Mool Niwas Name Mismatch in Uttarakhand: Original Domicile Certificate
For people in Uttarakhand applying for a mool niwas, or original residence, certificate, whose own name or their ancestors' names differ across the old khataunis, family registers and other records the claim rests on: why the chain of names matters, who corrects each record, and why a Gazette cannot help prove residence.
A mool niwas name mismatch is usually a chain of ancestors' names written differently across old khataunis and the family register. Link the generations through the family register, correct the record that is plainly wrong at its office, and apply in your own current name. Who qualifies is for the tehsil. No Gazette can prove residence.

For years Uttarakhand has debated who counts as an original resident, and mool niwas certificates matter for some jobs and schemes. The claim rests on old papers: a great-grandfather's khatauni, the family register, an old service book. Each wrote the ancestor's name its own way. A mool niwas name mismatch is that chain of names not lining up. This page explains mool niwas name mismatch.
We do not issue certificates or advise who qualifies. The rules have been disputed and may have changed, so ask the tehsil. For the ordinary residence certificate, read name change in residence certificate.
What Is Mool Niwas, in Brief?
- Mool niwas. Original residence: roots in the state going back generations.
- Sthayi niwas. Permanent residence, commonly given on long residence or a permanent home.
- Who issues. The state's revenue officers, through the tehsil.
- What it rests on. Old records showing where the family lived.
- Why it matters. For some state jobs, admissions and schemes, as each notice says.
A permanent residence certificate looks at you. A mool niwas claim looks at your grandfathers.
What Is Reported?
From news reports of 2011 and 2013 and a published summary of the domicile procedure. The rules have been debated and may have changed since.
| Point | What is reported |
|---|---|
| 2011 | A report said no Government order then defined mool niwas, and admission seekers could submit either a mool niwas or a permanent residence certificate |
| 2013 | A report of a Government order said those living in a state before 1950 are considered its permanent residents, in the context of caste certificates |
| Caste certificates | The same report described 9 November 2000 as a cut-off date for caste certificates, with an affidavit of permanent residence in one state |
| Domicile | Issued by the sub-divisional magistrate, commonly on a copy of the family register |
We give these to show how unsettled the ground is. We do not say who qualifies. The tehsil does.
Where Are the Names Written?
| Record | Kept by | Where it is corrected |
|---|---|---|
| The family register | The village or ward office | That office |
| Old khataunis and land records | The revenue department | The tehsil, rarely |
| Old school and service records | The school or employer | Usually not corrected now |
| Ancestors' death certificates | The Registrar | The Registrar |
| Your own Aadhaar and class 10 certificate | Their own offices | Their own offices |
Old records are rarely corrected. They are linked: shown to belong to the same family through the family register.
What Kinds of Mismatch Are There?
An ancestor written many ways
- "Ram Dutt" in one khatauni, "Ramdatt" in another
- The same man
- Linked through the family register
A broken link
- A generation missing from the register
- Or a father's name differing
- The register corrected
Your own name
- Your Aadhaar and class 10 differ
- Or the register has a home name
- Your own papers corrected first
The first is almost universal in the hills. It is a matter of linking, not correcting.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| An ancestor's spelling varies | Link through the family register | No |
| The register misses a generation | The village or ward office | No |
| The khatauni has a slip | The tehsil | No |
| An ancestor's death certificate differs | The Registrar | No |
| Your own papers differ | Aadhaar and the board first | No |
| Old records were lost | Ask what else is accepted | No |
| A caste certificate is also needed | Caste certificate | No |
| You changed your own name by choice | Gazette for your name only | For your name |
No Gazette proves residence. It can only record a person's own change of name.
How Do You Put It Right?
This is the general method for names. Who qualifies is for the tehsil.
Step 1: Ask the tehsil what it now needs for a mool niwas certificate
The rules have been disputed and changed.
Step 2: Collect the oldest records of your family's residence
Old khataunis, the family register, old school and service records.
Step 3: List every ancestor's name as each record writes it
Grandfather, great-grandfather, father.
Step 4: Trace the chain from them to you
Each generation linked to the next.
Step 5: Correct the family register where it differs
At the village or ward office.
Step 6: Correct your own Aadhaar and class 10 name where needed
Your certificate will carry your current name.
Step 7: Apply in your own name, with the chain of records
Through the tehsil or the online service.
Step 8: Keep the certificate with the papers it was based on
Later recruiters may ask.
What About the Chain of Ancestors?
- A mool niwas claim usually reaches back through a father and grandfather to older records.
- Each generation was written by a different clerk, in a different decade.
- Write out a simple family tree, with each name as each record has it.
- Mark which record shows which generation.
- The family register usually ties the generations together.
- Give the tehsil the tree with the records. It saves questions.
Read one notice for several family certificates, on family papers.
What About the Family Register?
- The family register lists the members of a household, with relationships.
- A published summary of the domicile procedure lists a copy of it among the papers.
- It is often the record that links a grandson to his grandfather.
- A missing generation or a wrong father's name breaks the chain.
- Correct it at the village or ward office, on the papers you have.
- Get a certified copy after correction.
What About Old Land Records?
- Old khataunis often show where a family held land generations ago.
- They name ancestors in old forms: a first name and a father's name, no surname.
- Old revenue records are rarely corrected now.
- Instead, show that the old name and the family register's name are one man.
- Certified copies of old records come from the tehsil's record room.
- Ask for them early. They can take time.
What About Your Own Name?
- The certificate will carry your own present name.
- Your Aadhaar and class 10 certificate should agree first.
- Your father's name should match how the family register shows him.
- A married woman's roots may run through her father's family. Ask the tehsil how that is treated.
- Keep the certificate with the papers it was issued on.
- A recruiter may ask to see them later.
Read residence certificate and Aadhaar.
What About Lost or Missing Records?
- Floods, fires and moves have destroyed many families' papers in the hills.
- The tehsil's record room may still hold copies of old land records.
- The family register is kept by the village or ward office.
- Ask the tehsil what other evidence it accepts.
- An affidavit may be asked to explain, but cannot replace records.
- A Gazette cannot replace them either.
Where Does a Gazette Come In?
A Gazette records a person's own change of name. It cannot prove where a family lived, or link ancestors.
Step 1: Confirm that a name has in fact changed
An ancestor written differently in old records is not a change of name.
Step 2: Remember that a Gazette cannot prove residence
It records a name, not where your family lived.
Step 3: Fix the exact new name
The spelling that will go on Aadhaar and the certificate.
Step 4: Make the affidavit and publish the newspaper notice
Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Commonly Rs 1,100 for an adult. It is not refunded.
Step 8: Send the file yourself, then update in order
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then Aadhaar and the tehsil.
Which Gazette Should You Use?
Only for your own change of name. The Gazette of India serves Aadhaar and the state.
Step 1: Remember whose certificate this is
The state's, issued by its revenue officers.
Step 2: Remember what else is read
Aadhaar, which is central.
Step 3: Prefer the Gazette of India
It serves Aadhaar as well as the state.
Step 4: Contact the Roorkee press only if a state notice suits you
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 5: Download the notice
Search egazette.gov.in and save the PDF.
For the difference between the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Happen?
| Mistake | What to do |
|---|---|
| Applying without the old records | Collect them first |
| Expecting every old spelling to match | Link, do not correct |
| A family register missing a generation | Correct it |
| Your own papers in two forms | Bring them together first |
| Thinking a Gazette proves residence | It does not |
| Paying an agent for a certificate | Apply through the tehsil |
| Swearing an affidavit you cannot support | Swear only what is true |
| Leaving it until a job notice | Start early |
| Losing the papers after issue | Keep them with the certificate |
A typical case we handle: a young woman from Almora needed a mool niwas certificate for a state scheme. Her great-grandfather appeared as "Har Dutt" in an old khatauni and "Hardatt Joshi" in the family register. Her father's name was in a third form. Her uncle asked us whether a Gazette would settle it. It would not. We told him to take the family register, the old khatauni and a family tree to the tehsil, linking each generation, and to ask the tehsil what else it needed. This is an illustrative example of the type of case we handle, not a named client review.
When you do not need us
For linking ancestors, correcting a family register or your own papers. The tehsil and the village office settle those. Who qualifies is for the tehsil. We are useful only where a person has changed their own name by choice.

People Also Ask About Mool Niwas
What is a mool niwas certificate?
A certificate of original residence in the state.
How is it different from a permanent residence certificate?
It rests on older family roots. Ask the tehsil.
My grandfather's name differs in old records. What do I do?
Link it through the family register.
Can a Gazette prove mool niwas?
No.
Is a gazette needed for a mool niwas name mismatch?
No.
Who issues the certificate?
The revenue officers, through the tehsil.
Has the state defined mool niwas in a Government order?
A 2011 report said no order then defined it, and the state set up a committee to clarify its position. We have not found a later order defining it, so ask the tehsil what applies now.
What is the mool niwas 1950 demand?
Groups such as the Mool Niwas Bhu-Kanoon Samanvay Sangharsh Samiti have campaigned for 1950 as the mool niwas cut-off together with a stricter land law, holding village meetings across Garhwal in late 2024. We report the demand, not a position on it.
What did Uttarakhand's 2025 land law change?
In February 2025 the Assembly passed an amendment barring people from outside the state from buying agricultural and horticultural land in 11 of its 13 districts. Haridwar and Udham Singh Nagar are excluded, though sales there need state approval.
Can someone from outside buy a house plot?
The amended law still lets non-residents buy under 250 square metres for residential use, with an affidavit that neither they nor their family bought such land elsewhere in the state. A false declaration can lead to the land being taken by the Government.
Why does the land law matter for names?
Land deals are read against land records and identity papers, so a family's names on khataunis and the family register should line up before any sale, purchase or affidavit.
What did the government say about mool niwas in 2024?
In September 2024 the Chief Minister said the government was sensitive to the land law and mool niwas issues and promised a comprehensive land law in the next budget session.

The 2011 position on mool niwas and permanent residence certificates, and the 2013 order on residence before 1950 and the caste certificate cut-off, are from news reports of the time. The domicile procedure is from a published summary. We did not read any present Government order defining mool niwas, and the rules may have changed. Nothing on this page says who qualifies. The tehsil and the sub-divisional magistrate are the authority.
