Disaster Relief Name Mismatch in Uttarakhand: Ex Gratia and Compensation Claims

For families claiming relief after a flood, a cloudburst, a landslide or another disaster, where a name on the relief list, a death certificate or a bank account does not match: who pays, which papers are read, how a slip is corrected, and what to do when papers were lost with the house.

Quick answer

A disaster relief name mismatch is put right at the tehsil. Ask the revenue official to correct the relief list while the survey is open. Have a death certificate corrected by the Registrar. See that the claimant's bank account is active and in the Aadhaar name. No Gazette is needed, and none would come in time.

A family in Uttarakhand at the tehsil after a landslide showing Aadhaar and a bank passbook to a revenue official checking the relief list
Disaster relief is paid on the relief list into a bank account, so the name on the list should be corrected to the Aadhaar name in the first week.

In most monsoons some village in these hills loses a house, a field or a life. The administration pays relief, and it pays by a list, a certificate and a bank account. A disaster relief name mismatch is one of those three not agreeing with the others, at the worst possible time for a family. This page explains disaster relief name mismatch, and how it is settled.

We do not handle relief claims, and this subject needs no Gazette. We wrote the page since families are sometimes told otherwise. What relief covers is from the central Government's norms for the disaster response fund, read in published copies. We did not read the state's own orders. For papers lost in a disaster, read lost or no documents to prove your name.

What Is Relief, and Who Pays It?

  • What it is. Money and help given by the Government to people struck by a notified disaster.
  • Where it comes from. The disaster response fund, under norms the central Government sets. A state may add its own.
  • Who gives it. The district administration, through the tehsil and its revenue officials.
  • How losses are recorded. A revenue official visits, and enters each affected family and its loss on a list.
  • How it is paid. Into a bank account, in the name on the list.
  • What it is not. Insurance, or damages in a court. It is given, not claimed as a debt.

Everything turns on the list. A family that is on it rightly is paid. A family that is on it wrongly, or under a name no paper carries, waits.

What Do the Norms Say?

From the central Government's list of items and norms of assistance from the disaster response fund, issued in October 2022 for the years to 2026, as states have published it. We give no amounts. They are revised, and a newer list may now apply.

What the national norms for the disaster response fund provide
HeadWhat the norms provide
A deathA payment to the family of each person who died, subject to certification of the cause of death by the appropriate authority
Loss of a limb or an eyeA payment that depends on the degree of disability
Serious injuryA payment for a person who needs a hospital stay
Clothing and household goodsA sum for each family that lost them
A houseHelp for a house destroyed or damaged, by the kind of house and the degree of damage
Land, crops and animalsHelp for each, with the loss certified by the competent authority

Two words recur in the norms: certified, and family. Each payment waits on an authority certifying something, and several go to a family and not to a named person. Both are where names come in.

Which Papers Are Read?

Papers of a disaster relief claim and where each is corrected
PaperMade byWhere it is corrected
The relief listThe revenue official, on a visitThe same official, or the tehsildar
The death certificateThe Registrar of births and deathsThe Registrar
The certificate of cause of deathA doctor, the police or the administrationWhoever issued it
Proof of the familyThe family register, a ration cardThe village office, or the supply office
Proof of the house or landThe tehsil, or the local bodyThe same
The claimant's Aadhaar and bank accountThe identity authority, and the bankAn Aadhaar centre, and the branch

The first row is written in the field, by hand, from what neighbours say, on a day when nobody has papers to show. It is the likeliest to carry a home name. It is also the easiest to correct, if someone asks in the first week.

What Kinds of Mismatch Are There?

The list has the name wrong

  • A home name, a spelling, a father's name in place of the son's
  • Written during the survey
  • Corrected by the revenue official, on Aadhaar

The dead person's papers differ

  • The death certificate and the person's Aadhaar or pension paper read differently
  • The administration is unsure it is one person
  • The Registrar corrects the certificate. Other papers link the rest

The claimant's own papers differ

  • A widow's Aadhaar in a maiden name, a bank account in a home name
  • Her tie to the person who died is not plain on paper
  • Her own papers are corrected, and the relationship shown

The second and third often come together, in an older couple whose papers were made by others. The husband is on record in two forms and the wife in a third, and the tehsil has to be shown that these are one household.

This page has no row with a plain yes. A relief claim is about who a person is and who the family is. Neither is settled by changing a name.

What Should You Do, Step by Step?

This is the general order. Begin in the first days, and ask a relative to do it if you cannot.

Step 1: Ask the revenue official how your family is entered on the list

The name of the person affected, the head of the family, and the loss recorded.

Step 2: Read those names against Aadhaar and the bank passbook

Relief is paid into an account, on an identity paper.

Step 3: Ask for a slip in the list to be corrected at once

While the survey is still open, and the official still remembers the house.

Step 4: For a death, get the death certificate and the certificate of cause

Read the name of the person who died on both.

Step 5: Gather what shows who the family is

A family register entry, a ration card, the claimant's own identity paper.

Step 6: For a house, gather what shows whose it was

A land record, a house tax receipt, an electricity bill.

Step 7: See that the bank account is open and in the claimant's own name

A dormant or wrongly named account sends the payment back.

Step 8: Where two papers still differ, ask the tehsil what it will accept

In writing. A sworn statement and a certificate from the village head are often taken.

What About the Relief List?

  • After a disaster a revenue official goes from house to house, and writes down who was affected and what was lost.
  • He writes fast, in Hindi, from what he is told. People are in shock, and papers may be under the rubble.
  • The head of the family is often entered by the name the village uses, and members by the names called out.
  • That list becomes the order for payment. A bank will not credit "Bachi Ram" to the account of "Bachan Singh Negi".
  • Ask to see your entry. If it is wrong, say so then, and show Aadhaar or any paper you have.
  • A correction asked for during the survey is a stroke of a pen. Asked for after sanction, it is a file.

Send someone to check even if the family has moved to a relative's house or a camp. Read home name and school name different in documents.

What About a Death in the Family?

  • The norms provide a payment to the family of a person who died, once the cause of death is certified by the appropriate authority.
  • So two certificates are read: the death certificate, and whatever certifies that the disaster caused the death.
  • The name of the person who died should be the same on both, and should match that person's own identity paper.
  • The Registrar corrects a slip in a death certificate, on the dead person's Aadhaar or other papers.
  • The family then shows who it is: a spouse, children, parents. The family register and a ration card usually serve.
  • Nobody can change the name of a person who has died. Where his papers were in two forms, they are linked by other proof.

Read name correction in a death certificate and legal heir certificate and nominee name mismatch in a bank claim, for the dead person's own accounts.

What About a Person Who Is Missing?

  • In a flood or a landslide some people are never found.
  • Without a body there is no ordinary death certificate, and without a certificate the payment for a death cannot be made in the ordinary way.
  • After large disasters the Government has laid down special procedures for treating the missing as dead, with inquiries and public notices.
  • We did not read those procedures, and they are set for each event. The district administration will say what applies.
  • The family should report the person missing at once, to the police and the tehsil, with the name exactly as on the person's identity paper.
  • That first report is the paper every later step rests on. A name written loosely in it follows the family for years.

Take a lawyer's advice early. The same question decides the person's bank accounts, pension, insurance and land.

What About a Damaged House?

  • The norms provide help for a house destroyed or damaged, by its kind and how badly it was hit.
  • The administration asks whose house it was. In a village that is often a father or grandfather, long dead, whose name still stands in the record.
  • Several brothers may have lived in parts of one house, under one roof and one entry.
  • Show what you have: the land record, a house tax receipt, an electricity or water bill, the family register.
  • Ask the tehsil how it treats a house recorded in a dead parent's name, and what each brother has to show.
  • Help to rebuild elsewhere, where the old site is unsafe, is a separate decision with its own papers.

For the future, have the land recorded in the living holders' names. Read name correction in khatauni and land records, name change in property documents and PMAY and Government scheme records.

What About the Bank Account?

  • Relief is paid into a bank account. The account has to be the claimant's own, and working.
  • An account not used for years may be dormant, and a credit to it fails or is held.
  • An account whose name differs from the relief list sends the payment back to the treasury.
  • A joint account led by the person who died cannot simply be used by the survivor. Tell the bank of the death.
  • A woman with no account of her own should open one, on Aadhaar, before the list is sent for payment.
  • Give the tehsil the account number and the bank's code from the passbook itself, not from memory.

Read name change in bank records and Jan Dhan account name mismatch.

Why Is a Gazette Not the Answer?

Families in distress are sometimes told that a Gazette will "match the names". It will not, and it would not arrive in time. These are its steps, set out so that the first three can be read.

Step 1: Do not start a Gazette for a relief claim

A Gazette takes weeks, and changes a living person's name. Relief is a matter of identity and relationship.

Step 2: Remember that a dead person's name cannot be changed

The papers of the person who died are linked by other proof, not altered.

Step 3: Use this only if the claimant changed a name by choice earlier

And the papers were never brought to the new name.

Step 4: Make the affidavit and publish the newspaper notice

Sign before a notary. Publish in a daily local leading newspaper, and keep the original newspaper.

Step 5: Type the form and sign the undertaking

Two typed copies of the specimen, signed in your old name with two witnesses, and the undertaking.

Step 6: Prepare the CD, photographs and certificate

The same text on a CD in MS Word, two self-attested photographs with identity proof, and a certificate that both copies match.

Step 7: Pay the charge on BharatKosh

Commonly Rs 1,100 for an adult. It is not refunded.

Step 8: Send the file yourself

To the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. Tell the tehsil that a notice is on its way.

See name correction vs name change.

What If a Name Was Changed Earlier?

Occasionally a claimant did change a name by choice, years before, and some papers still carry the old one. If a Gazette was published then, a copy of it settles the matter. If not, these points apply.

Step 1: Remember who pays relief

The district administration, into a bank account.

Step 2: Remember that the bank follows Aadhaar

Which follows the Gazette of India.

Step 3: Prefer the Gazette of India

In the rare case that one is needed at all.

Step 4: Contact the Roorkee press only if a state notice suits you

Take the contact from govtpress.uk.gov.in and ask if a private change of name notice is being accepted.

Step 5: Download the notice

Search gazettes.uk.gov.in and save the PDF.

Which Mistakes Do Families Make?

Common mistakes with names in a disaster relief claim
MistakeWhat to do
Not checking the entry on the relief listAsk to see it in the first week
Giving a home name to the survey officialGive the Aadhaar name
Reporting a missing person under a loose nameThe name on that person's identity paper
Leaving a slip in the death certificateAsk the Registrar at once
Giving a dormant or someone else's bank accountThe claimant's own, working account
Paying for a Gazette to match namesIt does not, and takes weeks
Paying an agent for a share of the reliefRelief is free. Deal with the tehsil yourself
Accepting a spoken refusalAsk for the reason in writing
Leaving the house in a dead parent's name afterwardsHave the record brought up to date

A typical case we handle: a family in Rudraprayag lost part of their house in a cloudburst. The relief list had the head of the family as "Bachi Ram". His Aadhaar and bank account read "Bachan Singh Rawat". The payment came back from the bank. His son was told by someone in the market to get a Gazette. No name had been changed, and a Gazette would have taken weeks. He went to the tehsil with his father's Aadhaar and passbook. The entry was corrected and the payment sent again. This is an illustrative example of the type of case we handle, not a named client review.

What is a lawyer's job, not ours

A missing person, a dispute within the family over who is paid, and a refusal of relief.

When you do not need us

For every relief claim. The tehsil, the Registrar and the bank settle the names. If anyone tells you a Gazette is needed for relief, ask the tehsil before you spend anything.

Relief is handled by the tehsil for your own village. If you are unsure which office corrects a paper, message us on WhatsApp and we will tell you, free.

Disaster Relief Name Mismatch: Frequently Asked Questions

What is a disaster relief name mismatch?+
A difference between the name on the administration's relief list or a death certificate and the claimant's or the dead person's other papers, which holds up relief after a flood, a landslide or another disaster.
Who pays disaster relief?+
The district administration, from the disaster response fund, under norms the central Government sets and the state follows or adds to.
What is paid for?+
The national norms list, among other things, a payment to the family of a person who died, payments for serious injury, and help for a damaged house, lost household goods, crops and animals.
Is anything needed to show the cause of a death?+
Yes. The norms make the payment to a dead person's family subject to certification of the cause of death by the appropriate authority.
Do I need a Gazette or an affidavit?+
Not a Gazette. A Gazette changes a living person's name and takes weeks. The tehsil may take a sworn statement where two papers differ.
The relief list has my name as the village calls me. What do I do?+
Ask the revenue official to correct it to the name on your Aadhaar while the survey is open. It is the simplest correction on this page, if made early.
My husband's death certificate spells his name differently from his Aadhaar. Will that stop the payment?+
It can delay it. Ask the Registrar to correct the certificate on his Aadhaar, and tell the tehsil that you have applied.
Who in the family receives the payment for a death?+
The administration decides, on the family's papers. Ask the tehsil whom it treats as the family, and what it wants to show the relationship.
My relative is missing and no body was found. Can the family claim?+
That needs a decision that the person is to be treated as dead. After past disasters the Government has set special procedures for it. Ask the district administration, and take a lawyer's advice.
The damaged house is in my late father's name. Who gets the relief?+
The administration looks at who lived in and owned the house. Show the land or house record, and the family's papers. Ask what it accepts where the record is in a dead parent's name.
The money was sanctioned and has not reached my account. Why?+
Often the account's name or number differs from the list, or the account is dormant. Check with the bank and the tehsil.
All our papers were lost with the house. How do we prove anything?+
Aadhaar can be recovered, and the tehsil, the school and the bank still hold their records. We have a page on rebuilding lost papers.
Is relief for an animal killed by a leopard the same thing?+
No. That is paid by the forest department under its own rules, and has its own page here.
Does insurance on the house or a life pay as well?+
That is separate, under the policy's own terms and papers. Relief from the administration does not replace it.
How long does relief take?+
We could not confirm a period. Immediate relief is meant to be quick. A claim with a name difference waits until it is settled.
Do you help with relief claims?+
No. The tehsil handles them. We prepare a Gazette where a living person's change of name needs one, which a relief claim almost never does.

This page is written by the Documentation Desk Team of UttarakhandNameChange.com, the team that prepares Gazette files for people across Uttarakhand.

It is reviewed by Advocate Vipin Chauhan.

The heads of relief, and that a payment to a dead person's family is subject to certification of the cause of death by the appropriate authority, are from the central Government's list of items and norms of assistance from the disaster response fund, issued in October 2022 for the years to 2026, read in copies published by other states. We gave no amounts, and a newer list may now apply. We did not read Uttarakhand's own orders, any procedure for missing persons, or how the family of a dead person is decided. How a relief list is made and corrected, what the tehsil accepts, and the bank account are general guidance. The tehsil and the district administration are the authority.

Names in a Relief Claim: The Short Version

Relief is paid by the district administration, on a list a revenue official writes in the field. Ask to see your entry in the first week, and have a wrong name corrected then. For a death, see that the death certificate and the certificate of cause carry the name on the dead person's own papers. Show who the family is, and whose the house was. Give a working bank account in the claimant's own Aadhaar name.

No Gazette is needed for relief. If you are unsure which office corrects a paper, message us on WhatsApp 9540005064, and we will reply in working hours.
