Name Change With Thumb Impression in Uttarakhand: For a Person Who Cannot Sign

For families of elderly parents and others who cannot sign their names, and who need a name corrected or changed: what replaces a signature, how an affidavit is made, what the family may and may not do for the person, what we could not confirm about the Gazette form, and why most such cases need no Gazette.

Quick answer

A name change with thumb impression is made as any other, with the person's thumb impression in place of a signature. The affidavit is read over and explained to the person before a notary, who attests the impression. Ask the Gazette office how it wants its form marked. Most elderly people's cases are corrections, and need no Gazette.

A person who cannot sign uses a thumb impression in place of a signature, after the paper is read over and explained and the notary attests it.

Many older people in the hills never learnt to write, and many who did can no longer hold a pen. Their names on Aadhaar, a pension book and a land record often differ, and the family is told to "get it changed". A name change with thumb impression is how that is done for a person who cannot sign. This page explains name change with thumb impression, and its limits.

How an affidavit is made by a person who cannot sign is the usual practice before a notary. The passport office's rule on which thumb is from its own instructions. We could not find the Gazette office's written rule on a thumb impression, and say so. For the affidavit itself, read name change affidavit in Uttarakhand.

What Replaces a Signature?

  • The mark. An impression of the thumb, in ink, where a signature would go.
  • Whose it is. Written beside it: the person's name, and which thumb.
  • The reading over. The paper is read and explained to the person, in the person's own language, before the mark is put.
  • The attestation. A notary, an official or witnesses record that this was done, as that office requires.
  • The person's presence. A thumb impression cannot be sent. The person has to be there.

A signature shows that a person who can read has agreed. A thumb impression shows only that a thumb touched the paper. The reading over and the attestation are what make it an agreement.

What Is Known, and What Is Not?

What is known and not known about a thumb impression in name change papers
PointPosition
An affidavitThe usual practice: read over and explained, the thumb impression put before the notary, and the notary's note that it was understood
A passport applicationThe passport office's instructions say an illiterate applicant puts the left thumb impression in place of a signature, and the right where the left is permanently unfit, with a note
AadhaarUpdated on fingerprints or iris. It carries no signature
A bankTakes a thumb impression, witnessed as its rules require
The Gazette of India formPublished notices show a signature in the existing old name. We could not find a written rule on a thumb impression. Ask before filing
The Uttarakhand GazetteNot known to us. Ask the press at Roorkee

The fifth row is the one a family most needs answered, and we will not guess at it. A file marked wrongly may be returned, and the fee is not refunded.

Where Is a Mark Asked For?

Papers of a name change and what takes the place of a signature on each
PaperOrdinarilyFor a person who cannot sign
The affidavitSigned before a notaryThumb impression, read over and attested
The newspaper noticeBooked by anyone, in the person's nameNo signature is printed
The Gazette formSigned in the old name, with two witnessesAs the Gazette office directs. Ask
Photographs and identity proofSelf-attestedAsk how these are to be attested
The Aadhaar updateFingerprints or irisThe same
The bank's formSignedThumb impression, witnessed

Aadhaar is the easiest, since it never asked for a signature. The affidavit is well settled. The Gazette form is the one to ask about.

What Kinds of Person Is This About?

Never learnt to write

  • Has always used a thumb impression
  • Every earlier paper carries one
  • Nothing to compare a signature with. The simplest case

Could sign, and no longer can

  • Age, a stroke, tremor, loss of sight or of a hand
  • Earlier papers carry a signature
  • A doctor's certificate explains the change

Cannot understand what is being signed

  • Advanced dementia, or a condition that takes away understanding
  • A thumb impression would mean nothing
  • Not a matter for an affidavit at all. See below

The third is different in kind, not in degree. A family that treats it as the first, to save trouble, does the person a wrong and creates a paper that can be undone.

A Gazette appears plainly once in eight rows.

How Is It Done?

This is the general method. The seventh step is settled before any file is prepared.

Step 1: Ask first if a Gazette is needed at all

Most elderly people's trouble is a spelling or a home name on one record, which that office corrects.

Step 2: Find out why the person cannot sign

Never learnt to write, or can no longer do so through age, illness or loss of sight. The papers differ a little for each.

Step 3: See that the person understands and agrees

The change is the person's own decision. Nobody can decide it for an adult who understands.

Step 4: Take the person to the notary in person

With an identity paper, and someone the person trusts who can read.

Step 5: Have the affidavit read over and explained, in the person's own language

Then the thumb impression is put, and the notary records that it was read over and understood.

Step 6: Have witnesses sign beside the impression, with their names and addresses

And write whose impression it is, and of which thumb.

Step 7: Ask the Gazette office, before filing, how it wants the form marked

The form is ordinarily signed in the old name. Do not guess at this step.

Step 8: Use the same thumb, the same way, on every later paper

Aadhaar itself needs no signature. Banks and the passport office have their own rules for an impression.

Is a Gazette Needed at All?

  • An elderly person has seldom chosen a new name. The name is the same as ever, and offices wrote it differently over the years.
  • "Bhagwati", "Bhagwati Devi" and "Bhagoti" on three papers are one woman, written three ways.
  • That is a correction. The office with the odd record corrects it, on her other papers.
  • Aadhaar is usually the place to begin, since pensions and bank accounts follow it.
  • A Gazette is for a person who is taking a name he or she did not have before.
  • So settle this before troubling an old person with a notary, a newspaper and a file to Delhi.

Read name correction vs name change, Kumari, Devi and the husband’s surname and old age and widow pension records.

How Is the Affidavit Made?

  • The person goes before the notary, with an identity paper. The notary has to see who is swearing.
  • The affidavit is read aloud and explained, in the language the person speaks at home.
  • The person says that it is true and that he or she agrees.
  • The thumb impression is put, in ink, where the signature would be. Its owner's name and the thumb used are written beside it.
  • The notary adds a note that the contents were read over and explained to the person, who understood them.
  • Someone who knows the person signs as having identified him or her, with name and address.

An affidavit with a bare thumb mark and no such note is weak, and may be refused. Read name change affidavit in Uttarakhand.

What About the Gazette Form?

  • The Gazette of India's form is ordinarily signed by the applicant in the existing old name, with two witnesses.
  • Published notices print the words "Signature (in existing old name)" beneath each one.
  • We could not find, in the Department of Publication's published material, how a person who cannot sign is to mark the form.
  • It may accept a thumb impression attested in a stated way. It may ask for something more.
  • So the question is put to the department before the file is made, and the form is marked as it says.
  • Do not have someone sign the old name for the person. That is not the person's signature, and it is not honest.

This is the one step on this page we cannot set out for you in advance. Read the proforma and format and why files are returned.

What May the Family Do?

What a son or daughter may do

  • Gather the papers, and find where the names differ
  • Take the person to the notary and the Aadhaar centre
  • Read every paper to the person, honestly
  • Sign as a witness, where the office allows a relative
  • Book the newspaper notice and post the file

What nobody may do

  • Sign the person's name
  • Guide the person's thumb onto a paper not explained
  • Decide a new name the person did not choose
  • Take an impression on a blank paper, to be filled later
  • Act when the person no longer understands

These are not formalities. An old person's thumb impression can also give away land. Offices know it, and look closely at who brought the person and why.

What If the Person Cannot Understand?

  • An affidavit is a statement the person swears to be true. A person who cannot understand it cannot swear it.
  • A thumb impression taken from such a person is not that person's act.
  • No relative becomes the guardian of an adult merely by being a relative.
  • Where someone has to act for an adult who cannot, the law has its own procedures for appointing that person.
  • That is a matter for legal advice, not for a documentation service.
  • In practice a correction of such a person's record is often possible on existing papers, without any statement from the person. Ask the office.

We did not read the law on guardianship of adults for this page, and give no opinion on it. Read name change in disability certificate and UDID.

What Are the Steps of the Gazette of India Route?

For a person who is in fact changing a name. The steps are the ordinary ones, with the mark attested and the form marked as directed.

Step 1: Fix the exact new name, and read it aloud to the person

In the form the person says it. Then spell it for those who will type it.

Step 2: Make the affidavit, with the thumb impression attested

As set out on this page. This is the paper everything else rests on.

Step 3: Publish the newspaper notice

In a daily local leading newspaper. Keep the full original page.

Step 4: Prepare the form in two copies, marked as the Gazette office directs

With two witnesses, who sign with their names and addresses.

Step 5: Prepare the soft copy, photographs and certificate

The same text on a CD in MS Word, two photographs with identity proof, and a certificate that both copies match.

Step 6: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult. It is not refunded.

Step 7: Send the file

To the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054.

Step 8: Update Aadhaar first, with the person present

Aadhaar is updated on fingerprints or iris, not on a signature.

See gazette name change in Uttarakhand.

Which Gazette Should You Use?

Decide by who will read the notice. For most elderly people that is Aadhaar, a bank and a pension office.

Step 1: List the offices that will read the notice

For an elderly person, usually Aadhaar, a bank and a pension office.

Step 2: Prefer the Gazette of India

Those offices follow central papers.

Step 3: Consider a state notice only for a record that stays in the state

Such as a land record at the tehsil. Ask the tehsil first.

Step 4: Contact the Roorkee press before preparing a state notice

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted, and how it treats a thumb impression.

Step 5: Download the notice

Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do Families Make?

Common mistakes in a name change for a person who cannot sign
MistakeWhat to do
Starting a Gazette for a spellingAsk first if it is a correction
Signing the parent's name for themThe parent's own thumb impression
A thumb mark with no note of reading overThe notary records it
Not saying whose thumb, and whichWrite it beside the mark
Guessing how to mark the Gazette formAsk the Gazette office first
Leaving the person at homeThe person has to be present
A different thumb on different papersThe same thumb throughout
Acting for a person who no longer understandsLegal advice
Choosing the name for the personThe person's own choice, said aloud

A typical case we handle: a man in Pauri wrote that his mother, who cannot write, was "Kamla" on her Aadhaar and "Kamla Devi" in her widow pension record, and that the bank had asked for a Gazette. We asked if she had ever taken a new name. She had not. Nothing was to be published. Her pension record was brought to her Aadhaar at the social welfare office, on her own thumb impression before the official. No affidavit to Delhi was needed, and we charged nothing. This is an illustrative example of the type of case we handle, not a named client review.

When you do not need us

For a spelling, a home name, a change of signature and an Aadhaar update. The offices concerned settle those with the person present. We are useful only where a person who cannot sign is in fact changing a name and a Gazette notification is needed.

All 13 districts: Dehradun, Haridwar, Pauri Garhwal, Tehri Garhwal, Rudraprayag, Chamoli, Uttarkashi, Nainital, Udham Singh Nagar, Almora, Bageshwar, Champawat and Pithoragarh. Nearly. His earlier papers carry a signature, so offices will compare. A doctor's certificate of why he cannot sign helps. Read our page on a change of signature.
Can a son or daughter sign for a parent?+
Not for an adult parent who understands and can put a thumb impression. The parent's own mark is needed. A child can help, read and be a witness.
What if the person cannot understand what is being done?+
Then nobody should take a thumb impression. A person who cannot understand cannot change a name by an affidavit. A court's order about who may act for the person may be the route. Take legal advice.
Can the person be a witness to someone else's papers?+
Ask the office concerned. Many prefer witnesses who can sign and write their own names and addresses.
How does Aadhaar deal with a person who cannot sign?+
Aadhaar is updated on fingerprints or iris, and carries no signature. The person has to be present.
How do banks deal with it?+
Banks take a thumb impression in place of a signature, witnessed as their rules require, and the person usually has to come to the branch to draw money.

On an affidavit, by the notary. On other papers, as that office requires: often by witnesses, sometimes by an official.
Can it be done at home, for a bedridden person?+
A notary may agree to come. The affidavit is still read over and explained, and the notary records where it was made. Ask the notary.
Is a name change by a person who cannot sign more likely to be questioned?+
It may be looked at more closely, since a mark is easier to obtain than a signature. Careful attestation and honest witnesses are the answer.
Do you take thumb impressions?+
No. A notary does. We prepare the Gazette file, once it is settled how the form is to be marked.

Who Wrote and Reviewed This Page?

This page is written by the Documentation Desk Team of UttarakhandNameChange.com, the team that prepares Gazette files for people across Uttarakhand.

It is reviewed by Advocate Vipin Chauhan.

That an illiterate applicant puts the left thumb impression in place of a signature, and the right only where the left is permanently unfit, is from the passport office's instructions for its application form. That published notices show a signature in the existing old name is from the Gazette of India itself. How an affidavit is made by a person who cannot sign is the usual practice before a notary, set out from general knowledge and not from a rule we read. We could not find the Department of Publication's written rule on a thumb impression on its form, or the Roorkee press's practice. We did not read the law on guardianship of adults, and give no opinion on it. Each office's own requirement is the authority.

A Name Change Without a Signature: The Short Version

A person who cannot sign can correct or change a name. A thumb impression takes the place of the signature, after the paper is read over and explained, and a notary or witnesses attest it. The person has to be present and has to understand. Ask the Gazette office how it wants its form marked before filing. Most elderly people's cases are corrections, settled at the office concerned on the person's own mark, with no Gazette.
