Legal Guardianship Name Mismatch in Uttarakhand: Adults With Disability and the National Trust
For families in Uttarakhand caring for an adult son or daughter with autism, cerebral palsy, intellectual disability or multiple disabilities, who need a legal guardian appointed after the age of 18, where the person's or guardian's name differs across the disability certificate, Aadhaar, the guardianship certificate and bank or pension records.
A legal guardianship name mismatch is fixed before applying. Bring the person's disability certificate, Aadhaar and birth certificate to one name, and the guardian's own papers to theirs. Then apply to the Local Level Committee under the National Trust Act. Banks have been told to rely on its certificate. No Gazette is needed or can appoint a guardian.

When a child with autism, cerebral palsy or an intellectual disability turns 18, parents are no longer their natural guardians in law. A bank, a pension office or a land record may then ask who can act. The National Trust Act lets a district committee appoint a guardian. A legal guardianship name mismatch is a name on those papers that does not agree. This page explains legal guardianship name mismatch.
We do not appoint guardians, and this subject needs no Gazette. The law is from the National Trust Act, 1999 and the Reserve Bank's 2007 circulars. For the disability certificate itself, read disability certificate and UDID.
What Is Legal Guardianship, in Brief?
- Who. Adults with autism, cerebral palsy, intellectual disability or multiple disabilities.
- Why. They may not be able to manage their own legal and money matters.
- The law. The National Trust Act, 1999.
- Who appoints. A Local Level Committee in the district.
- What it gives. Care of the person and their property.
The certificate names two people: the person with disability and the guardian. Both names must hold.
What Do the Law and the RBI Say?
From the National Trust Act, 1999 as summarised by the Reserve Bank, and the Reserve Bank's circulars of November 2007.
| Point | What is said |
|---|---|
| The power | A Local Level Committee may appoint a guardian for a person with disabilities covered by the Act |
| The guardian's role | Care of the person and property of the person with disability |
| Banks | Banks told to rely on guardianship certificates from these committees, or from district courts, to open and operate accounts |
| The guardian | May operate the account as long as they remain the guardian |
| The committee | Described in published guides as headed by the District Collector |
A bank reads the certificate against the account. If the person's name differs, the bank may hesitate.
Where Are the Names Written?
| Record | Whose name | Where it is corrected |
|---|---|---|
| Disability certificate and UDID | The person | The medical authority |
| Aadhaar | Both | An Aadhaar centre |
| Birth certificate | The person, naming the parents | The Registrar |
| Guardianship certificate | Both | The committee |
| Bank and pension records | The person | Each office |
The disability certificate and Aadhaar are the foundation. Correct them before applying.
What Kinds of Mismatch Are There?
The person's name
- A home name on the disability certificate
- A fuller name on Aadhaar
- One corrected first
The guardian's name
- A parent's short form
- Or a sibling with a married name
- Their own papers corrected
Old accounts
- A minor's account in a pet name
- The guardianship certificate in the full name
- The account updated
Families often find these only when the bank refuses. Check now.
Which Case Is Yours?
| The situation | Route | Gazette? |
|---|---|---|
| The disability certificate differs | The medical authority | No |
| The person's Aadhaar differs | An Aadhaar centre | No |
| The guardian's own papers differ | Their own offices | No |
| The certificate has a slip | The committee | No |
| A minor's account at 18 | The bank, with the certificate | No |
| A bank refuses | The branch, citing the RBI circular | No |
| A disability pension differs | The pension office | No |
| The guardian changed a name by choice | Gazette for the guardian | For the guardian |
Guardianship itself never needs a Gazette. It comes from the committee.
How Do You Put It Right?
This is the general method. Start before the 18th birthday.
Step 1: Read the person's name on the disability certificate and UDID
The guardianship application rests on them.
Step 2: Put the person's Aadhaar and birth certificate beside them
All should name them the same way.
Step 3: Read the proposed guardian's name on their own papers
The guardianship certificate will name them too.
Step 4: Correct the odd paper first
The disability certificate through its authority, Aadhaar at its centre.
Step 5: Apply to the Local Level Committee in matching names
In the form the rules set, with the papers.
Step 6: Read the guardianship certificate when issued
Both names, and the relationship.
Step 7: Give the bank the certificate to operate the account
The RBI has told banks to rely on it.
Step 8: Keep the certificate with the person's papers
Pensions, property and schemes will ask.
What Happens at 18?
- Until 18, parents act as natural guardians.
- At 18, the law treats the person as an adult.
- A bank operating a minor's account will ask who can now act.
- Families should apply for legal guardianship before the birthday, so there is no gap.
- Put the papers in one name before applying.
- Keep the disability certificate current.
Read minor bank account and conversion at 18 and guardians of children.
What About the Local Level Committee?
- The committee is set up in the district under the National Trust Act.
- Published guides describe it as headed by the District Collector.
- It receives applications in a set form and appoints a guardian by certificate.
- Ask at the District Collector's office or the social welfare office for the committee.
- Take the disability certificate, Aadhaar and the proposed guardian's papers.
- Read the certificate when it is issued.
What About Banks?
- The Reserve Bank told banks in 2007 to rely on these guardianship certificates.
- A guardian may open and operate the account while they remain guardian.
- The bank will read the person's name on the certificate against the account.
- An old account in a pet name should be updated to the certificate's name.
- If a branch refuses, show it the Reserve Bank's circular.
- Ask for the refusal in writing if it persists.
Read bank records.
What About the Guardian's Own Name?
- The certificate names the guardian as well.
- A parent, sibling or relative may be appointed.
- Their name on the certificate should match their own Aadhaar and PAN.
- A sister with a married name should apply in the name on her papers.
- If the guardian dies or cannot continue, apply for a new one.
- Plan who will take over, while you can.
What About Pensions, Property and Later?
- A disability pension is paid to the person's account, operated by the guardian.
- Property inherited by the person is managed by the guardian, within limits.
- A family pension for a disabled child after a parent's death reads the child's name.
- Every record should name the person as the certificate does.
- Keep the certificate with the person's papers.
- Ask a lawyer about property and wills.
Read old-age and disability pension and family pension.
Where Does a Gazette Come In?
Not for guardianship. Only where a person, such as the guardian, has changed a name by choice.
Step 1: Confirm that a name has in fact changed
A short form on one paper is not a change of name.
Step 2: Remember that guardianship is not a Gazette matter
It is given by the committee or a court.
Step 3: Fix the exact new name
The spelling that will go on Aadhaar and every record.
Step 4: Make the affidavit and publish the newspaper notice
Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.
Step 5: Type the form and sign the undertaking
Two typed copies of the specimen, signed with two witnesses, and the undertaking.
Step 6: Prepare the CD, photographs and certificate
The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.
Step 7: Pay the charge on BharatKosh
Ask the current charge. It is not refunded.
Step 8: Send the file yourself, then update in order
Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then Aadhaar and the rest.
Which Gazette Should You Use?
Aadhaar and banks are central. The Gazette of India is the one to use.
Step 1: Remember whose law this is
A central Act, applied through district committees.
Step 2: Remember what else is read
Aadhaar and banks, which are central.
Step 3: Prefer the Gazette of India
It serves Aadhaar and banks.
Step 4: Contact the Roorkee press only if a state notice suits you
Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.
Step 5: Download the notice
Search egazette.gov.in and save the PDF.
For the difference between the two, read Uttarakhand Gazette vs Gazette of India.
Which Mistakes Do Families Make?
| Mistake | What to do |
|---|---|
| Waiting until after 18 | Apply before |
| A home name on the disability certificate | Correct it first |
| An old account in a pet name | Update it |
| A guardian's papers in another form | Correct them |
| Accepting a bank's refusal | Show the RBI circular |
| Not planning a successor guardian | Plan now |
| Losing the certificate | Keep copies |
| Paying an agent | Apply to the committee |
| Thinking a Gazette appoints a guardian | It does not |
A typical case we handle: parents in Dehradun cared for their son with autism. His disability certificate read "Bittu", his Aadhaar "Aditya Rawat". When he turned 18, the bank froze his account until a guardian was appointed. His father asked us whether a Gazette was needed. It was not. The disability certificate was corrected to his Aadhaar name, and the Local Level Committee appointed his father as guardian. The bank accepted the certificate. This is an illustrative example of the type of case we handle, not a named client review.

That a Local Level Committee may appoint a guardian with care of the person and property, and that banks were told to rely on such certificates and those of district courts, are from the Reserve Bank's circulars of November 2007 and its summary of the National Trust Act, 1999. That the committee is headed by the District Collector and uses set forms is from published guides. We did not read the Act's rules or Uttarakhand's committee procedures. The committee and the bank are the authority.
