and sometimes a court.
- The law sets a time for payment and provides for interest on delay. Ask the labour office or a lawyer what applies now.
A dispute before the authority is a lawyer's or a union's work, not ours.
What About Government Employees?
- A Government servant's gratuity is paid under the pension rules of the Government concerned, with retirement and death gratuity each provided for.
- The nomination is made under those rules, on their own form, and kept with the service record.
- The same care applies: the nominee named as on the nominee's own papers, and the nomination renewed after marriage.
- A correction goes through the head of office, and for a pensioner through the pension authority.
- The family pension is a separate entitlement from the gratuity, with its own entries.
Read name change for government employees and name change in pension and family pension records.
Where Does a Gazette Come In?
Only where an employee has changed a name by choice, and the employer, like the bank, asks for a Gazette before it changes its record. It has no part in a nominee's spelling or in a dead employee's name.
Step 1: Confirm that it is a change of name, and not a spelling or a married surname
An employer corrects those on identity papers and a marriage certificate.
Step 2: Ask your employer what it needs to change the name in its record
Many ask for a Gazette for a change by choice.
Step 3: Fix the exact new name
The spelling that will go on Aadhaar, PAN, the bank and the employer's record.
Step 4: Make the affidavit and publish the newspaper notice
Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then update in order
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then Aadhaar and PAN, the bank, the employer's record and the nomination.
Would the Uttarakhand Gazette Do?
An employer in the state may accept it. Aadhaar, PAN and the provident fund office are the reasons to prefer the Gazette of India.
Step 1: Ask your employer which Gazette it accepts
A private employer usually follows what the provident fund office and the bank accept.
Step 2: Think about Aadhaar, PAN and a later employer
The Gazette of India serves them all.
Step 3: Contact the Roorkee press
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 4: Ask for the papers, the format and the fee, and submit
Keep photocopies of everything.
Step 5: Download the notice
Search gazettes.uk.gov.in and save the PDF.
To weigh the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do Employees Make?
| Mistake | What to do |
|---|---|
| Never filing a nomination | File one, and get it acknowledged |
| Leaving a bachelor's nomination after marriage | File a fresh one |
| Writing a nominee's name from memory | Copy it from the nominee's Aadhaar |
| Naming a brother or a friend while a family exists | The law treats that as void |
| Not replacing a nominee who has died | File a fresh nomination |
| Leaving your own name short in the employer's record | Correct it before you leave |
| Keeping no copy at home | Keep the acknowledged duplicate |
| Paying for a Gazette to fix a nominee's spelling | A modified nomination does it |
| The family not knowing a nomination exists | Tell them, and show them the copy |
A typical case we handle: a machine operator at a factory in Rudrapur died in service. His nomination, filed in 2009, named his wife as "Munni Devi". Her Aadhaar and bank account read "Manju Devi". The employer held the payment, and her brother-in-law asked us for a Gazette. She did not need one. Munni was a home name that no paper of hers had ever carried. Her marriage certificate and the family register named her as his wife under her real name, and the employer paid on those with her identity papers. This is an illustrative example of the type of case we handle, not a named client review.
When you do not need us
For a spelling in the employer's record or in a nomination, a married surname, and a family's claim after a death. The employer, the Registrar and the tehsil settle those. We are useful only where an employee has changed a name by choice and a Gazette notification is asked for.

Names in a Gratuity File: The Short Version
A gratuity file carries the employee's name, the nominee's name and, at the end, a claimant's. Ask your employer for a copy of your nomination and read it. Have your own name corrected in the employer's record on Aadhaar and PAN. File a fresh nomination after marriage, or when a nominee has died, naming each nominee as on Aadhaar. Keep the acknowledged copy at home and tell your family. After a death, the nominee claims with the death certificate and the paper that links any two names.
A spelling needs no Gazette. To find out which record to correct, send photos on WhatsApp 9540005064, and we will reply in working hours.
