Maternity Benefit Name Mismatch in Uttarakhand: Claim From Your Employer

For working women in Uttarakhand claiming maternity benefit from an employer, whose name on the employer's records differs from Aadhaar, PAN, the salary account or the baby's birth certificate, often because of a marriage: what the law now provides, which papers must agree, and how to link a maiden and married name without delay.

Quick answer

A maternity benefit name mismatch is usually a maiden name on the employer's records and a married name on Aadhaar, or the reverse. Give HR the marriage certificate, claim in one name, and get the medical certificate and salary account in that name. Maternity benefit is now under the Social Security Code. No Gazette is needed.

A maternity benefit is paid from the employer's records, so a maiden name there and a married name on Aadhaar are linked by the marriage certificate.

Women working in Uttarakhand's factories, hospitals, schools, hotels and offices are entitled to paid maternity leave from their employer. Many marry while employed, and their papers change at different times. A maternity benefit name mismatch is the employer's record naming a woman one way and her other papers another, found just when she needs to claim. This page explains maternity benefit name mismatch.

We do not handle claims, and this subject needs no Gazette. The law is from reports of the Code on Social Security, 2020, which replaced the old Act in November 2025. For the Government's maternity cash scheme, read PM Matru Vandana Yojana.

What Is Maternity Benefit, in Brief?

  • What it is. Paid leave from an employer around the birth of a child.
  • The law. Chapter VI of the Code on Social Security, 2020, from 21 November 2025.
  • The old law. The Maternity Benefit Act, 1961, now replaced.
  • Who pays. The employer, or ESIC for women covered by employees' state insurance.
  • How it is claimed. By written notice to the employer, with medical proof.

The employer pays from its own records. If those records and your bank account name you differently, the payment can stall.

What Does the Code Provide?

From published analyses of Chapter VI of the Code on Social Security, 2020, sections 59 to 72, and the central rules of 2026.

What the Code on Social Security provides on maternity benefit
PointWhat is reported
Who is coveredFactories, mines, plantations, and shops or establishments with ten or more employees, among others notified
EligibilityAt least 80 days' work in the establishment in the twelve months before the expected delivery
DurationUp to 26 weeks, not more than eight before delivery, for a woman with fewer than two surviving children. Twelve weeks otherwise
Medical bonusRs 3,500, or the amount notified, where free pre-natal and post-natal care is not provided
Notice and nomineeWritten notice to the employer, which may name a person to whom the benefit is paid
CrècheRequired in establishments with fifty or more employees

The notice and the payment both carry your name. Make them the name on your employer's record and your bank.

Where Is Your Name Written?

Records read in a maternity benefit claim and where each is corrected
RecordMade whenWhere it is corrected
The employer's recordWhen you joinedHR, on your papers
The salary accountWhen you joined, or openedThe branch
Aadhaar and PANPerhaps updated after marriageTheir own offices
The medical certificateAt the clinicThe doctor
The baby's birth certificateAfter birthThe Registrar

The first two decide the payment. The others support the claim, and the last lasts the child's lifetime.

What Kinds of Mismatch Are There?

Maiden and married names

  • Employer in one, Aadhaar in the other
  • Both yours
  • Linked by the marriage certificate

A slip at the clinic

  • The medical certificate written as said
  • A husband's surname, a short form
  • Reissued by the doctor

The baby's certificate

  • The mother's name entered differently
  • From the hospital's form
  • Corrected by the Registrar

None of these is a change of name. Each is a record made at a different moment of a life that changed.

No benefit waits for a Gazette. The marriage certificate, HR and the branch settle almost every case.

How Do You Put It Right?

This is the general method. Start in the early months of pregnancy.

Step 1: Read your name on the employer's records

Appointment letter, attendance, salary slips and the HR system.

Step 2: Put your Aadhaar, PAN and salary account beside them

After marriage they may carry another surname.

Step 3: Decide which name you will use, and bring the others to it

Either the name on your papers now, or a married name you have adopted.

Step 4: Give your employer written notice of the claim

In the form the rules set, in the name on your records.

Step 5: Attach the medical proof in the same name

A doctor's certificate written from your identity paper.

Step 6: After the birth, check the child's birth certificate

Your name as the mother should match your papers.

Step 7: Ask that the benefit be paid to your own account

In your name, or to the person you nominate in the notice.

Step 8: Keep copies of the notice, certificate and payment record

In case a complaint is needed.

What About a Maiden and a Married Name?

  • Many women join work in a maiden name and marry later.
  • Some update Aadhaar and PAN, some do not. Employers' records often lag behind.
  • Neither name is wrong. The marriage certificate shows they are one woman.
  • Give HR the marriage certificate and ask that your record be updated, or that it note both names.
  • Bring the salary account to the same name as the employer's record.
  • You are not required to change your name on marriage at all.

Read name change after marriage and is a name change compulsory after marriage.

What About the Notice and the Certificate?

  • The claim begins with a written notice to the employer, in the form the rules set.
  • Write your name as the employer's record carries it.
  • The notice may name a person to whom the benefit can be paid. Name that person as on their papers.
  • Attach a doctor's certificate of pregnancy or delivery.
  • Give the doctor your identity paper, so the name is copied, not heard.
  • Keep a copy of the notice with the date given.

Read medical certificate name mismatch.

What About the Baby's Birth Certificate?

  • The hospital sends details for the birth register, often from a form filled in a hurry.
  • The mother may be entered by her married surname, her maiden name, or a short form.
  • The child's papers for life will carry that entry.
  • Read the certificate as soon as it is issued.
  • A slip is corrected by the Registrar, on your identity papers.
  • The father's name should be as on his papers too.

Read name change in birth certificate and mother's name correction in a birth certificate.

What About ESI and Other Schemes?

  • Women covered by employees' state insurance receive maternity benefit through ESIC, not the employer.
  • ESIC reads its own record of you, which should match Aadhaar.
  • The Government's maternity cash scheme, PM Matru Vandana, is separate again, and reads the MCP card and Aadhaar.
  • A woman may be entitled under more than one. Each reads its own record.
  • Keep all of them to one name, or link them with the marriage certificate.
  • Ask HR which route applies to you.

Read ESIC records, PM Matru Vandana and the MCP card.

What If the Employer Does Not Pay?

  • The central rules let a woman complain in writing to the Inspector-cum-Facilitator if the benefit is withheld.
  • Keep the notice, the certificate, salary slips and bank statements.
  • A name difference should not be an excuse. Show the marriage certificate.
  • Dismissal during maternity absence is protected against under the Code.
  • A dispute about whether you qualify is for the inspector, or a lawyer.
  • Ask the labour office in your district where to file.

Read employee compensation, another claim under the same Code.

Where Does a Gazette Come In?

Not for a married surname. Only where a woman has changed her name by choice, and even then the claim proceeds on linking papers.

Step 1: Confirm that your name has in fact changed

A married surname with a marriage certificate needs no Gazette.

Step 2: Do not let it hold up the benefit

A Gazette takes weeks. Claim on the name your records carry.

Step 3: Fix the exact new name

The spelling that will go on Aadhaar, PAN and the employer's records.

Step 4: Make the affidavit and publish the newspaper notice

Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.

Step 5: Type the form and sign the undertaking

Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.

Step 6: Prepare the CD, photographs and certificate

The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.

Step 7: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult. It is not refunded.

Step 8: Send the file yourself, then update in order

Send it to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Then Aadhaar, PAN and the employer.

See gazette name change in Uttarakhand.

Which Gazette Should You Use?

The Code is central and read with Aadhaar, PAN and the bank. The Gazette of India is the one to use.

Step 1: Remember whose law this is

A central Code, administered with the state.

Step 2: Remember what it is read with

Aadhaar, PAN and the bank, which are central.

Step 3: Prefer the Gazette of India

It serves all of them.

Step 4: Contact the Roorkee press only if a state notice suits another purpose

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.

Step 5: Download the notice

Search egazette.gov.in and save the PDF.

Which Mistakes Do Women Make?

Common mistakes with names in a maternity benefit claim
MistakeWhat to do
Leaving HR's record in the maiden name unexplainedGive the marriage certificate
A salary account in another nameBring it into line
A medical certificate in a husband's surname not on your papersAsk the doctor to use your identity paper
Giving notice lateGive it early, in writing
Not reading the baby's certificateRead it at once
Assuming ESI and the employer both payAsk HR which applies
Accepting a refusal over a nameComplain in writing
Changing Aadhaar in the middle of the claimClaim first, update later
Thinking a married name needs a GazetteThe marriage certificate is enough

A typical case we handle: a nurse at a private hospital in Dehradun joined as "Priyanka Rawat" and married a year later. She updated her Aadhaar to "Priyanka Negi" but not her hospital record or salary account. When she gave notice, the accounts office paused the claim over the two names. She asked us whether a Gazette was needed. It was not. She gave HR her marriage certificate, and the benefit was paid to her salary account in the name on her record. This is an illustrative example of the type of case we handle, not a named client review.

When you do not need us

For a married surname, a medical certificate, a salary account or a baby's certificate. HR, the doctor, the branch and the Registrar settle those. We are useful only where a woman has changed her name by choice and a Gazette notification is asked for.
